Hello Everyone,

I am certain that most of us here are waiting for our second NOA and have been waiting for some time.
We were originally told we'd get ours this month and now we're informed it's going to take another 1-7 months.

My Fiancee got a hold of someone who can really help us with our case but before we push on. We need some evidence on the situation currently.

I was wondering if anyone here can help assist me with the following questions:

1. What is taking so long for applications to process?
2. How many people have applied this year as appose to last year?
3. How long is the average application viewed and approved?
4. What was the difference in waiting time for 2013 and 2011?

Some of these such as #2 and #3 I'll probably find on this site and didn't need to post it here but I feel that while I'm researching, someone else may have a different source than the one I would've been looking at. So the more sources and information I can find the better.

If all works out and we can reduce the waiting time, even it's a month or a week or even a day.
I'd be happy that I tried.

I would wait a month to get all the original signatures & documents I need now before filing.

You want to avoid a RFE if you can help it at any stage of the process. RFEs can cause a delay of more than a month, you never know.

Hello! I'm from Argentina and my fiancee is from the States. We submitted the I-129f on February 1st and as of today, more than 60 days later, the USCIS website tells us that the application is still in the 'Initial Review' stage.

1) Any ideas (approximations perhaps) of how long it will take until the I-129f is approved?
You've waited 2months. It's possible you could wait another 3 or 4 months more b4 NOA2.

2) The second and more important question concerns the fact that my fiancee and I are travelling international to work for 3 months (we are biologists working in the Dominican Republic) starting the 20th of April. Will there be anything important that we need to do when the I-129f is approved? Does the petitioner have to supply finger prints? If so, is this something we can have done and waiting to send out ahead of time. We're really worried that while we are abroad, there will be things we need to tend to but simply can't. So we're hoping to find out from this forum (as we've already skimmed the guides and they aren't clear) whether or not there is action that we need to take once the I-129f is approved.

The K-1 guides is not clear on what to do after getting NOA2? Please go read it gain.

Consulting or hiring a lawyer will not help speed up your case. Others would even tell you lawyers delayed or didn't help in their case. Hiring a lawyer makes no difference IMO, unless one has a tenuous case.

I think it will be worth unleashing your plan B - the idea of you moving to her country, all things being equal.

The petitioner can write a simple letter to USCIS advising them s/he is withdrawing the petition. If you're at the NVC state you write a letter similarly.

Just a straight forward "to whom it may concern" letter with a heading and details of the case/particulars. Then s/he mails the letter in making sure it's traceable and they sign for it.

I am not one of the expert for the income/poverty level requirement. But I believe you making $20,000 with children, you will require a co-sponsor.

You're on the K-1 path. You or your Co-sponsor do NOT fill the I-864.

The I-134 is the form you fill. If you require a co-sponsor, I believe they also fill that form. See the instructions: http://www.uscis.gov.../i-134instr.pdf

Go back there and get married then file for cr1. That's your best and only chance. Two red flags on your shoulders
- The country from wich the beneficiary is from!
-The HUGE gap of age between you.
File for cr1 and frontload your package with tonnes of evidence and hopefully that might work out for both of you.

Very good idea...even though it be at couple's own expense, but at least they would be building evidence he's consistently trying to get clean and hasn't failed a drug test since the visa refusal.

W2 and paystubs can be photocopies.

Yep you're right...! 90pecent of the time they don't even look at these phone & text records at the interview.

 

My wife just finished her interview last month. The loads of phone, email & other evidence we had was not even looked at. Not a single question was asked her and we easily got an approval. She's is here with me cool & dandy!

 

However, I agree that it's better to have these phone records/evidence than not. OP good luck!

My fiancé is a recent college graduate and has spent 6 months here with me in London, so she had to give up her retail job. She has a few interview lined up in her field. 

My question is that when they ask for your fiancé occupation what should i put down? 

If she is currently in school, put down "student" and the dates. If she has had prior jobs/occupations, you would want to put them down and the dates as well. That's what we did and had no problems. Best of luck!

Very much aware of the supplement. I wanted the OP to explain why the need to send a lengthy supplement when in fact sufficient space is provided for that purpose on the petition form?

