My assets are several ISA's. I'm really confused as to why these would by considered unsuitable as they are easily convertable if need be. The divide by 3 rule means they don't make up the full amount, but added to her salary, they more than do.
The thing that puzzles me is that they didn't actually ask for more documents before they'll process (ie request for evidence), they simple state that what we have will be discussed at the interview. They merely suggest that it might be a good idea to find a co-sponsor. Makes me wonder if they don't understand the evidence that was sent?


Say her shortfall was $1000, your assets would have to make up three times that amount, ($3000) or for sake of argument five times that amount ($5000) in order to be considered. If they do not meet that requirement they wont even consider them and you will need a co sponsor. If she has a family member or friend that could co sponsor it shouldnt be too big of a set back, maybe two weeks for them to gather info and documentation!

Your assets as the intending immigrant can count under certain circumstances and ''must be equal to at least 3 times the difference between the poverty guidelines and the sponsors household income". They must be assets that can be 'converted into cash within one year and without hardship to the owner'. If your assets did not meet these requirements I would suggest getting a Co-Sponsor ASAP. It can be anyone residing in the US with a passport/greencard/valid US birth certificate and naturalization papers etc... Make sure they fill out their own I-864 or an I-864A if they reside with your spouse good.gif

Actually the immigrants assets must be equal to at least 5 times the difference. The USC's assets must equal 3 times.


I do believe its 3 times the difference for spouses of USC's as stated on the I-864 on the assets page.

Hi All

Finally got an interview date for IR-1 visa in London. I have filled via DCF.

We have filled in the A of S but now just questioning one thing. My wife who is the US citizen and also the petitioner is currently employed in the UK where we live. We have put down her current income on the A of S. However, she will be leaving that job when we move to the states so her income once we get to the US until we land jobs will be 0.

Because your wife IS employed I would suggest you mark the box for "employed" and state that it will not continue after you move to the states. On your wife's I-864 as some folks on this website have done, she could convert her salary from British pounds into US dollars and quote the exchange rate off to the side.
As I understand her father is going to co-sponsor but he is NOT a joint household member as you are filing DCF so he will need to fill out his own I-864 with his income and documentation.

How long ago did you submit the original I864? If it was before the 2008 tax return filing date they MAY ask to see a new one with that years tax return copies or transcripts. Although since you already called and they told you it wasnt necessary it might be better to be safe than sorry and take a copy or a new version. Just my opinion tho good.gif

As others have said depending on Toby's size/weight and the airline you use, he MIGHT be able to fly in the cabin in a kennel/carrier small enough to fit under the seat in front of you. Each airline should have on their website their pet policy. We are bringing our cat (under 10 pounds) from europe to the USA on Monday. We've gotten him the proper paperwork (a health certificate from the vet saying he's in good health) and will have to pay about $200 but its so worth it! If not some others have suggested there is also cargo if Toby isnt small enough for the cabin.They put the animal(s) in a pressurized and temperature controlled area under the plane for safe travels. I think if you search for a 'sky kennel' you should be able to find a list of available sizes and prices. Leaving a family member is never easy and animals are just as much a family member as any other! Hope this helps!

What incentive or reason would that Tier One staffer have to tell the customer "That some petitions are just easier than others". Who told him to say this? Is this one their canned answers? Just sounds fishy to me.


I can tell from the experience of dealing with loads of paperwork and documentation. "Some are just easier than others". My job is dealing with information and paperwork given to me by clients. Depending one a very cursory glance at how the paperwork is provided I can tell you that some are just easier than others. I can imagine that individuals looking at packets of K-1 information would do the same. For me, I don't really care at what date something is provided to me for the most part. If it is neat and to the point I can knock it out in no time. However, if I get a messy pile with more information to go over it gets stuck in a cabinet that I will work on on Sundays probably when I have more time and also no interruptions.

When I filed my K-1 packet I made it as neat and easy to understand as possible and I don't think it took too long for my wife to get her visa. My wife is now giving a friend some help with information on doing a K-1 and I have seen his paperwork...it looks like a lawnmower has gone over it. I don't even want to try to dig through his ####### to understand it and I can see a officer thinking the same thing.

Best thing to do is just call USCIS and explain this email to them to see if there is anything to it. @uscis.dhs.gov does appear to be a valid address used by USCIS/DHS or as best a quick Google search does show link with that to valid USCIS pages. If this is spam or a scam I can't see the point of it unless it is just to "punk" the recipient. Call to be safe.

Seems I have answered my own question. I just called the National Passport office and the lady stated that sometimes the passport and certificate are sent in separate mailings. I should give it about a week and if it isn't received by then to have the passport holder call back.

For those who applied for a passport did they make you give them the original citizenship certificate? When my wife applied for her passport that would not accept a photocopy and said she must give the original, and that they would return it with the passport. She just received her passport, but the certificate was not in the packet. Neither of us liked the idea of giving the original certificate....

