This is a supervisor, Lila, I talked to her yesterday , she told me my K3 is out of AP, but the operators keep saying its still in AP.
Im suppose to call her back Friday 09/18/09 I also talked to her about my CR1, she said she was moving it to the final reveiw desk. I still want to know, WHY do they want us to call them back??? ,do you think that is strange???

It's the first time it's happened to me. I don't know, perhaps it's to keep me from calling three times a day to see if we're out of AP yet.

Sorry to be a wet blanket, but if your NOA2 was 10/14 then it's highly unlikely that your case shipped out from NVC on 10/16.

First of all, the service centers ship approved petitions to NVC in batches, not necessarily immediately after approval. If yours missed the outgoing batch for the day, it might not have even been sent to NVC 'til a day or two after the NOA2 date. Figure in another couple days for transit time. Then, at minimum, plan on 1-2 days at NVC before shipping out to BKK—and that's not even accounting for the possibility of that special hell known as additional processing.

Your best bet is to call NVC and try to find out your status with them—and, while you're at it, your consular case number, which you'll need for inquiries with BKK.

Policies differ from consulate to consulate. It appears that Seoul is willing to reissue the K-1 under the specified circumstances. Getting it by email will be nice, of course, and hopefully you got the names of the consular staff with whom you spoke on the phone; but multiple attestation, which you now have, is a good sign. As the previous poster stated, your fiance(e) needs an ORIGINAL, SIGNED I-134 (with supporting documentation) for the interview. A printout of a scanned copy is not going to cut it.

You only need a co-sponsor if your income (and/or assets) are not sufficient to meet the guidelines (i.e., 125% of current poverty level, as per the I-864 instructions).

Also, be aware that not all consulates accept co-sponsors for the K-1. It's best to check with your consulate and follow their directives exactly.

Again, it should be the most recently filed return. Also useful to show current income are pay stubs (the most recent 6 months' worth are often suggested) and a recently dated letter from your employer stating your position, date and basis of hire (permanent full-time, hopefully), and salary. Hopefully, taken together, these documents will demonstrate current AND sustained income.

Gary is correct in saying that there are no specific rules for adjudicating the I-134. The consular officer must be satisfied that the applicant will not become a public charge when he/she reaches the US. Gary is also correct in saying that most consulates use the I-864 guidelines (125% of current federal poverty guidelines based on household size).

K-1 applicants do not use the I-864 or -864EZ until after visa issuance and POE. They come into play at AOS time.

The OP is talking about the I-134 used at the consular stage of the K-1 process. There is no I-134EZ.

All the questions you've asked are consulate-dependent to a greater or lesser extent.
  1. How the consulate sends the "Packet 3" info depends on the consulate. If they utilize e-mail, it'll probably go to you, as there's nowhere on the I-129F to record the beneficiary's e-mail address. If they use regular mail or a courier service, it'll go to the beneficiary's mailing address as reported on page 2 of the I-129F. If the beneficiary has moved, you or she should contact the consulate.
  2. The visa applicant (i.e., your fiancee) is responsible for arranging her medical exam.
  3. Varies by consulate.
I would suggest posting in the Embassy/Consulate forum and putting the specific consulate's name (Tokyo or Naha) in the subject so that others who've been through there before can offer you specific information based on their experiences.

It depends on the consulate that will be issuing your visa. Many—I'd say most—require at least DS-230 Part I, if not the entire form, as part of the Packet 3 requirements.

Although the K-1 is technically a nonimmigrant visa, it leads by design to adjustment of status to lawful permanent resident. Hence, it's treated like an immigrant visa. It can only be issued by consulates that process immigrant visas, and the clearance procedures utilized are IV procedures, not NIV. But as it is technically a nonimmigrant visa, the application process often includes elements from both the IV and NIV processes.

Edit: I just noticed that your fiance is from Ukraine. Kiev is one of the consulates that does not require the DS-230 for K-1 applicants.

The DS-156 online form does not submit or store any information you enter. It only uses it to generate a printable form with a unique barcode that captures the form data. So if you make a mistake, you can redo it as many times as it takes.

The DS-160 is a different animal. Information submitted on that form is entered directly into Department of State computers, and can then be pulled up on demand through the consulate's network.

When you request by phone, you shouldn't have to talk to anyone. It's all done via an automated response system. Call 1-800-829-1040 and follow the prompts.

I also faxed a 4506T, and after several weeks with no response, I called in a request via the automated system. I had my transcripts within a week.

You don't need transcripts for the I-134. The benefit of having them, however, is that they prove that you filed and the IRS accepted your return. Anyone can fill out a 1040; a copy of the return does not prove that it was filed.

NVC will not request an affidavit of support in K-1 cases. The consulate will require that for the interview. So if you're planning to go to India for the interview, you can take the affidavit(s) and supporting documents with you, or you can send them ahead to your fiance.

As for fees, there is an additional $131 fee required for the visa. Follow the consulate's instructions to pay this fee at or before the interview.

You are confusing the K-1 process with the IR-1/CR-1 process.

For the K-1, after the USCIS service center approves your I-129F petition (aka NOA2), the approved petition is sent to NVC. NVC conducts additional background checks on the beneficiary, then forwards the case to the consulate where the beneficiary will interview. NVC only collects forms and fees in the IR-1/CR-1 visa process.

For K-1s, Affidavit(s) of Support are required at the time of the consular interview.
