Your fiance must fill out an I-134. You must admit both of these crimes.

For the conviction in the Netherlands, you will need to obtain certified arrest and court records, as well as translations. Larceny, even if petty, constitutes a crime of moral turpitude. Since it was a single occurrence and due to the minor nature, it will probably not cause you to be deemed inadmissible if you admit it fully.

As for the offense in the US, it sounds like a simple assault or disorderly conduct citation. Again, you should provide copies of the arrest and court records. They will have records of this from your background checks, so again, you must admit it. Simple assault and/or disorderly conduct are not considered crimes of moral turpitude, so again this should not render you inadmissible provided you admit and explain fully.

If, as you say, your income is more than double the guideline for your household size (including your fiancee), you have no need to show any bank account information. The tax returns (3 years is overkill for the I-134, by the way—the most recent year is sufficient unless it was uncharacteristically low) and employment letter are sufficient. If you're going to add anything, add pay stubs for the last 6 months.

Exact form requirements vary by consulate. According to the VisaJourney Santiago Consulate information page, they require DS-230 Part I, DS-156, and DS-156K. This information was last updated in 2007, though, so no guarantee that it's current.

Fillable, savable versions of DS-156K and DS-230 are available in my signature. According to the State Department (and contrary to some poor advice you may receive from other VJ users), the DS-156 must be fully filled out and printed from the online form at http://evisaforms.state.gov.

Debt is not counted against you in figuring income/assets to meet the support requirements. On the other hand, available credit cannot be counted as an asset toward meeting the requirements.

All depends on the consulate. Many, perhaps most, will allow the US citizen to attend with the alien fiance. A few only allow the K-1 applicant (beneficiary) to enter.

Where it's allowed, it can't hurt for the US citizen to attend. In some cases, again depending on the consulate, it's absolutely essential.

Numerous people have successfully obtained K-1 visas using I-134s that followed the VJ example form ("N/A - K-1 Visa process for permanent residence").

Further, this answer is in keeping with the actual legal nature of the I-134 per State Department consular regulations. The I-134 is not legally binding. It is not a contract requiring you to commit to specific contributions to the support of the person. The I-134, according to the Foreign Affairs Manual, is simply a tool to assist the consular officer in determining that the sponsor's means are sufficient to file an I-864 at the time of AOS, which is a legally binding contract with the government.

Ok great. Now for this list of assets. I have very little in assets and income myself. My mother will be the primary supporter for my fiancee. The list of assets would be hers. Would the consular want to see last 6 months of bank statements and letter stating she is the owner and manager of a motel?

I assume the 3 years of tax returns would only be used for the i-864. I think it would be cumbersome if my fiancee takes those with her to the Consular during her interview.

If her income is sufficient to meet the requirements, there's no need to list assets (including bank balances). If assets are listed to meet the requirements, supporting documentation is required for each.

Generally, the most recent tax return (presumably 2008) is sufficient for the I-134. If the income reflected on that return is substantially lower than usual, you may wish to submit returns for the 2 previous years in order to demonstrate sustained earning potential.

Hey guys,

I have my interview on friday in Dublin, Ireland and i was reading on the check list that they may need to take my passtport and it will be expressed mailed back t me. I have no problem with this, they can have it. The only thing is i will need it back by Wednesday as i'm going out of the country.

Does anyone know if they can do what they need to do the same day and give it back or do i just need to hope i have it back by Wednesday?

One more thing, Dublin give the Visa the same day right? Any help on this i would be really greatful. Thanks a million guys.

Hi Dermot,
In Dublin you can get your visa the same day and I believe they offer a fast delivery or personal pick up option. I think the fast delivery can be next working day but if you are based near or in Dublin, you may as well collect it personally. If your interview is Friday you will definitely get it back before Wednesday.

honestly i give up with the rules and regulations.....the guy at the embassy told me I must carry my x-ray in my hand luggage in case immigration at the POE want to see it. Nobody asked to see it and yes its a bloody big envelope to try and squash into your hand luggage. One day someone will see the benefit to writing a full procedures manual for visa holders. Until that time we have visa journey.

sorry I must have misunderstood, I did get an opened envelope containing my x-ray and you should carry this in your hand luggage to POE, in addition to the envelope you will receive when your passport is returned by the courier service from the US London embassy. This envelope is sealed and MUST NOT be opened. It can only be opened by an immigration officer at your POE.

