We have yet to hear anything yet as well (NOA 1 Oct 20th). I guess we are in the slow lane. When you see petitions approved in a couple of months it is rather disconcerting. The first come first served looks to be nonsense, which is our biggest gripe. I hope you get your approval soon and you can start to move forward in your lives.

I would be grateful if some sage can enlighten us concerning the preparation and dating of these documents. We are currently still awaiting NOA2 for our I 130 which all being well shouldn't be too far away. We have been assembling all the documentation required in advance and have signed the DS-230 Part 1 and the I 864 in anticipation of approval in order to expedite the process as best we can.

Is there a problem with having these documents dated prior to approval?

I personally cannot see that it matters as if the information was to change then of course we would redo the document, but then again like lots of things there may be a reason why this must not be done.

Many thanks I shall endeavor to get an appointment. It would seem I have to get some "code" to put in the subject line of an email in order for London to receive the email?

I wonder has anyone done this for London?

It seems difficult to be able to simply contact the embassy (and unsure if I will get the info I require) without calling that extortionate help line number.

All I need is an appointment (bear in mind a 4 hour journey) to have this form signed.

Oh well but another hurdle to cross.

I have to get this G 146 form signed at the US Embassy in London. If I just turn up I reckon I will have no chance of getting it signed and its a 4 hour min Journey from where I live. I would be grateful for advice here.? I know they are really busy there, though this should not take long to do.

Best way is to email the consulate. To do this you have to telephone 09042-450-100 this is a premium line number costing £1.20 a minute. From what I can gather it's a call center that the US Embassy has contracted out to a company in Scotland. They are very pleasant on the line but obviously in no rush. When you get through (I chose option 3 on phone) ask straight away for email code. It is a code that you must put in the email subject line in order that the email will not be rejected. This is in order that the embassy only receives sensible mail (or helps to reduce spam).

I hope that helps anybody who needs to get through to Embassy staff. It is in fact the best way. I shall update you all in my request for an interview in order to get a form signed.

By the way you also have to pot your full name , date of birth and Query in the message.

How I feel for you both. I have been there and done the K3 thing before (long long story) and I feel stay with the CR 1. The K3 at your stage could be just more hassle and pain. Perhaps you could email the embassy that you have contacted before and put them in the picture of your concerns. Mirror this information to your congressman/lady's immigration assistant to seek help on this matter.

letting those in authority be aware of your position at this stage is paramount as it could prove to be invaluable should you have problems. perhaps they may be able to expedite you given your situation.

I am sending the original with the DS-230 and taking a photocopy of the original police certificate to the interview. At the interview you need to remember to ask for the originals to be returned to you.

To the best of my knowledge another original Police certificate is not required.

I am sorry to hear of so many waiting so long for adjudication and approval. This post was meant as a means that others should be able to benefit from actions that are available once one petition goes past the normal processing time.

I do hope that for those that have an extended period without approval contact their respective congressman/lady's immigration representative and ask them to inquire as to the status of their individual case. One would have felt by now
that with all the requests that must come the way of congressmen and lady's that they themselves would be a little tired of this and bring about the radical change that would appear to be necessary.

US citizens are paying for this immigration service and to the best of my knowledge are very vocal in complaining when service fails to reach an acceptable standard. If 6 months is an acceptable time for the processing of an I 130 then ok just sit and wait it out if not then you have the right to voice your opinion where it counts and should do so.

I often hear oil the squeaky wheel with regards to inquiring about ones case.. This wheel needs replacing lol

We sincerely hope all couples displaced for such lengthy periods get re-united soon.

I know that the stress for couples is unreal and I cannot see why the process is as elongated as it is other than a form of immigration control. As far as VSC goes, it is indeed a mystery as to why they are taking so long compared to CSC. Shortly we shall be outside the normal processing time quoted by Vermont.

What would be the most effective means to get our case looked at, adjudicated ?

I can imagine there are plenty who have an NOA 1 prior to ours ( 20th Oct 2008 ) but I would be grateful to be advised as to the most effective course of action to take should we fall outside this time frame.

When I see that according to visajourney VSC is adjudicating cases some 100 days later than those by CSC I start to wonder where all the fairness is, and what happened to the first come first served scenario rofl.gif . Either way this disparity in progressing cases seems to me to be grossly unfair.

I have never attempted to call USCIS from the UK but I see no reason why you should not be able to call from Canada. Perhaps you have to drop the 1 from the 1-800 number to get access. Roberta has always called with regards to ourselves as she is in the US.

Perhaps there is someone else who can help with this for I personally do not know?

Paris Heart many thanks for your kind comments, we are hoping for an approval soon, as like everyone else in this process we want to get on with our lives together as intended. Fortunately Roberta is coming over to visit me in Mid May with her twin daughters. So we are all excited about that. Roberta will get to meet my parents and brother for the first time. I have arranged accommodation for us all in Devon England so they are in for a wonderful holiday all being well. As for calling USCIS and chasing the petition we are just waiting for the 6 month point (20th April) as per their normal processing forecast and then attempt to get this I 130 adjudicated and approved.

