October 22nd here, in the process of writing a nice little letter to my Senators and to the media about this issue. I was expecting a 4 or 5 month wait, maybe 6 at the most, but seeing this has me and my fiancee filled with dread. :(

Just wanted to let everyone know I got my approval from CSC today! I AM SOOOO HAPPY!!!!!!! I have been waiting for a little less than 9 months. Our NOA1 date was July 24.
I literally cried my eyes out when I got the text. (tears of joy).

I am completely convinced that this approval would't have come for a few more months if I didn't contact my senator. A few hours after my approval the senate's office called me to tell me that they contacted CSC on Monday and that my case was approved today. My advice to everyone, CONTACT YOUR SENATOR. It doesn't hurt to try. SO SO HAPPY!!!!!!! Good luck to everyone! <3 :dance: :dance:

I had the sam RFE! they wanted the date location etc, i submitted 100 pictures after with all that information. wow it took forever along like you sent them alot more information. I am sitll waiting though for my no2. Hope soon even though everyday now is taking longer and longer.



Wait a minute, that is absolutely the silliest reason for a RFE ever! You could have had the pictures taken 20 years ago, but as long as you wrote down the date being within the last two years (the exact date), then you are good to go? Do these people at the service centers possess a brain?

I had an RFE after 7 months of waiting for NOA2. We were notified via text/email that the RFE was coming but it took about a week to receive the actual letter detailing what we needed to do. It was a quick fix and we were able to submit it within a week. We received our NOA2 about 4-5 weeks later- approved! I tried to look at it like this- I was actually thankful for the RFE because it meant that someone was FINALLY reviewing our paperwork! We also had a lawyer, but had not been instructed to put both the full date/location on the back of our pictures (I think I just had the month/year listed). So, we had to provide further proof that we had met within 2 years of our application. I probably went overboard providing documents and support but I know it is all evidence that will need to be provided eventually, so front loading is not going to hurt. Hang in there and good luck!



Well sh*t! I am in the same boat, their instructions only told me the month and year of the photo along with other information shown below. Hope we do not get a RFE for something as trivial as the day.


PHOTOS OF U.S. CITIZEN AND FOREIGN FIANCE(E) TOGETHER. 3 to 10 photos of U.S. Citizen and Foreign Fiance(e) together. You should include pictures that clearly show both of your faces in the SAME picture frame. If possible, include 1-2 additional photos with you and your Foreign Fiancé (e) with Foreign Fiancé (e)’s family and/or friends and/or one where you may be celebrating the engagement.
YOU MUST INCLUDE THE FOLLOWING INFORMATION ON THE BACK OF EACH PHOTO:
1) Month and Year the photo was taken;
2) City and Country where photo was taken;
3) What you were doing at the time the photo was taken (i.e. Dinner at restaurant, Engagement party, at the park, etc.); and
4) If others are also in the photo, you must explain or identify them (i.e.
mother, father, relative, friend).

I guess when your congress person tells you that they are just trying to make it look like they are doing something, haha. Might get a vote or two from it. ;)


Apologies, when the casefile is at USCIS, country-to-interview-in makes no difference for queue what so ever.

However, you are suffering from the 'DACA-priority' at CSC, alas. You and thousands of others. I wish there was a better answer, but there's not.

I have a NOA1 date of Oct. 22nd and with all of the recent approvals, checked the status of those who fall into the similar category and noticed that none were approved. I dug a little deeper, going back to August 1st, and found a total of 15 results which were similar to mine (China, Guangzhou, Aug. 1 through Oct. 31) and out of those 15, only one has been approved. Is this typical for China to have more scrutiny or longer wait times than other countries? I contacted my congressman a few weeks ago and he wrote me back saying that he wrote a letter and sent it to the CSC asking for my petition to be expedited (I'm a Gulf War Vet which I did mention and probably why I got the expedite) but have not heard anything and seen no touches on my petition as of yet. Just wondering if anyone else here has had any experience with Chinese visas or not.

Edit: I forgot to mention that I never asked for an expedite, I only wrote him because of my concern over no petitions being processed since late July.

Hi all,

Just wanted to share. This was my first experience calling USCIS, I'm October 24th NOA1 at VSC so my 5 months have past now. She asked me how long has it been, I said more then 5mo now, more then the time line on your website, so she said "ok I will file a service request for you", then she asked what is the date on the NOA1, I said 10/24, and she goes "oh well its within our processing time, we are currently processing 10/1, wait about 23 day." There is nothing worst then waiting for something and not knowing, I can't even begin to describe it. At this point I don't know if I'm just venting or what.



