K-1 Fiance(e) Visa Process & ProceduresWhat time of day does USCIS update case status?
It's a lovely thought that the USCIS folks never sleep. :P But maybe it's like my online banking....they actually do the work during business hours and it just takes the computer til midnight to actually show the changes. Maybe it's their server.

K-1 Fiance(e) Visa Process & ProceduresWhat time of day does USCIS update case status?
Well, i was just wondering if anyone has noticed a specific time of day the USCIS updates the case status page? I thought if i could avoid checking it every 30 mins during the day that would be a little less stressful, if that's possible.

K-1 Fiance(e) Visa Process & ProceduresCan Fiance Visit On Tourist Visa While Waiting For K-1?
Just to let everyone know, my fiance` and I flew into Charlotte Douglas International in NC this past tuesday. I went through the international customs line with him so they questioned him while i was standing there. They asked how long he was gonna be staying (3 months), how long he stayed the last time he was here ( 2 weeks) and who he would be staying with (his fiance`). They also asked what he did back hom, job wise. That was it. I was so relieved. Maybe it helped that i was standing there with him, i dunno. Good luck to anyone facing the same situation.

Thursday (the 29th) i'm going to see my fiance` in England and then on the 10th we're coming back here together so I'll be going through customs over there and he'll be going through customs here in NC. I'll let everybody know how it goes. I'm nervous about it already, mainly for him, i don't think i'll have a problem. Fingers crossed.

I have an AT&T prepaid calling card and I called customer service to request a print out of my calls....they told me I needed a subpeona for that. Too much trouble for me so I just left them out. I did send emails and postage receipts from where we'd mailed things to each other. Hope this helps.

we brought a bank statement of pete's and a letter from his boss saying he was to return to the UK and come back to work. it's also a good idea to have a copy of your NOA1 with you if you already have it, that way you can prove that you've started the process and are attempting to do it the legal way. hope this helps :star:

K-1 Fiance(e) Visa Process & ProceduresNOA-2 email!
I am trying to not be jealous since our NOA1 from California was a couple of weeks before yours.

However, on your comments, since my husband is from the UK we have been looking at the history of the Londond Embassy and I think you can be more optomistic concerning interview date. It seems to be fairly common for the Packet 3 sent by the London Embassy to arrive 3-4 weeks after approval (and rare to be more than 5 weeks) and when you respond to Packet 3, the Embassy figures out when your interview is (from what I can figure out). However, after rsponding to Packet 3, the time people wait for an interview does seem to vary significant, For example, there are 7 people on visajourney indicating an interview in London in January and after responding to Packet 3 they waited anywhere from 3 to 12 weeks for an interview. So I think if you respond promptly to Packet 3 the beginning of May is the absolutely latest for the interview but could be earlier. (You can use the timeline search function to search for this type of information ... it is very helpful.)

K-1 Fiance(e) Visa Process & ProceduresOctober and waiting...
We got our NOA1 October 13 for a K-3 and we are still waiting ... not very patiently. We were touched in November but that was probably because our address in the UK changed. If you search timelines there are still plenty of Octobers unapproved even though Novembers are getting approved ... don't understand how they can process apllications so randomly. My husband is arriving next Wednesday for a 10 day visit. It is what keeps me from total melt down.

K-1 Fiance(e) Visa Process & ProceduresAny success filing K-1 Independently?
My husband just completed his interview at the London Embassy. I-130 was filed on Sept. 1, 2006 and visa was delivered on April 21, 2007 so it took us almost 8 months. We are a K-3 not a K-1 but the process is fairly similar. Since every embassy has its own quirks look at the UK forum for lots of info about interviewing in London. I think it takes about 40 days to get your police report in the UK and it is good for 1 year. My husband got the form by going to the local police station ... don't know if you can get it mailed to you in the US. The medical is done in London and can be scheduled after you get your Packet 3. Packet 3 is usually mailed to a UK address so I don't know what happens if you are not in the UK. Unfortunately, you have no control over most of the process ... USCIS, the NVC and the Embassy have most of the control. However, one step you control is when you receive your Packet 3 you will have forms & a checklist to send back ... the sooner you send it back the sooner you are interviewed. Start preparing for the return of Packet 3 before you receive Packet 3 ... my husband returned it the same day he received it.

K-1 Fiance(e) Visa Process & ProceduresCalling all UK'rs--interview question
They did not ask us for any tax returns. The only item they asked for with the I-134 was my employment letter ... but my compensation is significantly above poverty level so that may be why they asked for nothing else. I would definitely have the most recent tax return but more might not be necessary. We had 3 years of tax returns with us ... just in case.

