I disagree with the assertion that the 4 kids CRBAs are not good proof or evidence of marriage relationship.

I think the couple having four (4) children spanning several years is strong evidence of a steady ongoing relationship. Of course, they need other pieces of proof to make it complete - like joint tax returns, bills in both names, leases, life insurance, car notes in both nanes etc etc.

Now OP, let me address your other questions:
1. Yes your husband will still use his 'old' A-#. As do not change, so write it oh the new forms you're filling.
2. Yes copies of your US passport is acceptable as proof of citizenship. Make a clean copy of the biopage or the entire passport.

Just a quick addition to this "None" issue. I read when you write none for not having a middle name for instance, some very 'bright' uscis or NVC employee will type that into your information to make none as your middle name.

It's a funny joke I guess. But it won't be funny at all the hassle that one would have to endure to fix the error.

If the question asked does NOT apply to you or your wife, you write "N/A". For example, if you're asked about ex-wife or ex-husband and you have nit been divorced before, I would write N/A because it does not apply to you.

I would think one will use "None" for a question asked that does NOT relate to you. For example, if the question is asking you about your middle name and you don't have one, you write "None".

But I understand the headscratch with "none" and "n/a". Sometimes they seem to be synonymous.

I do not think you should be worried. Most important thing is the date his divorce was finalized and when you two got married.

From the dates you provide, his divorce became final before you married him. Whether you were seeing him when he was separated to me it's immaterial.

Hello, I have looked at all the requirements that a petitioner needs to file for a cr1, and I have everything except for my birth certificate. I have my US passport and naturalization certificate, but my birth certificate is probably lost somewhere in the Philippines. My sister emailed me scanned copies. Is this good enough? If it isn't, do I have other options?

Your sister sent you scanned copies of the BC? If you can't find it, no big deal.

Clean legible copies is all you need at the uscis stage.

But a copy of passport biopage meets the requirement.

You can add a copy of the naturalization certificate.

If you have the means to go live with your husband, sure by all means do that. It won't affect your process in my view. Living with him there will even help you gather documents that will be vital down the road at nvc and come interview time. Just make sure you are able to keep 'track' of your mails back in the States in case uscis send you anything.

Also, I would say do not compare the timing of your filing with others who filed last year. In addition, do not compare your case to anyone's case as each case is unique and different. Right now, it is taking almost a year just to get a decision with uscis alone. Best of luck!

That statement means: it is NOT a good reason or one of the stated criteria for granting expedites.
Simply put, husband in the hospital with available professional care and other family members present is NOT enough justifiable reason for uscis to hurry your case ahead of others in line.
If expedites were that simple and easy to come by, then everyone one will go for it and there won't be any need for a line. That said, I wish your husband a speedy recovery. And if you decide to go for the expedite you get it.

I entered USA at Seattle airport last Wednesday, the officer at immigration office told me that the address I used for green card delivery cannot be changed (there is a form we need to fill up when entering USA, with info like how much you are carrying, value of goods, etc). At that moment, I hadn't found an apartment yet, so I used my brother's in law's address. But now I have found an apartment, is it possible that I can change the delivery address of my green card? If so, what should I do?

USCIS has this 'delayed' response to address change and where to mail your greencard. A friend's wife was in a similar predicament as you. She went online to update the new address. She called and provided the new address.

Yet uscis still mailed the green card to the old address. So I will say even if you're able to change to a new address online, still make sure you keep an eye out so your GC doesn't get sent ti your old address. I call it employees working robotically and not paying attention to the fine critical details. Best!

Oh I see what you mean... When you check "other", you will write what form you're submitting I.e. I-130.

Sorry for your loss with your dad's passing. Please accept my sympathies and condolences.

 

I don't have any specific advice to add, except these questions;

 

1. What exactly did she lie to you about? Is it when she said she will be arriving on such & such date and the dates kept changing? Do you realize her arrival in Hawaii is out of her control? For goodness sake she has no visa in hand yet. So it's not possible for her to give you a firm date of arrival.

 

2. Do you also realize it is very possible that her phone was stolen? Do you have reason(s) not to believe her?...Is there a past history to make you doubt her? If she has lied to you in the past about simple things, then I can understand how you're feeling. Are you feeding on what was said by your dad or hearsay by friends & family? In any case, give your lady the benefit of the doubt on the phone and her arrival date.

 

3. I'm sure you're aware that pregnant women go through a lot of changes. She is going through very serious biological, psychological, physiological and emotional ups & downs that we as men can not imagine. These changes might explain why she is being distant lately and not responding as often & promptly as she used to with your communications. My wife keep telling me how she is going through this changes and being forgetful of simple things she easily did before pregnancy and I'm wondering hmmm... But I have to accept it and take her word for it because I haven't been pregnant before. I carry a little keg around (NOT six pack) and it's hard doing that... how much more carrying a 35 or 36 weeks bulge around. lol.lol. 

 

I hope you reflect on all this and give your lady some slack.

