1. He can print a copy of his tax transcripts from the irs.gov website.

 

2. If he has the original Divorce Cert, ask him to FedEx or Expressmail it to you. Otherwise, he must go to the court house where the judge signed the final divorce decree to get an original copy or certified copy.

 

These are two important documents the 'Guides' up the top of the page recommends you have come interview day. You could have avoided this unnecessary delay of getting your visa. Good luck!

People i had my interview today, i spent 4 hours at the consulate.. the interview was very short like 5-10 minutes..

CO asked

how we met? Where?

how many times we visited each other ?

In which state is he living?

How old is our daughter?

Where does he work?

 

The problem is CO asked me to bring the IRS transcripts, I showed him his W2 but consulate wanted to see only the IRS transcripts

My husband is out of state, he got his W2 but has not filed it yet.

Please friends advise can we get his IRS transcripts even when he is out of states

Second problem is he didnt send his original divorce certificate  just he sent the copy, CO wants me to bring his original divorce certificate.

Hmm...  As a EU country citizen- I can not travel to the US on VWP/ESTA.  Five of the EU countries are not part of the program. Poland included. 

It would take years for Lena to get a citizenship in the EU.

I agree though that a lot of people come to the US on VWP and then AOS.

Being a citizen of an EU country will not make it easier for Lena to move to the US. She will still need to go through the process.
 
 
Lena- I remember your post a while back that you would have trouble finding a sponsor. However, in order to move to the US  your husband must file an I-130 petition first. File a petition and worry about a sponsor when the time comes. Also- request an expedite. I think it's very possible it would get approved, given the situation in Ukraine.

BP, if the OP moves to a EU country and become a citizen there (granted I don't know how long that process takes), IMO, the OP will have it much easier to immigrate to the US...Why? Because of the VWP & ESTA.

Lots of people have taken advantage of the favoritism 'clause' to migrate here painlessly. They tell you they're coming for a visit, then suddenly change their minds, get married to a US citizen all their 'sins' are forgiven. In my view, this is unfair to others from other countries (mostly poor developing countries. Look at Mexico, right next to our southern border have a wall barrier while Canada to our north get to come & go as they please!)

Sorry I digresssed. But I say the uncomfortable truths others don't want to hear.

Why do you think you can't go along with the NVC process as the beneficiary?

All your husband need to do is send you the requisite AOS and IV documents to be sent (mailed or courier) to the NVC.

My wife as the beneficiary filled her own DS-260 online with no problems.I had all her original documents, mailed it in to nvc painlessly. Had easy interview and easy approval.

The issue isn't whether the interwer is nice or not. It is about whether they are professional, fair and look at the body of evidence in your casefile to make an impartial decision.

I can careless if they smile or not, or if they're nice or not. As long as they are NOT biase, or have no predisposition to thinking any case is fraudulent merely by the background of the visa applicant.

I don't think it matters to much, but for your peace of mind do what is suggested earlier.

Our NOA1 only had my wife's first & last name. The NOA2 had first name, middle initial & last name. At NVC, all her documents bore her FULL name. Her visa also bears her full name. Her GC also bears her full nameà

So I think its a style of the adjudicator at uscis only. Not much of a big issue. But if it makes you get peace of mind, get it fixed now. Good luck!

This is really 50/50. It may depend on how strict the adjudicator is. I would not translate the whole *book* and contract jargons as you say. I will do only the 3 relevant pages plus the referenced page.

Why I would not translate entire lease? Because it is just one other document you need to proof a bona fide marriage. If you have others to support it then you will be ok.
Remember, it's better to pull pieces of good supporting evidenctiary documents from the instruction list to make your I-130 petition look whole. In other words, you need pieces of good tangible evidence to paint a complete picture of your marriage. Good luck!

They clearly told you all you need to submit in order to get an approval. I.e.:
Itenaries, photos of you two together with family, lease agreement, insurance docs, affidavits, financial docs like western union receipts, bank statements, birth cert of child or children if any, joint credit card statements if any, and a host of others. Also, don't forget to submit passport pictures of you both.

I'm a May 2013 filer of an I130 for my Taiwanese wife.  We've been waiting forever and FINALLY received a letter on Saturday asking for more evidence of our marriage.  I'm at a bit of ropes end here and am very angry and stressed about this.  We sent in as evidence with the initial application, copy in English of our marriage certificate, isn't that proof enough???  I also submitted our lease for 9/2012 to 9/2013 which has my wife on it, unfortunately it was in Chinese, but we attached to it a signed Affidavit in English from our landlord saying that she had knowledge of our marriage, that my wife was on the lease, and that we had been living together.  Of course, we were only married in 3/2013 so I don't know what good that will do.
 
