You have several options:

1) Get married, she stays and applies for AOS, EAD, AP. You won't have to spend extended time apart but your fiancee/spouse won't be able to go home and settle her affairs until her AP is approved. She also has to be ready in case she is asked to prove she did not have "immigration intent" when she came in on her B1 visa. Don't worry about the I-94 expiring as any overstay is usually overlooked for spouses of USCs who apply for AOS. Please note that if her "overstay" runs over 6 months before you are able to apply for AOS, then she should not apply for AP as she might trigger a ban when she tries to re-enter the USA.

2) Get married, she goes home and you file for K3 or CR1/CR2 visa. Doing it this way, your fiancee/spouse can go home and wrap up her affairs properly. You will have to spend time apart while the visa is being processed. She should leave before her I-94 expires.

3) Not get married, she goes home and file for K1. Same as number 2 but K1s are usually processed faster than K3 or CR1/CR2 visas.

This is correct. The visitor visa will remain current even though there is an I-130 on file. Your wife will, however, need to show sufficient proof at the POE that she will be returning to the Philippines after her visit.

This is correct. You can file for your stepdaughter by virtue of her being your stepdaughter. She falls within USCIS' definition of "your child" who can be petitioned by a USC via the I-130.

You will need to apply for the AOS and pay the fees 21 months from the time you pass thru your point of entry. Once that is approved they will issue a 10 year green card.



This is not correct. OP's wife is coming in on a CR1 visa. She automatically becomes a legal permanent resident when she is processed at the POE. She will get an I-551 stamp in her passport and her actual green card will arrive anytime between 3-6 weeks.

I have 6 more questions for you... On the DS230 form that we filled out, it said on the bottom somewhere I think on Part II about getting a Social Security Card Sent to Her... Should we be antisipating receiving her SSC in the mail since we checked that block or does she need to take her passport to the Social Security Office here in the US and apply?

Second Question, does she need to apply for a work permit, or because of the stamp I-551 she will get, she will be able to work without doing any further paper work?

Third Question.... She is working on her PhD and will need to go back to Russia for a short time, just 2 weeks after she comes to the USA... I think about 4 months or so after she gets here she will need to go back for 2 weeks... Does she need to fill out the paper work to request to re-enter the USA, or since it's only for 2 weeks she doesn't need to fill any paperwork out?

Fifth Question... How long does it take for her to get her conditional green card so that she doesn't have to use the stamp that is going to be in her passport the I-551.

Sixth Question... the conditional passport is for 2 years, but the 2 years is not after being married for 2 years, but 2 years from the date it was issued correct?

They will tell you at point of entry that the SS card will take 2-4 weeks to arrive. If you don't receive it in 4 weeks you should go to a SS officce with birth certificate and pass port.

A work permit is not needed. The I-551 stamp can be used as a temporary "green card".

The CR1 visa is good for multiple entries. She should be sure and carry her marriage certificate along with the visa for the return entry though.

The 2 green card will probably take 6-8 weeks to arrive.

It's for 2 years from date of arrival in the U.S. Three montys prior to that date, you should file for the AOS, or 21 months from date of entry.

As a son sponsoring a parent, they are eligible to file for AOS in the US. I'm not sure how unauthorized work and overstay will impact on the approval of the application. Reading the instructions for the I-485 it seems like overstay is "forgiven" for immediate relatives (parent, spouse, child) or a USC. It's not too clear about unauthorized work though. Maybe someone with similar experience can share here.

Since your wife was inspected at entry and she married a USC (you), her overstay will be forgiven.

You should submit the I-864 (affidavit of support) and I-693 (medical exam) together with the forms that you already have. Suggest you file for the EAD also since it's already part of the fee, just in case the green card is delayed.

She should have gotten an I-551 stamp in her passport when she was processed at the POE. With that stamp your wife can go get her SSN, get a DL and work. No need to wait for the actual green card to arrive.

The visa was approved 3yrs and almost 4 months after your marriage. Your husband should definitely have gotten an IR1 when he entered. Does he have his physical green card already? If not, then perhaps you can make an INFOPASS and ask the USCIS records to be corrected to show that he is an IR1 and not a CR1.

He will not need to leave the US when his H2B visa expires. He should not leave the country if his H2B visa expires and he does not have an approved AP in hand yet.

Pushbrk, my husband was adopted by his (then) stepfather. When hubby's adoption was completed, the court arranged for a new birth certificate to be issued for my husband and it showed his stepfather as his father. That is part of the biographical data associated with birth and they are changed when an adoption is completed.

When my son's adoption process is completed, I would like it to be reflected in his birth records. Since my son was born in the Philippines we, obviously, need to submit the adoption documents to the government office in the Philippines that manages such records. We want these changes to be reflected in the Philippines so that my son will be able to maintain dual citizenship if he wants to without any problems.

Hi everyone...I'm just trying to get a clearer understanding of this process, as this is the one that I plan to do w/ my husband. Now, please bear with me as I have a couple of questions!

1. Once the petition for the I-130 is approved, it then moves forward to the NVC? Right?
2. Once it's at the NVC, I know there's a ton of other paperwork to collect, but are there any other approvals necessary, or is the case simply complete when all of the forms and fees have been collected?
3. Once the case is completed at the NVC, do THEY assign an interview date? If so, is it a date that they pick, or is it a date given to them by the Embassy of your spouses country?

Those are my main questions at this point...I probably will have tons more, but I'm just trying to sort the whole process out. And does it seem like there's a 5 month waiting period between the filing of the petition and case completion at NVC?

Did they generate the bill FIRST before you tried to pay it? If they hadn't generated the bill yet, it's too early to pay...you can't jump that far ahead of the actual issue date...now if they DID generate the bill already, then I think you should definitely contact NVC to find out what's going on. Hey Mohan...I'm in the same boat as you seems like. My case was transferred to CSC back on the 15th. I hadn't heard anything again, until I finally got a touch on 3/2, but still nothing further (btw, I was never notified of the "touch" via e-mail even though I'm signed up for e-mail notification...I just happened to check the website & there it was). I tried calling too but got the "6 month processing" bit as well. I don't know what else to do but wait. I'm here 4 support if ya need me! rose.gif

My case was transferred to CSC 2 days after yours, arrived on the 20th, and was touched on the 21st. But I haven't heard anything since then. So the NVC just accepted my payment for AOS and I am beginning to assemble the packet. My question is, which one of the forms (I-864 or I-864EZ) would be better to complete. I'm only filing for my husband, and of course my salary from my job exceeds the 125% poverty guidelines. Wouldn't I be better off just doing the EZ form? Seems like less of a hassle. Anybody had any problems with any one of the forms versus the other? Thanks for your help! good.gif

I overlooked the fact that he will need to sign part I of the 230 form, so tonight I will be scanning it in the system and e-mailing it to him, so he can sign it and send it back to me overnight. One of the shortcuts (ling) don't tell you that 2 passport photo's are needed for this process, make sure you have enough passport photos on hand too.


When I was down there a few weeks ago I had him take 6 passport photos and I brought back 4...I also had him sign 3 copies of the DS 230 Pt 1 as well...he's going to pick up his police certificate tomorrow (they never called to let him know it was ready), and I will send him the money to have it sent over here via FEDEX or DHL...I just don't trust the JA mail system with something so important...

Does this bill need to be paid before I receive the IV documents? Also, can I pay the IV bill without having sent in the documents for the AOS? Will they accept the payment, or do I have to wait and send in the AOS package first?