The original packet should include both the petitioner and beneficiary's letter of intent (see example here). If you did not include this in your original application, you will have to wait for a (possible but likely) RFE.
An RFE may delay your application, but they generally don't have a significant impact on your processing time.

Good luck,
Caro

Right but you can forget April. The process takes longer than that.

Can i just possibly write a Letter of Intent, print it, affix signature and scan it and send it to my fiancee via email????....also what date do i have to put? the date we sent our application or the recent date?...thnx....

The instructions call for signed orignal letters. I expect you have plenty of time to mail yours.

K-1 Fiance(e) Visa Process & ProceduresCONFUSED and WORRIED...pls help...thnx
Hi everyone.....

I have been an avid visitor of this site and got myself registered recently as i find the forum and members here very helpful...As i am doing a head-draining research all the time as much as i could about matters concerning K1, i have read on one site a personal write-up of their experience on dealing with the K1 process....and my question is:

1. Letter of Intent to Marry
my fiancee just wrote a letter of our request asking them for their assistance in helping us process our papers and just wrote BOTH our names under it...with NO signatures from BOTH of us. My fiancee called the USCIS if its possible for us to send the Letter of Intent (individual with signature) and put them on our file since our file is still on que just to save time for possible delay but told us its NOT possible and just wait for NOTICE via mail. Is this just okey or Will these cause a possible RFE?...and so how long does it normally take?

We are very much concern of a time frame because as of the moment am here in Germany on a student visa and my visa expires in April..and CANT afford any delay.... blush.gif

Can any of you guys here give us a helpful advice of the issue just to relieve our worries abit?

thank you soo much....

Age only matters if there is a HUGE gap.

Hey guys,
I wonder if it makes a different if Sam and I are only 20 years old? I'm sure most people apply for visa they are already done with school and got a good job!

Well originally me and my fiancee met on cherry blossoms.com. At first i wasnt really sure that if it was a marriage broker or not being that they had there own chat room. I paid a fee for a membership she did not. They advised us not to give out any personal info. Well we did not use that website long and went to yahoo messenger. Well we stated this under the advise of my lawyer which just to comply with Imbra i sent her my criminal back ground and also had it stated in the intent to marry that she has seen it and understood it, because we were not sure that cherryblossoms complied or not . Now cherry blossoms is one of the biggest sites like that out there and they are credited. So im wondering since she has my criminal record and it has been stated in the intent to marry will I have any delays because of that.?My lawyer said that it shouldnt. He said that it is better to be completely honest how we met even though we did not use the site for long at all.

K-1 Fiance(e) Visa Process & ProceduresK1 costs ??
In short..... It's expensive.

My fiancee is in the Philippines. Between government fees, plane tickets, legal advice, monthly support, sending her to the other side of the country twice for her medical exam and interview, I've easily spent $10,000 so far. And she's not even here yet. I'll need to spend another almost $2000 for her plane ticket here.

Once she arrives, there the adjustment of status from visa to perminant resident, SSN, drivers license, marriage, significantly increased insurance (auto, health, dental... maternity coverage alone will be $700 a month).

Granted, some of these expences would exist whether my bride is domestic or "imported" laughing.gif but you still need to factor them in. If we get the maternity coverage, my insurance costs alone will increase by more than $1000 a month, but that would also be true if I married a local woman.

I've seen others say to send in copies of all pages of the passport too. I just provided copies of the photo page and the entry departure page showing the visit. USCIS never mentioned the lack of the rest of the pages. The NVC never mentioned it. Our embassy interview is in just under two weeks. I'm confident the embassy won't mention it either.

If you are using passport instead of birth certificate to prove the petitioner is a USC, the instructions for the I129F specifically say to include copies of all pages, I think even including the cover. For entry stamps to prove you have met, they only ask for the ID page and the relevant entry stamps. We also did what you did.

Songbird, thank you very much for the clarifcation. I didn't realize that.

That's what I would send. Just to clarify, it has to be the "long form." That's the one that lists whatever information about your parents the county you were born in deems relevant (mine even had the name of the OB who delivered me!). I'm sure photocopies of your passport would be fine instead, but they want ALL the pages--which just adds to the bulk of your package unnecessarily.

I believe that providing copies of all pages is much more important for the adjustment of status once she gets here than it is for the K-1.

If you want to be absolutely sure, it certainly doesn't hurt to provide copies of all pages.

K-1 Fiance(e) Visa Process & ProceduresBirth certificate VS Passport copies
A copy of a certified birth certificate will be fine to show citizenship for the I-129F, but you're also going to need to include a copy of your passport photo page and entry/departure page to document that you made a trip to her country and that you've actually met in person. You are going to need both.

