I did not send a letter with intent to marry either. I am wondering what is going on with case. It's been 5 months and I havent recieved my NOA2 or and an RFE either. I am wondering if I am going to get an RFE or just my NOA2



You are probably good as well. If you are going to get a RFE it will be within the first month of processing, if you already received your NOA1 then the next time you will know is at the interview level.

No by looking at your timeline you are good, I got the RFE before they cashed my money order and your payment was already processed. You should be good for now, but it took them 5 months to send me my NOA1

It would have taken the bureaucrat who RFEd you less time to look up the Zip code on the internet and write it down than to fill out an RFE sheet.



what is even sadder is the fact that Jamaica is a 3rd world country and doesn't have zip codes!!!!! LOL They actually made me put on a separate piece of paper that Jamaica doesn't have zip codes!!! And these are people we are forced to trust with getting our loved ones over here!!! Help us all!!!

Hello everyone,

I am new on here but I have a concern. As I am reading all of the wonderful success stories, I am getting a little nervous. Everyone seems to have submitted a letter of intent to marry.

When I filled out my 1-129F I was never asked to submit this letter. Actually, the first time I heard about it was on here about a week ago. My status now is that the Consulate in Jamaica states that they sent my packet 3 to my fiance'.

Is this letter going to cause road blocks at this stage in the process?

Dont go and get all the vaccinations done again just yet!! Best thing to do would be to get a blood test done to check immunity for those things which are age appropriate for your fiance to have done.

I just had my blood checked for antibodies for Measles, Mumps, Rubella and Chicken Pox (varicella), as these are the ones that are age appropriate for me to have if I don't already have immunity for them. Plus I was told I will have to have the Tdap (Tetanus/Diphtheria/Pertussis) and flu shot done also (note - the flu shot is only required if it actually flu season at the time of the medical exam).

Keep in mind...I'm not 100% sure on this since I am doing the IR-1/CR-1 not K-1.... but I don't think fiances have to have the vaccinations done prior to coming to the US...I think they just have to be done before you Adjust Status.....myabe someone can correct me on this??

While good advise - She is getting advice from people with experience with the Jamaican medical that the blood titre will NOT work and is not an option.

Dealing with Jamaica, there are four options:
1, Have your medical records
2. Go to your school and see if you can obtain a copy of your immunization records
3. Go to the clinic, prior to your medical, and obtain all the shots
4. Show up at the medical without any of the above, and pay an arm and a leg for the shots.

My fiance' had no record of his shots either. He went to the clinic near his home and got 4 of the initial shots, they cannot give them all at one time. He then went to his appointment a week later and received the rest. He paid $4,000 JMD at the clinic and another $18,000 JMD for exam and the rest of his shots at his medical exam

Then it is at the Embassy in Jamaica and you need to contact them to see if the packet 3 has been sent to your fiance.

I called NVC tonight and spoke to a rep that said that USCIS will send me more than one approval notice. The first one says my K-1 petition has been forwarded onto the consulate, while the second one says that my petition has been sent from USCIS to NVC.

Has this happened to anyone else?

Is this true?

The rep also said that I should contact USCIS because since I didn't receive the second notice USCIS still has it and it hasn't been passed on to NVC yet.

Can anyone who has had their petitions sent to their embassies confirm this? It's for a K-1 also, so the path for a CR-1 or I-130 may differ.

Your first letter which is called NOA1 will let you know that your petition for alien fiance has been accepted. Your second letter which is called NOA2 will say that your petition has been approved and forwarded to NVC. Once your petition is forwarded to NVC you will need to call them about any further information about your petition. NVC will send you a letter (does not always happen, I had to call them)stating that your paperwork has been sent to the consulate in Jamaica.

Once the consulate receives your paperwork they are supposed to send what is called a packet 3 (DS-230 form) to your fiance' to fill out and send back to the Embassy so they can schedule the interview. This is where it can get real frustrating because your fiance may never see the packet 3 and you or your fiance will have to request it from the embassy via email.

In a perfect world if you don't hit any road blocks, your fiance will receive the interview letter. At that time your fiance can schedule the medical exam and pay visa fees at NCB Bank.

