Hey everyone, my fiance and I got our NOA2 on Sept 26, and are now getting the other documents together for his interview (I-134, birth certificate, etc) and wonder what is the best way to send my fiance these items? Definitely want a tracking number and a signature on delivery I'd imagine, maybe UPS? Any suggestions would be greatly appreciated.

Hey all, we are filling out the I-134 and my dad is going to be our co-sponsor. On page 1 #3 it says "This affidavit is executed on behalf of the following person": my fiance is listed here. My question is in that same section it asks for the "Relationship to Sponsor". Now is that asking what my fiance's relationship to my father is i.e "future father-in-law" or should I put fiance as I am technically the sponsor, my dad is co-sponsor. Unsure as to how to answer that.

Also do we need to write "co-sponsor" on the form somewhere or is it relatively obvious since there are 2 I-134's being sent and my dad's is the one meeting the income requirements?

We were a little confused about that too. For ours, I put I do intend and then stating to help out with food/groceries as needed until fiance is able to work. We had a co-sponsor, my dad, who also put I intend, and to supply a place to stay until my daughter's fiance is able to work. I hope that is correct. Can anyone shed some light on that for us?

Thank you for your support and advice. I email the US Embassy in Cairo weekly at ConsularCairoNIV@state.gov, but get the same message, "The case is pending necessary administrative processing." It is very frustrating.


I did send my fiance an Eid gift. I don't know if he received it (the mail is shaky in Sudan). Next Ramadan we will be together. Inshallah. Salaam.

Our Visa (I-129F) petition was approved by USCIS (in April 2007). My fiance was interviewed for a K-1 Visa at the US Embassy in Cairo. We were told that my fiance (from Sudan) had to have a background clearance. We have waited patiently for 5 months, but keep being told that the case is still pending. Does anyone have any suggestions how to speed the Visa process along?

example ours is: EXP 11 MAY 2011A

i see you say it left NVC May3....so yours will be EXP 03 MAY 2011A (maybe try 02 MAY or 04 MAY?).
then it should be able to find a package where the destination is London, England.
but my guess is that it has been delivered if they shipped it around the time you say.

In response to your later message. I recently came to the USA from the UK via Philladelphia. As went through there before thought that there would be no problems. However, I was told by the Customs officer to go to an office on the side. Once there I was told by another officer to get mmy luggage. He then proceeded for a good 2 hours to ask me the same questions over and over ( me giving the same answer over and over !!) and looking through my personal stuff. He even checked emails on my laptop adn text messages on my phone!!. Whilst looking through my personal belongings he came across my qualifications and a resume I was bringing to the USA for when I was able to work. O dear!!!.......another questionning session began and I addimently told the officer that I did not intend to work whilst I was here.He then called my fiance and asked him a few questions too!! By this time I was crying and very upset as I had missed my connecting flight to Charlotte.

He told me I should not bring all documentation with me ( the dicumentation you stated above) as it looks like I'mtrying to work and move to the USA. Why on Gods good Earth would I want to work illegally when I'm going through the difficult and long process of being legal to marry?????

Through my eyes it is very difficult to see the person you love (fiancee) whilst going through the K-1 process!!

This topic is discussed over and over. Out of curiosity I submitted the question on the CBP website two years ago. I got an email response from Andrea at CBP. It's the same advice that's repeated on VJ often.



In order to enter the U.S. while a K-1 Visa is being processed, you will have to convince the admitting U.S. CBP Officer that you are simply visiting the U.S. rather than attempting to enter for immigration purposes before your visa is granted. In order to do this, you will need to provide documents to verify that you have very strong ties to your home country. All of the following documents should be used to accomplish this:

Deed, Mortgage Statement, or Rental Lease Agreement in your name
Utility Statements in your name
Bank Statements in your name
Employment Records in your name
Letter from employer stating that you are expected back to work on a certain date

It is also advised that you have a roundtrip ticket and pack very lightly for a short trip to the U.S. The purpose of this is to prove that you have strong ties to your home country and are not willing to sever those ties by staying in the U.S. past your departure date as mandated on your I-94W Departure Record, or by circumventing immigration regulations.

Additionally, you should be aware that even with all of appropriate documents to verify strong ties to your home country, the U.S. CBP Officer has the final say on whether or not you will be allowed entry.

We are close to out estimated NOA2 date and I just want to know if there is anything we could be doing in advance so as not to be held up waiting on something like a Dr. appointment.

So many questions! I just received my W2 and my income is JUST barely shy of the 125% guideline for a family of 5.

1. If I have a Court Order for a substantial amount of child support that puts my income far above where it needs to be. Can I count that at income? I can't always show where it has been deposited into my bank account because its sometimes paid in cash and then just used directly to pay bills. If I can Count it with the Court Order as proof, then I'm all set. If not...

2. I can put enough in savings to cover the difference X 5, but does it matter that I am JUST now putting it in? Does it have to have been there for a while or anything like that?

3. Suppose we have more than enough to cover the difference in savings. We apply for AOS immediately when the beneficiary arrives, having plenty in savings to meet I-864 requirements. How long must that money remain in savings? We's like to use it for a DP on a home, but must it remain in savings until... AOS is approved?

The question asks if you were "arrested or convicted of any offense or crime..." Since they separate "offenses" from "crime" I would say you answer YES. However it is not an offense that would disqualify you for a visa to the US and the US does not care if he overstayed a visa in Japan. Of course he will have to have a Japanese police certificate (required of any country where he lived for more than 6 months after age 16) and that will show no criminal offenses. I would attach trhe Japanese police cetificate and a letter of explanation of the answer to question 38.

