Hi guys,

I was going to just copy and paste my fiancées email, but she said “MAI”. She told me to rewrite it and then post it.

First thing she said was that the visa website she uses posted that she will not need to get a queue number, but after waiting for a while she realized that she would need one of these. After they separated the tourist from the immigration individuals she went to window 5 to check the documentation. They said everything was ok with the documents. She was worried because the information I provided had two holes (on her site they said you can’t put holes in the documents) in the top of the sheets, but they told her not to worry about that as they are very neat, just worry about the police certificate.

They checked over the provided documents and she said just wrote my name on the DS156K and she was told to have a seat and wait. She began her waiting at around 7:55am and was the last person in the room when the officer called her for the interview at 12:15pm. She said the questions were pretty simple, and tomorrow she will give me those questions in detail.

Basically he told her to submit more information concerning the police certificate and that she can submit it on any Monday between 13:00 – 15:00. He returned all personal information back to her (emails, chat logs, cards, letters etc…). She said that the official/interviewer was nice to everyone, but seemed very tired. That was one thing I was worried about as some reports I had read is that they do not have such great people skills at the embassy.

Ohhhh, the nerves!!! My fiancee is going for her appointment in oh......about 45 minutes. I feel like Marlon Brando in Apocalypse Now "the horror, the horror". I called her to make sure she woke up early enough.... star_smile.gif

If I bit my nails, I would have no fingers now...LOL. Either way, I know we will not get the visa today due the fact she is waiting on a second police certificate, but I am worried how the official will react to missing such an important piece.

I hope they treat her with respect and that everything is smooth.

My fiancee will not reschedule the interview. Her friends from Thai visa websites have told her to go to the interview and she will just be asked for more information. I will continue to email the embassy just to let them know of the situation. I feel much better if the embassy knows of this situation before the interview date. The police told her that the police appointment card would work, but I think they just told her this to make her feel better. I guess that will only show that she applied for the report.

My worry is how the official will react to not having a very important piece of information. They do give you plenty of time to acquire the requested information.

That sucks. I'd give the mail lady a day or two more to find the letter. If not, then you'll have to decide which is better, calling/emailing the embassy and asking for the interview to be pushed back, or going to the interview and getting the equivalent of an RFE at the end of the interview.

Personally I'd ask the embassy for a delay. At least then you've got a solid date to work with instead of going into limbo.


I have emailed the embassy twice and keep getting an automated response that says the same thing. It seems you have put specific items in the subject line so it doesn't get booted to their version of spam blocker. Even putting what they request in the subject line I get the same response. I will keep trying...

What should be done if the police certificate will not be ready at the time of the interview? The police sent my fiancée her police certificate, but she never received it. The police told her that it was sent express and was signed for this past Monday, but the individual at her condo who receives the mail can not locate it. I have not spoken to her yet just had some offline messages on Yahoo concerning this. I am not sure if the police can expedite a new one or what the embassy will do. She has her interview on June 16th.

What mobile plans do you guys have in the US? International text messaging is adding about 100-150USD a month to my mobile bill with SprintPCS. The long distance is only .13 a minute (I think this is pretty damn cheap), but they charge .25 outgoing and .20 incoming international text. Most plans I look at do not have any international pricing plans. Any of you have international friendly plans with any other cell carriers?

A question concerning the documents that are taken to the embassy interview. I sent a complete copy of the I-129F packet the exact way that I filed it. The financial information I sent to my fiancée pretty much in the same format that I filed I-129F. They are in a tabbed file folder attached to the top of the folder via two-hole punched.

My fiancée read on her forum that the embassy will not accept papers with holes in them and she will have to remove them from the file folder. What type of experience do you guys have with the paperwork requirements? Are the holes going to be a problem?

Huge amounts of elation at the receipt of the NOA2 only to be followed my huge amounts of worry because finding out her family is totally against her moving to the US. I really do not know what to do. Unfortunately I don't have the good fortune of being able to stay or travel to Thailand for large amounts of time. I feel sad over the pressure and lack of support that she has and I can't be there to help her.

On February 24, 2008, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

...is this NOA2??? If so it came only 60 days from the NOA1, and seems 40 days faster than the average. Honestly I wasn't looking for this until April at the earliest.

Hi all,

I have been lurking around this forum for a time and decided to post my particulars with the fiancée visa process.

I have known my fiancée, Suchada for over two years now and we had our first meeting just a few months ago in November. As soon as I returned from Thailand we started to work on the I-129F and I mailed it the day after Christmas. So far I received the NOA1 on January 2nd, now from our readings it looks like months of waiting ahead of us.

