Sooo, as you all know, I had my interview on the 16th of May. Supposedly approved.... but then put on AP....You guys know the rest of the story...

 

 

I have been calling DOS twice a week. Checking the website every 1 hour during the day (pathetic I know lol) My case was last updated May 22. So, after finding out that 2 of our member (that had the interview the same day) should be getting their visa/passport soon, I figure, let me call DOS and see what is going on with my case...

 

The lady again said, "your case is still under AP", I asked ma'am, can you please let me know what is the reason?? Of course she can't tell me b/c she doesn't know (or so they say) She did say that no document is needed. I asked then what is the AP about?, she said that they are checking to see if he qualifies for a visa. (Well is that my reason? or is she telling me this to shut me up? lol) Ok, I understand that they do the back ground check, but how long can it take?? I am so confused. They kept his passport, everything looked good. The CO was even thinking about more questions to ask us.

 

So I decided to email the consul today, in hopes of getting an answer to my dilemma.

 

Sorry guys I just needed to vent...Any words of encouragement or advice is greatly appreciated crying.gif  (Please do not judge me, I know that there are many people who has been put on AP for months and hasn't received anything. I just need peace of mind)

 

FYI:

The other times I called I asked a couple of questions...

 

What is the difference between Administrative Processing and Administrative Review? "NONE"

What is mandatory administrative process and administrative process at embassy level? "I am not sure where are you getting these terms, there are is no such thing as that"

 

And supposedly, everyone is put under AP even if it is a day or 2.....so the one guy mentioned...

There is not a specific timeline for AP as you know already...My encouraging words to you is just be patient and keep checking frequently. Your visa will come through sooner than you know it. Best!

You are supposed to fill out the DS-260 online (on the CAEC site) after the switch to electronic forms. Unfortunately, some embassies/consulates still use the paper forms (not sure why the London Embassy is asking for the DS-230, probably outdated instructions letter?)

 

As suggested earlier, the folks in the UK sub-forum can tell you exactly what form is currently being accepted.

 

When my wife went to her interview last month, we weren't sure which form version the embassy in Ghana accepted. Even though, we had submitted the DS-260 online, we filled the DS-230 and brought it on the day of interview just in case. The DS-230 was not required, but we didn't stand to lose anything anyway.

Oh I get the point trust me. You could have used other descriptors to still let people know who or what CO was being referred to here. Go back and read your original post. The point is this: CO's are trained to be fair, regardless of race, gender, social status, social perception, social class etc of the visa applicant in the performance of their duties.

 

As I said before, if you feel wrongly or unfairly denied a visa, take up the issue with the CO or consulate. Unfortunately there is no appeal process for a visa denial that I know of to advise you on. There's a reason why the United States government gave these COs the absolute authority to deny or approve visas. Arguing with me & going in circles in a public forum serves no purpose.

We are going in circles here. The points made will have to be let rest. Obviously the CO thinks otherwise that's why she rejected/refused you the visa.

 

Arguing about a rejection in this forum will not get your case approved. You need to take it up with the CO or the embassy if you think you were refused wrongly or have a genuine case. Let's stop going in circles in a square.

ofcourse no 1 can tell co who to approve!!!! but sometimes it happens that a genuine case got rejected n it happened with me but hopefully that does nt happen again and  thnx for the wish:)

Point is, as visa applicants, we can NOT tell a CO how to do their job - i.e. who to approve and who not to approve. They look strictly at the body of evidence presented before them. Skin color, social status, perception of him or her in that particular society is irrelevant.

 

If the CO "rejected every other visa interview she took", it may be that those applicants do not have a genuine relationship or a strong application? How about those that were approved? So your assertion is that this very CO has never approved ONE visa applicant since she been at her post?

 

My advise is, if we don't get approved we should look at reasons other than the CO's race or gender. Try again, you might succeed next time.

i have heard abt that co she rejected every other visa interview she took 

i was fully prepared with all the evidences n ginuine relaionship

Yes I have been to Pakistan many times. I have actually worked in the consulate and do work for the Department of State. Sure I don't work in consular, I know those working there go about their jobs professionally. Also, we all get the same notices and memos about how not be biased & impartial in the conduct of official duties.