 

A supplement is any information that will not fit on the original form.  Usually the supplement being referred to is a description of the circumstances of meeting.  For this question, a simple answer is all that is required and will easily fit in the space provided on the form.  However, some will write a more lengthy description, sometimes a page or more, detailing their circumstances of meeting and including a bit of relationship history.

Are you talking about a sworn affidavit(s) from friends acknowledging your relationship? If that's the case, then have them notarize the affidavit.

 

A scanned copy will do just fine. Besides, you submit copies only at the petition stage with uscis anyway. But just to reiterate the point; affidavits from friends & family are secondary evidence and also carry little weight.

Hello again; 

 

So, I know letters from friends aren't great proof of a relationship or an on-going relationship; but our friends are willing to write them, and I figure they must be better than no proof, right?

 

Here is my question:  Some of our friends are in faraway places like Hong Kong (one letter excellent letter we expect to receive is from the President of the Seminary in HK where we met). Thus it takes a very long time for an original copy of a letter to arrive.  

 

If they print, sign and scan a copy to me, is that okay??  (sorry, I know this is a REALLY elementary question, but I couldn't find it answered in other conversations)

Hi All,

First thank you to all that have replied to my many posts, you've all been great help making this complicted process a little eaiser for me and my fiance. 

A little background, my friend who is her cousin introduced us in August and we just knew.  I went back to visit in December, and I'm now filing the K-1 visa process, when you know you know right? smile.png

I have completed the final packet, think i'm ready to send off, made 2 copies of the ENTIRE packet and just wanted some of you guys to look over what i'm sending in to see I'm missing anything.  I know signatures and dates are very important and I'm positive I've looked over the package enough time that Im not missing any signatures or dates.

 

Listed below is page by page of the packet:

1. Form G-1145 e-Notification of Application

2. I-129F Cover Letter with table of content

3. Payment with personal check (I put the check in a zip-lock bag and stapled it to a page and titled page Payment with Personal Check)

4. Form I-129F and supplement type page of how we met

5. G-325a for both self and fiancee, both have additional page with passport style photos with names on the back

6. My Certificate of Naturalization, copy of front and back (not sure why cause back is black, but following the instruction to the "t" is my goal)

7. Fiance Letter of Intent for both myself and fiancee

8.  My Divorce Certificate (both FL-180 and FL-190, I'm from Cali)

9.  My fiance's Divorce Certificate. We're Vietnamese, I signed a statement that I translated her original certificate myself, my translated version of her certificate, and her actual divorce certificate.

10. Proof of having met in person:

      -  Boarding passes - baggage ticket stub - copy of visa front and back stamped - itinerary of flight - hotel receipts of entire trip (3 different hotels) - photos from trip (i picked 7 pictures with friends and family i really liked) - Letter of support from both of her parents and a letter of support from her cousin who is my friend who introduced us - Receipt of engagement ring and from our engagement party - Receipt of a day tour we took

11. Proof of Ongoing Relationship

      -  Phone bills showing calls with eachother (i'm nervous with this because we didn't talk hours at a time, from August till December when I went back to meet her, I was finishing up my last semester of my masters program so we mostly e-mailed when possible) - Chat logs from Skype (after I visit, I set up Skpye for her and we've talked since almost every day for hours) - About 40 pages of e-mails we sent back and forth to eachother.

 

I know this was a long post and thank you for reading it all.  If I have everything in order, I plan on sending the package immediately on Tuesday.  Any suggestions from experience members are very much wanted.  Thanks again for your time.

more update : a tier 2 officer actually just called back and asked a lot of questions, then acknowledged we never got the RFE , gave us a reference number, said we would get the RFE resend on the 18th of Feb. but my fiance should still go to the appointment on the 15th and they already might have it there by then. so, my advice so far : definately Infopass appointment first thing but also phone call to the service center. and if anyone wants to avoid a redicilous amount of time waiting in line it seems to be worth it having them call you back. 

