WOW! Thanks for all the advice! She does understand more English than she lets on, definitely more than she will speak. Her mother will tell me something that her daughter had done and her daughter will correct her in Russian, but she definitely understood what her mother said in English...lol Her mother does teach her English, and her daughter will often say things to her in English if she doesn't want others to overhear. But right now her daughter seems more interested in learning phrases that she can say to me, like "how do you do?", "how was your day?", etc. She seems to understand my replies as long as I keep them simple.

I have bought her a number of English books, like the (ugh) ####### and Jane books, a dictionary with pix especially for young children, a number of workbooks and puzzle books for children, all in English. She devours them! So perhaps she is picking up more than she lets on and when she feels confident enough she will suddenly start speaking English.

So I will give my fiancee all this info, and we will decide what we want to do. A tutor definitely, and sink or swim, a.k.a. Immersion, is probably the way we will go. It also depends on how late or early in the school year they arrive here. Anyway, again, thanks for all the info, I greatly appreciate it! :thumbs:

My fiancee has a 6 year old daughter, and I'm guessing that once we get their visa they will be arriving here during the school year. Do we throw her daughter to the wolves and enroll her right away in school, or wait until the following year and enroll her then? Her daughter speaks very little English, mainly just common phrases such as "hello" "how do you do", etc. We are looking for an English tutor there in Russia and if we can find one, well, this question may be moot...lol But what if we can't find one??

Does anyone have experience with this? Do we give her time to improve her English before she is enrolled in school? Or enroll her immediately and let her sink or swim? She is a very bright child, sometimes too bright for her own good...lol I learned German, as an adult, by the sink or swim method and it's not fun at all. I would hate for her to be damaged somehow by being suddenly immersed in a completely alien culture with people speaking to you in a foreign language. I do know that children pick up languages much faster and easier than adults, but I want this to be as easy and painfree as possible for her. She has such a sunny, sweet, outgoing personality that I would hate to see anything happen that would change that.

Mine took 69 days with no RFE's, My NOA-1 date was March 3, and NOA-2 was May 8. This is through the CSC. But I was lucky and just slipped under the IMBRA b.s., so it probably will take a little longer than it used to. Hmm, hopefully not, but when has the government ever changed the way they did something and actually made it faster and more efficient?

When I read your first post, I was thinking congressman. And you are on the right track here.

My best friend had a similar experience with the Vietnamese consulate. He immediately called his Congressman, a few months later his wife was on a plane bound for her new home.
It can be reversed.

Don't give up.

Good morning to my VJ family.

I had so much wished for Friday approvals for the folks that are faithfully, vigilantly waiting!

It has been 4 months now since i have seen my wife. Tomorrow afternoon God willing I will be somewhere over the arctic on a 777 headed for China to see my wife and celebrate Chinese New Year with her.

As I write this there is a note of bittersweet knowing that others will not be with their loved ones.:(.

I have been close to being a pest to one of my senators' and my congressman's immigration people for weeks now. They grew to recognize my voice!
Also I called USCIS customer service every day or two, I politely gave them (tier 2 if possible) as much grief as I was experiencing. I felt that this was a fair trade.:rofl:.

My hair is now standing on end!!!!!!!
As I was writing the last post a few minutes ago my text alert went off !!!
So I went to my account to check and:

"On January 14, 2011, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."

I most sincerely hope and pray that this means that approvals are forthcoming for all.

This is a sweet payoff for me as I have been busy emailing and calling Senators, Congress people, newspapers, TV, and other media about our plight for weeks now.
I may never know for sure if all of the prodding actually did anything one way or the other. I would like to believe that others actions have made an impact, I hope that mine did as well.

I must now call my wife!!!

Today I got a reply from my Senator's office concerning my I-130. They had placed an inquiry regarding my case.

This is the reply we received:

"The I-130 file has been forwarded to EXAMS for processing. Please allow 45-60 business days before a decision or other Notice of Action is rendered."

Any one care to guess what "EXAMS" means? I don't have a clue.

Mine is one of the cases that was transferred from CSC to TSC of course.
I called NCSC about the "EXAMS" mystery and got escalated from Tier 1 to Tier 2, both ladies were very nice.
Neither of them were able to shine any light on the "EXAMS" mystery.
Tier 2 officer advised that I must wait.:(.