Calling USCIS is just a huge waste of time. Talked to their tier1 and tier2 people and they just blabbed the same thing that the CSC is processing July 18th and to wait three more months. :rofl:

This is such a relief!!!! I almost lost hope for the approval. My fiance contacted senators for so many times but they weren't so helpful but today my fiance got a called from both senators that our petition was approved. Pictures are a good thing (did you remember to date the back and include the names of those in the photo and where you were at?) but I think they also look for transcripts of daily communications.  Did you send anything like phone bills (if you even call one another), toll receipts or receipts for filling up the tank when traveling to see him?  You are kind of in a unique situation from many of us where we only communicate over the phone, VOIP or video calls, Email and chat.  We try to provide all of those logs that we can; for you it may be a bit more difficult.  If you can, take photos every weekend you meet and if the camera has the option to print the date and time on the face of the photos, set it.

Oct. 22nd here, looks like they have maybe done about 10% of October so I wouldn't worry too much. I checked about 40 numbers near mine and saw one RFE, one NOA2 and all the rest in Initial Review. They will get to us soon I hope. :star:

Hi guys me and my fiancé our 8 years in relationship we are high school sweet heart since 2005. They migrate in the year of 2007 and every 2 years he visited me in the philippines. Right now he filled already his citizenship and we are waiting for his fingerprinting etc. can someone help me here? His planning to file a fiancé visa after his oath taking, do you think we need a attorney? Because we read the requirements there is a lot of papers to fill up and can you give me advice how to proof our relationship because way back 2005 there is no facebook and our communication everyday is skype calls, magic jack and yahoo messenger before skype invented, i wish some one will help me on this thanks in advance

 

After my attorney experience I would say definitely no to hiring one; waste of money, takes longer and still get a RFE.  Unless someone can highly recommend one (and I don't think I've seen any posts that are positive on any of them), stay far away, do the research using this website and file the paperwork yourselves.  You'll get faster responses to your questions here on the forums also.

Current status updates:  

 

NOA1:  Oct. 22

touched:  Oct. 25

RFE(touch):  Apr. 25

RFE(letter sent):  Apr. 30

 

I just checked the mail this morning and still no RFE letter and this is now day 12.  I called them earlier this week and as expected, was told to wait 15 days and there was nothing they could do for me until then.  I plan to call them on Tuesday evening (mail arrives before noon at my house) but this is making me very nervous now.  

 

I received my NOA1 within a few days so my guess is that the CSC never mailed it or they mailed it to my lawyer which doesn't make any sense.  I did ask them when I had them on the phone and they said it should come to me since the NOA1 came to me.  I have also been trying to contact my lawyer to find out if they received it but now I find out that they are in the process of moving or have moved their office from New York to Florida.  I tried to call them and found out that one of the numbers has been disconnected and the other a woman answered and told me to Email them.  If they do not respond this week (just sent them another Email this morning) then I am going to start the process of filing with small claims court against them to recover all expenses.  If I end up having to do this it will be a last resort because they have all of our paperwork and they front loaded our petition so if anything gets lost, we're probably screwed.  

 

So here are my questions:  

 

1.  If the lawyer does not respond, how do I get them removed from my petition as my representative if that is even possible.  Is there a form for this?  

2.  Can they (CSC) send the followup RFE letter overnight with a tracking number or just send with tracking information?  Is it an option to request this from them?  

 

Also, if any of you are thinking about hiring a lawyer; DON'T!!!

My fiancee and I received a RFE and there is NOTHING (you here me CSC!) that will ever keep us apart, no matter how long it takes or if we have to move to a country with a more friendly immigration policy.  We are soulmates and nothing is more important to us than our lives together.  

 

Sounds like he did not really care about you much less truly love you.  You do not want to love someone like that, keep searching, you'll find the right person.

I'm just writing to make sure we aren't alone on this one..... been waiting nearly 2 weeks for our RFE to arrive in the mail.  I'm no postal service expert, but I do know it doesn't take this long for mail to travel from California to Washington State.  It's no shock that they didn't mail it when they said they would but I was hoping to be pleasantly surprised.  So what's average?  How long did you wait for your hardcopy to arrive?

 

They sent mine to my lawyer (they just called me today), been 15 days exactly since the second RFE notification that they mailed it so my guess is it has been in their office for at least a week.

 So I just checked our status for our petion .and it says on June 5th they mailed us a RFE. Does that mean it was actually sent out in the mail June 5th.as if so I guess we could expect it any day.as we are at the California office and my fiance address is in california also.

Just kind of nervous as to what it could be .hope it's something simple.my fiance just said that he may have forgotten to date the back of the photos he sent, could this be it?  Also when it came to photo evidence they where mostly print outs from online(Facebook photo albums etc) do they see print outs as a problem? Do they only accept original photos?

Also once we have mailed them back and they are satisfied.on average how long does it take to get a approval after that? 

 

Sorry you received a RFE but the good news is that you will most likely be approved soon.  Our first RFE notification was sent on Apr. 25 and the second on Apr. 30th that they actually mailed the document.  We had a lawyer so that delayed everything for us getting our reply sent in.  As for the photos, that was part of the reason for our RFE, many of the photos were not date stamped by the camera but we also believe that they lost our evidence.  There are a few posts on the forums (you may need to do some searching) on how to add the date stamp to the digital photos which is what we did.  The program just looks at the date stamp which is embedded in every digital photo and adds that to the photos for printing.

