She really is a great person, I'm just not the one her heart is into.

I come to find out yesterday that she still has feelings for her ex-boyfriend. She thought that by me going over there, she would know if it was really love or not. It turns out that she sees me more like a very good friend. That's my queue.


I can't see how she can be a great person, when she obviously lead you on and used you to be able to validate whether she still had feelings for her ex or not. She at least should have, out of respect and consideration, mentioned this to you earlier or as soon as you met, instead of making you go there and out of your way for her.

Although she is to, in a way, be commended for being upfront with you by admitting how she felt to your face, the fact she kept this in the dark all along until then was cruel and selfish, imho. Why make you travel over there and even introduce you to her family, when she all along knew she still had feelings for her ex? It was when she realized you had developed true, real feelings and were serious about having a relationship with her, perhaps even considering marriage, that she dropped the bomb on you.

She played you.

Since no one knows for sure the reason(s) why the USCIS is asking the OP to resubmit certain documentation all over again, let's instead speculate. Could it be that it has conflicting, incorrect or missing info? Is it highly credible, or convincing enough? Does it meet certain criteria to perhaps even be considered?

How can the USCIS be the one to blame or at fault in this situation?

I just tried to make it a point that some immigrants who have ulterior motives purposely do things legally, regardless of which visa they had to come in.

Even K1, K3 and CR visas have been fraudulently used by some immigrants, just to be able to get here! How many cases such as these have we not seen right here on VJ before?

Just disagreeing here - two months isn't enough time for anyone to decide whether the're happy to live somewhere. if anything, the first few months are a happy dreamy vacation. that was merely the case for me when i moved to england for 1.5 years (on a student visa). of course, doing that isn't a viable option for everybody, but it was very much worth it.


Two months, not only to decide whether or not she could live here, but also to decide if they can live together or not.

Not enough time for neither, nor.

Well, it's time to do house work and I have chilled a lot. However, I would hope:

1. If they - CSC- do read this they learn from their errors and,

2. Digital dated photos are not any better evidence then dates printed on back

3. That a very neat package in 4 sections each thin and with a cover letter could be perused in 5 min and a reasonable person would say it is a real relationship would be acceptable.

They took the time to point out that my airline tickets only show day and month so it does not prove what year I was there even though they have acknowledge my passport stamp does show this- they say the two do not show anything!!!!!!

Your application is a priviledge, not a right. As such, you shouldn't be complaining.

In love? There's no love in this situation! None of her posts mention her husband, nor show any concern for his well-being. She only inquires about the different possible consequences if she gets caught!

I understand you are going by the advice of your lawyer. I am not going to say I disrespect you for considering it because well, it was advice from a lawyer and you are new to the process and are still figuring it all out. I too was originally going to just go and get married due to advice I recieved.
Your lawyer is wrong though. All I can say to you is DO NOT chance it just because it seems like the easy way out! Your lawyer is telling you to directly lie to the USCIS about your intentions to marry. The fact that marriage has already been mentioned right there shows that your intentions would be not to visit. Do the K1 route, not only will it be the right way, but you will sleep better at night. Better to wait 6 months then to have a 10 year to lifetime ban.


I just would like to see how blaming it on her atty., if she gets caught, is going to fly with the 'CIS Agency.

She knows it's fraud, she knows it's wrong and she knows it's risky. There's no way to justify her action by blaming on her atty's. advice.

I had a long consultation with him and he stated that lots of people get married on the spur of the moment, like folks who get married in Vegas, for example. That there is no way to prove I intended to marry when I "crossed to visit." He advised to play it off as if I didn't know it in the moment, but to actually get married while being over there (a change of plans type of thing).


If you don't feel comfortable with his advice, don't follow it.

Note: it will be an informal ceremony, not a huge wedding. I'm really concerned about what to do.

Either way, my question was in regards to what I was "ADVICED" and did not state this was my intent. I questioned about the fine so that I could address it with the attorney, along with all the other fraud related advice. As my initial question stated, I had concerns to begin with. Hi guys!

It has been over four months (NOA1: Jan 4th, 2006) since I submitted the I-129F application. I have called and e-mailed the CSC and they have told me that my case is undergoing security checks.

It is already May, my case is still at the CSC and I am supposed to get married in December. How is this going to work out? I am very stressed out, because I don't seem to know what they are doing. I e-mailed my senators, congressmen etc. last week, but I haven't heard anything from them.

What else can I do? Should I hire a lawyer? My case has been touched four times, but I don't know whether it is due to me sending them e-mails or what!

Please help, I am very scared that the wedding won't take place in time. Anyone else in my situation; why is it taking ages for my NOA2?

Why are you so desperate to obtain immigration benefits, when you're still 7 mos. away from the wedding? I'm pretty sure that if you told the 'CIS you'd be marrying in Dec., they already know your paperwork needs to be processed before then. But you continuously making phone calls and sending e-mails to senators, the USCIS and congressmen in order to get your case approved asap makes it look like you're only interested in obtaining immigration benefits and nothing more.

My boyfriend is Thai and we currently live in Thailand. We would like to travel to the US next year, get married, stay about a year and then come back again to live in Thailand. But applying for an AOS when his fiance visa runs out is expensive and a lot of work, since he might not even stay long enough to finish the process. Does anyone know of any other options for us? He definitely can't get a tourist (visitor's) visa, we already tried that once and got denied. I'd appreciate any ideas.


How convenient! Not make the US their permanent place of residence but live here for however long it takes to get the GC .

