If it's just a name used between the two of you, I wouldn't worry about including that.

If she's ever used it on paper (signing documents, applying for jobs, credit, etc.) it should be included.

You don't need to submit death certificates for your parents, brothers, sisters, or practically anyone else. The only death certificates that might be needed is if you had a previous marriage that ended because of the death of your spouse. In that event, you'd submit the death certificate rather than a divorce decree.

f. Number 35 - I've been to the US so many times, but when they talk of previous visits, how far back should I go? I can remember up to maybe three years ago, but other than that, I really can't remember. Also, I'm planning a day trip in October to go shopping with some friends, should I add this to the application as well?

I know this is a lot, but I couldn't seem to find the right information in the forums after looking! Thanks so much for your help in advance smile.gif

Just because NVC gave you the new case number does not mean that the case has been transferred. Unless you were specifically told that the case was transferred and the date, you can't assume that it has. Significant numbers of us are being shunted into additional processing at NVC, which can add weeks to the process.

I'm not familiar with procedures at CDJ, but I know that the State Department's visa line can tell you whether the consulate has sent out the pre-interview packet yet. Perhaps someone with experience at CDJ can jump in.

I know it will be easier but I'm just not sure that I can afford to come back down that quickly. It's always advisable for the USC to attend the interview if possible. If it's not possible, it's good to include an explanation in the new letter of intent to marry that you'll provide to your fiance for the interview.
5. Is it still only Cuidad Juarez that we can go through?? I see that there is a consulate in Guadalajara which is only 1 hour away from us... ??? CDJ is the only consulate in Mexico that processes immigrant visas, and in general only IV posts process K-1s.

Your funds do not matter; only the USC's income. He will need to send you tax returns or tax transcripts, the past three years is best, and maybe a letter from his employer. It's all up in the Guides at the top of the page. Read on.

For the I-134, most consulates are only interested in the most recent year's tax return/transcript.

Also, the most important thing to demonstrate at the consulate is current, sustained income. The tax return helps with the "sustained" part, but in order to demonstrate current income, pay stubs (provide the last six months' worth if possible) and letter of employment (if he can get one) should be sent as well.

At minimum, you need an I-134 Affidavit of Support from your US citizen fiance that demonstrates income and/or assets that exceed 125% of the federal poverty guidelines for his household size (including you).

If your fiance's income and/or assets do not exceed this threshold, he will need to secure a co-sponsor (presuming your consulate allows them) who does have sufficient income and/or assets. The co-sponsor's income/assets cannot be combined with your fiance's to meet the requirements. You need one sponsor who can meet the requirements on his/her own.

Most consulates will not consider the intending immigrant's assets in making the public charge determination—and even if they do, you'll almost always need an I-134 from the US citizen fiance anyway.

Thanks a bunch kids. These forums are GREAT. Totally answered so many questions that I just can't find anywhere else!

Firstly: The US citizen fiance must submit an I-134. If you're using a co-sponsor, that person must submit an I-134 in addition to—not instead of—the USC fiance.

Secondly: 3-4 months from NOA1 to NOA2 sounds about right for CSC. Be aware that it may take longer—USCIS considers 5 months to be the normal processing time for I-129F petitions, and will not entertain service requests before that time has elapsed. After the interview, the visa is generally issued in a matter of 1 or 2 days unless the application is put into administrative processing for some reason (uncommon, especially in Canada). Once the visa is issued, it is valid for entry to the US for six months from the date of issue. Be aware that you generally can't "choose" when to use the visa, i.e., you can't make visa-free visitor entries to the US after the visa is issued. Once the visa is issued, your next entry to the US will "activate" the visa.

No. You do not list her as a dependent. There's no specific household count section on the I-134, but the consular officer will add the intending immigrants in #3 to the number of dependents in #8 to arrive at the household size for poverty guideline purposes.


If his ex-wife is still covered by the provisions of the I-864 he submitted for her, she needs to be counted on the I-134 and I-864 as wholly dependent. He will also have to reveal that he has submitted an affidavit of support for her in the past. The only way he can NOT include her is

1. She has been paying into the SS system the required 40 quarters. She can have acheived this faster than you think. By filing a joint tax return she can be credited for 8 quarters per year. Alla arrived in September 2008 and just received her SS statement and has accumulated 8 quarters already.

2. She has become a US citizen

3. Left the country and surrendered her permanent residency.

I misread the question. For some reason I had it in my head that he was asking if his fiancee should be counted as a dependent. I apologize for the confusion. blush.gif

That said, are you sure the OP has to list his ex as wholly dependent? He definitely has to disclose the prior affidavit of support. She could potentially be wholly dependent on him for support, but unless she actually is receiving full or partial support from him, is it correct to list her as a dependent? Or will the CO automatically add +1 to the household count for the prior affidavit?

That's the old version of the form, which must be signed in the presence of a notary, who then notarizes the signature.

Download and use the current version, which does not require notarization, from USCIS: http://www.uscis.gov.../form/I-134.pdf
(unless your instructions from the embassy specifically require a notarized I-134. If in doubt, call or email them to confirm their policy)

The old version required notarization. The current version (in use since 2008) does not. The current version can be downloaded from http://www.uscis.gov.../form/I-134.pdf.

Remember, the standard you have to meet is not "the poverty line," but 125% of current federal poverty guidelines based on the sponsor's household size (including the intending immigrant). The guidelines are available at http://www.uscis.gov...form/I-864P.pdf. The right column, in bold type, shows the levels you have to meet. The only exception to this is if your US citizen fiance is serving in the military, in which case 100% rather than 125% of the poverty guidelines applies.

If your salary is comfortably over the guidelines (not just barely), then income evidence is enough. Remember, you need to show current income, so pay stubs and a letter of employment (if available) are a very good idea. Information on bank accounts (including a bank letter) and other assets is only necessary if you need to use them to meet the requirements.

Your sponsor can get her IRS Transcripts - just get her to call 800 829 3676 and order them over the phone. That's what I asked my fiance to do. We are waiting on them now, hopefully it's not that long of a wait!
They are quite expensive though (around $50 each), so let her know that. I asked my fiance to get the last 3 years done because there are some threads here that say it is safe to have extra. Not sure if that is still the case with a co-sponsor though.

Okay, this is very helpful information.

First of all, the Approval Notice states a validity of four months from the date of approval. Don't worry about this. It has nothing to do with when you're required to marry your fiance. The consulate is aware that your approval will expire before the interview. They have the authority to extend the validity. The US fiance will have to submit a new letter of intent to marry (possibly notarized) at the time of the interview. With this letter, they will extend the validity.

Questions about the medical exam are consulate-specific. Now that you've identified the consulate as Montreal, people with experience there will be able to help you.

The most common advice I've seen here at VJ is the last six months' pay stubs. Obviously that's easier to do if you're paid monthly rather than biweekly. In any case, a year's worth is probably overkill.

This doesn't really answer your question, but the US State Department thinks you can get one through the Uzbek embassy, so they're going to expect one for the interview:
