I sent a whole load of stuff because im divorced so i went a bit overkill with it. We were married and lived together in the UK before we moved to the US so i sent everything from there too and basically from the beginning of the relationship in 2009. People say not to repeat information, but since we NEVER had to prove our relationship at any point during the DCF process, there is nothing on file.

I made an envelope for every year and one for our daughter. They contained things from each calendar year such as photos, travel documents, a copy of his visa from when he came to live in the UK with me, joint bills, joint bank accounts, joint lease, bills showing common address, daughters birth certificate, her CRBA, custody agreement, child support order, rent receipts, photos, cards sent to us both, one affidavit from our mutual friend and witness at our wedding etc. Along with the green card copy, i-751 application, divorce decree, money order etc.

I made a contents list and taped it to the front of each envelope and tried to be as organized as possible because the last thing they want to do is open an envelope full of random papers and have to sort through piles of somebody elses life. And i dont want them to think its a mess and shove it to the bottom of the pile and forget about it!

Im not sure about the translations on whether you can do them yourself but they usually need to be notarized.

For the evidence, just print a few pictures including some with your friends and family etc and some wedding ones. Any size photo is ok, that doesnt really matter. A few emails or chat logs too. The affidavits usually need to cover the basics, how long they have known you, did they attend your wedding, how many people were there. That kind of thing. There are a few other threads around here which include those so it might be worth searching.

Where your partner intends to live, is there a sample of one already filled in in the guidance notes? Usually you can find them on your local embassy website. The UK one has a sample and that section says "Not yet known".

Everyone else has given great advice on it all but just wanted to add that the reason for the Embassy probably giving different information is that filing in London is slightly different from filing in the US. Im assuming you called the Embassy in London but your husband filed from the US? Im currently filing in London and ive noticed quite a lot of things i have to do are quite different to what others have to do filing from elsewhere.

A joint sponsor would probably be the most straight forward way to go. With assetts, you need to show that you can have the cash available within a year (correct me if im wrong anybody! Ive not got to this part yet but been researching) which i dont expect is very easy to do. Especially with it being in the UK. You cant sell anything here at the moment unless you accept rock bottom prices. It wouldnt hurt to put both down though. At least with both, if they arent satisfied with the assets, it wont delay anything.

My husband (the petitioner) also has no tax returns since 2009/2010 since he was a student and then he moved to the UK. So we will be using a joint sponsor.

It depends what you did and when and if you have been honest about it in the rest of the process if it comes up.

A speeding offence 10 years ago that never reoccurred, for example. That would usually just get looked over. A murder, obviously, they will probably deny that one!
Shoplifting i suppose it would depend on when it was and if the crime ever happened again. If it was some candy when you were 14 i doubt they would be bothered. I obviously cant give 100% accurate information because i havent been through it yet (I dont have any offences either)and each embassy is slightly different with how they handle things. If you are worried, its worth giving them a call to know what to expect.

I have a question and it pertains to the G-325A. Figured this was an old thread that I could bring back to life.

The form asks:

"This form is submitted in connection with an application for" and then lists naturalization, permanent residence, or other as an option. My goal is permanent residence, but technically the form I'm submitting the G-325A with is the I-130 petition for alien resident and is not an actual application for permanent residence. Am I getting too technical? Can I just state that the form is in connection with an application for permanent residence?

For that i just put permanent residence. Because thats what i will be in the end! Try not to over think it. Thats got me worrying too many times! Then i find out it was a lot more simple than i thought.

Definitely do it. I sent off for mine earlier in the week, 4 weeks after NOA1. Just allowing plenty of time for any mishaps! I would have done it sooner if i could find somebody to sign the photo!

A caution age 15 usually disappears from your record anyway from what ive heard, so i wouldnt worry. As long as youre honest about it, it should be fine.

Im just curious about why your daughter needs to be sponsored? If she is your biological daughter and you are a USC, she will have claim to citizenship. And therefore wont need to be sponsored. Or have i missed something here?

Oh ok. In Serbia when you go to schedule a marriage you give your data and on the end they ask you which surname will be used after the ceremony, so thats why i thought that its the same there. They still show maiden surname and mother/father name but the last line states which surname was taken after the actual ceremony.Srry if I made some confusion

I figured it would probably be different in other countries. Its always interesting to learn how other countries do things though! :)

All we got asked when we made the appointment to schedule the marriage was whether we were related (no!) and a few details about each other asked separately. Probably just to make sure we really did know each other. The name change only comes if you feel like doing it afterwards and its a simple case of taking the marriage certificate to the places that have your name. Banks, doctors etc.

correct me if im wrong but if the surname on the marriage certificate after concluding the marriage is changed (if she took her husbands and it is stated on the mc) then all the other doc on her maiden surname are invalid and she need to change them ?


A UK marriage certificate lists the husbands name and the wifes maiden name. It also lists the name and occupation of both of their fathers. It doesnt say anything about the wifes new name.

The only other thing you might want to do if you keep your maiden name is change your title to Mrs on bank accounts etc. I cant remember if the passport shows a title.