 

For your peace of mind though, let her have the baby and get a DNA test asap. Stay strong and best of luck!

Emailed them and got a response that I clearly did not read that the blue sheet states that shes in administrative processing. Then they let me know that someone else can submit her passport on her behalf at the embassy on any working Thurs or Sun at 2pm, and then the visa will be in the passport in 4-5 business days from then. Maybe I should have just gone with Ankara.

Danial, I don't think the background of your mom's citizenship matters at all. Your wife was attending a spousal visa interview, NOT a derivative interview.

 

Frankly, the CO was being a j**k. Unfortunately this is what you are faced with. I would provide all or any extra evidence they're asking for - and hope it works in your favor. Best of luck!

I would post your question(s) in the UAE sub-forum for specific answers.

 

I doubt if the same consular officer does the AP/background checks. As busy as these consulates are, the COs are always busy reviewing and interviewing visa applicants. So the AP/background checks are assigned to other consular staffs with security background checks expertise and/or experience.

That makes sense, and I thought maybe UAE would be different since they are in a better relationship with the US, but I understand that they have to start with Guilty until proven innocent.

 

Is it the same Consular Officer that will be doing the administrative processing or does someone else do the review? Since the email to Abu Dhabi form asks for the case number I thought I could just ask some simple questions to see if there is more she has to provide while she is there (since the only check box checked was passport and she did have her passport).

Unfortunately no one can predict when AP will end. Just be patient and hope it end quickly.

 

I have said it before and I will say it again. Consular Officers in poor countries and some Muslim countries approach their jobs/reviews of visa applications with bias. They were NOT having a bad day as you think, they just like to treat people horribly. I saw this during my wife's interview --- and it's a shame!

 

A female friend who works closely with the Consular Staffs (mind you I also work for a different Bureau of State) also tells me these Consular Officers basically "hate it" when they get posted to the not so cozy posts. They view, for the most part, all visa applicants as fraudulent until they prove themselves legit and innocent. They give visa applicants unnecessarily a hard time to go. And very often, they hide behind the fact that they (COs) denial decisions do not have to be explained to anyone or can be challenged, so they practically do what they want without any consequences. It's unfortunate but these are the undocumented truths of the predicament of visa applicants from poor countries and/or countries the US perceives as hostile (mostly Muslim countries).

Also, I had filed for I-129F a few months ago before filing the I-130 which looking back is a mistake because I couldn't afford the services of an immig attorney to get the right counsel. Anyway, I received the NOA1 two months ago telling me the application has been receieved. I tried tracking or checking the receipt number on USCIS website, and it tells me "that receipt number cannot be found". I called USCIS and spoke to someone who told me they are having issues with their system and that I should check later. My NOA1 also informed me that my case has been sent to the Vermont Service Center (VSC) to be adjudicated on that they let me know when a decision is made.

So here are my questions: How efficient or good is the VSC at processing these cases? how fast are they compared to other National Service Centers/Benefit Centers? Has anyone here in the forum experience the issue of not being able to track your case status lately in the USCIS website? If that's the case, why wouldn't USCIS try fixing the problem as soon as possible since at least people would like to know where they are in the process? I understance one has to exercise alot of patience dealing with this process and USCIS, but isn't what we paid for to get the best service? And is it too much to ask a government agency to fix their system?

Because your legal marriage is less than 2 years old, if you were to apply and be approved today, then you would be issued the CR-1 visa, which would require you to remove conditions 2 years after receiving your green card. If you are approved after you have been married for 2 years, then you'll be issued an IR-1 visa, and you won't have to remove conditions. It won't affect anything but the type of visa you will get in the end. In the end, you need to prove that your marriage is legit. It doesn't matter how long you've been married. The evidence of customary marriage and children should provide sufficient evidence that your marriage isn't a scam.

And when you think about it, what does it matter if you get an IR-1 or a CR-1? As long as you get your visa, you can become a permanent resident. As long as you're still together after 2 more years (once you enter) you can remove the conditions. The only problem I would see is if you were worried that you weren't going to be together after 2 years. Then it might prevent you from removing conditions.

Hi All,
I just filed I-130 for my spouse on 12/07/12. I have a few questions about the process and the marriage certificate we presented. I have read extensively about the IR1 and CR1 visas - relating to the marriage being less than two(2) years old or more than two(2) years old. But my issue is that we got married through the customary way five years ago(i.e. customary marriage). However, we only registered our marriage at the courts in her home country this year to obtained the marriage license. But all other documents of ours show five years - for example our daughter's CRBA birth certificate, marriage photos, emails, passport stamps during my visits, western union receipts etc etc. Will my wife be issued an IR1 or CR1 visa based on this information? Also, my wife retained her last name after our marriage,i.e. on our marriage certificate. Will this be a problem when adjudicating my case?

Can someone in the forum with similar experience share please? Kindly let me know what I need to do so this wouldn't be an issue? Thanks so much!
