Your guidebook is correct. The beneficiary should answer "no" to this question on the DS-156 UNLESS someone else has previously filed an immigrant visa petition on his/her behalf. While the K-1 visa presumes immigrant intent, it is technically speaking a non-immigrant visa. Hence, the I-129F is not an immigrant visa petition.

Because they are talking about the beneficiary, not the petitioner. You are the petitioner and therefore you do not list your children, only the beneficiary's children, in that age category.


The OP is the beneficiary, not the petitioner. The daughter is the child of the petitioner and the beneficiary, so the beneficiary will need to list her on his DS-156K as it says all children under the age of 21.

Um... first you said don't list her, then you said don't list her as following you. It really wasn't clear the first time around.

To the OP: The form is pretty clear: List all children under the age of 21. She won't be accompanying you, and she won't be following you, so tick "No" for both. If you're concerned about it, you could write "See explanation on attached sheet" on the next line and attach a sheet explaining that your child is a US citizen and already living in the US?but this probably isn't necessary. It will already be clear from question 37 on the DS-156, "Are any of the following persons in the U.S., or do they have U.S. legal permanent residence or U.S. citizenship?"

Why can't he start the next step? You don't need the NOA2 hardcopy to start gathering documents for the interview stage. We just got our NOA2 on Thursday evening, 8/27, and I've already assembled all the Packet 3.5 forms and evidence that Elisha will need to take to her interview.

In fact, thanks to the wonders of the Internet, he can send you all the documents before the NOA2 hardcopy shows up. You certainly don't need the original NOA2 for the interview. If it hasn't shown up by the time all the other documents are ready, he can send those and then send you a scan of the NOA2 by email, which you can then print out to show if necessary.

All that being said... it often takes at least a week, sometimes 2, to receive any kind of mail from USCIS.

The consulate can revalidate the petition if the approval expires. They will require a letter from the petitioner requesting the extension and reaffirming intent to marry. Some consulates require this to be notarized, others don't.

NVC doesn't have a toll-free number. The number is 603-334-0700. K-1 cases aren't entered into their system, so you'll have to talk to an operator. When you get to the voice menu for the automated voice system, press 1 for English, then 5 to speak to an operator. When they answer, be prepared to provide your USCIS receipt number (or NVC case number if you have it), beneficiary's name and date of birth, and petitioner's name and date of birth.

I don't think that's true; I've read in several places that K-1 cases aren't entered into their automated system because they usually aren't at NVC very long. I'll try next time I call though!

Unlike USCIS, NVC does accept calls from beneficiaries. You'll need to have the USCIS receipt number and the petitioner's name and date of birth (as well as your own) handy for identification purposes, however.

If you follow the instructions for the older form (suggested by many posters here to avoid possible RFEs), print 4 of each and sign each copy individually.

Every NOA2 says that the approved petition is being forward to the listed consulate.

In reality, every approved I-129F petition is transferred to NVC, which runs additional checks on the beneficiary (usually 2-4 days unless you're unfortunate enough to get picked for "additional processing") before forwarding it to the listed consulate.

USCIS does not forward any petitions directly to consulates. They all go through NVC. There is nothing to "find out for sure" from CSC. This is the way it works. For sure.

Congrats. I think your case is K1; I was told that NVC generally only handle immigrant visas, your case should be forwarded to the embassy with jurisdiction over your case.

Just to clarify: all approved I-129F petitions go through NVC prior to forwarding to the consular post. At minimum, NVC runs a name check on the beneficiary before sending the petition onward. If the name check does not clear immediately, or if your petition is "randomly" selected for additional processing, your petition will be delayed a matter of days or weeks before being sent to the consulate.
