just curious! why you would travel on an expired greencard?


Once you have that extension letter, it's no longer "expired." You can't file the I-751 (removal of conditions) until 90 days before the 2-year green card expires, but it takes USCIS way longer than 90 days to process the I-751 and issue a 10-year (permanent) green card. That's why you get an automatic 1-year extension on your I-751 NOA1 that specifically states that it's valid for employment and travel.

To the OP's question, my wife's 2-year GC was set to expire in March and she and our daughter traveled to Korea in June with her "expired" GC and extension letter. I joined her two weeks later and we came back together at the end of July. Absolutely no issues at POE. You definitely want to bring the original letter, as the airline will want to see it when you check in to return to the US. To be honest though, I don't even remember the CBP inspector looking at the letter; I'm pretty sure the extended validity came up on his screen right away when he scanned her "expired" GC.

You may want to call about this. The danger here is that if they don't get your rescheduling request in time they'll consider the appointment missed—and a missed biometrics appointment leads them to consider the I-751 application abandoned. When that happens, his LPR status technically terminates immediately, meaning he can't work until you get it all sorted out. Tread very carefully here.

He will definitely need the original letter when he gets ready to travel back to the U.S. CBP will have record of his extension at the POE but the airlines will demand to see the original letter before they'll let him board a US-bound flight.

I can't speak to the questions regarding biometrics scheduling. We did a walk-in on ours the day after we got the letter, a few weeks before the scheduled appointment.

Just out of curiosity, how long has your husband been out of the country?

I don't know if this is silly or not but I might as well try! I've already posted questions about filing for my ROC, and how my card expires Feb. 14th, 2013. I've been married for 3 years as of October 26th, 2012. Am I able to just file for citizenship, or do I still have to do the ROC? (because I wasn't married for two years when we started) Just wondering, and if so that would save a lot of time! Thank you for your help!

(Also adding in, I have never worked since arriving in the USA. My husband has supported me completely as I'm just a housewife, and I'm not entirely sure what this 40 work credit thing is that I've read on the boards is!)

You still have to file for ROC. You become eligible for citizenship based on marriage to a USC after 3 years of residency, not of marriage. Based on your card expiry date, you became a resident on February 14, 2011. Thus, you won't be eligible to apply for citizenship until (90 days before) February 14, 2014. Your window to file for ROC opens this Wednesday, November 14th.

The work credit thing relates to the I-864 affidavit of support that your husband (and joint sponsor(s), if applicable) filed during the CR-1 visa process. The obligations of sponsors under that affidavit cease when the beneficiary (i.e., you) become a US citizen or have received credit for 40 quarters of work from the Social Security Administration.

Looks good to me too... you have pretty much everything we did, and we were recently approved without an interview.

We included our passports, life insurance also.

Passports might be good if you have entry/exit stamps showing trip(s) taken together... if not, probably not needed. Any insurance policy showing joint coverage or designation of spouse as beneficiary is good.

Looks good...just want to suggest some additional docs that you might want to include if applicable. Copies of Drivers Licenses to show same address, copies of library cards, any kids? if so, copy of birth certificate, any affidavits from family/friends attesting to your ongoing relationship and marriage? Any joint titles on cars?

We also sent our daughter's birth certificate, as well as her baptismal certificate and health insurance coverage info showing both my wife (the GC holder) and our daughter as covered dependents on my policy. Affidavits aren't considered particularly strong evidence (see the "I-751 evidence" pinned thread at the top of the forum); you can probably skip them if you have lots of other primary evidence showing cohabitation, intermingling of finances, etc. While they can't hurt, I wouldn't expend a ton of effort on them.

I think I've seen a lot of people sending 3 years tax records though I don't know if its really required. I was planning on sending in 3 years myself.

If you have three years of joint tax filings, it can't hurt to send all three. It all depends on the timing of the marriage and the ROC filing window. In our case, our ROC filing window fell before our 2012 tax filing so we were only able to send two years' worth.

Forgot about biometrics. They did them for her GC, they do them at POE for visitors (including VWP). Yet another reason why this is a terrible idea.

Also, as a GC holder she's probably not even VWP eligible anymore. If she doesn't get rejected by the ESTA system, this ruse will almost certainly be discovered at POE and will put her in a world of hurt.

Certified or registered mail is overkill. If you're cutting it close to your 2-year GC expiration date, you'll want to use Express Mail (in which case tracking and delivery confirmation is included). If time is of the essence, make sure you tick the box for waiver of signature as requiring someone to sign for the package can delay delivery by a day or more.

If it doesn't absolutely, positively need to be there overnight, then use Priority Mail with Delivery Confirmation—not Signature Confirmation, for the reason described above.

Yes, the dates for removal of conditions and citizenship eligibility are based on the "Resident Since" date, which is the date of AOS approval for K-1 visa holders who adjusted status in the US. I've heard of one case where the AOS decision took a long time and USCIS backdated the "Resident Since" date on the green card, but that's the exception. In any case, you have to go by the date on the card, not the date of marriage.

You apply to remove conditions within the 90 days before the 2-year expiration date on the conditional GC. That means your ROC window opens in June 2014. The N-400 filing window opens 90 days prior to the 3rd anniversary of LPR status, so you're looking at June 2015.

