I don't think the process has changed. The Police certificate had to be mailed to the NVC when we applied almost 3 years ago. I doubt you can get a simple namecheck outside of Canada. You will need to do a full boat fingerprint check which will take about six months to process.

Changing it is a huge PITA.. big enough for a dozen falafal balls at least. I vote stable US address. Of someones house you have the keys to if possible. Someone who loves you too because when you phone them every day and ask if you have mail this will help :-)

What should have happened was for you to file the I-130, when you got the receipt for the I-130, that should have gone with your marriage certificate, with the I-129F. Sounds like DHS approved a married person for a fiance Visa, glad the consulate caught it. Bunch of morons 4 sure working there.

And you send in the I-130 with a translated copy of your foreign marriage certificate. After you get a receipt notice for it, you can send in the I-129F with yet another copy of it and the translation (Thats two so far) Of course you will want to keep one for yourself.. you see where I am leading, get lots of copies and translations. This is not all you need to send. Check the guides here for all the stuff to fill in and what to send etc. If you have any specific questions or are unsure how to fill out the form just ask.

I find the requirement of joint financials slightly laughable because, at least as far as joint bank account is concerned, we can't legally set up a joint account if my husband is not in the country (which of course he's not allowed to be because we're filing for the visa). Has anyone else gone through this? And if so, do you think the documentation I have is enough? Thanks in advance for any advice you can provide!


I am sure that the USCIS finds it just as laughable as the fact that you entered into a legitimate marriage with an overseas person and the only evidence of this relationship you posess are some ticket stubs and a phone record.

There is no law against you putting them on a US bank account. Its just difficult to do unless he has a tax number or SSN. Many people get approved with less though. The Marriage Certificate itself is the only documentation they require at the service center so you probably will not get RFE'd for anything else. Its the damned Consular official you have to worry about. He is likely to be the same guy... Make sure you both show up for the interview and bring wedding pictures and letters of support from family etc.

This is why you should send a personal check and not a money order but I digress.. You know, there seems to be no concept of a post dated check here. I send my mortgage company a post dated check and it clears way before the date on it. I think the USCIS is just being goofy and if they put that check in the bank it would clear without issue.

You can only get a K3 from abroad.. thats goofy. I guess you could go home and get it.. but what for? It has to be based on an I-130 anyhow. Age out cases (Prior to August 2002 I think) Were suposed to file an I-485 AOS.. I dunno perhaps they dont make a Visa 4 U.

Why are you contacting that office if you have your NOA1's & Priority dates? Anyhow, looks reasonably straight forward to me despite the words simultaneously and earlier priority date etc. The information is fairly meaningless as the I-129 could slow down and the I-130 speed up.

To avoid this ####### in its entirety. Own everything jointly. That way, when hubby kicks over, you allready own everything and there is no tax on what you allready own.

Of course, The evil 401K plans and other various ways for the govt to scam estate taxes from the middle class do go into probate and have estate tax implications. No getting around that AFAIK.

It is different if the income was earned in Canada and they allready deducted all the tax and now you have to mush the forms around to get the most back (or pay the least) in our case. With a baby, they should only give partial deduction and prorate it lol.

I agree. Thats my job :-) But it would have cost like 8000.00 in taxes had he not taken the exclusion. Shoot me for being a greedy pig. But I don't think the exclusion is the same as filing as a non resident. Interestingly enough, on Part II, question 14 of the 2555, he left it blank. When I questioned him on this he says that that is always left blank unless you are trying to build a case where you are trying to make your tax home abroad for the first time. I dunno, he studies this stuff, I don't.

Just to mention further, we filed a joint 1040. Not a 1040 NR or anything like that. The only resident type questions are in the foreign earned income statement (2555) where it asks about her foreign address and employer. It is here, in part II of the 2555 where she qualifies herself for the foreign earned income exclusion under the Bona Fide Residence test.

So, at this point, what did she do? Did she file as a non-resident and throw away her chances at becoming a USC? Or, did she simply take a foreign earned income exclusion as a permanent resident? Lawyers love this ####### I am sure lol. I am thinking we just answer NO instead of YES and then act confused if they say anything, which is appropriate in this case anyways.

Well pffft.. that makes no sense at all. What if you get your green card say in November. Then what, just because you have a green card, you are going to file as a resident for the whole year? I kind of get the point of the question. But she qualifies under the Bona Fide residence Test to make her tax home in Canada for the year she immigrated. She’s just following the law and the advice of her financial advisor. I was hoping someone else may have run into this issue themselves and am curious on how they may have dealt with it or if it even became an issue.

On the N-400, there is a question which asks:

Have You EVER filed with non-resident status after becoming a permanent resident. Well, Yes, Most folks probably did the first year. My wife got here in late April of 05 and for the 05 tax year, she filed as a non-resident on the advice of our accountant. She did file a US return however. Will this cause any issues with the N-400? We will be able to file the N-400 in seven months. Just thinking ahead!

When I first looked at sending in the N-400, the general school of thought was to send it in 6 months prior to becoming eligible. Is this still true? The six months seemed to be based on the average time it took your local office to process an N-400, meaning that if you were filing in a service center that took a year to process an N-400 then you could send in your petition a year in advance. I don't see local office processing times for N-400's posted anywhere anymore. What’s the buzz in Hartford CT?

The child is a Canadian Citizen. The birth should be registered with a Canadian consulate and an application made for a citizenship document. If you were born in Canada, and your daughter was born in Canada then the child should be sure to get a non-expiring certificate of Citizenship. This is the link you need.

I was born in the US to Canadian parents. My parents registered me and I still have the old yellow papers. I needed them recently to get a passport and citizenship certificate. If I dodn't have those papers I would have had a lot of explaining to do. The citizenship certificate process from outside Canada takes a year to complete and you need to make an appointment at a Canadian consulate to do the paperwork.

My wife became an LPR in April of 2005 so she can apply for Citizenship in January of 2008. At that point we will only have 2 years of US tax returns (2005, 2006). What should we do? We normally do not file until at least March.

Mine came 2 days after NOA1. when did you get your NOA1? A lot may have to do with where you are getting your prints taken which depends on where you live. We are in Connecticut Zip code 06810, our center is in New Rock City.

Congrats! Let me guess. Boston, which I beleive takes 8 months to process an N400 has magicaly processed everything in a couple of months. No doubt whats happening is petitions are being spread out and not very evenly. That would mean anybody could be approved at any time.