We hope others are approved this month as there seems to have been a real slowdown of I 130 approvals from Vermont lately. There also seems to be this blanket excuse that some petitions take longer than others to adjudicate. Hmm well I am sure verifying information from certain countries can be a little more difficult, however I find the time scale for this hard to believe given the tools at USCIS's disposal. After all I 130 documents form exactly the same pattern for everyone!

Best wishes for all involved in this drawn out process, we wish you all to be with your loved ones soon. Meanwhile we have our holiday together to look forward to and perhaps we shall be lucky and have an approval too.

The case status online system was I believe a good idea when it was formulated in that petitioners and beneficiary's could see there case and get an indication if it was transferred or moved etc. However like all computer systems no input = no output and I guess either the adjudicators are failing to do something, the system is failing to respond to adjudicators/staff input, supervisors are failing to ensure the system is being utilized or what I think, is that they have just about abandoned it.

It was a sensible system, and yes as was mentioned previously it has probably saved thousands of calls to USCIS. But this is a tired system that is in need of serious overhaul. One must remember though that if this immigration system is streamlined (as it should be) should a tier of the process be removed, then what would the impact be on jobs. Not only within USCIS but with attorneys and there staff. What loss in revenue would be incurred as surely with less paperwork and less of a process, why should you pay such $ amounts.

So really there is and most certainly at the moment no reason to change the system too much. I think people would get a shock as to the revenue received by this immigration system and then if we were to account for the revenue that attorneys make we would be indeed amazed. You have a captive market with immigration, and as we have seen not to far in the distant past, increases in fees. Arguably we have seen an improvement in the processing times but then again with the increase in personnel recruited (which we as immigrants and US citizens have paid for) we should have seen a speed up of processing.

So ladies and gentlemen we know what we have and in the knowledge it isn't likely to change in the near future all we can do is wait and wait and wait.

Joking aside it is easy to criticize when you do not know the full picture and I am sure if we were party to the full picture we may have a different outlook. Meanwhile we are more or less on the same boat, wishing to be re united with the ones we love.

Irrespective of the time frame difference between the K3 and the IR-1 I would strongly advise you take the IR-1 route. I know from personal experience how much hassle the K3 route really is, never mind how much more costly.

Our I 130 NOA 1 was the 20th Oct 2008 so all being well this month please.

Being separated is tough in that there is so much going on in a marriage and being apart especially for a protracted time is so stressful knowing that there are so many things to be done at home and you are not there to do them. I suppose when you are together you are spoilt and get so used to one another and do things for one another as much out of habit as need. Oh well we shall keep checking the mail and hoping and praying that this process will not take much longer.

Well we have a NOA1 for I 130 dated 22nd October 2008. Going by the way things are we are looking for an approval approx May 22nd. I just cannot see Vermont being any quicker than that. Of course there is also the possibility of a transfer to California, though I doubt it now that we are buried within the depths of Vermont.

We had to send in a correction to a mistake we made on our I 130, which I am posting tomorrow. Just hope that it arrives and gets placed in our file safely. Apart from that we are in the waiting game like thousands of others.

Sorry to hear that but I think your lawyer should provide you a copy ( even a photocopy) of whatever he is receiving from NVC to give you an update of your case . Your lawyer, being your AGENT, is the one who will receive your mails/emails.

If you will look on the NVC flowchart ( can be found on WIKI), there is a note at the bottom that if you have a lawyer the DS3032 will not be generated/ sent by NVC because the lawyer will be automatically the AGENT. I read also somewhere that if you want your lawyer to be out of your case, there is a form that you need to fill up and send to NVC so that all future correspondence will be sent to the new agent of your choice. Maybe somebody else here on VJ have more infos regarding this option.

you can ask NVC what document they need and you can send it back to them without using a lawyer. I think this is a RFE and VJ people can help you once you tell them which documents NVC need. or NVC can help you how to send it back to them.

You know what, thats exactly what entered my mind. But when I tried to call NVC today, there was no available agent to talk to me so they told me to call later. In doing so, would our case number be enough as reference for them to give me the requirements they are asking?


I believe, being the beneficiary or petitioner, you have the right to know the information or status of your case even if you have the lawyer whom NVC will send the correspondence.

Hi! correct me if I'm wrong but do you mean DS-230 or DS 3032? According to what i read if you have a lawyer, then the beneficiary will not receive the DS3032 ( Choice of Agent) 'coz the lawyer will be the agent automatically. But if you are referring to DS-230 ( the application for Immigrant Visa), then you actually need to fill-up the form and submit that with the required documents to NVC via your lawyer. That's what you're paying him for...to make your processing easier ...suppose to be. I understand that many are really getting upset with their lawyers 'coz it seems like they're adding more days to your waiting period. I wish you'll have a speedy process inspite of that.

If you will look on the US embassy website, specifically Manila, you will only see that the CENOMAR is listed as a requirement for K1 (to prove that they are single) but with the testimonials of those who already have their interview for IR1/CR1 visa, the MARRIAGE INDEX is part of the requirement....and to obtain the Marriage index, you have to go to NSO or request online( whichever is convenient for you) . My husband got our Marriage index certificate recently and he was ask by the NSO personnel to fill up a request form which is the same form he used when he got his CENOMAR before we got married.

I'd rather be in a position wherein I have the document and the CO didn't ask for it THAN for them to ask for something and I don't have anything to show. Hope this helps yes.gif
