IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsIV Fee Payment stays IN PROCESS

Great!

My last payment was "Rejected". Paid it again and it's 'in process'.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsIV Fee Payment stays IN PROCESS

My status changed to not paid as well. Also on the receipts page it showed 'REJECTED'. So my wife paid again (online) after confirming with NVC cust service that she will not get charged twice.

Now I have an 'IN PROGRESS' as well as a transaction ID that has been applied to that status.

We have already sent in the IV package and its got delivery confirmed.

Hoping NVC will pick up speed now.

K&D, everything you just said happened to the T to us.

Thanks for that detail explanation.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsIV Fee Payment stays IN PROCESS

For AOS, when we paid the $88, a transaction ID was generated the moment we paid. However, for IV, its been 8 days and still no Transaction ID. Does anyone think its a glitch? Maybe we should call them?

Yah I know its frustrating. I think we should wait for them to fix as I don't think it will take longer than 2 weeks to fix (because thats how long it takes were we to send money order or check).

I have told my wife to call NVC first thing tomorrow morning to see if they're having tech problem with transaction ID.

Will keep you guys updated.

I have the same problem too. I paid same date and around same time - No transaction ID.

I called NVC the last two days and all I get is misinformation and the run around. It is a glitch in their payment system. We plan to wait it out until Friday, as sending a money order or cashier's check will take too long to process. Let us know if you hear anything new.

US Embassy and Consulate DiscussionTaxes

Okay, I see where this conversation is going! anyway the question never indicated anything about a "JUDGEMENT" too me when you say owe taxes my thoughts are "when you file your taxes you owe vs. getting a refund" so, therfore you have the options to pay or make payment arrangements. So if that is the case why would that be considered a judgement? In fact that is not a judgement. Most US citizens have owed taxes spmetime in their lives. However, if you pay them are make arrangements it will not be a judgment. And I cannot see how that will an effect on a visa case. These are only my thoughts!!!! I never said I was 100% correct, sooooo no need to have a nasty reply. this site is to help , and I was on going on what my thought were!!!! some ppl are such a debbie downer.

thank you so much for your reply

K-3 Spouse Visa Process & ProceduresApril K3 Filers

This is an invitation to anyone who filed a K3 in or close to April to post on this thread. It seems that many of us who have filed in April are having delays with checks being cleared and receiving a NOA1. I think it would be helpful to keep each other updated with concerns or activity on our visa applications.

I plan to call USCIS within the next two days because it will be 30 days since my packaged arrived without my check clearing or receiving a NOA1.

IMBRA Special TopicsDoes a person who has domestic violence can get visa K1?
Was this question discussed exhustively earlier today or earlier in the week if my memory serves me right? But anyhow, I wouldn't take the advice on this forum as sacrosanct - it's best to listen to advice on here carefully and make a good decision out of what you hear or read.

That said, regarding your situation, you will be better served by consulting with a lawyer. You can still shop around and get a good lawyer for less than the 2grand figure you quoted. Remember, if one is NOT a lawyer, they cannot provide you with precise advise on a specific legal issue involving an immigration process. That's a no-go area for non-expert(s).

Seek a person with the requisite expertise and you will be glad you did in the end!

Good luck to you both!

IMBRA Special TopicsDoes a person who has domestic violence can get visa K1?
Talk to a lawyer my friend...That way the attorney can navigate the nitty gritty of the process for you both. The attorney also has the requisite expertise to deal with your situation. More importantly, the attorney can best explain the process and s/he can naviagte and counter appropriately to the delicate issue of the charges.

Your question about which process is "harder"; I-130 or I-129F... I honestly believe you will be better off pursueing the I-130 route. My experience tells me the I-130 is somewhat a simpler/easier path if you take the time to gather the right documentation. Ofcourse every case is unique and different and depends on it's own circumstances that's why you both need to go consult with an attorney right away.

Goodluck and I wish you the very best!

I am sure you're aware that immigrants from Pakistan are usually required to go through additional administrative processing as well right? I believe it may be mandatory but someone else can let us know that for sure. I don't think cussing and losing your temper is going to help with your progress at all. No matter what, you have a long journey ahead so try to remain calm and have some patience.

USCIS Service CentersMSC Reciept Number

Im here in San Francisco, on the USCIS Website it says Janurary 11th they sent out the NOA 1 Notice to me, and the Reciept Number begins with MSC .... anyone else have this reciept number ? what " lockbox" is this ? i was expecting a CSC #

Yes I do have an MSC receipt number too even though I should have had VSC receipt #. But since sometime in August 2012 I believe, some I-130 petitions get sent to the NBC in Missouri. The National Benefits Center was originally created as the Missouri Service Center (MSC) and some petitions get sent there to ease pressure on centers as CSC, VSC etc. So even though you live in San Francisco, you were sent to NBC thus your first three letters bearing MSC.