 

All I ask is please do not inject race into the process because your visa wasn't approved.

 

How someone might be "looked at differently in Pakistani" because of their race is for that society to deal with. No wonder we have so much issues because of our tendency to make all things racial. It doesn't have to be so!

To the OP, why do you have to put African-American in quote (I.e. "african american")?

And to the second response, no need to even comment on.

Why inject race into a visa interview? If your visa is denied, it is denied because the CO looked at your body of evidence presented and s/he does NOT think you deserve to be approved. Stop this race nonsense.

Thanks. Hard to proof this since I call him in the middle of the night and sometimes when he just wakes up from bed and sometimes he is still in bed. But I will place the relationship in the Hands of God.

It is easy for people to conceal another relationship regardless of what time of the night or day you call, especially when you're over 6000miles away. Calling him at odd hours will NOT reveal whether he has a girlfriend or is cheating on you.

Remember one could easily tell a guy or lady laying next to them this: "hey lady/guy xyz, I got this woman in the US who is 'pestering' me with calls so when I get such calls know that its this 'desparate' woman trying to get attention from me". The other woman could easily understand this especially if they don't know all the facts and/or if he's lying. Please I am NOT calling you desparate by any stretch of the word, especially when I don't know you, but understand that it is well easy for someone to say that to another woman behind your back.

Hope you find Mr. Right who will be onboard with you. Very best wishes!

When I sent my fiance a list of the documents I needed from her, I got them back in about 12 hours. She doesn't even have a printer or scanner in her house. If you want my opinion, I'd say he is lying to you. Stalling since November is not procrastination or "Africa time," it's "I don't actually care about you." He has another woman, I'd bet $100 on it. Why would you want to marry someone you have so many doubts about anyway? We all have some little minor doubts or worries, but your situation is pretty bad, IMO.

OP, imagine if at the beginning stage he's this uncommitted to the process, how much responsive will he be in case and just in case you guys get a RFE? - or at the NVC or consulate stage when you two will need to coordinate and respond in a timely fashion to some requested documents?

Another side to your issue is that, he may have a girlfriend and is not sure about you, or at best he's undecided at embarking on this journey with you. Simply, he doesn't want to do it so in his mind, procrastinating sending you the documents will make you give up or go away with time. Seriously, you are invested in this at 100% effort while he's at 50% at best. Please do NOT push things so you will come across to him as desparate. Remember, this is a long journey and if he's not 'into you' or not into it, you will only see problems down the road after he gets here. Think twice before doing this!

Every post I see from you is complaining about the Amnesty Act which you don't even know how it works (as evident from your other postings).

Post your timeline so we can see where you are in this process and to see if you are even entitled to be complaining like this all the time.

Don't keep giving people misinformation as they are trying to deal with this rather trying time in their lives and they sure in the hell don't need to hear your disillusioned, over exaggeration about the process.

People need hope and people to talk to that share their pain, not negative comments telling them they will be doubling every waiting time they say. I just hope people are smart enough to see your posts for what they are and not as gospel.

Pretty annoyed with all that negativity about the immigration process myself, while I've waited longer than most. Be grateful your coming into a country that cares about who is entering, allow them to do their job, if you don't like it then go live in the country your spouse is in! I bet that process is pretty easy, why???? People are migrating to the U.S. usually when marrying a U.S. Citizen.
Just deal with it, like the rest of us. I'm sure they would appreciate a kind customer inquiring than an out of control one. That person answering your call has not one ounce of responsibility for your file!

So I got the approval letter(NAO2) from USCIS dated Dec 14 on Dec 16 informing that case has been forwarded to NVC. I have been calling them everyday in January who told me it takes 15 business days,apparently they haven't had 15 business days as of Jan 15(I know right....where can I sign up for this job!)

Finally,yesterday(Jan 16) they "received" the case but will take 15-20 business days for a case number. I LOST my mind, is this considered normal?? Are these people living in 2013,the age of iphones and 4g LTE, 50GB data speed! I feel like they have a typewriter upstairs with a 75 yr old typing these cases into the system.