I had to choose between the two options too! It is a hard choise because I had a friend that got married to her Mexican fiance while she visited and she claims she got her green card in 4 months but I am pretty sure it was not that easy... I was told by another friend that she cant leave the country until everything is done!
I talked to a friend of the family who works for a law firm in the immigration side... I dont know how much they charge but I can tell you that I just sent the I-129F form for the K-1 visa and it is not very difficult! yes it is nervewrecking and stressful but anyone can do it! just pay extra attention and double check the all the papers! This website is great full of examples and support!
I chose to do it the right way because my fiance while Italian lives in the UK and has a 7 year old and god forbid anything happens to her and he not being able to be there.. the relationship as it is is not the best as it is thanks to the mom.

and no there are no question about , and when i move i was not sure about everything , I also have a letter from him that said that we are friend and he was responsible of my stay in the country , cause we have passions x dogs in common , and we wanted to go together to show dogs..and visiting kennel and breeder .

If OP does AOS then they also need I-130.

The only question I have is whether or not the OP disclosed a bf in the states when applying for a B2 visa, since they are from a VWP country.


Cause the VWP allowed you to remain in the country just for 3 months ..if you want to remain more you need the visa process and ask for a B2 .

Well ,
i really have to thank you all for the kind help .
I will talk again with the lawyer in the afternoon cause I already planned a meeting call with her so I will see also her suggestion at this point .
Then i think I will take all the weekend to decide with my boyfriend which way we are ready to go through .
I have to consider also the fact that if i want to get married before the expiry of my stay... ( 24th October ) I have not so much time to organize everything , and i have no idea how long it can take .

This will not be the first time nor the last one when someone shows up on a visitor visa and AOS takes place. Not everyone shows up in the US with the intention to stay. Some come to see their boyfriends and find it hard to be apart again and some come to break it off.

I know someone who came to visit their gf awhile back and something clicked ( maybe it was the right time and the right place) and they decided to adjust status in here and got married. No problems whatsoever through out the process and now they are in the Naturalization stage and have been happily married with a couple of kids

The option is there if it feel right to get married to your boyfriend Pollina

Last month I have been to an immigration lawyer for a consult about my Visa , cause i was already in contact with the lawyer I sent some emails asking about K1 .
She should send me the agreement ( in case I will decide to proceed with her ) , but she anticipate me the cost :

500$ to open my case and fill the Form I-129F
500$ to send the form
and she told me the the total cost till the end of the process will be around 3500 $ .

what do you think ?
what would be the cost if I will proceed without lawyer .
I am just worried ( in that case ) to make some mistake in the form or maybe to loose more time .

( pensa , sono in America da tre mesi e sei la prima persona con cui posso parlare italiano !! :-) )

I agree! I think you should come back to Italy and do it the proper way. The last thing you want to do is piss immigration off. You lied about your motives (entering the states) and as far as they are concerned, you may be lying about other things too. They take lying very seriously. If I were you, I would go the K1 route. If you don't mind me asking, what kind of visa did you get? Was it a B2?

The form I-129F for K1 visa can be filed anytime by the USC. The process can begin before your authorized stay expires. As you are already aware, you will need to leave when your authorized stay ends.

Hi all ,
I am Italian and I am in the US since end of April 2011 with an holiday visa x 6 months .
I came here cause in love with an American guy , but asked for an holiday visa first cause we wanted to spend some time together.
Now after some months together we don't want to be one without the other anymore but at the end of October my Visa will expire and I have to go back to Italy .
We were thinking about a fiancè Visa ..and then get married as soon as possible , but from other topics and internet we realize that is not so quick as we hoped ..at least 4/6 months .
Some friend suggested us to get married while I am here , but I am not sure it can be the safer way .
So I am now a little bit confused about what to do ..and I am not sure if could be easier ask help to an immigration lawyer or not .

Hope that someone of you can give me some kind good suggestion .

No. As long as your co-sponsor has adequaye income they do not care about foreclosure, dreit rating, etc. They do not even ask.

Your only concern will be documenting that you are living together as husband and wife, try to get some documentation of where you are living, even a lease to rent a room for example. Something in writing. There is no problem with living at a relative's or friends, per se, just being able to porve it is more difficult.

We are in the last stages of our K1 visa process. The I-129F was approved in February of this year and we haven't scheduled my fiance's US Embassy interview yet. I live with my mom and she's my co-sponsor, but they are foreclosing on her house, which is in her name. However,she has an income well over the poverty line.
My mom and I are moving soon, in with a family friend, and my fiance will be moving there too, should he be given his visa after the interview.
Will our situation cause him to be denied entry even though we will ensure that he wont become a "public charge" and he will have a place to live?
Any advice would be appreciated.

You each fill out a separate I-134 and each of you attach your own documentation to the form. Your mother will also need to attach evidence she is a US citizen or Permanent Resident (birth certificate or copy of her passport) and supporting documentation for each claim she makes. Her family size will be herself, your fiancee and any other dependents she has. YOUR family size will be two, you and your fiancee. Your mother DOES NOT claim you as a dependent.

There will be two complete, separate I-134s and supporting documents.

My mother meets the requirements of 125% or more above the poverty line and has agreed to be the joint sponsor for my fiancé, since I don't meet the poverty line.
Our issue is how is it filled out? I'm afraid I'll put my information instead of hers, or vice versa (as in who signs it ect.) Any help will be appreciated :) especially any examples of this for me to follow, because thus far, I haven't found any.
