I have been informed that I will have an I-130 interview (beneficiary interview) as yet to be scheduled. Can anyone shed any light as to why this may be the case as this just prolongs what has already been a long process. We have a NOA 1 date of 20th Oct 2008 and from what I can gather should the interview be successful then the I-130 would be forwarded to NVC for continuation of processing.

If there is anyone who could shed light on this I would be grateful.

There is no requirement to send in photographs with your I-130 petition. What we did do though was to send in two affidavits from people we know..a friend and the wife's daughter to verify that we have a bona fida relationship. I do believe there is no real requirement for that either but they do say that you make submit these to help establish that you do in fact have a normal relationship.

No problem. I actually did send evidence when I filed the I-130 but for some reason, we still got the RFE. So I sent the original evidence again, along with some additional evidence and some pictures of our wedding and pictures of the birth of our son (showing the 3 of us together).


I must admit I am a little at a loss here in that you received an RFE for proof of marriage relationship. In compiling all the forms together for dispatch once we get the word from VSC I have seen no requirement for submission of proof of marital relationship? If there is a requirement we shall obviously put some together in order that we don't receive an RFE when we submit our documents.

If you can advise or give some insight about this occurence we would be most grateful.

We were approved on the 8th of June and have yet to receive any paper receipt/notification of our NOA 2 approval. I wonder is there any time frame that we should be looking at in order to receive said document.

Or has USCIS stopped producing them? I also notice that our online status has not changed either and wonder if again this is normal?

I had 2 boxes checked. Evidence and Other.

The Other was for I-864 AOS. I took care of that right away. She gave them my tax returns. Problem solved.

The Evidence box was more difficult. When she went back with more proof....... still not enough. I had the following for my evidence initially:

6 photos
6 pages of phone bills
copies of 2 passports that clearly showed I lived in Thailand. 50 Thai immigration stamps.
2 utility bills from our address in Thailand with both of our names on the bills from the time we lived there.

They said NO. We want more photos. So we went on a photo taking festival in Bangkok. 2 disposable cameras worth. Off to the one hour photo shop to get developed. Took the photos to the Embassy the next day. Approved, pick it up tomorrow.

The point I am making, is if they want to screw with you, they are gonna do it.

I also previously thought it was pointless for me to go to the Embassy. I figured she could go alone. Even though I never talked to anyone at the Embassy last Tuesday, I think them seeing my ugly face there helped as well. I know some people can not afford this. Actually, I really couldn't.

Take this for what it means. I don't know. Blows my mind a K-1 can just walk in and out like they are picking up some fries and a burger, but if you want IR-1/CR-1, they want to see something.

Just love the picking up some fries and a burger remark... yes it would certainly appear that on the CR-1 route you are under the microscope whilst K-1 seem to fly through. Great post and to the point and I laughed when I saw what evidence you produced for it seems that we are put under so much pressure to produce all sorts of evidence when in reality as a couple you work your lives out between yourselves...ie ...bills etc.

Hi,

We just called the NVC and got through to their automated response system. It said that our case was complete on August 9th. Does this mean they now send our case to the counselor in Montreal or do we still have to wait for an information packet? Any help of this timeline is much appreciated

Have you received a letter in the mail yet? I called the automated system after I received the letter and it says
that they do not have our case number from USCIS and the letter states the Case Number from USCIC as well as the
one from NVC. So I couldn't tell you based on what I have received. My letter is dated August 6 from NVC.zIt also states that my fiance will be receiving a packet from the embassy after they forward it to them.

I know some people write to their senator, or whomever, but does it really do any good? Does it make the chance of getting visa for fiance to come quicker or better or????? What does it really do? We are dealing with Casablanca now, so does it make them more friendlier at the interview by knowing we contacted our Senator? Tell me please and must I do it. Is it only for a peace of mind that we have sounded off to them??????????

Now that my fiance has his letter finally (today) from the embassy in Morocco, he has to fill out the DS 230. Where it has financial suport to show proof, is that for him or for me? I would think that would be his financial papers, don't you.

I need a quick answer, cause I did not send any of my paperwork to him. I heard Casa does not ask for the Petitioner's financial support.