There is a K-1 guide in the guide section of VJ and there is also alot of info in the K-1 forum. Good Luck

And, visitor's visas from JA are hit or miss.

The K3 is approved but I am almost finished with the I-130 also. At this point I would rather just continue the Embassy route for the I-130, go to the embassy with my wife for the interview and get the CR-1 their instead of doing an AOS. Anyone know of a reason I cannot do this? Anyone done this before?

My husband submitted his DS-260 online...it says it takes 3-5 business days to process and get a response....My question is that since his interview shall be in Islamabad embassy, does he need to send the civil documents before to NVC or embassy??? OR he takes those documents with him when he has the interview????

Have you read or visited the NVC filers Oct 2013 thread? I would advice you check it out asap. The answer (s) to your questions can be found there(sorry I'm on a mobile so can't give u the link).

But to answer your question in the nutshell, NVC 'intakes' required civil docs and forwards it to the embassies/consulates. However, there are embassy specific requirements for civil documents that's why I urge you to go read that thread or visit the nvc website (CEAC.gov site).

Also, even though NVC will take your original documents, it is a great idea to have set copies of all your documents on hand to bring to the interview just in case. It is also good to visit the regional forum here on this site so you know whatexactly others going through the Islamabad consulate are doing. GL!

For NVC IV document intake, it is the originals or certified copies by the issuing agency.

No one wants to send their originals but that's what the regs or rules states. So I'm afraid you have no choice. Besides the CO will return your originals after the interview is over...or you remind your spouse to ask for them.

Lastly, I would advise you re-read the NVC Filers October thread, especially the first couple post. The process is very well laid out there for you. Good luck!

Unfortunately India is a complicated place to do any kind of bureaucratic formalities. It took about 9 months for my husband to even get a passport and several months for us to get a marriage certificate - I shudder to think about going through another process for a legal name change and new passport. wacko.png
 
Thanks to Blueberry Pancake also, I have read that thread you linked to, and most of the advice is to simply write "None" or "No last name". I guess my main concern would be future difficulties for life in the US. 
 
 





Actually the majority advice or opinion in the thread BP provided you was to use (- ----- ) in the last name space. See the pushbrk's and others within that thread.

This is same situation when you go for visa interview and try to convince to the officer that i will come back to my native country !!
 
In that situation you need to avoid traveling because if you fail to convince the officer will be consider the port entry refusal which is a big problem.

TJandKC, I would let your fiancé read these posts above so he sees that that quark lawyer's advice were off base and dangerous. In fact, the lawyer was most definitely setting you guys up for failure!

Hi everyone!
 
After lurking around  on this site gathering information and reading personal experiences for a whole year, its finally time for my own visajourney with the love of my life. We are currently planning to get married in Norway sometime between October and November this year, and then file for the I-130 as soon as I can get our marriage certificate translated and apostille'd. 
 
Here's our story in short; We met January 3rd in 2011, at a dollar beer night at Senor Frogs in Honolulu, Hawaii (Where she is from). The following 6 months were spent texting, facetiming, skyping, writing letters, you name it. And finally in July 2011, she visited me in Norway, and I was sold. We met while I was in my last year of getting my masters degree, so shortly after her visit, I landed a job. The perks with this job was my schedule, working for 2 weeks and having 4 weeks off. So needless to say, I had a lot of time off and also money to spare. I then decided to go and see her as often as I could, which turned out to be quite often. So almost every month up until this day, I've been traveling to Portland to see my love. I've always been traveling under the ESTA VWP, since I'm Norwegian, and I've never had any trouble getting in, despite my frequent visits. We even went as far as to rent an apartment together, with my name on the lease, water bill, sewage etc. And I also bought her a car that we have together (I'm on the title, but not on the insurrance paper) 
 
