IR-1 / CR-1 Spouse Visa Process & ProceduresFilling taxes for 2012 while abroad
1. You can file taxes with zero (0) income. Many years ago in college I filed taxes with 0 income (1040EZ form).

2. Deadline for filing 2012 taxes is April 15th 2013 UNLESS one gets an EXTENSION. So technically, one will not have a tax transcript until after that date. But you can bring a copy of your parent's personal returns that they filed with you to the interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresAttachment Sheets

I asked about the G-325A form yesterday. That's why I said I saw somewhere that it had to be handwritten, or maybe I saw on a youtube video pertaining to the I-130, I don't remember. I just want to get everything right so time will not be wasted having to redo it later on. Thanks for your answer

Nonetheless you now have what you need to proceed. Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice certificate from city in the US

You are correct. Police certificates are required for all countries lived in except the US. The USCIS, NVC and consulate all run separate FBI background checks, at which any criminal history within the US would be discovered.

Agree!

IR-1 / CR-1 Spouse Visa Process & ProceduresI-797, Notice of Action Received

Choice is terrific!

It is not a problem with him staying in the US. Other than that, is there any downside to applying for the Adjustment of Status vs him going back to Australia and going the NVC route? As I see it, it is saving us some work of him going back and forth to Australia until things are approved.

From the approved NOA2 you posted earlier, it's clear your husband can apply for Adjustment of Status (AOS) in the United States. USCIS even tells you the steps to follow to get this done.

It's terrific to have both choice presented to you. I would go RIGHT AHEAD and apply for AOS right now. Best of luck!

Boggy - if you look at the G325a it doesn't have numbers for the questions. You have to write out the entire question for the 4th line.

APPLICANT'S NAME
APPLICANT'S DATE OF BIRTH
APPLICANT'S PLACE OF BIRTH
ADDITIONAL INFORMATION REGARDING G325a Question: Applicant's Employment Last Five Years:

"Answer question"

APPLICANT'S SIGNATURE: ______________________________

On the G325a you can do 1 of 2 things... First you can can simply write in the box "See Attachment" and then provide all the answers on the attachment sheet OR you can fill it up until the last line then write "See Attachment" on the bottom line and fill out the last item on the attachment sheet.

As for last employment abroad - simply list your present employment.

IR-1 / CR-1 Spouse Visa Process & ProceduresVisa Application Cancelled for lack of communication with consulate.

I did recieve an e-mail for the interview and bios apppointments confirming the appointments. The only e-mail address I can find for the consulate is under the public inquiry and it says that they will respond in 10 to 15 days. We will need to be in Juarez about the same time. I was told by the operator at the appointment number that the interview and bios appointments for my wife are still scheduled. Unsure what to do next.
Thanks for responding.

So print the confirmation email and bios appointment and send to the consulate telling them they(consulate) agreed and rescheduled your appointment to March 27, 2013. You can even email this info and put your case# in the email subject line. Hopefully your email can be directed to the IV section. Don't be surprised if one office in the IV section does NOT know what the other office is doing pertaining to your case(it happens).

Describe specific details of your case in the email timeline. Make this short and to the point. While at the same time, try calling the consulate to get this resolved. Sorry I don't have any contact # for you. If you have proof they agreed to reschedule your interview, then they should not turn around and send you a letter "cancelling your wife's application for no communication". Make sure you resolve this issue before leaving for Juarez.

IR-1 / CR-1 Spouse Visa Process & ProceduresGhana interview- should petitioner attend?

Posted Image

This is the same as with our consulate in Guayaquil. I think for any high fraud country it's important for the petitioner to go, and if I'm not mistaken Ghana ranks amount the high fraud countries. I'd be on a plane a few days before the interview if I were you! Posted Image

I would say OP should attend his wife's impending visa interview NOT because "Ghana ranks among the high fraud countries" as the powers that be have categorized this country.

But rather the couple have invested lots of money and time, and would like to see to a successful end (where interview goes well and visa granted).

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE Status

Hi all,

So we sent our RFE reply last April 15, 2013. On April 22, we received an email from USCIS , checked our status and it says "RFE Response Review"..The next day we checked it, it was back to "Initial Review"..
Is this normal? Or should i start to worry again. Our case has been long overdue before the RFE and i don't know how to handle another delay..

Any input is much appreciated..

Give it about 4 to 6weeks after sending RFE response to hear anything substantive - whether approved or not.

I wouldn't worry just yet, besides it's only ten days ago since you sent in the rfe response. Give it some time.
