As of this morning our checking account shows a pending debit from "VSC FIELD OFFICE PAYMENT," so it looks like our NOA1 is on the way!

As an aside, the electronic debit thing annoys me... back when I filed the I-129F for my then-fiancee's K-1, I was able to get the receipt number from the online check image well before the paper NOA1 showed up in the mail. No more, apparently. :(

The two checks may have been the problem... if they got separated (or worse yet, one somehow got lost), the mailroom drones who open the envelopes would just mark it for a "no payment received" rejection.

From the I-751 instructions:


You may submit one check or money order for both the application and biometric fees, for a total of $590.

Not only is a single check what the directions say to do, it gives USCIS one less thing to possibly screw up.

You're fine. You don't have to file exactly on the 90th day before expiration. What matters is filing within the 90-day period before it expires, which you did.

SOME consulates allow this, MOST do not but I understand you offer it as an example of their discretion.

Itwould be a terrible dis-service to state to VJ members that the "requirement" is 0%


If anything, the fact that most consulates don't allow self-sponsorship is further evidence that the I-864 guidelines weigh heavily in consular officers' consideration of the 212(a) public charge requirements. 9 FAM 41.81 PN 2 specifically allows for "self-sponsorship," stating that "It would not be unusual, therefore, for a healthy alien of working age, applying alone, to be able to establish eligibility during the visa interview without the need for substantiating documentation." But the I-864 requirements state that the intending immigrant's income can only be considered if it will continue from the same source after entry to the United States. Most consulates won't allow self-sponsorship... so which do you think they're going by, the FAM or the I-864 requirements?

Then the poster should have posted it in the Embassy and Consulate Forum and noted in his subject that it applies to Manila, not made an overarching pronouncement about the I-134. A lot of experienced, knowledgeable people have provided copious evidence that the information is not universally applicable.

merkin, the applicable law here is INA sections 212(a)(4) and 213A(f)(1). 212(a)(4) states that an affidavit of support under 213A may be considered in determining admissibility under this section. 213A(f)(1)(E) says the requirement is 125 percent of the federal poverty line. So that's the law.

The standards for adjudication by consular officers are set out in the Foreign Affairs Manual. As I cited above, 9 FAM 41.81 PN 2 states that the K visa applicant must meet the public charge requirements in INA 212(a). 212(a) takes us back to 213A, which gets us back to the 125% requirement.

So... Manila may accept 100%. That's within their discretion. But it is in no way a law or requirement.

This is a rather shortsighted statement. Once the visa is issued, your fiance(e) has 6 months at most to enter the US. Then you have 90 days from entry to get married. Since your new spouse won't be able to work or travel abroad until you start the AOS process, you will most likely not want to delay. So you're looking at 9 months at most (and more often less) to get to 125%. Yes, when it comes to AOS you can use a co-sponsor—a prospect not to be taken lightly either, as the co-sponsor is taking on a legal and financial obligation by signing that affidavit of support.

What's the point of bringing your significant other here if you aren't confident that he/she will be able to successfully adjust status and stay here? I agree that it's a process and you need to take it one step at a time, but you also need to look ahead to know what's coming at you and be prepared to handle it.

merkin, fair enough. 100% works for Manila, which could work to the advantage of some because Manila doesn't accept co-sponsors at the visa application stage.

Nevertheless, it's also fair to say that other consulates may vary. Just as other consulates may accept co-sponsors during the visa application process, other consulates may be looking for 125% rather than 100%.

As usual here at VJ, the moral of the story is do your research. Your mileage may vary at the visa application stage because there are so many different consulates and they're given such wide latitude on making the public charge determination. Find out about the requirements at your consulate, and figure out how you're going to meet (or better yet, comfortably exceed) them.

merkin, your information is correct—but you're kind of missing the point.

  • Consular officers have wide latitude in making the determination regarding adequate support. They're not required to ask for the I-134 at all. If they do, there's no hard-and-fast rule for adjudicating it. The Foreign Affairs Manual states only that "It is only necessary that the consular officer be able to conclude that the alien is not likely to become a public charge." (cf. 9 FAM 41.81 PN 2)
  • The 125% requirement comes into play shortly after the K-1 holder enters the US, marries the petitioner, and applies to adjust status. If at that point you can't demonstrate the 125%, adjustment of status will be denied. Consular officers are not unaware of this fact.
Given these two facts, if you try to skate by at the interview with support documents that only show 100%, you're playing with fire. You'll have to meet the 125% requirement in very short order anyway, and since the consular officer makes the call, that 25% may lead to a denial. It also may not, but do you really want to take that chance?

You can call the Department of State Visa Services information line at (202) 663-1225. Have your MNL case number ready, and follow the prompts to talk to a human. They'll be able to tell you whether the embassy has received the package and logged it into their system.