1/ was your envelope open once you receaved it from your interview at the embassy ?

When i had my interview the lady behind the booth opened it showed it had my chest X-ray in it gave me a photograph and put that in there

the only envelope i had was the one that gets sent from the embassy along with your passport when you have been approved. That one SHOULD NOT BE OPENED AT ALL COSTS as I opened it by mistake and was told I wouldnt be able to enter the US. I had to spend a further two weeks in London sending it back to be resealed and sent out again.

Hi all,
Getting the police certificate "extrait de casier judiciaire" is a piece of cake. They don't ask crazy documentation, it's free and they usually send it within 2/3 days. At least when u fill online as a french citizen. It shouldn't take much longer if you are born outside France.
Good luck with that one, but don't worry it's definitly not the most difficult document to get when filling!!

Yeah I might be in the wrong place on this board. I just saw previous questions on I-864's here so I posted here. My apologies if I'm wrong.

My wife filed for extensions prior to us getting married to give us more time to get married. They haven't been approved or not approved. At this point anyway, they are pretty much null and void since we got married and have moved on to a different process.

So yes, my mother is in the same household. We are just using her income to supplement my income and put us over the required mark.

Geez could they possibly make this process any more confusing? Anyway...

Here's the scenario real quick:

My now wife was here from Brazil on a 6 month B1/B2 Visa. We met, got married, she lives with me now, has filed for a couple of Visa extensions while we go through this process, almost ready to send in the forms now. I'm currently a student with a part-time job. Obviously I don't make enough to qualify as a sole sponsor. We stay with my mother and she's agreed to be a joint sponsor. I have two quick questions:

1) Does she (my mother) fill out an I-864 or an I-864A?

2) On my I-864, question #8: I am sponsoring the principal immigrant named in Part 2 above- Yes No (Applicable only in cases with two joint sponsors)

There is a box next to the first part of that question and than boxes next to both Yes and No. Do I check the first box and than do I check Yes or No? I originally had it checked Yes but my wife and mom looked it over and they say they think I'm supposed to check No.

Sorry for the lame question, I'm just trying to get this thing right the first time through. Ugh.

Everyone gets the letter that says that the petition will be forwarded to the visa-issuing post within a week. My letter was dated September 4, but NVC received it on August 31 and placed it into AP immediately. AP was finished on September 21 (per phone conversation with NVC supervisor), the file "left" NVC (i.e., they sent it to the mailroom) on September 22, and it appears to have been picked up by DHL for delivery to Seoul on September 23.

In short, the letter bears no relation to reality if you're in AP. Despite the oft-repeated claim that "we will contact you when this processing is complete," NVC will not call or email you when you're out of AP. The only way you will find out is to keep calling.

I don't think it's that, because I've seen both "EXP" and "CORRESPONDENCE" packages going to the same embassy. To take ours as an example, there's a CORRESPONDENCE to Seoul that was shipped on 9/22 (the day NVC said our case was sent), and an EXP 22 SEP 2009A to Seoul shipped on 9/23.

Did the DHL tracking number match? I tried to check "CORRESPONDENCE" and did not see one to Paris "with my I think was my Paris package" yesterday at all. My EXP tracking number was 9211354806

No, they were shipped one day apart and had different tracking numbers. The 9/22 shipment was 2 pounds, the 9/23 was 4 pounds. 2 pounds would be closer to the weight of our I-129F package. On the other hand, I've heard they will combine files for the same embassy into a single shipment to save money, so ours could be in the 4 lb. 9/23 package.

Obviously, I hope the 9/22 was ours—the sooner the better!

I've noticed that there is conflicting info here on VJ regarding how to track petitions shipped via DHL from NVC to the consulate.

In this post on the General K1 Guides and Info thread (pinned in the K-1 Process and Procedures forum), it suggests using "CORRESPONDENCE" as the shipment reference (and 03801 as the Origin Postal Code) on the DHL Track by Reference page. But on some of the NVC guides, I've read that the reference is "EXP 21 SEP 2009A," where the date is generally one day before NVC says the case left their facility.

In checking the DHL page, it appears that NVC uses both: both references return results from the U.S. Department of State to various embassy and consulate cities worldwide.

Is it possible that the EXP reference is for IR-1/CR-1 packages, while CORRESPONDENCE is used on K-1s? Could it be a matter of different mail clerks using different references? Does anyone have any idea at all what the difference is (if any)? biggrin.gif