Today I received an email notice that our I-130 (NOA1 7-7-2010) was being transferred from CSC to The Texas service center. I wonder how many others got the same type notice?
I hope this doesn't start the clock over!

I realize that others have waited far longer than us for their NOA2. Still the waiting is painful.

Hello to all.

I had my CR1/IR1 application sent on May, then recently in november I got the acceptance and I signed in for Electronic Processing to the NVC. I filed for DS260 online and sent all the AOS packets on November 18, I received confirmation email of receipt of that email, however they didn't get back to me after that, until December 22 with an RFE for the DS260 to correct the previous addresses I've lived since I was 16. However, nothing on the AOS Packets.

They were taking so long to get back to me, so I called them yesterday and they came to me with the news that they haven't received the AOS Packets, or the supporting documents for the DS260. I told them we sent them by email on november 18 and that we even got an automated response of email receipt. They simply told me to send them again. Does this happen often with Electronic Processing? I sent them again with through our 2 email accounts, but now I have to wait weeks more?

I sent them in PDF format, one being 9mb and the other 12mb and supporting documents being 13mb. Is there a file size limit for the Electronic Processing?

I also sent them an email on December 9 stating that I had sent all the information, but we did not receive any confirmation or further communication. I did not get a reply to that email either.

I am getting desperate now!! We have a 5 months old now baby, and we need income! I cannot work yet because of this ordeal!! and time is running!

Can I contact my wife's congressman to accelerate things a little bit? He was a neighbor and I think he can be reached easily.

9Mb and 12Mb files are quite large for any email server. I would recommend breaking them down in to smaller pieces (more individual emails) or compressing/scanning at lower resolution. 200 Dpi or less is usually quite adequate. I have found that 600K per page in black and white is usually adequate for PDF text. If color PDF is needed scan in lowest bit color 600k per page is usually adequate. examine the scan results before you scan of course. I hope this is helpful.

You are quite a ways away from becoming a US citizen. You will be come a permenant resident first. Since you did not have intentions to marry and stay in the US, you can adjust your status. Have your USC wife file the I-130, I-485, G-325, the supporting documents and decide whether you want to file for your employment and travel documents (follow the guides for adjustment of status).

I would file as soon as possible to avoid falling out of status from your tourist visa

I don't know how your friend's petition for her granchild was accepted in the first place. According to the USCIS website, a US Citizen can petiition for the following family members:

*Husband or wife
*Unmarried child under 21 years of age
*Unmarried son or daughter over 21
*Married son or daughter of any age
*Brother or sister, if the sponsor is at least 21 years old, or
*Parent, if the sponsor is at least 21 years old.

Nowhere is a grandchild mentioned. I think that the little girl will have to wait until her dad (your friend's son) becomes a LPR before her own petition will be processed. This time, it will be her dad who will be submitting the petition.

Technically, it will not be a conversion of a B1/B2 visa to an immigrant one. Your friend will be applying for a totally new and different benefit (whether AOS, K3, CR1/IR1).

Based on the facts:

- She's got a 12mth Tourist visa which was granted to her in Australia
- She's been here since Sept 2006


Ask your friend to check her I-94. Even if she was granted a tourist visa that's valid for 12 months, she was probably given only 90 days stay for this particular visit. It is very rare for immigration to grant 12 month visits at a time. So, there is a possibility that your friend has already overstayed. If she has overstayed, then she has to make her decision before her overstay goes over 180 days as she will then be subject to a 3-year bar.

- She plans to return to Australia twice this year for her sister's wedding and then xmas.


If your friend decides to apply for AOS here, which she can once she marries her fiance, she will have to wait until she gets her Advance Parole approved before she can leave the country. So she will need to make a determination whether she can get her AP in time for her sister's wedding. If she is short of time she might just consider going through the K3 or CR1/IR1 route. The down side is that she will have to wait until she gets her K3 or CR1 before she can come back to the US (unless she is able to get her B1/B2 visa renewed).

Once approved, there won't be any restrictions on his legal permanent resident (LPR) status. If he gets approval before your 2nd wedding anniversary, then his LPR status will be conditional. He will still enjoy all the rights and privileges of an LPR. The only difference would be, he will need to apply for removal of conditions before his 2-year green card expires.