Thank you all for such kind thoughts and expressions. It truly means alot coming from couples who are going thru this process and distance from one another. The "everyday couples" that don't have to expierence being apart from one another, all the paperwork and fees and delays in planning a wedding (because you simply can't), they don't understand the dynamics of relationship that we have. They just see a one sided relationship that's not normal.
I have come to the conclusion that as far as our relationship goes, I'm giving him a couple of days to prove, beyond any doubt to me that anything maybe salvagable. i.e. I'm checking out if the relationship. The ball is in his court. He should start sending flowers everyday to my work. Even if he has to panhandle in the streets for money to do it. I deserve to showered with as much affection possible given the distance. And so on. -- But I don't think he going to do this.
In the meantime, I am going to start selling some of his things. The is not being done of malice, I'm covering expenses.



I think the key here is whether he actually had a relationship with another woman or simply slept with her. Neither is excusable however one doesnt involve feelings etc. Its all very well for him to be sorry but if he really cared as much as you do, how could he do this to you? Only you can make the decision.

We filed for K-1 whilst I was visiting the US from the UK. I then decided to stay the entire 3 month allowance under the visa waiver programme. I left the US and went back to the UK for 2 weeks after the 3 months had expired, and then returned to the US for a further 10 weeks. I then returned to the UK only for my medical and embassy interview. I was absolutely honest at POE and said I wanted to spend as much time with my fiance as possible and was never once questioned about my ties back in the UK. To be honest, I hadn't found Visa Journey at this time and had no idea that my long visits to the US may have caused problems at immigration. You can only try the same thing and see what happens. Of course no one can give you any guarantees but my story shows it can be done.

Its kind of sad how a drama filled thread like this gets so many posts, the question of what to do was answered a LONG time ago, now other people are just jumping in to be apart of the drama... Now people are bickering back and forth amongst themselves, which is pointless. Is he making a mistake by marrying someone who is already married, and lying about it to the US govt? Maybe, but its his life and his right to make all the mistakes he wants, because ultimately, he has to live with it. Its not our job to save him or make him do anything.

This thread is like a 10 car pile up that everyone is rubbernecking to see if someone died, its kind of horrible. Lets all turn our energies towards something constructive, like helping people who really need help in this forum instead of fighting with each other and repeating the same advice over and over. Nothing new can really be said unless someone here is an immigration attorney with lots of Philippines experience.

Yeah just talk with her and try to reach a compromise. Try to make her understand that you aren't ashamed of her but she doesn't understand how people can be. Maybe the compromise can be you can get all your friends together and have them talk to her on skype so they can see how she is, and make sure she knows that if she has a problem with something you do to talk to you first. If people want respect they must give it so you both need to find out what things are considered totally disrespectful to each other and which things you require. These are the things that need to be done asap because things don't just magically get easier or better once your married :lol:

Thats why they need to talk to each other, imo they need to get to know each other a LOT better before getting married because if they're having a problem communicating now (to the point where she is posting things asking US what he should do rather than talking it out with him) then they are in for a rocky time. I'm not a fan of airing out dirty laundry like this on a public forum, it's embarrassing and now look at all the people demonising her fiance. If I were him I would feel very hurt and upset by this as she is about the situation which started it.

And I had to hear their stupid fears and comments about my ex everytime I talked about him, I wished I would have just waited like he is doing. And I didn't even marry my ex or have the sort of history this guy has. They don't know she's a good enough person yet, they will think they are thinking of him when they try and cast doubt on this relationship and talk bad about her amongst themselves for months before she even sets foot in the country. He is trying to protect her from that because he cannot control what other people do. Regardless of what you think he 'should' do, I don't think his heart is in the wrong place and she should at least appreciate that.

Glad you came on and clarified what's been going on. While I feel your pain for the troubles your first wife caused, you can not compare one person to the next. While it is normal to have some doubts, hiding the existence of your wife to your friends isn't fair to her.

You should have no "shame" in what happened the first time around, as it was not your doing that caused the relationship to fail. On the same hand - your new wife has done nothing wrong and deserves your respect and acknowledgement that she exists.

You can NOT live your life worrying about what others think or say. Your happiness and that of your wife is the only thing important.

It's apparently important to her or she would not have posted her concerns.