It's probably best and cheaper to buy a round trip ticket for your fiance to come here. I'm sure many of these relationships don't work out so well. If you buy a round trip, find out what the price is to change the date. You may need to be flexible.

I sure hope, though, that he is buying the ticket for some other reason.

However, the biggest thorn in our side has been the fact that I've had a long unfortunate drawn out divorce proceeding (talking years here) that will finally be over and done with by August. While I do want to be able to be with my fiance ASAP, I'm wondering if there are any huge pitfalls to filing the I-129F within a month or so once my proceedings become final. I also have 2 children, will that complicate matters or extend the timeline? (im the foreign fiancee, he's the USC)

I guess I'm just feeling a bit frustrated that by making one small mistake can prevent her from obtaining a B2. It doesn't seem fair.

I was quite knowledgable about the whole K1 process and have done everything else without flaw up until this. You can see my husband recieved his residency in less than 6 months from filing AOS. We recieved his K1 in about 100 days from filing...I can't believe I overlooked this question on the DS230.

I am essentially just trying to appeal their decision by somehow proving that showing intent to immigrate was a mistake...and feel that maybe a congressional rep. can help sway the opinion of the embassy. They seem to be on our side.

The only other option I can think of is just waiting until June when this thing expires and appeal at that point.

Yodrak...we didn't contractually hire the congress person to speak for us...we simply want them to use their power to help us get our message to the Embassy. Kingston Embassy has an extremely tough reputation. I have been trying for the past two days to get them on the phone to no avail...They haven't responded to our emails...

We sent a letter explaining the situation and apologizing for our mistake in confusing the issue. This letter was emailed to the embassy and my congressperson is simply going to follow up for us. The embassy told the mother of my husbands daughter that the b2 would have been approved but there is some pending documentation that needs to be "cleared". Cleared was his word choice...not mine.

My husband is going to continue to try to call...but this is a huge challenge. We both felt that having our congressperson make the connection for us that maybe the embassy would be more likely to readdress their decision. maybe I'm being naive to the situation...but we have to try.

I will give a brief synopsis of what has happened.

ON my then fiances DS230 we stated that he had a daugther. When it asked if she would be immigrating with him now we said NO. When it asked if she would be immigrating at a later date we said YES. I was instructed that this was the best answer to give assuming that sometime in the future we may file an I-130 when she is old enough to decide that.

We went two days ago to the embassy to apply for a B2 visa for her and were rejected based on an existing petition already in her file showing that she is "intending to immigrate". The officer in Jamaica stated that we needed to "clear her name" off of the petition before he could process a B2.

I am trying to communicate through my congresspersons liason to the embassy. I am wondering if anyone knows how I can withdraw the mistake that I have made. I'm not sure if she's been approved for a K2...as nothing in my documentation ever has her name on it. No communication from USCIS or the NVC ever states her name. I am now wondering if they entered her name into the system based on the DS230 and are just trying to give us the run around...

I know this is monotonous and confusing...but if you have some insight I would love to hear it. I'm sending out my letter at noon today. I want to get the ball rolling as fast as possible before everything goes into the great abyss.

At least they are setting goals which is indeed encouraging good.gif . It really is a scandal that some processing times have been as long as they have. Peoples lives are on hold and family's have suffered not only separation but financially as well. I am really encouraged that the US immigration service is making strides to cut down on the processing times.

Perhaps along the way the paperwork and fees could be more streamlined as well. Not only can it be daunting to the uninformed but also thwart with the potential for an RFE. Visa Journey has indeed been extremely informative, with the vast array of individuals experience and those very experienced in the process who advise us, long may it continue.

You can use your trip itineries can also prove as evidence of trips there to see your wife....I also sent e-mails and chat records and phone records from start to current at USCIS, not sure if they were needed. I also sent a police report since I already had it here. I sent photographs of wedding and with family members and i sent copy of his and my birth certificate.....We received an RFE from USCIS, they requested our ARABIC copy of marriage certificate after sending only the English translation.....passport stamps, insurance cards like BC/BS....if she is on bank accounts or beneficiary of 401K or life insurance policies since you are already married....I also had a copy of his identity card and sent it since it was in my pocession already...letters from her or copies of letter you have mailed her or receipts of mails...receipts of money grams, western unions, etc......... maybe someone can add more to the list.

This may be a dumb question, but why is there such a huge difference in wait times between VSC and CSC? Is it the sheer volume of applications and such that the CSC gets. Is it the difference in the work ethic of the East and West coast? "Dude, surfs up!" And it's just going to get far, far worse if they enact this guest worker/amnesty program that D.C. thinks is the greatest thing since interns started working at the Capital and the WH...lol

WOW! Thanks for all the advice! She does understand more English than she lets on, definitely more than she will speak. Her mother will tell me something that her daughter had done and her daughter will correct her in Russian, but she definitely understood what her mother said in English...lol Her mother does teach her English, and her daughter will often say things to her in English if she doesn't want others to overhear. But right now her daughter seems more interested in learning phrases that she can say to me, like "how do you do?", "how was your day?", etc. She seems to understand my replies as long as I keep them simple.

I have bought her a number of English books, like the (ugh) ####### and Jane books, a dictionary with pix especially for young children, a number of workbooks and puzzle books for children, all in English. She devours them! So perhaps she is picking up more than she lets on and when she feels confident enough she will suddenly start speaking English.

So I will give my fiancee all this info, and we will decide what we want to do. A tutor definitely, and sink or swim, a.k.a. Immersion, is probably the way we will go. It also depends on how late or early in the school year they arrive here. Anyway, again, thanks for all the info, I greatly appreciate it! :thumbs:
