K-1 Fiance(e) Visa Process & ProceduresRussia Processing times
My NOA 1 date was Mar 3, 2006, NOA 2 date of May 8, 2006, and my fiancee's interview date is August 14th, 2006. This is all out of the CSC and since it was pre-IMBRA I'm sure it will take a little longer for you. But it went faster than I thought it would, at least in my case. Good luck and hang in there, it will be worth it!!

K-1 Fiance(e) Visa Process & ProceduresAm I the only K-1 with Russian Fiance?
There are a few of us, I couldn't tell you how many. I think the Embassy in Moscow does around 20 interviews a day, but perhaps only 4 or 5, at the most, are for K-1 visas. My fiancee has her interview on the 14th of August, so hang in there it will happen for you too. Good luck, and follow the advice that you find on this site and you shouldn't go wrong. Ask questions if you aren't sure about something, as the smart old cliche says "the only dumb question is the one you don't ask". :D

K-1 Fiance(e) Visa Process & ProceduresFinally got the visa!
Yup, yup, yup! We finally got the visa! My fiancee had her visa interview on August 14 at the Moscow Embassy, all went well, but they wanted a letter from her exhusband giving his permission for my fiancee to bring her daughter with her. After days of negotiation he finally agreed to give his permission, all he wanted in return was a chance to see his daughter and spend time with her. Why he waited 5 years to see his daughter is quite the mystery, but my fiancee agreed and her whole family went along as a sort of mass chaperone. Her daughter, 7 years old, didn't want much to do with this stranger, but the visit went off without a hitch.

So, my fiancee mailed off the letter to the Embassy, and the day they received it she called them and was told to call back in 3-4 days for their answer. She called 4 days later and they told her to call the next day, she called and was told to call later in the day. Anyway, this ####### went on for weeks, and finally something told me to check the DHL website and run the tracking number the Embassy had given her on the day of her interview. To my surprise the website showed that the packet had left the Embassy the day before at 2:20pm, she had last talked to them at around 6pm that same day and they again told her there was no update, this was after DHL had already picked up her packet. Do they use computers at the Embassy???

Anyway, she called the local DHL office and they told her the packet was already on the truck for delivery. It was delivered around 5:30pm and the visa was in the passport! So much for the Embassy keeping us, and themselves, updated. So, now all they have to do is get on the plane, Oct 6, and go through the POE stuff and then we will finally be together!!

K-1 Fiance(e) Visa Process & Proceduresfilling out the i-129
is it ok to print by hand in blue or black ink? or, should it really be typed? in regards to question 18. should i just tell them of how we met for the first time in person this past september? or , do they want to know the whole story about how we met online in january? does it all go together in an attachment? also, when i was in moscow, ilyana signed and dated her g-325a and letter of intent. so, the dates on some of our papers will differ from about a month. is that ok? the photo i have for her g-325a, will they want some kind of proof that it was taken less than 30 days from filing? i'm not cut out for this kind of work. i appreciate any help

K-1 Fiance(e) Visa Process & ProceduresI'm confused
Hi all! I am wondering if you can help me clear up some of my confusion. As you can tell by my sig, I received my NOA from the CSC on Oct 30. saying that my I-129F petition has been approved and sent to the NVC.

I was under the impression that the NVC does the background check (FBI Name Check) on me. Is this true? If so, what processing does the CIS/CSC do? Should I take the fact that CIS got done with my petition in only 2 months as a good sign that the NVC will be quick about processing my petition?

I am a very private person and don't like the idea of anyone digging into my personal history and will be VERY glad when it is done.

K-1 Fiance(e) Visa Process & ProceduresBiometric Test

Thanks so much to everyone who responded. I am so glad that I find this site.

I have 2 biometric interviews one on 1 March and the other on 6th March - can I ring them an ask them to allow me to have 1 interview instead of two. What happens after that? What happens at the next stage - is it the final interview and what do I need to bring - thanks again

When you go to your first biometrics appointment on March 1, bring all your NOAs and the appointment letter for the March 6th appointment. Ask them if they can do both at the same time so you won't have to return for the second appointment.

K-1 Fiance(e) Visa Process & ProceduresBiometric Test
Biometrics is not a test nor an interview. It's a process where they get your physical description (height, weight, color of eyes, color of hair, etc), fingerprints, digital picture and digital signature.

It is painless and usually quick. Don't worry about it. Just bring your I-485 and I-765 NOAs, the appointment letters, photo ID and marriage certificate.

K-1 Fiance(e) Visa Process & ProceduresPrior k1 petitioner
Billy,

The lawyer you talked to is wrong. The I-864 Factsheet on the USCIS website says ....

13. When does a sponsor's obligation to support sponsored aliens end?

The sponsorship obligation continues until the sponsored alien naturalizes, has worked or can be credited with 40 quarters of work, leaves the United States permanently, or dies. However, a sponsor or the sponsor's estate remains liable for any support or requests for repayment of benefits that arose before the support obligation ended.

14. Does divorce nullify the sponsorship agreement?

No, divorce does not nullify the sponsorship agreement.

So, as already mentioned by Yodrak, you will need to consider your ex-wife when you count your 'household' size to determine your income requirement.

Good luck on your new K-1 petition!

I see that Ty beat me to the draw :)

K-1 Fiance(e) Visa Process & Procedurestravel post marriage

I won't have my green card until after 2 years of marriage, though, will I? Also, we are planning on keeping his house here until he returns (and the AF moves him to his next base in the US next spring)...so maybe that would be enough proof of permanent residency? I feel like a prisoner here!!!