I have read on here also that, initially some people have MSC and then later down the process they get transfered back to their local field offices.

Either way you have some waiting to do. Good luck on your journey!

AP is Additional Processing. Some countries get automatically put into Additional Processing (extra wait time after the visa interview or at other parts of the journey). Nigeria is NOT one of those countries, so don't freak out.

Thank u everone for your comments.. I am new to this.. Im actually Heather not Charles.. Im in the US and i hired an attorney that specializes in this specific petition for Nigeria.. They have never had a denial and my attorney did say the CSC is behind.. He didnt promise me 2-4 months that was just an estimate.. I think i got hopeful too soon.. Also, i dont kno all of the abbreviations being used.. What is an AP? That nigeria may or may not have? I kno many many Nigerians over here on a K-1 or at least i kno of them..i guess i will not plan my wedding til Charles is home.. N they cant visit from Nigeria n its so costly to fly over there so im just missing him n wondering how much longer til my baby comes home

Hi Heather,

Welcome to the site! AP = Administrative Processing, whereby the IV unit at the embassy/consulate do further checks (including security background checks) before visa issuance/approving visa application.

I would say spend the wait time doing lots of research, gather more evidence about your case, read and get 'zoomed' into news about immigration and above all be patient for process to play itself out.

Unfortunately, Nigeria is considered 'high fraud country' by the powers that be, but as someone pointed out earlier, there's no such thing as automatic AP there. Lagos for instance, is a very difficult embassy to go through but not impossible if one has a genuine case, have their evidentiary documents in order, and cross their t's and dot their i's. Once again, welcome to the forums and best of luck!

It is ludicrous to assume that someone would take such retribution because they received an email. Do you really think this way? I can only say "wow"

Officials in the government are not going to try and take retribution because you are a pain in the butt. They don't have the time or the inclination. And the fallout if it were revealed is not worth the risk. The worst case scenario is that you will be ignored. Period.

When I worked constituent relations, we knew who the real pains were. They called all the time, about everything. We rolled our eyes when they contacted us, but took care of them and answered their questions immediately. Aside from the instant contact from my team, they were given no other preferential treatment. Their cases were not expedited. They were simply told what the process was, and where their cases were in that process. We only did this because we knew they had to be dealt with. But there was no retribution.

Our biggest problem with USCIS is not that we are being singled out. Our problem is that we are just some faceless case number among millions of others. That and they are a big black box that refuses to be responsive to us about anything.

Wow! Wow was my sentiments exactly

Some of these people are out of control on this site. Now, they're telling others what repercussions they'll be facing or what 'dark fate' awaits them because s/he dared send an email to a USCIS director about their personal case and processing delays generally?. Unbelievable!

Stand alone I-130s and other cases since August 15th 2012 are sent to NBC to ease workload pressures on the USCIS' main service centers. See link below for more detailed info on this:

So if I defined "adjudication" as "based on legal review of a case" as stated in my Wikidpedia link...it is thus impossible for him to infer what 'pending adjudication' means in terms of immigration?

Give the guy SOME credit

Please do not twist the issue. All I'm telling you is this: your wiki link only provides a generic definition.

No where does the link remotely address 'pending adjudication' as related to immigration.

Since this an immigration forum, a helpful & concise answer would necessitate going to the official immigration source - i.e. uscis' website and doing a search there for precise answer(s).

USCIS Service CentersQuestion

What is pending adjudication? thanks

This is a direct definition of your question by USCIS: See the section I bolded.

Also, see the link below for further reading.

Jurisdiction--"Still Pending Adjudication by the Service"

Several commenters requested that the regulations clarify what is meant by "still pending adjudication by the Service" for purposes of determining who is eligible to apply with the Service.

Section 240.62(a) of the proposed rule provides for Service jurisdiction over certain applicants whose asylum applications are "pending adjudication by the Service" at the time the applicants apply for relief under NACARA. For the sake of clarity, the interim rule contains a definition of this phrase at § 240.60. An asylum application will be considered "pending adjudication by the Service," if the Service has not served the applicant with a final decision or referred the application to the Immigration Court. This means that, unless the Service has served the applicant with a final decision to grant asylum or deny asylum, or has served the applicant with documents referring his or her application to the Immigration Court, the asylum application will be considered pending with the Service, even if a final decision has been made by the Service, but not yet served on the applicant.

visit the link below..................

https://egov.uscis.g...d/CaseStatus.do

it says now..

Expect a 30-45-day delay between when your application or petition is filed and when your information is available in Case Status Online, depending on the volume of applications USCIS receives.

it means no one knows the exact date, that when their petition is approved, untill u wait more 30-45 days, or by calling them (USCIS), it really comes on last nerve.