They don't need or want to see 250 emails or IM's. They want to see evidence of continued communication. Printing out two or three emails a month should be plenty. I did like the suggestion from earlier about also printing a LIST of all the emails and IM's. Include copies of phone records. If you've been sending money on a regular basis, include copies of the western union receipts. Copies of cards you may have sent her for her birthday, valentines, aniversary, christmas and so on. Photos of the two of you together. Anything you can think of that will establish an ongoing relationship. You don't need 250 emails or IM's to do that, just a sampling.

Good luck.

Wouldn't money transfers make them curious or cautious about the whole "mail order bride" or "green card scam" scenarios? Would depend on the amounts, I guess...

Most fraud cases result in the USC being defrauded so, sending money abroad usually isn't a positive piece of evidence. Even when positive, there is usually far more compelling evidence than money transfers.

I am using a paid service to guide us through the K-1 process. I have been replying on their advice throughout this ridiculous maze we all have to go through. This service helps about 2000 couples per year get their visas. They've been doing this for 20 years and I trust their advice. The vast majority of their clients have Philippine fiancees or spouses and my fiancee is Filipina.

The advice that they gave me was to include the western union receipts. We are not at all short of other evidence. This is just one more piece to establish an ongoing relationship.

Just a quick question, my mother is a registered notarizer. Would the consulate look at it strangely if she was the one who notarized my Affidavit of Support? Thanks in advance!

I don't know what the notary law says about notarizing for immediate realtives. I know that if I was a notary I could not notarize anything for myself or my wife. I don't know if that extends to parents, children or siblings. A cousin, aunt or so on would be fine.

If you mother is a notary, she is required to have a current notary handbook. The answer would be in that book.

Hey all. My girlfriend, soon to be fiancee, and I are just beginning the Visa journey. She is Canadian, works in the home health care field, and will likely be getting laid off at the end of February 2008. She could potentially find another job in Canada after February, but it sure seems as though this would be a great time to have her move to the States. We have known each other for 3+ years, been dating for over a year, and I will ask for her hand in marriage (again, this time with a ring!) here very soon (meeting the folks in a few weeks! She still doesn't know exactly when!). She will be going to school here in the States (if all goes well) upon entry, as a LPN (nurse) or nurse's aide (initially). We are confused as to the best options for Visa application, K-1 fiance, K-3 marriage, or possibly even educational visa. We obviously want to be completely up front about the situation and how to best work through the Visa process. Any comments or suggestions as to the best course? In actuality, we are already engaged, I'm a bit old fashioned and will ask her again with a ring (money's been tight until recently). We are planning to get married, though no date set as of yet, in the early Spring to mid Summer of 2008. Any guidance would be most appreciated!

My advice is to go the K-1 route. It is much faster than the CR-1 or K-3 process. I filed for my husband last November, and we are still awaiting an interview. At any rate, good luck!

Thanks a bunch; we have read the first link (alot!), the second one has more information we are unfamiliar with. Great stuff, thanks. I figured the timeline was a bit "happy"... Thanks for the information; that is exactly what we don't want to do! Do you have any suggestions as to where to start with the USCIS.gov site? We've both looked and are a bit confused as to the timing. We will be "officially" engaged in October, and are planning to marry approximately 6 months later (will be dependent upon getting her parents and other family down here). Thanks for your reply!

Oh, and throw your timeline expectations out the window. Because the visa will dictate when she's here...6 mos is not a lot of time at all, visa wise.

thill67: Small world indeed...! She works for the group out of Victoria, Juan de Fuca. Two of the firms are shutting down due to the lack of increase in $$$ from VIHA. If I'm not mistaken, the one in Surrey is remaining solvent. It looks like they are in negotiation, the Union and VIHA; we'll see what happens...

I worked in the home health care field in B.C. before I left Canada. Where does your fiance currently work? I worked for Fraser Health Authority in Surrey, B.C. I'm just curious if perhaps I may have known her.

K-1 Fiance(e) Visa Process & ProceduresI am back
Joe,

Hope you will find the happiness you seek this time around. Wishing you the best of luck.

We went to Cebu for a vacation this summer. Three wonderful weeks of warm & funny moments with family, going to the beach(es) and pigging out on the food. I'm not sure if December would be a good time to go but if you get a chance, check out Sumilon Island. It's AWESOME!! It used to be a Marine Reserve and they are trying to maintain a balance between having a nice resort without spoiling the marine life. If your fiancee knows a local travel agent, she should talk to them as they sometimes have good packages available.