I will now post my next update here probably after the 15th. Hoping that in the future it will be of help to others

I am listening to everyone but of course will follow more likely the advice of the one(s) with similar experience. Based on that I am doing my research and as Ning suggested : we will do EVERYTHING necessary to sort this out. I will update the outcome here, maybe as help as well for others in the future with the same problem. I am very thankful that a forum like this excists and about how many people want to help. Hi :-) 

My fiance ( american citizen ) and I are pretty confused of what would be the wisest thing to do in our case and I would really appreciate any suggestions.

Our case : My fiance filed the petition I-129f for the K1 Visa in September 2013. We got the acceptance confirmation via email and a few days later the letter with the Form I-797. So far so good. Then we never heard from them until the 22nd of January 2014 when my fiance received a text message that our status has been updated. So we checked our status online and were in shock when we had to read that we were denied and have to wait for the letter with the explanation. My fiance received that letter yesterday ( 31st of january ). 

Here is a part of it : On November 09, 2013 USCIS requested that you submit additional evidence. You were given 87 days to respond. During that time......and so on ....and then ...As of this date the petitioner has not responded and additional time may not be granted

And then it telsl us about our opportunity to file a motion in order to reopen or reconsider etc.....

NOW : since we never received a RFE in ANY form ( no email, no text message and no hard copy ) not only are we speechless but we, of course want to find the fastest and safest solution. I've already tried to do some research but still am not sure what to do. I guess my fiance first has to call the service center and ask for a TIER 2 person ? Is that right ? I am not sure how we can proof that we never received anything so I assume either way we will have to either file a motion or simply refile the whole petition. Question is : what is faster ? 

We have been waiting for a very long time to get to this stage of getting engaged to be married and finally start our life TOGETHER in the US ( I am german but live in Greece for many years ). We really thought we got it all right and were trying to be as accurate as possible with all required documents for the I- 129f ( I was in the US again for a visit, so we were filing together ). Which doesn't matter because if something was missing or not right, it is of course only fair enough that they ask for it. But now we still don't even know WHAT wasn't right since we never got anything.

Also it says we were given 87 days to respond but got denied already after 74 days. Not that that matters but still doesn't seem quite right either.

 

So, fact seems to be that their mistake will cost us not only our nerves but also more money and a lot more time until I can finally move over to the US and stay for good. The time factor is the hardest because it is no fun travelling back and forth and being separated over and over again. 

 

Thank you in advance for any suggestion what would be the wisest ( just only timewise ) for us to do.

The info pass route is a good advise. I suggest the USC make that appointment.

 

Secondly, if you look at the K-1 checklist up the top of the page and compare that to your original submission, 9-times out of 10 you will find what document you were missing. Thus the reason for uscis issuing the RFE.

 

I also agree that you file a new petition if you are able to ascertain the source of the first RFE; (and that is a big *if*)

I mentioned to you about my wife's friend in the earlier post. As I stated earlier, the CO simply said he doesn't believe the relationship is genuine. When you get denied a B2 visa, it does NOT mean your K1 will be denied.

 

The larger point I'm making is this: it's 50/50. The B2 denial may have ZERO impact on the K1 for most applicants, but sometimes and very unfairly COs get influenced negatively and that may impact the decision to refuse a K1; although the CO will not put on paper or tell you "I denied the K1 because the applicant has been denied a B2 in the past".

 

Someone mentioned that being denied B2 does not make one ineligible for the K1. Being refused or denied a visa is TOTALLY DIFFERENT from being "ineligible". IMO, these are two different things and that needs to be pointed out. A quick google search will give one the clear distinction between "being ineligible" and being refused/denied" a visa.

 

Of course, your case is different and the past B2 refusal will have ZERO impact on your outcome. Best of luck!

Your response has been very enlightening and thank you so much for that. I was going to and fro with all the responses on my query and the thing is why did the CO put objection for your wife's friend's B2 and K1 visa? There should be some genuine and strong reasons behind all this. They cannot put rejection according to their whimes and fancies. Mine was simply because insufficient ties with my country. Now here I'm already telling them that I'm going there to marry this guy and later on immigrate to their country. So according to me all depends on your honesty, how strong case evidences you have of the continued relationship and its not a fake marriage but genuine.