Hi everyone, I need some information please...........My fiance who had his first interview Sept. 13 in Casablanca got the 221G form. Now they have called him to come back and bring proof of our relationship. He had it the first time, but did not want to see any of it. Thank goodness I went back in November and now he has more proof.

Hopefully, he will get visa this time, since they never did send our papers to USCIS as they stated they would. My question is IF he gets visa, comes here, we get married within the 90 day period, how soon after our marriage do we file for AOS and EAD? And do we need to file for Advance for Parole so we can go back and visit his family?

I need all the info anyone can give me. Thanks.

You can always take a train or Greyhound bus to Charlotte, but either way will be a long time to get there. That is the only solution unless you know of someone who could take you.

hi, i read a post here in VJ about her husband having a class b medical result and got an RFE bec the husband did not have a follow up "check up" after a week if his stay in US, how could he have known if it was never disclosed to him? absurd. Anyway, I also have a class B condition coz of my thyroid disorder. I saw it while the nurse here in our accredited clinic was discussing about the CD xray, etc..guess my vision is that clear and accurate to even see that i am supposed to see a doctor after a month of stay in US yes.gif the thing is, it was never discussed by the nurse nor the consul to me, but Im really planning to do it within a month of my stay in the US. My question is, USCIS might wonder how did i found out about it when it was never disclosed to me? whistling.gif they might accuse me of peeking at the result (I know this sound stupid), im sorry but the nurse was a litlle careless with the papers while talking to me, I swear! shes probably tired then. So, as Ive said, I plan to get checked, get medical report and submit it together with my documents for AOS. I just want to avoid RFE as well.

strange coz in my case, when I gave my police clearance to the filipino pre screener, he returned it to me and said that they dont need it anymore. I dont know if its just in my case or they just dont need it anymore coz they get the NBI clearance anyway.

yeah,I stayed in two different cities and I just submitted my police clearance from where i currently reside. The two cities im talking bout is just in Manila, so im not sure if theyre as not strict if you had lived in the province or outside Manila, but dont cut corners with US embassy, just go do it anyway.

My husband had his MMR at his doctor's last week. He is old enough that he never had it as a child but they also don't have his childhood medical records. I think if there is no record of your husband's childhood shot then they will give it to him anyway when he has his medical. Also note that the MMR can be 1 dose or 2 doses (4 weeks apart) but it is more likely to be 1 dose. My husband only had the 1 shot.

My UK husband using visa waiver has never had any problems (3 entries into US since we were married ... August 4, 2006 ... 7 entries in total in less than 2 years) but he has never stayed that long (I lived in the UK for 7 months). His longest stay was 3 weeks.

1. if you are interviewing in London you should read the reviews written by people who have interviewed there - seems like often very little support is requested
2. since you are married your interview might be different - there are many more fiance visas than spouse visas so descriptions of interviews might not apply to your situation
3. I might know more after my husband's interview on Wed. (Yeah!) but we are a K-3 not a Cr-1/IR-1. We are bringing very little support to the interview, other than each other, but I also lived with him England for 7 months so ongoing relationship is easier to show.

My spouse got his on Sept. 19. 2006 for the K-3 interview.....He asked the CO what is administrative processing and was told that he would find out when he called him back. So the case is still under administratve processing. However, he has another interview scheduled very soon for the CR1 but we were told that a visa would not be issued until the adminstravite b/s is complete. I don't get them.

On the I-864 poverty guidelines it has a list of 'Means Tested Public Benefits'

I always thought this meant that the non immigrant spouse could not receive any of these benefits when going to live in the US but does it also mean that the petitioner cannot receive any of these benefits either.

I was thinking of applying for childcare benefits, since it is so expensive in North Carolina, and I will be the sole breadwinner until hubby gets his visa.

Ok I am still confused..........I didn't send it w/the original I-130...I sent it in when the NVC requested it. But it's been a year now & we are still on the waiting list at the Dominican Consulate....

I just wanted to know if it expired after lets say a year or if I could take the same one that I submitted to the NVC, especially for the sponsor, since she lives in another state & it would be a hassle for her to have to fill it out again w/all of her documentatin & than send it to me.