Have you sent in your AOS application? Processing times keep changing so it probably will not take 2 years before you get your green card. In order for you to travel overseas and still be able to re-enter the US, you need a green card or an Advance Parole document. I think that the AP only allows for short periods of travel. Hope someone corrects me if I'm wrong.

Thanks for your help. Sorry, I thought this was for K1 fiance visa- related questions. I'll switch to another forum. I guess, provided your information is correct, that I will teach for 6 months instead of 12. With any luck my fiance will get posted in a country that I can travel with him to for the year... or, better yet, he won't have to go at all! Thanks again.

Just don't leave the country before you get your GC or you have an AP document.

K-1 Fiance(e) Visa Process & Procedurestravel post marriage
Once you have your green card (whether conditional or 10-year), you will need to maintain residence in the US in order to keep your status as LPR. You have to be able to show proof that you are still maintaining your primary residence in the US. This is kind of a delicate situation as the interpretation of how "abandonment of residence" is dependent on how USCIS perceives your situation.

K-1 Fiance(e) Visa Process & ProceduresThey kept my fiancees packet!!!
Neal,

A tip for when you do your AOS. Submit only copies and keep the originals. USCIS will not return any original documents that you submit. You will bring these originals to the AOS interview in case the interviewing officer wants to see them.

K-1 Fiance(e) Visa Process & ProceduresNeed Help
Larry,

If your fiancee can only stay for 3 weeks, then there won't be enough time for her to file for AOS/EAD/AP and receive her AP. If she really has to leave after you get married, then you either apply for a K3 or CR1/IR1 so that she can re-enter. This could take months.

Wouldn't it be better to postpone her entry to the US until she has finally tied up any loose ends?

K-1 Fiance(e) Visa Process & ProceduresWhen can we get married?
Yeah, talk to a live person about SSN requirements for marriage licenses. The county we are in also required SSN but we could submit an affidavit stating we do not have one in lieu of the SSN.

K-1 Fiance(e) Visa Process & ProceduresAuthorisation to Work

I was wondering about that... Does anyone know, if you look online and see that your EAD is approved, can you start working or do you need to wait until they actually send it to you? I hear that every once in awhile, where someone was approved and never knew it because they screwed up!

When you get hired, the employer usually asks for a copy of your SS card. If your SS card has the "work with USCIS authorization only" notation, then the employer is supposed to ask for such proof (either an EAD, GC or some other form of authorization).

So, technically, you are supposed to wait until you actually get your EAD before you can work as you will need to present it to your employer. An online status indicating an approved EAD is, unfortunately, not on the list of acceptable proof of authorization to work.

K-1 Fiance(e) Visa Process & ProceduresFiancee's child learning English. The best way?
It's so true about young children being able to absorb new languages so quickly.

I recall years ago when my son was just 4, we moved to another island in the Philippines where the local dialect was different from what my son grew up with. After a few days of getting settled in, I finally allowed him to go out and play with our next door neighbors. At the end of the day, when my son came back, he was already speaking phrases of a new dialect!

So, don't worry too much about the child learning the language. Interaction with other kids and kids tv shows (like Sesame Street) will greatly help her to learn the language.

IR-1 / CR-1 Spouse Visa Process & ProceduresUSPS...Notice left?
Commensensical...are u trying to be funny?....as many people on here have had petitions approved on the weekend I believed that maybe they were open on Sat. (at least for a few hours). I know not on Sundays. There are many gov't businesses open on Saturday, so really is it that farfetched of an idea? Don't think you have to be so sarcastic the next time. Thanks.

Hi guys...I shipped my AOS package to NH on 7/23. It was delivered to the address on 7/25 (today!) at 9:35 am. When I checked the tracking online it said that a "notice was left". IR-1 / CR-1 Spouse Visa Process & ProceduresGeneral idea of how long it will take
QUOTE (887643 @ Aug 6 2009, 08:22 PM) <{POST_SNAPBACK}>
Hi everyone. I am new here, and was wondering if anyone could give me a general idea how long it will be from the time I file I-130 until my husband can come to the states. He is in Jamaica, has no criminal record, and has never been to the US. If I'm reading the timeline right, it will take around a year? Thanks

Hi there! On average it'll take about a year, but usually less. You can venture over to the Yardie forum and check out the Yardie Interview Schedule spreadsheets, and check out the timelines for those of us who filed CR-1's...you'll probably notice that those that took a likkle longer got caught up in the huge slow down in processing last year, but things seem to be back on track for the most part. If you have any questions regarding the process don't hesitate to come on over and ask, or if you just want to jump in the Yard chat then feel free! There are some really great folks in the forum! Good luck on your journey! Let me know if I can help in any way good.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresDid I make a mistake?
So I just looked on the US Postal Service website to see if my DS230 had been delivered, and it is showing that it has not been delivered eventhough it was supposed to have been delivered by 11:00 am today. mad.gif This might have been a blessing in disguise! So, I just went online and paid the IV Bill so hopefully that will process in the next day or 2, around the same time they enter the DS 230 into the system. I'll keep my fingers crossed! wacko.gif

You know what...there was a barcoded sheet that came w/ the false RFE that they said to include with the DS 230 package. This is what it basically looks like:

National Visa Center
ATTN. DR
31 Rochester Avenue, Ste 100
Portsmouth, NH 03801

(barcode)

(Checklist Letter Response)

CRI
(Beneficiary's name)

Do you think that this will suffice? I hope so unsure.gif

Hi guys...well I've paid my AOS fee and returned the AOS package. I got a false RFE (I think that's what you call it) because I hadn't sent in the DS 230 or paid that fee. Well, today I sent in the DS 230 package, but I still haven't paid the IV bill yet. Is that gonna be a problem? I was going to pay it later this week...