We stumbled upon this site while browsing for ways and steps on how does a fiancé visa works. My name is Anna and i am 24 yrs of age currently. I am a US Citizen and i would like to petition my boyfriend in order for him to come here in the US. Ive read the K1 visa guide and its quite overwhelming and a lot to intake in one sitting. Im scared i might overlook something that would cost him his denial. My question is, are we gonna be having a hard time filling for these requests and would it be more convenient to just hire a lawyer to fix our k1 visa papers or is it something we can do on our own? We're new to this and we are kind of lost. Thank you in advance for the advices you'll be giving!

 

Whatever you do DO NOT HIRE A LAWYER!  Ours has slowed down our process by months.

We do have a lawyer, he is not delaying our RFE (maybe he does, I don't know) but all I know is that the whole USCIS system sucks. It's been a month and we still haven't gotten that hardcopy thingy. Called them several times already to resend it, but still no luck. SIGH!

 

It sounds like to me that your lawyer may be responding to the RFE's without telling you about it.  It may be that they messed up your paperwork and they are trying to correct their mistake.  You will not know because the RFE hard copy will not be mailed to you, it goes directly to the lawyer.  I read some past RFE posts on these forums where people were complaining that the lawyer made a mistake and was handling all of the communication between the service center themselves and not telling the clients.  Our RFE reply was delayed because it sat on the lawyers desk for over a week (nearly two) before they told us they had received it.  All that time, for two weeks, my fiance and I were waiting for the letter to come to us and it never did, which caused us much stress.  

 

I would call USCIS and get the address changed so that any future communications go directly to you and not to the lawyer.  Should at least give you the peace of mind knowing exactly when you receive the letter and not having to depend on the lawyer telling you (or not telling you) that they received it.

Did you receive your RFE.I am also waiting for RFE on mail since 28 days and haven't received it.

 

If you hired a lawyer, that will delay your RFE.  We made the mistake of hiring one and by my estimates, it delayed our RFE being replied to by two weeks, could have been more but I was on them every day to get our reply sent out.  

 

I recommend that you call USCIS directly, don't go through your lawyer; you can call them directly after 15 days if you have not received a hard copy of your RFE; if it has not been 15 days since the date they currently have on the website they will not help you!  Also, I called them after I found the lawyer was delaying us and had them change the address of future letters to my address, this should prevent any future delays caused by the lawyer.  You will need to be very pleasant with the tier 1 person, tell them your story and exactly what you want done.  I told them that our lawyer was not being responsive and delaying our RFE reply and they put me in touch with the tier 2 officer and they submitted the change.  Remember it pays to be courteous on the phone as they can make your life miserable if they want to.

The idea that they are spitting out RFE's just to bolster their numbers probably doesn't hold water. It takes more time to spit out an RFE than it does an approval, and the same adjudicator then holds on to the file until the RFE evidence comes back, so they don't even get rid of it. And they can't spit out an RFE without looking at the file in the first place.

Looking at an old thread written by someone who used to be an adjudicator, they don't like doing RFE's. They only do them because the cases are randomly reviewed for quality, and if a file gets approved that should have had an RFE, the adjudicator gets dinged on their performance stats (which are linked to pay raises). So they truly have no motivation to spit out useless RFE's.

Sorry that there's been a delay in processing, but at least you know the interminable wait is over and now you're finally on the road!



I think of it the same as a police officer, he doesn't like to give out tickets, it causes them more paperwork and no one likes doing paperwork, but they do have to meet a monthly quota so they have to. Probably the same at the service centers.

You would think so but you would be wrong.  Wait for the second (you might get two the same day) and that is the date that they put it in the mail.

Thank you for your response. but what made me concern more is the fourth sentence of their notice. It states, "...A new processing period will begin when we receive your response...". This sentence made me worry that if I have to wait another 6 months or so to get processed my case.

No, you do not start over, once they receive your RFE reply I think the typical turn around is two to four weeks.  Yes, all RFE's say that same sentence.  

 

And for the mail delivery, it could be three days or 10+ days if you are us.  I guess the USPS uses the pony express when delivering mail to Ohio.  sad.png

We were approved on June 4th and today I received our Guangzhou case number, then, when I checked my Email, I found an Email from USCIC which I thought was odd saying our case status was in Initial Review.  Is this some type of system reset or should we be concerned?  It looks like a address update maybe (though our addresses have not changed).

Just talked to DOS, they told me to call back in 2 to 3 weeks!  Does this sound correct?  

 

Also, the person I talked to said that Guangzhou will schedule the interview appointment and that I was not responsible for this; is this also correct information?

On the cgifederal.secure.force.com website they ask for Priority Date, is that the date they received our petition?  

 

Also, my fiancee is convinced that she has to pay at a bank for the visa (the amount was over 2000 RMB I believe), but I told her that I can pay for it through this website (I think it is $265), am I correct in my assumption?