On August 9th 2013 I decided to take the next step and propose. I had to leave shortly after to go home to Norway and back to work, so we planned on getting legally married when I were to return in September/October. Unfortunately, my employer decided that instead of going to work as scheduled, I were to take a one month course in Houston, Texas. As I had just returned from the US and only had 5 days in between my departure and new arrival, I was quite skeptic as to how the immigration officer would react to this. At my arrival in Houston, I was pulled aside for further questioning. This interrogation lasted for 6 hours, with a lot of waiting and just sitting around. I answered everything truthfully and told them my story. The officers believed my story and let me off with a warning saying that I should have the proper Visa in place for my next return. So instead of pushing my luck trying to travel to the US under VWP and get married, we decided that we should just get the legal part done over here in Norway. And also, reading on this forum, I came to the conclusion that applying for a B1/2 visa was useless, as I would have to state that my fiance is living in the US, and that would pretty much be an automatic denial.
 
When my fiance realized that this process was going to be time consuming and meant that we would have to spend some time apart, she insisted on consulting with a lawyer. I on the other hand have been intensively studying the CR-1 visa process and I'm fairly confident that we'll be able to do this on our own. Anyway, I told her that if she wanted to hear it from a lawyer, she was more then welcome to get a consultation hour. 
 
A few interesting things from the Lawyer; 
When he heard our story, he strongly advised that I were to be removed from any papers with both our names on it, to quote "hide our paper trail". When she asked about the I-130 application, he said to just submit marriage certificate and application, no other proof. He also said nothing about the G-325a. The lawyer wanted upwards of 3000 dollars just to help us with the visa application, not included fee's for the petition etc. Which in my opinion is horribly overpriced. Anyway, after she talked to him, she calmed down a bit since she pretty much got the same answers from him as I had previously told her. So together we decided that we should file and do this visa-application on our own. Our case should be pretty straightforward, since we are just one year apart in age, both with educations and jobs, and me being from a low-fraud country.With great help from the Visajourney community I'm sure that we will be able to complete and get this journey done with in no time!
 
And now to  my questions:












  • What is your opinion about the lawyers recommendation on "hiding our paper trail"? The lawyer is flat out wrong. The paper trail helps your case in my opinion. Gather as much "relationship trail" as possible. Most members on here will not recommend a lawyer unless one has a very complicated case.
  • In the I-130 application, I'd like to send at least photos of our history together and maybe a few affidavits to support our relationship together with the translated and apostille'd marriage certificate. But would sending things like our lease, electricty bill, water bill, sewage bill and car title benefit or work against us in this case? I'm thinking since these things were signed before I was a legal resident, would this affect our case negatively? Short answer is NO. In fact the evidence you mention will work in your favor. If anything they strongly help to prove the "Bona fides" of your relationship and/or "financial co-mingling".   • Is the G-325a still required to attach to the I-130 application? (I can see its mentioned in the guides for CR-1 here, but I'm not sure how up to date they are). Yes G-325A is required for you both - You fill one and your spouse also fills one. See the guides for sample cover page and sample forms to be included in the petition.
  • Is the DS-230 and DS-3032 obsolete now that the DS-260 and DS-261 is online? Yes the DS260 and DS261 are online forms meant to replace the DS230 and DS3032 respectively. They are submitted electronically. Here's a link for you - read particularly the first two posts: http://www.visajourn...ber-2013/page-5. But I must say those forms are for the NVC stage of the process. So I would not focus too much on them until you file your petition and get your NOA1. Good luck!

Hi,
 
Since it was impossible for us to move to USA in next 6 months, I decided to reschedule my interview time from 7th of November 2013 to about April 2014.So, I sent an email to the IV section of US embassy in Madrid to reschedule my interview time because of my engagement in a university project. Yesterday they replied me that it is okay and we canceled you interview time, but we have our interview timetable till end of December 2013 and you should contact us in March 2014 for new interview time.
 
Now my questions are: 
 
Do I need to inform NVC that I canceled the interview time of 7th of November and I want to postpone it for April?
 
Does it affect the process of my immigration visa if I postpone my interview time for 6 monthsunsure.png ?

No is the answer to all of your questions.

If the embassy has agreed to reschedule your interview and given you confirmation to that effect, then you're ok. I believe once NVC completes it's work and forwards your case, their job is done.

You deal with the embassy/consulate directly going forward. Good luck!