I sent my I-864 on 8-06 along w/the I-864A from my sponsor(for the I-130).....I read somewhere that this form doesn't expire. is that true? When we go to the interview do the sponsor & myself have to fill out new I-864s & get new employer letters(since the ones submitted will be over a year old)....

I've been reading on this forum on how it's much better for spouse to be approved on the I-130 instead of the I-129F...MY I-130 is at 17xxx & the I-129F is at 18xxx.....

So it looks like the I-130 will come along first but what if the I-129F jumps ahead(that's why most of us filed that one so our loved ones could travel faster) but 1 to 2 month difference is no big deal considering the inconvenience & expense the I-129F will bring....

Would I be able to cancel the I-129F in case it does jump ahead and just wait for the I-130 to come thru???

Or does dthis sound crazy??????

Did you keep the receipt that you got from US Visit. Did you get a passport stamp when you arrived in your arrival country. If so, you can include a copy of this when you send your card back. Your experience is not unique and is quite common. I would get into a complete panic about it, but take measures to return the card to the USCIS at the London KY address.


:yes: :yes: My parents had a slightly similar problem once. They turned in their I-94s but somehow they were misplaced and USCIS thought they had overstayed their last visit. My parents just submitted copies of the (Philippine) entry stamps on their passports, their (obviously used) return tickets and boarding passes.

Hi guys...I'm very disheartened right now. Our petition was transferred from VSC to CSC on Jan 14. Aside from a touch shortly thereafter, and 1 touch on 3/2, we have not heard anything. It seems like there were alot of folks who were transferred around that same time, and they've already been approved! crying.gif When will it be our turn? I just feel so anxious and helpless. I spoke with an operator on the phone today and all he could tell me was that the case is pending, and that the reason it was transferred to CSC is so they could be processed faster! DUH! blush.gif I'm just frustrated...sorry for venting...

Ok...so I've been reading through the guides on here regarding the NVC and clearly I'm confused wacko.gif wacko.gif . I'm not rushing to get out of NVC at this point, and I just wanna make sure I do everything right the 1st time. With that being said...I have 2 questions: 1) once the I-864 bill has been generated (per the AVR), can I go ahead and pay it and send in the package later?, and 2) I filed for an extension on my '08 taxes...do I have to wait to file them in order to send them in with the package, or can I use '05, '06, '07 taxes?

I may have an answer to your question. My husband's (then he was my fiance) K-1 was denied for a specific reason. Long story short we got married in Oct of 2007, and I filed the I-130 back in Dec. The petition was just approved by USCIS on 4/20/09. Hopefully we will get through NVC without any major glitches, and the only thing left will be the interview. Cool, I hope your husband gets his visa soon! I plan on following in your footsteps. Getting married in May, and filing our I130 in June or July. Trying to make it to where he has his interview next year, because with this 2 week vacation and 2 weeks this past February, I will only have 32 hours of pto by the end of the year, and I MUST be there for his interview this time.

Can somebody tell me at what stage of the NVC process will my husband need to get his police certificate? Does he need it before the whole case is complete, or does he just need it for the interview? unsure.gif Thanks! good.gif

You're right dm! I misread your post and understood you meant CR1 status had already been granted, when it's really been form I-130 (petition for alien relative) instead, which would in turn explain why his CR1 status interview has been scheduled already. That being the case, once the I-130 is approved it cannot be retracted by the Agency, nor the USC, unless he/she provides the Agency with ample and highly credible evidence that the alien didn't deserve approval to begin with, as to make the Agency reconsider their decision. I find this very hard to accomplish though.

Queen, in your case and based on the above, all you'd have to do is not submit form I-864 once received.

If the CR1 has been approved already, then why would the embassy in his home country schedule an appointment for him at the end of the month? Based on the info. provided in the OP's beginning post, it seems as if the scheduled end of the month interview is to actually get CR1 status granted.

Queen, am I wrong in making this assumption? If so, then what's the interview exactly for?

I apologize for my typo. What I truly meant to write was that once DIVORCED, he could then file for the "bona fide" marriage waiver on his own, to be used towards the I-485 (adjustment of status form).