I'm appalled by their service,are they held accountable for their jobs? The phone operator Jazmine goes "these time-frames are what it is and can't be changed,SIR", that put me over the edge,asked for supervisor contact and gave me nvcresearch email id and to put attn: Ben on subject line. I feel this is all waste of time with "Ben" being a fictional character that goes straight to trash. I told Jazmine,USCIS taking time to do background check is understandable but getting a damn case number from NVC in 2 months is ridiculous.

Waiting for your loved one is excruciating itself, dragging the process as simple as a case number should NOT take 2 months. Now onto my questions,I hope someone could shed some light into this
1. Is there anything that I can do at this point, should I proceed with an email to "Ben"?
2. Do they organize these cases based on visa category? If so,shouldn't my case be top 3 category?
3. If you want to complain about NVC, who can you contact, I want to do my part to make this process faster in future
4. Is NVC subcontracted by private firm?

Just like another poster said, 20 days is quite normal to get a case number at NVC.

1. No, unfortunately its a waiting game. Not sure the email to "Ben" will help much. You might get assigned a case number before you get a response from "Ben".
2. Not sure of this.
3. NVC has a complains/comments email and hotlines. You can find it on the Dept of State website.
4. NVC is an agency under the State Dept. Just like most govt agencies, they have lots of PSC (personal services contractors) working there. So NVC is not contracted by private firm per se. So there are contract employees working alongside regular govt employees to get the job done.

As another poster said, you can call NVC today and hopefully you'll get your #.

Just be patient and your # will be assigned soon. It won't hurt to send your complain email though, but not sure how fast it will move your process forward.

Have you posted this in the India sub-forum to garner Mumbai specific responses? If not, you can ask a mod to move  it there. I'm not to too familiar with the specifics of Mumbai. I can tell you about the general process.

 

Now to your questions: 1) Do exactly what the checklist says. The first one about mailing the civil docs - you physically mail in the original civil docs including the PCC to NVC. You need to review the NVC steps up the top of this page and also read Saylin's info (first two posts) and follow strictly. Make sure to add your printed bar-coded cover sheet with your original docs. See link below.

2). Since you failed to respond to all the questions on the AOS form (I-864, I-864A or I-864EZ), which ever one that applied to your case, you need to fill it all over again and submit with the supporting docs. I have submitted DS-260 online and AOS (Affidavit of Support) via my attorney. I'm not sure what are the documents my attorney submitted to NVC. I have got below checklist cover letter from NVC. It has 2 sections. I understand the issue with AOS which is under F-FINANCIAL EVIDENCE but I'm not sure about part - 1. My attorney didn't ask me for any original document other than photocopies of supporting documents. My case is assigned to Mumbai Consulate (BMB). Do I need to send all civil documents to NVC  (including Police Clearance Certificate) ?

I emailed them and asked if the packet 3 could be emailed to me and they told me no and then instructed for the beneficiary to come to the Embassy and pick it up on a particular date and time.

I sent three years of tax transcripts from the IRS (not tax returns). I also sent the bank letter and not bank statements. If there is an account that is not reported on the bank letter, I think you should send the bank statement. I also sent three pay stubs and two years of W-2's.

I sent 3 years tax returns with W-2's, letter from employer and the 2 most recent paystubs. I sent bank statements from the account that he had the card to so that they can see this was how I was sending him money.

I sent my marriage and divorce certificates, no pictures, no emails, no telephone bills, no letters. Both my I-130 and I-129 were approved on same date, without any RFEs.

Yes this is the way I am going. It is at the interview that you have to do the convincing. For the I-130 and I-129F you just have to show the legal documentation to prove you are eligible for the petition.

K-3 Spouse Visa Process & Procedures129F sent to Vermont?
I filed my I-130 with Vermont mid Mar then filed a I-129F (in prep for K-3) with Chicago about 7 days later with the receipt from Vermont. Got a receipt from Chicago stating they got it.
Today I get a notice to tell me they sent the I-129F to Vermont. I thought it would be approved at the Missouri center? Has anyone else had this happen?
