Thanks, There is no notation by translator as you mention at top of your post. I should be able to find someone where I live to do this. I have no need to deal with anyone in Guangzhou. My divorce was from Shenzhen in Guangdong Province.

I had an ill-advised marriage in China. I have the official 3-page Chinese divorce papers on white paper with a few red stamps and the official 3-page translated divorce papers. There is no stamp of any kind on the translated papers. Both on A3 size paper and translated copy is the grayish colored paper.

Questions:
Do I need to send these to a Chinese consulate in the U.S. for a notarization from them stating the translated divorce papers are a true translation...And only send translated papers with this notarization?
Would I just need to send the translated papers with a K-1 and no notarization?
Would I need to send both, as is, with no notarization?

I think that's all the possible variations.

Does the signature on the certification claiming the attached translation of "Divorce Decree" is accurate need to be original? Or can I have my fiance have the divorce decree, translated decree, and certification scanned and saved as a pdf and sent to me by email...then have her mail originals. I would then submit what I print from the emailed pdf file and have the originals if and when they asked for them.

If I don't need the original, initially for filing, of her divorce decree, or marriage certificate (name change issue) I suppose I could just have these scanned, saved as pdf or I suppose a jpeg, and emailed to me. I could find someone locally to do a translation and certification. - Da?

I have a different take on this issue.

If one doesn't receive an RFE they are further ahead. If they do, have they really lost any time? Considering the time waiting for the form with original signature. If it's only going to take a few days to a week, maybe wait. If it takes longer why not send in without signature of beneficiary?

Yes, you're right. Question 10 asks if you've previously filed a visa application for anyone. I filed a K-3 and the corresponding I-129F (not officially a K-1) for my wife. It's just so easy to associate the I-129F with a K-1 in one's mind, which is not always the case. I don't know why they say corresponding when each had its own fees. At least in Spring of 2007 they did. I think I read you don't get hit twice now.

I was just reading over the document requirements for the interview, and I am having second thoughts about the birth certificate requirement. Will my fiance need a copy of my birth certificate too, or just his own? The requirement says "yourself, your spouse", but since we are not spouses yet does that mean only if your spouse is a beneficiary too?
It is too late to send anything down to him. What should I do?

Is it ok to change the topic for a sec, and say that the 'cat hugging' picture that the poster billsgirl has is really neat. My cats pretty much hate each other, so that is an unusual sight to see. :) Also, I don't know if this is true about the original 129F form in this thread, but the one I submitted was the newer 5/23/06 edition (updated /w IMBRA questions). I'm wondering if those are all on the fast-track, and also if this means that the pre-IMBRA people are actually moving forward now. It would be nice to believe that. Also, I received no RFE's, period. So maybe I sent them everything, or maybe they're being more liberal on approvals for the moment just to pump things through faster. What I sent was emails, postcards, photos, phone bills, airline receipts. But anyway, I think/hope it's a win for everyone to get more cases out of the way. Though I can't see any morality in mine coming before the ones before me. :/

Part of me wants to run off and get married and just AOS, but I suppose the proper way is to file K1 and wait.. Ugh, this long distance thing is rough!!

Hello everyone. I am looking for a little information and reassurance regarding my K1 packet. In looking around on the site I saw many photos of folks packets which seem large and have many papers in them. When going through the guides I followed what was suggested to send and my packet is no where near the size as those I have seen. Is it really imperative to provide hundreds of emails/chats/phone logs for the initial application? I have included along with all the forms and certificates required, a copy of my passport and the stamps showing my two trips to visit my fiance, a copy of his passport and stamps showing his three trips here to the US to visit me, the boarding passes and flight information we have (not all unfortunately), about two emails, two envelopes, a copy of the receipt for the engagement ring. I have many, many emails, yahoo logs, and other documentation but is this really necessary to send initially. My concern is too much sometimes bogs things down, right?

Any advice would be appreciated. We have been waiting a year to start this process and I am concerned about any other hold ups!!

My fiance is self employed and has traveled to USA many times in past with this career. His brother runs his business while away and he has had no issues with coming into the country. He has came in twice on his B2 to visit and both times given 6 months stay duration without any issue or concern. My question really wasn't "if" they will let him in, more the issue of will the border agent note that the petition has been filed or not? The bigger question is, will it cause problems at his interview regarding him coming to visit me during process. I don't see any issue with him traveling here while awaiting K1 process as long as he is doing it legally and not overstaying. Thank you for your thoughts thus far.

I am thinking to be safe, I will wait till the 3rd to submit and will await his arrival on the 4th. The forms will not be accepted until after he arrives and I will not have to change the initial petition as he is not in the states when I apply. Again, not concerned about the law as we are following it as stated, just border agent..

We are submitting our I-129F on July 2nd (as his divorce will be finalized) and the plan is that he will be traveling July 4th to the US on his B-2 Visa which expires on July 10th, 2012. He is planning on staying for the full six months or as long as allowed by boarder agents on the arrival date. He is concerned that this travel may "look bad" when the K1 is looked at, my thought is, as long as he doesn't lie if asked at the boarder there is nothing wrong with him coming to visit and return on/before his set date on his I-94. We are hoping this puts us very close to his Packet 3 in Sydney and possibly him coming straight back.