My question is what more can I submit, I'm attaching the list of things they would like, but we don't have the financial things, I can send them printed copies of our texting this past year that we have been separated.  Do you recommend having my parents sign affidavit's attesting to knowledge of our marriage?  They will certainly do that although they didn't actually attend the wedding...is that ok?  Do they need to be notarized? 
 
The other thing is that they said we didn't submit passport photos, which we DID????!!! Could they have lost part of our application in the transfer?  Should I call them and ask for advice? Get a lawyer?
 
I'm at my wits end here and any advice would be greatly appreciated!!!

You should have used the name she's going to be using going forward, but there's nothing you need to do now.  Just use the correct name on the visa application and everything else at the NVC stage.
 
You committed another common error though on C17.  Your wife is not your relative's spouse.  You are.  Your name goes there as your alien relatives spouse.  If she has children, her children's information goes there too.  No worries.  It's such a common error, they just ignore it.
 
Sounds strange?  Think about how the I-130 would be used if you were filing for your mother.  Her husband's name would appear there and you and your siblings would as well.

Be sure to send or mail the RFE response by means of which you can have tracking with it.

 

You can send it USPS express mail which is next day or two day service depending on the location or priority mail with delivery confirmation which is a 2-3day service. Other options are UPS or FedEx service which are more expensive. As said already, make a complete photocopy of your entire REF response for your records.Good luck!

Yes the tickets receipts, your itineraries of visiting each other, your passport stamps, boarding passes, your hotel receipts, your statement for paying the insurance all are great proof of a bonafide relationship.

Check up the top of the page in the forum here. There are a great many examples of bona fide relationship evidence to submit. But as said earlier, what you have will be sufficient. Just organize all of your evidence so that all of it as a WHOLE paint a complete genuine picture of you relationship. Good luck!

Also, you can have a co-sponsor when the time comes. As much as both of you currently having no employment is a drawback, lots of people have done it without. A co sponsor can be a family member or a close friend who meets the financial requirements.

Finally, go with what your mind & gut tells you. Go ahead and make a decision based on feedback and your research. You don't have time to waste. The only bad thing is letting indecision take the better part of you. GL!

Hi, currently due to backlogged cases, 7month approvals are rare. The 7months you see in another person's timeline belongs to the past - probably two or more years ago. Current wait times are about 12months on average.

Also, I see you have set plans for October. I would say that's not realistic and feasible due to what I said earlier. I would not pay for hotel or make any concrete plans until your wife has her visa in hand. I would advice that you spend time reading others experience before paying for anything. Good luck!

Really? Where did you read or hear checklist is not a request for additional information?

What you do now? Double read or check the check list letter you received if it is asking for any additional info. If it is not, then call NVC to enquire why it was sent in the first place. Good luck!

But i have read many time check list cover letter they never aske for the additional document,its only kind of informative letter that NVC received our document and thery have some contact number for crosspondince etc....nothing to send them pending.......

The list of reasons people hire professionals is longer than my arm.  The one major reasons that is most often over-looked in these discussions is that many people simply either have other time priorities than to do the necessary study to learn how to do it themselves though they would be fully capable of doing so.
 
I have a great vehicle I want to keep and use long term.  I'll be taking it in tomorrow to have the transmission rebuilt by a professional transmission shop I was referred to by my regular mechanic.  I'm perfectly capable of doing the work myself but since I've never done it before and have a busy life doing things that for my own reasons are more important to me, I choose not to bother to devote my time to learning how and then doing it myself.
 
The second big mistake many members make in these discussions is to presume that because a person was able to use the internet to find visajourney.com and ask a question, they are both capable and dedicated enough to do this themselves.  Many making that mistake, don't even really know yet whether THEY are capable of completing the process without their own mistakes causing delays or worse, because THEY don't even have their own petitions approved yet, much less their loved one in the USA with them.
 
Now, if anybody has a sure fire method of repelling copperheads from the yard, so my dog doesn't get bitten again, I'm into doing that myself. :joy:

Now, with the copperheads, I would rather get a professional exterminator because of my phobia of snakes. Hope op consider the *snakes* in this process.

Hi Everyone,
 
We submitted DS-260 on September 19 and Mailed our Civil Documents to NVC on September 20. Civil Documents Showed up in NVC's System on September 23.
Today we got checklist from NVC that they are waiting for Civil Documents from us to review DS-260 form. We dont understand why they are asking if its already with them.
 
Have anyone been though this? We will really appreciate your thoughts and comments on this issue

Read the first two post of the NVC Filers October thread. It is quite a regular occurrence for NVC to issue such 'false checklist'. Just call them to confirm receipt of your civil documents.