From what he just explained, the most important people already know about her. He's waiting until the rest can meet her in person. I don't think that's unreasonable considering some people are judgemental and could let those misconceptions fester in their minds for months before she gets here. If he waits til she's there before introducing her to his friends they will see right off she is a good person and not have time for their minds to be poisoned. Seems pretty reasonable to me :thumbs:

I noticed that the I-134 form currently available shows expiration of 5/31/10, but my fiancee will probably have her inteview scheduled in July. I assume that form I will fill out and send her for her interview so that will be after 5/31/10. I know what I will be putting down on the current form but if it changes, how will I know what will be valid starting in June? I won't be dealing with the Phillipines but this is a US form and since I found this discussion thought I would ask.

hi all,
I went back to the consulate to give my fingerprint again.
it was pretty weird cause everyone was called by their number and the consul called me by my name to come at the window. the PAris consulate is very packed with 20 windows and always 40 to 80 people waiting so everyone was like "who is that girl who get called by her name???!!"

anyways I eventually received the visa kicking.gif kicking.gif and I'm flying home on Tuesday smile.gif

we're gonna get married ASAP at the courthouse (celebration with families will be later in France) and now I'm kind of wondering how it works with the SSN. I looked at the guide and the forum but it isn't so clear to me. the VJ guide says I shall get my SSN with my K1 and then that I shall come back after the wedding to change my name. It also says that I shouldn't try to get my SSN too soon after I enter the US cause I may not be in the system yet. ok but what if I want to get married ASAP? can I get married without the SSN and get it after?

Another question I have is about expediting EAD. I may have a job offer to start late January and I wonder how easy/hard it is to get my case expedite if I have a solid job offer? I read some people managed to do it but I don't know what's the exact process and how likely it is to get it accepted.. do some of u know about that? I asked the consul she was very confident I could get my case expedite but well..: I don't quite trust consuls...

hi all!
My interview went ok.
They didn't ask for Kai's new letter of intend. just mine.
and they accepted I864 instead of I134 for the supporting form (yeah I didn't read well enough my packet 3 and we had already prepared everything according to the VJ guide. Unfortunatly the Paris embassy VJ guide was wrong saying we needed to fill I-864. I updated it so no other couple make the same mistake again:))
the consul said I'll probably receive my passport back sometime next week kicking.gif

Hi April filers!
I've got a little question here.
When I was in the US end of September Kai and I got NOA2 and we decided to get ready for the interview (all the I-something and so on). We wrote the Letters of Intend and signed them. As u can see in our timeline we experience serious delays between NOA2 and actual interview and now I'm wondering if it's gonna be a problem that the letter of intend is 3 month old.. I already know the birth certificate is not good anymore (3rd time I go get one at my town hall this year: it starts being ridiculous..)
Interview is on Thursday..
any clue on that one?

The TB is a relatively new requirement. It's good you got it! Did you happen do get a vaccination record from the doc to submit with your AOS???

We put the wedding pics taken with our camera onto my daughters laptop (ours was busy at the time) and she was kind enough to do a complete restore (curse that geek mother of hers for showing her how! laughing.gif) Anyway...waiting on others now ...and still procrastinating about AOS. whistling.gif

hi all,
I'm also in the US now, although not with my K1 in hand yet:(
I'm visiting for thanksgiving. We had a return ticket to use so well... I jumped in the plane! I'm now waiting till I get my interview date (I sent packet 3 back 10 days ago) and I'll jump in a plane back to Paris. I'm fearing it's gonna be in January..
The custom was easy as never before, eventhough It's my 3rd trip within a 6 month period. I just said "thanksgiving" "couple of weeks"... the more I worry about it the smoother it gets.. it's so unpredictable..
Well, Happy thanksgiving to all of you that are now in the US, and sorry for those still waiting...sad.gif

Have you tried calling DOS? (The USC) and seeing if they can help at all? or atleast give you more information on where your case is right now, physically. DOS know everything the Embassy do and most people say they are better than calling the embassy.

"this is not an overnight process" <-- that is incredibly insulting for them to say that to you.

Thanks for the tip!! Kai called and they said our case is now in Paris and package 3 isn't sent yet.
it took kai about 3 minutes to get an operator on the phone. that's very efficient!

thanks for your messages. We are now waiting for package 3 from the Paris Consulate. There is no way to get a consulate officer on the phone (execpt if they call us as they did last week) so there's not much we can do now, but wait..

The three months comes off the embassy site as an approximate date for the time of interview from the arrival of the package to the embassy. I've seen numerous Iranian people on this site that have been granted an interview within the three month period. My son has already completed the process with USCIS and NVC and his package just got to the embassy yesterday. We were hoping for an interview by the end of January.

For an Iranian visa applicant, you also need to factor in post-interview Administrative Review delays. Most if not all Iranian applicants require additional security checks after the interview before the visa can be issued. Three to six months after the interview is not uncommon.

OP, perhaps the consular officer was "disrespectful" toward you. I've certainly heard of this happening to others.

But I don't know how you conclude that their holding on to your passport is "disrespectful." They have procedures that need to be completed. They're doing their jobs. The fact that they held onto your passport means that they expect to be able to issue your visa in the not-too-distant future, which requires that your passport be in their possession.

Take my word as someone who was screwed at nearly every stage of this process: the process sucks. But seriously, unless you enjoy living life in a constant state of pissed-off-ness, you need to be more judicious about what you allow to offend you.