Just curious as to what others think. Thanks for any advice or information you can offer..

Who ever the lawyer you went to is an idiot. The consulate is a part of the department of state, and they can not be sued. As for the congressman's liason, at this point it won't do any good to contact the USCIS because they don't have it yet. The only answer they will give her is that the petition was approved. The key is the consulate right now, make sure it is them she is contacting not the embassy. Is she sending an email? They will respond, as Kiya stated, so that is the best way to get across. They usually respond within 2 or 3 weeks. If the petition does go back it will go by diplomatic pouch, and they can provide a number so it can be tracked. One it reaches the service center then it will do no good to contact the consulate.

I can't help you with your health issues, but if you can just go and spend some time with him it would be helpful for you both to get yourselfs together and prepared for this.

And as for the lawyer Kiya is talking about, I highly recommend him. He understand returned petitions inside and out, not many immigration lawyers do.

well i finished this semester of school today! yipee! One less thing to think about. I have gained some weight and my sugar level was up today. I have to concentrate on losing a few pounds now. I was wondering if anyone has any idea what i can do about the drinking water in jordan? I mean i got a nasty kidney infection there and i only drnk bottled water, and lots of it. I am thinking to take a britta water filter. Should I boil the water first? someone told me to try purchasing only water from maybe Germany? I want to see my husband but being sick in Jordan is the pits. actually i took claratin and allegry and zyrtec a few years ago, but not lately. I do use the flonaise nasal spray. i recently got a new prescription for allegra but never tried it yet. Thanks for the input, I appreciate it.

The only time I need one is when I am sick in my chest. Normally I dont need it, Winter time is the worst. This week I will be sending in my passport to have a new one issued with my new last name. I am also sending in one for my daughter because I am hoping to be able to take her, she is 10. This is hard on all of us. I am thinking to not take college courses next semester and concentrate on my marriage. We are both willing to wait as long as it takes, but never expected this at all. So salbutamol is as good as albuterol or better? I have allergies also and took shots until they kicked me off because I had a red itchy face and sounded like a frog. The allergies can cause asthma. The worst things for me are mold and dust mites. I appreciate your input......you gals do not even know what it means to me. THANKS SO MUCH


I was thinking of allergies too. mold is the WORST for mine also. Have you tried just taking claritin? And yes, salbutamol is just as good as albuterol. edit-- if you get the salbutamol in JO, get the cipla, not the generic blue brand...it has some additive that made my breathing a little worse. The cipla is only like 50 piasters more than the other. smile.gif

That would be so great to take your daughter too. I would put school off also, if I was you; to relieve some stress and save money. One semester in the grand scheme of things isnt going to do much harm.

I have taken a look at her form, and sure enough they marked the 212(a), and it states that it is to be sent back with the recommendation to revoke. My guess is that they marked it wrong, but it appears that she is having trouble getting a representative to assist her.


Well I am having a problem getting anyone to help me. I have decided to go back to Jordan, just not sure when. I work 6 days a week and I need to pay someone every day I dont work! I have no retirement, medical, blah blah blah. I am between a rock and a hard place right now. Contacted one lawyer said 2,500 and 500 to sue. Sue for what???/ He says to sue is the only way to get results. Congressmens office I talk to a Melissa who last told me nobody answers her from Amman and she would hang up and call USCIS directly.....never replied to me. Honestly ladies I DONT KNOW WHAT TO DO. So I take it sending everything to the Congressmens office and Senator is a waste of time now????? Wednesday I am planning to send off for a name change on my passport, I was not prepared to be going back to Jordan. I have asthma problems in Winter and the dread is horrible. Give me some advice, I have been sick over there once. Since being married I am taking blood pressure medication. My doctor has been very helpful trying to get me through this time until my husband could get here to help me. We live on an Indian Reservation and I am a Native, everyone knows everyone. I hate flying and had to take meds not to have a panic attack!! This is not good. Just point me in the right direction and I will do as best as I can. Yes it was for a CR1.

I think it is time for you to prepare yourself for a long wait. This process is very time consuming, and it is important that you continue to gather evidence. There is no quick fix to this, so your best luck would be to have a representative that will assist you through the next year or longer to get this resolved.

Edited to add that yes, the fact that he answered the question wrong about your employment is a big issue. That would need to be explained as well.


yes he interviewed in English, he is very good in English from all the hours and hours on the phone. No luck with congressmen or senator, but I am putting a binder together ASAP OF ALL OUR PROOF TO SUBMIT TO THEM to see if they will help. I will submit to them emails, chats, copies of outside of envelopes from me to him, sms messages for last year, phone bills, and pictures. This will take a little time as he is sending me all the emails he had from me. I think if I can provide a congressmen or senator with the whole thing they may be more apt to help. That is my hope anyway. It will also include my doctors visit notes and copies of the antibiotics in arabic. What do you think?

