Some of the posts in the thread ("so what if she's scamming me? I get to 'hit that' for three years and then I can get a new one!") are exactly the kind of stuff that cause people to look askance at IMBs and marriages that come about through them. I know every case is different, and I'm willing to bet that most people who meet their SOs through IMBs are not like the guys who posted that kind of #######. But it does grind my gears that people like those guys are clogging up the system leading to longer waits for people like Elisha and me who actually met in person and developed our relationship while living in the same country.

My repeated requests for assistance to the National Visa Center by email and regular mail have gone unanswered. I simply do not know where else to turn.

On August 31, 2009, NVC received our approved I-129F Petition for Alien Fiancée and entered it into their system. Since then, our case has disappeared into "additional processing." It is my understanding that NVC policy is to forward approved I-129Fs to the listed consulate within a week of receipt from USCIS. Based on my research, the vast majority of I-129Fs are sent onward within 2 to 4 days. Ours has been at NVC for nearly three weeks, with no indication when it might be forwarded and no explanation for the delay.

My fiancée and I made every effort to include all required documentation in our I-129F submission, and I am confident that our petition was complete and correct in every respect. Neither I nor my fiancée has ever been arrested or charged with a crime, much less convicted of one. My fiancée and I met while I was resident in Korea, and she is a highly educated individual with an impeccable resume; the bona fides of our relationship are beyond reproach. I am unable to fathom any reason for this excessive and unreasonable delay.

(Elisha) and I have already endured five months of waiting for USCIS to adjudicate our I-129F petition. While I recognize that your office has no control over that agency, you can exercise influence and oversight over the NVC. This stage of the process has already taken multiple times longer than average. The continued prolongation of this process imposes daily heartbreak upon (Elisha) and me. Moreover, it constitutes an immense logistical and financial hardship to us, as we can make no plans for our reunion and marriage while our petition is held hostage to the arbitrary whim of a contract facility. Finally, this delay reflects incredibly poorly upon the United States of America: (Elisha's) family, friends, and colleagues cannot understand why our country does not welcome a person of such high personal and professional caliber, but rather continues to subject her to unwarranted and unreasonable delays. I have no explanation to offer them, and am left only with embarrassment and shame for the land of my birth.

Therefore, I respectfully request that you do everything in your power to ascertain the status of our case and see that it be forwarded to Seoul at the earliest possible opportunity. (Elisha) and I will be eternally grateful for whatever assistance you can provide to us in this regard. Well, it's not only the NVC that doesn't accept incoming faxes. The Office of the Assistant Secretary of State for Consular Affairs doesn't either.

EDIT: ... because the fax number in the phone directory on the DoS website is wrong! I called the office, they gave me the correct number, and the fax went through! WOOHOO!

Well I don't think verifying a divorce document from Canada would be too difficult, shouldn't really be a problem with most countries I would imagine. As for the custody documents....that isn't even asked for until the interview stage. I actually missed a day of calling NVC yesterday on account of feeling like garbage. Not that it mattered—I called today and got the same line of hooey as usual: "undergoing additional processing, unfortunately we have no timeframe for this process." I was feeling ornery so I asked to speak to a supervisor who didn't have any additional information but offered to put in a request to "the unit" (what unit that is, she didn't tell me) to see if they could move things along and/or let me know how much longer this might take. She gave me her name and suggested calling back Monday or Tuesday.

This version of the page says 5 months for I-129Fs at VSC, while this one says April 23.

I guess I should have been clearer. I wasn't talking about Asian names in general, but rather names whose native alphabet is non-Roman.

To take an example, let's imagine Kim Jong-il were trying to get a visa. His name in Korean is written ???. We most commonly see it Romanized as Kim Jong-il, but it can also be written Gim Jeong-il, Kim Jeong-il, Kim Jung-il, etc. The State Department runs name checks on most, if not all, of those possible spellings. USCIS only checks the name as written on the I-129F and/or G-325A.

As far as I've been able to gather, all NVC does on approved K-1 petitions is run an FBI name check on the beneficiary. That's supposed to come back right away, though: USCIS already ran one just prior to approving the petition, and if a name check has been done on the person within 120 days, FBI doesn't repeat it, they just send the results of the recent check.

BUT... I think we may be getting screwed because Elisha's Korean. Asian names can be Romanized in many different ways, and from what I've read the State Department's software requests name checks on numerous spelling variations of Asian names, whereas USCIS just runs the spelling provided on the applications. So... we may indeed both be waiting on the FBI to clear these name checks.

Please don't take any of the foregoing as definitive, by the way; it's merely my understanding of what little I've been able to find on these subjects.

You might try calling back and getting one of the Tier I kids to file the service request for you. They're often far more willing to do it than the Tier II curmudgeons.

This was one of those ideas that sounded great until I actually looked into it. Friggin' St. Albans, VT is nearly in Canada and a solid 225 miles from Portsmouth, NH.

AP at NVC is like a cruel joke. You finally get out of USCIS and you think you've got a straight shot to the consulate... and then they yank you into this hellhole and treat you like a mushroom (i.e., keep you in the dark and feed you horse puckey).

Depending on the reason for the denial, you could appeal, file a new K-1 petition, or marry in the Philippines and file for a CR-1 visa (and, optionally, the K-3). That being said, denials aren't all that common, though they do happen as we've unfortunately seen in our March family.

But don't get ahead of yourself. You're at 6 months now. Have you gotten an RFE? Does your USCIS online case status show any "touches"? Have you filed a service request with USCIS, or asked your congressman or senator to look into your case?