At least it gives us a timelime of when to expect to see a case status for a petition as opposed entering a receipt # and coming up empty and not seeing any movement....geez USCIS

If USCIS stopped expediting cases on medical grounds, it must announce it to the general public through a bulletin or something. We would have seen an announcement on its website by now.

I doubt very much that uscis will convey such a major change in policy/regulation through some one-on-one medium from an immigration officer to an individual.

They (USCIS) will take your folder apart in order to scan your evidence/papers into their system. So it is entirely up to you to keep the sheets of paper or binders. It's a great idea to save every penny. You're going to need it down the road. Good luck!

I put it in project folder with clear sheets to keep up with papers while I got them together. Should I mail it in the folder, looks very nice, or should I just stick all the papers in an envelope? I don't mind extra shipping charges.

Waivers (I-601 and I-212) and Administrative Processes (221g)some problem in Cr1 and Cr2 visa------------New delhi

Hi all VJ friends, according to 221 g sheet got on 16 December 2011 i had to submit the guardianship document with in the time limit of one year but i was failed cos a court case took long to finish so i had submitted a letter of request to grant me some more time to submit the guardianship document with rest all asked documents related with my husband and me in vfs on 13/12/2012.and i got the guardianship declaration on 5/3/2013 and after this i had sent the copy of guardianship document through registered post to embassy, new Delhi.our passports are with embassy from the day when i had submitted documents to vfs.The tracking report says it has already delivered to embassy but when i sent e-mail to vfs they say embassy don't accept the documents like this and i have to wait when the AP of both our CR1 AND CR2 visa will finish they will contact me for more documents.I want to know:
1-The documents sent by registered post reached to the consular? You're the only person who can answer this - call the IV section to enquire if documents is received. Or call courier service for confirmation of delivery. If you already have confirmation from courier service, then onus is on IV section. The cases are on AP will they deny cos i was failed to submit it before? You said you sent a letter requesting an extension, right? If so, how are they going to deny your visa without first denying your extension request? When you sent in the request for extension, did you hear anything from the IV section? Verify if your extension request is granted. But they knew that a case of guardianship was goign on in the court even then they can deny? Not sure. Again, verify this with IV section. Call them. Email them and call again until someone gives you some answers!
2-our cases are on AP its more then four months. I got call from the embassy the lady asked questions related to our marriage,my daughter from previous marriage, our family after that Two officials on 26 February 2013 came at our home asked many questions from my mother and then the neighbors and went back and after that no news has
come. Be patient. It takes some time for the two officers to finish the investigative report of what they were able to ascertain relating to your case. Then they will present the report to whoever sent them, before a determination is made about your case. its really gives me much tension Ap is killing and when i want to get some news vfs has no answer just to keep on checking you status on line and Dos says embassy has all the news what is going on in your cases its also disturbing. Call or keep checking until you get some answers. But note that AP takes time, so patience is required on your part. Hope your issues is resolved quickly. Best!
So friends if you have answer of my questions pls advise me.

See bolded. Hope someone with India specific answers will come along. Good luck

Waivers (I-601 and I-212) and Administrative Processes (221g)Administrative Processing...Not looking Good

Sooo, as you all know, I had my interview on the 16th of May. Supposedly approved.... but then put on AP....You guys know the rest of the story...

I have been calling DOS twice a week. Checking the website every 1 hour during the day (pathetic I know lol) My case was last updated May 22. So, after finding out that 2 of our member (that had the interview the same day) should be getting their visa/passport soon, I figure, let me call DOS and see what is going on with my case...

The lady again said, "your case is still under AP", I asked ma'am, can you please let me know what is the reason?? Of course she can't tell me b/c she doesn't know (or so they say) She did say that no document is needed. I asked then what is the AP about?, she said that they are checking to see if he qualifies for a visa. (Well is that my reason? or is she telling me this to shut me up? lol) Ok, I understand that they do the back ground check, but how long can it take?? I am so confused. They kept his passport, everything looked good. The CO was even thinking about more questions to ask us.

So I decided to email the consul today, in hopes of getting an answer to my dilemma.

Sorry guys I just needed to vent...Any words of encouragement or advice is greatly appreciated crying.gif  (Please do not judge me, I know that there are many people who has been put on AP for months and hasn't received anything. I just need peace of mind)

FYI:

The other times I called I asked a couple of questions...

What is the difference between Administrative Processing and Administrative Review? "NONE"

What is mandatory administrative process and administrative process at embassy level? "I am not sure where are you getting these terms, there are is no such thing as that"

And supposedly, everyone is put under AP even if it is a day or 2.....so the one guy mentioned...

There is not a specific timeline for AP as you know already...My encouraging words to you is just be patient and keep checking frequently. Your visa will come through sooner than you know it. Best!