He took about 100 emails from me, letters snail mail from me, pictures, phone records. No chats . He said he felt very confident during the interview and was shocked in the end when she returned all original documents and told him he could tell his wife not to bother contacting them and that she could start all over again if she wanted, but if she didnt want to she did not have to. There is not a lot of pictures with family or with him, 90 percent of the time I was the one taking the pictures.

I have given my old computer that crashed to a friend to try to recover chats..............there was a lot.

I know the interviewer asked where i worked and he said the post office, and i am actually a star route contractor for the postal service which means i am SELF EMPLOYED. This could have been a big mistake. He thought they would ask what I did and he would tell them my wife has a contract with the Post Office and she delivers the mail. (She never asked)

She asked if we had a wedding party, he said no. She asked why, he said "we did not have time." The truth was i had a horrible uti infection that turned to a kidney infection from the 3rd day i was in Jordan!! The first doctor visit I was given antibiotics for 7 days. The day after I finished them the pain was worse than in the beginning. We went to another doctor who gave me more antibiotics and performed an ultra sound on my kidneys . She told me that the infection that i had was severe. This doctor said we need to do a sensativity test to find the correct antibiotic....but I would be home by then. She did give me antibotics and told me to go to my own doctor at home and stop taking what she gave me. I returned in agonizing pain during all the flights (3 planes) and went to my doctor the very next day. I was given more antibiotics and was cured this time.

I do have a copy of the doctor visit here that says i had taken cipro for 7 days before seeing him. He never documented everything i told him, like being out of the country. I do have the empty boxes of antibiotics in Arabic here at home that I can copy. I do not have any receipts from those doctors. My husband does know the pharmacist well enough to get a letter from her. The day i left we walked to the pharmacy becaue i was in so much pain. She gave me some coli-urinal effervesent granules from egypt to use only during the plane ride to help with pain. I still have that also. We only visited one place in Irbid together, we had to cancel going anywhere because I was in so much pain.

The interviewer asked if there was letters or emails from him to me he said NO. I had a few, but not many. Most of our conversations have been by telephone, text messages. He never even told her he could get the ones I have. When she asked if he had more proof he looked into his bag and said NO. He thought she was talking about right there and then..............not could he get more proof and provide it. He said he felt shy to say that his wife had an infection and had to use the bathroom every five minutes. Even if the interview was in Arabic he would have given the same answers. He felt he was only suppose to answer he questions, but provide more unless she asked.

I dont know what your financial situaton is but I was told to look for a pro bono lawer or low cost since I dont have the financial means to fight this in court. The congressmens office said it would need to be appealed in washing DC. I am clueless right now. I have two kids I am the sole provider and I work six days a week and go to college three days a week............I was not prepared for this. I am not even gong to class today because I came home from work crying my eyes out.

I was also told to appeal by congressmen office. I called them three times and they said Jordan Embassy does not reply. She did give me names of no profit organization that may be able to help. I have left a message with no help. The good news is someone told me I can get copies of sms text messages on my phone so i called today and they said yes i can have them for the past 12 months for a charge of 5 bucks per month...they will ship out on a cd in 3 to 4 working days. This will show daily contact for the past year. I also use www.startec.com for all my calls to Jordan and i do them for a few min each day now for a daily record and then use the www.alosmart.com calling cards for longer times.

I used www.alosmart.com also. What i did was go to my bank and had them print out all the $10 purchases I made to Alosmart since 2006 when we started talking! It was a bank print out from my account with a letter attached from a gal that works there saying to feel free to contact her if they had any questions. I did not do a print out from Alosmart, but I can do that also. Thanks for bringing that to my attenton.

My husband had an intverview in Jordan on October 2008 and was given a 221g which states that they are sending back our petition and going to deny our CR1 petition. I need help! The interviewer was a woman and she never even looked at our phone records. He said she looked at the pictures one by one, then focused on our emails. In the end she said you dont have enough evidence and said we are returning this back to USA and you can tell your wife not to contact us here. He said he never even seen this coming and was like in a daze. He remembers her saying you can tell your wife she can start all over if she wants, or you dont have to if you dont want to. Well maybe that is not word for word, but that is what he got out of it. He was crushed!!! We have spent hours and hours on the phone, but unfortuantely they were calling cards that you cant track that I got for really cheap..............I can call Jordan for $2 to a house phone for over an hour and 24 minutes to a cell phone!!!! What do they expect? But its not good proof! I have contacted the embassy by email and was told it was being returned and to contact USCIS for further details. I also have contacted my congressman who tells me that we will need to appeal it. Anyone got any ideas? Is there anything else that I can do at this time?

Update: She passed her interview and she'll be here on July 29th. Point of entry is in San Francisco.

Already moved in to my new digs in San Jose...somewhat far from work but I've been taking Caltrain so no worries hehe. Once she's working we'll be looking for apartments around Mt. View all the way to peninsula but it's in the air until I discuss it with her.

Other than that, I'm counting down the days til I see her again =)