I got an email from uscis that on June 26 ( today) I was placed in line for interview scheduling!!!:dance:
I had the funny feeling that this was going to happen this week. Sure enough, they didn't take too long!

By the way, had my Biometrics last week on 22nd (friday)!


Same here, I received and email on Monday referencing our being placed in line for an interview. We had our boimetrics appointment on Thursday 21st. I am guessing maybe a late August interview appointment. Not sure how busy the Raleigh-Durham office is, as for the biometrics appointment my wife was the only one there when we left. The appointment time was 3pm and she realized in the parking lot they forgot to provide her with the pamphlet study guide thingy...when she returned they had already locked the doors. They did open and give her the pamphlet.

@ ZeeBee: My PRC expires on 12/14/21
@Frali: I read the guide to naturalization again at the USCIS website and it did say there that I am eligible to apply if I've been a permanent resident for 3 years AND married to an USC for 3 years or more. Knowing that I came to the US via K1, I'm thinking that the USCIS doesn't recognize the conditional 2 years as continuous residence.

Anybody that came to the US via K1 and now applying for naturalization? I'm thinking of canceling my INFOPASS appointment. There's no sense of driving 1 1/2 hr to Philly for something that I'm not eligible for. As you can see down on my about me page, I came to the US on 2009 and married my husband the same year. I was granted PR status last year.


My wife and I utilized the K-1 visa. Our time line is pretty darn close to yours. Married 2/2009, AoS Greencard 7/2009, RoC Greencard 2/2012. You are actually a few months ahead of us on the 10 yr GC. We filed the N400 on 4/27 and received the NOA already. Might just be simple date miscalculation on their part.

You can always file an amended return to correct this, I wold talk with a CPA, not a tax preparer about this. A CPA understands much more about tax law, a preparer like you find at H&R Block only knows enough to fill out forms properly and tend to not know all the ins and outs of the tax code.


Could not agree more. If your tax return has anything more complicated than a single W-2, get professional tax assistance from a CPA, Enrolled Agent or a tax practitioner...stay away from the "Fast Food" preparers from H&R Block and Jackson Hewitt. If you are married then according to the Internal Revenue Code you have two options(except in very specific circumstances): Married Filing Jointly or Married Filing Separately

You were given erroneous advice from your tax preparer and you as the taxpayer are liable for the erroneous tax return not the preparer. Basically your preparer prepared a fraudulent return for you. Good luck with the amendment process.

Glad the IRS is going to require testing and continuing professional education for preparers now.

I have used a two-hole punch on the top of every paper I have ever submitted to USCIS. I use a top-tab pressboard classification folder for my submissions. All documents from the I-485 to the current I-751 have been in the same format.

We submitted affidavits with our I-751. I too wonder what weight these do hold for the official who reads them, but they have to be of some value if they are listed as a form of possible evidence. I did limit myself as to who I had write and affidavit for us. I wanted them to be professional with the ability to utilize professional letterhead and someone due to their position, considered an upstanding member of the community. I had my pastor who was also the pastor of our wedding here in the states a few years back, and also a member of law enforcement to write letters for us. Again, not sure what value they have, but I tried to make these affidavits as "conflict-of-interest" free as can be with something like this.

I have read about people using family members and even the spouse to submit affidavits...these to me do seem to be pointless and a waste.

I left that up to the person writing the affidavit, and not sure of the importance of the salutation. On one of mine they addressed it "Dear USCIS" and the other used "To Whom it May Concern" I provided them with the address and the basics of what I need and let them run with it.

That may be the case, I don't discount that. I'm just saying I didn't do this for ours. Perhaps they didn't need the affidavits as supporting evidence in our case and the approval wasn't based on them and disregarded whether notarized or not.


I think that goes back to the debate if they put much bearing at all on these affidavits whether notarized or not. If evidence is lacking those might be the last ditch effort before an RFE. After reading other situations I am beginning to feel I should have skipped sending affidavits as waiting on those added 3 weeks to getting my I-751 out. I am in disagreement here with many who state that an affidavit does not need to be notarized. The instructions for I-751 do call these affidavits and by my understanding of the definition of an affidavit is a "sworn statement of fact" witnessed by someone legally eligible to take oaths. I am not an attorney so my definition might be outdated, but to me an affidavit will require notarization. Notaries are fairly cheap and easy to find. So my recommendation is to be safe and get them notarized.

If I remember correctly we sent in nine photographs from various time frames. I used pictures that showed great differences in appearance and location (snow, beach, mountains, beard, no beard etc...) I just attached the pictures to a sheet of paper with double-sided tape. On the sheet of paper I typed the date, location, reason for being there and anyone who was in the picture with us. Also wrote the same information on the back of each photograph. Nothing too elaborate as far as the pictures go. We are still in processing of the ROC as we just finished the bio appointment.

I used this same format for the I-485 and AOS.