Yes unless she plans to get a new passport in her married name before its needed in the visa process. If she wont be changing her name at all then her fathers name. If she plans to change it at a later date, its probably best to do it now, otherwise things start getting difficult to change.

It depends on whether you have chosen to use your married name or keep your maiden one. Like driving licence, passport, bank cards. Whatever they say, use that name because its the one you use. I use my married name so i just used that on the forms, except where it asks for my maiden name. My NOA2 said beneficiary Holly MARRIED NAME (AKA MAIDEN NAME) just like that. Both are recognised. Its just your personal preference.

Sounds like you have all of the bases covered :thumbs:

My daughter is only 18 months so ive not done much as far as enrolling her in anything goes. I will find her a daycare (when i get a job!) and everything once i get there. Its not something i feel comfortable doing without seeing the place so it'll have to wait.

We have a NY State drivers licence (where in NY State will you be? We'll be there too!).
Bank account - we will just print off a few statements since theyre all online.
Job offer letter for open employment.
Voting registration card.
Letter to my landlord giving them notice of us moving.

So you have pretty much the same as we do. I can hopefully come back and give more accurate info about what they need in the next couple of months after my interview!

Yes i meant start gathering the forms now rather than submit now. I sent the forms for my father in law to fill in a couple of weeks after NOA1 but they only just did them for me last week and i received them back in the mail the day before NOA2, then i got my husband to do his last night.

You can file your taxes with the IRS for the last 3 years now if you havent already done so.

For the I-864, my husband has no income right now and hasnt for two years so we wrote a signed statement of why he hasnt filed (not required, no income)and attached his W-2 and tax return from the third year. For the joint sponsor, we have the I-864, his W-2 and tax return for the most recent year and pay stubs. We have about 7 pay stubs, most of them from June and July but a couple from March and May too, simply because they were the ones they could find. All of these documents are photocopies.

Your situation is a bit different, but i hope that outlines what you need to gather with your I-864 so it might be worth starting soon so there is no pressure to find all of these things at the last minute.

Im not sure what happens next when you file in the US because i was able to do DCF. I was just approved (I-130) last week in 69 days. So if you get expedited, you may be approved a LOT faster than that, and mine was fast by most timelines. I hear the auto expedite happens when the USC states they are residing abroad.

The I-864 is good for 1 year. So if you decide to use a joint sponsor, they can do that for you at any point from now really. I believe that has to be mailed to the NVC and costs $88 (somebody correct me if im wrong, its completely different for UK DCF)

The thing to remember with making the move after the visa is issued, is the visa is only valid for 6 months from the MEDICAL. So if you have your medical in january, then your interview in march, you must move by july. Of course you can just leave a few weeks between submitting forms.

You can get a joint sponsor (anybody who lives in the US and meets the income requirements) to sort out the I-864.

Domicile does not have to be established when you live abroad but you do have to show steps you are taking to re-establish domicile and fully intend to do it. What we have done (my husband the USC and I both live in England), is get a letter from his new employer to show he will be going back to work, show bank statements from the account he still has, show his voting card etc.

You can all fly out together, but your wife cannot fly before you.

I didnt say to leave your job! Dont do that :lol: I said people use those when they are leaving where they are to re-establish domicile in the US when they have been away. I dont know if you work for a US company where your job will continue when you get back. If that is the case, a letter from your company explaining you are temporarily abroad for work will do the same job.

Those of us doing DCF have to prove this too. What most people do, is show resignations from jobs, lease on a house (or contract drawn up with parents/siblings etc to live with them), job offers in the US. Maybe a letter from the company you work for to state that you will be leaving in December.

I thought things sounded close from your NOA1 date that you posted somewhere. And as far as i know, there are only the two of us around at the moment with such close dates. Sounds like you will be ok with the documents you plan to get. You could scan a copy of your entry stamp into the US if they gave you one too for if theyre looking for the obvious things.

Did your lawyer send back DS-230 and DS-2001 yet?

That means that you need to prove you have set up a life there and are no longer living in the UK. So showing bills in your name, bank statements, tenancy agreement and many other things at the interview will be needed. To file DCF (which you did) the petitioner (you, the USC) needs to prove intent to domicile if they have not yet moved to the US by the time of the interview or proof of domicile if you have already moved.

It does not matter if you are at the interview or not. Your husband just needs to take all of the documents with him. Chances are, you would not be let in anyway. I have also answered your question over in the DCF part of the forum.

I read something a good while ago on another site and the UK beneficiary was asked for their marriage certificate from their previous marriage but ive not heard of any USC's being asked.

If its not too difficult to get one and it will put yours and Stewart's minds at rest then personally i would get it anyway. I've got far too many things that i KNOW i dont need because theres no chance im giving them any reason to have me walk out of there without an approval.

To do a DCF your fiancee must have lived in the UK for 6 months before you file (file after youre married obviously). You could get married in 15 days if you wanted to (required time for notice) and that route is a lot quicker than filing from the US. The process takes roughly 6 months currently. That is for the spousal visa. And you must move to the US within 6 months of the visa being issued.
