IR-1 / CR-1 Spouse Visa Process & ProceduresShould NVC know about the rescheduled interview time?

Dear all,

Hi,

Since it was impossible for us to move to USA in next 6 months, I decided to reschedule my interview time from 7th of November 2013 to about April 2014.So, I sent an email to the IV section of US embassy in Madrid to reschedule my interview time because of my engagement in a university project. Yesterday they replied me that it is okay and we canceled you interview time, but we have our interview timetable till end of December 2013 and you should contact us in March 2014 for new interview time.

Now my questions are:

Do I need to inform NVC that I canceled the interview time of 7th of November and I want to postpone it for April?

Does it affect the process of my immigration visa if I postpone my interview time for 6 monthsunsure.png ?

Thanks for any help and experience.....helpsmilie.gif

No is the answer to all of your questions.

If the embassy has agreed to reschedule your interview and given you confirmation to that effect, then you're ok. I believe once NVC completes it's work and forwards your case, their job is done.

You deal with the embassy/consulate directly going forward. Good luck!

Photos are little part of the whole body of evidence uscis require. Your package look well organized and meticulously put together.

Besides, you're carrying the best evidence in my opinion...your child together! Relax and enjoy!

Do you photos to include? It could be selections from the lifespan of your relationship. If you don't have passport stamps, the iterenaries is ok.
Do you have any bills or money transfer receipts in both names? You can include car rental receipts too.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresAPPROVED BUT NO LETTER OR STATUS UPDATE DUE TO MY SPOUSE HAVING A COMMON NAME

My lawyer was able to get insight and was contacted too see why we have not sent papers, but they then told her she had to have evidence of my approval -__- and nor her or i received anything

they told her that due to the outstadning number of applicants with the name of carlos(my pose is why the application got messed up and my husbands approval was given to someone else knowing it belonged to him

This is really unbelievable explanation by uscis if what you're saying is true...that because of so many applicants with the name "carlos", your petition "got messed up and your husband's approval given to someone else"??

And your lawyer accepted this explanation? I understand uscis mistakes, but this explanation really seem/sound imbecile.

The last bit of your question. Use the sample cover sheet/page in the I-130 guide and ADAPT it to suit your needs and the volume of evidence you're sending in.

IR-1 / CR-1 Spouse Visa Process & ProceduresG-325A Residence Question, I-130 Additional Proof
For the G-325a, list ALL addresses you and your husband have lived at during the years it asks for (last 5yrs?).

For photos its your choice-- you use as many as you want. But I would select a good set of a cross-section of the span of your relationship to send. Ziplock or printing your pictures on 8x10 photo paper is up to you.

Lastly, the cover sheet. Yes you can use one and there is a sample in the guides section up the top of this page.

IR-1 / CR-1 Spouse Visa Process & ProceduresDoes Signature on DS-230 have to be in black inc?
Most government forms asks to "print clearly and sign in BLACK INK". So I always use black ink to print & sign.

The only exception is where the form specifically asks me to use "blue ink". Otherwise I always use black ink.

Read this article why it's a good idea to use black ink: http://ezinearticles...Blue&id=5075723

No. As the petitioner you do not submit a police certificate.

The NVC guide up the top of the page clearly lays out the requirements of that stage of the process. Please read it.

if it your primary home you can't liquidate it without harm so you don't include it.  If it is a rental then you can include the net value ( appraised market - amounts owed) only.

I'm confused by this answer. Can you provide the source (s) of this info? A link? A reference material?

IR-1 / CR-1 Spouse Visa Process & ProceduresPlease i need advise

Yes you can as long as you have access to the internet and you make sure that you have the fees in your bank account.

It's critical that you make the first contact and that they have both your email addresses.

You will have to logon to the payment portal and input your bank account credentials to pay (maybe take your laptop or smartphone with you). It absolutely important that you take along any documents and copies.

I'm pretty certain they'll have UPS/FEDEX/DHL in Morocco.

Excellent advise! OP, if you must travel then by all means follow Gowon's lead here. Good luck!

It's ok to write date, place and people in photos at the back.

Have you thought of making your photos into a collage on 8x11 photo paper? That way, you would have 4 or 5 or even 6 individual photos on one paper.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo I need a lawyer? CR1

1000$ is WAY too much to spend. They do not care they don't make sure there are no mistakes on the forms. You pay them the money - they make YOU get all the papers and then all they do is fill in the blanks.

You can do it all yourself - for free - not to mention the fact that you have more time to make sure there are no errors.

VJ has example forms filled out and step by step guides showing what you need. - all free all available right here.

Agreed completely!

OP, read up and build some knowledge about the process while saving yourself some money too! Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresFinancial co-mingling suggestions
Sending money/remittances through Western Union, Money gram is another form of financial comingling.

Use those WU and money gram receipts as evidence. That's what we used and we were approved with no problems.

Another is money wire or transfer through your bank here and your spouse's home country bank is another such example. Use those recipients.

We also used receipts of a vehicle I purchased and shipped to my spouse.

We also used the freight receipts from a commercial shipping of our personal effects including my daughter's strollers and other such baby goods. My wife was the recipient and the receipts showed her name and all itemized charges. Use those receipts.

See comments in red above.

Looks very well put together! You've included more than enough evidence to get a one-shot straight approval (Note: we only had 80pages total).

Last thing, we included Beneficiary's birth certificate and passport biographic page, even though some have said it is NOT required at this stage. As you can see some members have gotten RFE'd for this lately so IMHO, it won't hurt to add.

Good Luck!!!

10yrs age difference is NOT overly a wide gap between couples. I would say it's quite common and should not raise a red flag.

Also, lots of people including myself have had divorce and its not been an issue.

What is unusual is the call from the embassy prior to the interview.

Incorrect- the visa bulletin shows minor kids and spouses of LPRs as current, ie they get processed immediately, same as US citizens.

Talking about to time of approval at the uscis stage only; California Service Center - 19.8 Month(s) not visa availability.

IR-1 / CR-1 Spouse Visa Process & ProceduresEvidence of Bona Fide Marriage
Yes you can use the primary two pages of your rental agreement showing both names and signatures as further bona fide marriage evidence.

With the lease agreement and any other evidence, if you're mailing the I-130 petition into a lockbox then you must do a translation of the documents.

If DCF, the documents do not need to be translated. I do not think there's DCF in France so this point may be moot anyway.

Your husband can also visit you in the US using VWP while the petition is processing/pending. Good luck!

No - don't fill out or submit the I-864 at the petition stage. You will do that later down the road at NVC stage.

Yes check "yes" under immigration proceedings.

If he was under removal proceedings, even thought he left the country voluntarily, I believe you will still have to state so - "removal". But let's wait a bit, another member with experience in that area will come along to give you a more substantive response to that part of your question.

It's not a problem. Always feel free to ask any questions you may have. This process is stressful enough to carry on by yourself. I'm pulling for you both!

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling I 130 with an old A Number? (And any other advice you'd care to give.)
It is a good idea if you're added to your husband's bank account. It doesn't have to have excessive transaction activities for it to be acceptable as evidence. As long as it shows both names, its good.

Also, note that all you're trying to do is pulling pieces of documents together to make a body of evidence that help proof or substantiate the bona fide marriage/relationship.

Of course down the road, at the NVC and interview stage, make sure to have more such evidence available to include in your package. Best of luck!
