Depending on the reason for the denial, you could appeal, file a new K-1 petition, or marry in the Philippines and file for a CR-1 visa (and, optionally, the K-3). That being said, denials aren't all that common, though they do happen as we've unfortunately seen in our March family.

But don't get ahead of yourself. You're at 6 months now. Have you gotten an RFE? Does your USCIS online case status show any "touches"? Have you filed a service request with USCIS, or asked your congressman or senator to look into your case?

Well, let's see...
  • AmyStan got approved, but Amy has to do the sputum culture so they've got a couple months to go...
  • missmissy got an RFE, responded to it, they resumed processing, and now she's anxiously awaiting NOA2... Same for CarlJessica, I believe...
  • Poor Richard (Richard-Joanna) still hasn't heard ANYTHING. Keep them in your prayers.
  • strega got approved and the file is now at the consulate in Italy, but they're waiting on some paperwork before they can schedule the interview.
  • dgard got approved, not sure where he and his SO are in the process
Feel free to add to my list, and apologies if I missed you; the oversight wasn't intentional!

And we got approved, but now we've been stuck in NVC hell for nearly 2 weeks with no timeframe for when we'll get out. It doesn't feel like we're any further along than 2 weeks ago. I know we are, but it's small comfort when I see our chances of coming back together when we hoped swirling down the drain once again.

I just got my letter from DOS saying the NVC has received an approved I-129F and to let me know that within a week it will be forwarded to the consulate. Did you receive this letter? I assume i am still in AP cause i havent called again this week and i've read some threads of ppl getting that letter and still being stuck in AP. Also the one time i did call the NVC they told me we were in AP and they said they would notify me by e-mail which I've never heard anyone say that they notified in that way by NVC.


Yeah, I got the same letter. It was dated September 4 and said that our petition would be forwarded "within a week." Well, today is 1 week from the 4th, and as far I know we're still stuck in that hellhole. They haven't responded to my email from this morning. I'll probably go ahead and call one more time before I leave the office.

strega, here's what the Naples consular page says about the K-1 process:

1 You will receive a packet of information from the U.S. Consulate containing application instructions and forms.

2 When you have obtained all the required documents and completed all forms, you must fax the DS-230 Part I Form for each applicant to the Immigrant Visa Unit in Naples at 081 583 8394.

3 Two weeks after faxing the DS-230 to the Immigrant Visa Unit, call the Visa Information Service (see contact information at bottom of this page) to schedule your medical appointment and interview. You will need to identify yourself to telephone operators with the last four digits of the Petitioner’s social security number.

4 Bring your passport, 1 photograph, and vaccination records to the medical appointment on the first day and all remaining documents to the visa interview on the second day.


As for DS-157, I'm not sure but the consulate page doesn't mention it.

Awww... so awesome that you guys could spend so much time together! I know how hard it must have been to see them off, but you're well on your way to being together for good! Here's hoping and praying that the court gives him what he needs quickly so you guys can get this over with!

As for the DS-230, all I can advise is to follow the instructions from your consulate. The procedure in Seoul is to fax in the DS-230 Part I right away, then schedule the appointment on their website. But your mileage may definitely vary!

Don't worry about the approved petition expiring. If it's getting close, you can send a letter to the consulate explaining the circumstances, reaffirming your intent to marry, and asking them to extend the validity of the petition. They'll give you another four months, and it can be done more than once if necessary. There's a sample letter in the Example Forms section for this. good.gif

Well, my congressman's immigration caseworker just called. She talked to NVC, and they gave her the standard "could be 2 to 3 weeks" line. blink.gif

You don't need police certificates for time spent in the US. That's all covered by the checks that USCIS, NVC, and the embassy run on you in the course of the process. good.gif

The only exception to this would be if you were arrested during the time that you were in the US. If so, you'll need certified copies of the arrest records (and court records, if any) showing the disposition of the case.