The citizenship filing window based on marriage to a USC opens 90 days prior to the 3rd anniversary of the date you became a permanent resident—not 3rd anniversary of marriage. Look at the "Resident Since" date on your GC and add 3 years.

Yes, it's possible. If your ROC is still pending (unlikely, but possible) they will expedite it once you have an N-400 pending.

Yes...everybody was a little uncertain, I think, and I saw people referring to binders to make sure they were doing things right, and a supervisor had to be called to confirm what date to expire the new license: was it one year from the date on the green card or one year from the date on the NOA (they settled on one year from the date on the green card, which didn't worry me much one way or the other, since there was only 2 days difference in my case). But everybody found the information they needed to get me licensed.

I was fortunate that it was shortly before Christmas, and my local DMV was very quiet. I was in and out in 25 minutes: I didn't even have time to look at the reading I'd brought with me to pass the time. I was called to the counter before I'd finished filling out the form!

Probably the biggest hassle in my case was that my driver's license expired before I received the NOA, so I had to take the city bus to the DMV, since my wife was working. At least I didn't have to make any transfers between routes!


They made you fill out the form just like you were applying for the first time, right? That's the impression that I got from reading the DMV website.

I cut it very close. Mailed my packet on the 7th by Express Mail, and USPS shows it arrived on the 8th. My green card expired on the 11th (Sunday), so I'd REALLY like my NOA to get here so I can go to the DMV and renew my driver's license (since Virginia requires "proof of legal presence" to issue a license).

Did you manage to renew your Virginia license with the NOA? We're also in Virginia, so my wife's license expires the same day as her GC.

You are correct, but only N. Ireland is a part of the UK (the six counties in the north of Ireland that form part of the UK). My parents are from a part of Ireland that isn't, and never was, under British rule, referred to as Eire. Only an Irish passport will be granted if you were born in or have parental ties to Eire.

Ive just been reading some posts on dual citizenship and I was wondering whether its possible to have tri-citizenship?

I am UK citizen with Irish parents, so can get Irish citizenship at any time and was thinking of doing this. I am a Perm Res here in the US and wondered whether I can apply for the US citizenship and keep both UK and Irish?

Also, is my USC husband allowed UK or Irish citizenship even though we both live here in the US ?

I only received my CGC in February 2007 so I have a fairly long wait until I am able to apply. Being granted US citizenship would make me a tri-citizen, and so far Ive got by fine with my UK/Irish citizenships. Very easy. Basically Britain doesn't recognize the US citizenship, and the US doesn't recognize the UK one. Neither country will force you to relinquish citizenship so basically your SO can have both. As a Brit, I will be applying for US citizenship in the next few years, and that will be my third. I have UK and Ireland at present.

We have Blue Cross Blue Shield through my husband's employer. Its non-contributory on our part (for which we are very grateful), and the co-pay is $10 per visit. When I was diagnosed with skin cancer, I received incredibly good care by one of the best surgeons in the DC metro, and all for $10 ! There doesn't seem to be any exlcusions to the plan either so we are very happy with them.

absolutely I would remove laundry from a dryer that had finished its dry cycle. If the owner cannot be bothered to wait for their laundry then they can't expect that people will wait for a dryer. If you don't want your laundry touched then stay with it.

I'm very lucky to have my entire family here with me at the moment (mum, dad and brother). the only thing is I feel down when I think of my parents going home Saturday and my brother the following Saturday. Im gonna make sure tomorrow morning that I enjoy the rest of the their visit, and I am going back to London for Christmas now with hubby (his idea and he's buying the tickets - angel). I am always heartbroken for the first few days when my family go home but I have done this twice before so I can get through it again. I think this is a great thread - lots of good advice for keeping our chins up and our hearts in one piece !!

Definitely not a sheltie !! They really do need a lot of exercise and are extremely intelligent, so to be alone for long periods of time will result in a destructive and loud dog (they bark like crazy). We are in the process of adopting a golden retriever, however my husband works from home full time and I work from home 2-3 days a week so someone is always around. If you have a dog you really need someone around to feed and exercise it, and of course they require a lot of training and socialization with other dogs and people. ALL dogs need exercise so a dog will have you up at 6am for a walk and potty time EVERY single morning. We have two cats at the moment that have their own cat door as they like to roam outside. Aside from feeding them in the morning and evening, they pretty much do their own thing. The like to sit with us in the evening and play with their toys but you can leave them alone all day if you need to and they will likely just sleep. Also if you are away for one night, you don't have to have anyone feed your cat as you can just leave a big bowl of dry food for them and a big water bowl and they are fine.

The loan officer was fantastic and is now a good friend of ours. We put our house on the market straight away, sold it in 2 days, and moved into our current home within 5 weeks. Also, the home builder paid all of our closing, provided window treatments, $30k in upgrades, and buy-down for the mortgage !! hooray.

I'm obviously not sure of the rules for all airlines, but I have had an airline agree to credit 75% of a non changeable/non refundable ticket to a new ticket when I couldn't make a booked flight.