I am very excited and happy that the application is in the system now.

This is a wonderful site, and the I-129F guide was such a great help in my preparations.

True, true. Dropping a personal exemption from your tax return would probably cause a balance due situation with the IRS. If this dependent was also a qualifier for the Earned Income Credit there could be a substantial balance due to the IRS (don't forget the state also...this could effect your respective state return). Like Jim said there is nothing wrong with amending a return to remove a dependent, but just be aware of the tax consequences of such an action. At a later date you could go back and amend the return a second time to then claim the dependent again. Then you must be aware of the statute of limitations to claim a refund.

This is all information concerning just the return and the taxing agencies...not information in anyway concerning filings with the USCIS.

This is a DCF case, so not a K visa. The visa will be IR1. In most K3 visa cases the couple live in different countries.

I'm trying to convey a principle here. Not only are the questions asked in the present tense but they expect the truth as answers. To qualify to file DCF you and your spouse would have the same current address abroad. Just tell the truth. It's making up lies that will cause you problems.

question about Part 3 of the I-864 form relating to Part 4B
Hello again,

I've got another question relating to Part 3 (Information on the Immigrant(s) You are Sponsoring) on the I-864 form. My question is about Part 3 where there is a box at the bottom of the page where it is asked that you "list any spouse and/or children immigrating with the immigrant named above in this Part."

First I'll give a little background info to help with why I'm asking about this. I'm a US citizen and my husband is Dutch and we reside now in the Netherlands. We're going through DCF so he can get a visa so we can move to the US. I am his sponsor and we also have a joint-sponsor who is my mom living in the US

On to my question, because we live in the Netherlands now, would my co-sponsor have put my name in the box in Part 3 as a spouse immigrating with my husband to the US??
Even though I'm a US citizen, I assumed technically I'm "immigrating" back to the US, with him. This section (Part 3) is integral to answering Part 4B Sponsor's Household Size so I thought I should ask first. But for our joint-sponsor, it seems I should be written in because when we move to the US, we will be temporarily staying with my parents for a couple weeks till we get a house), thus should I be counted as an immigrant in Part 3 ??so that I'm counted in Part 4B for joint -sponsors household size? If they do not add me here, where should I be listed or do I go on their I-864 at all??

So, do I belong at all in the box in Part 3 as a U.S. citizen wife "immigrating back to America" on mine and/or my joint sponsors I-864 forms?

Now i'm not an expert but I think since you realize you need a co-sponsor they will be more concerned with the co-sponsors income and where they get it. Since you are in school and don't have a lot of real income, as long as you show the money from a 'job' they wont be too concerned about you, the USC. You can use up to two 'co-sponsors', such as mother and father, or aunt and uncle as long as they can show their income on their tax returns for the passed 3 years meets the requirements, you should be a-ok wink.gif

I'm not sure that last post is entirely correct. As I understand it you can have up to TWO joint-sponsors.
In this case the sister and father can combine their incomes to reach the requirement (considering the sister and father live in the same household? not sure if that works if they do not)

I, too, did not file taxes for the past three years. So I attach a note to my I-864 stating that I did not file because my income did not require me to do so, signed it, and attached a page from the IRS tax guide stating the filing requirements. Add this to the I-864 that you fill out. If you live in the same household as your parents, one of them also files an I-864 and the other one will file an I-864A. hope this helps wink.gif

I've filled and kept copies of all U.S. federal taxes for the past 5 years. One concern is regarding the country of domicile. Currently we 'reside' in Korea. In order to put the U.S. as my country of domicile, I have to prove that in good faith we intend to move to the U.S. I can do this with proof of acceptance to graduate school in the U.S so I don't figure this will be much of a problem.

My question is with me using school as the main evidence to support domicile in the U.S. Can I still be the sole sponsor for my wife? Going to school in the U.S. would indicate that my job here in Korea would end and that I won't have future cash inflow. (The purpose of the I-864 is to prove that you can support the family member financial.)

The way I see it, I can fulfill both requirements of income and domicile but they conflict with each other. I could have my parents fill out a supporting document but I would rather not.

Any advice would be appreciated.

Anyone that has delt with immigration knows that you need to be prepared for anything.


In order to sponsor your wife on your own, you would have to prove that your income will continue from the same source, preferably US based income. But since you'll be moving, it won't so you will need a co-sponsor. You seem set on domicile, especially if you have any bank accounts in the US that you've maintained, maybe a current drivers license would be useful as well. You can use an address of perhaps the co-sponsor or family member in the US.

There is a page in the instructions for the tax form 1040 which shows the filing requirements in a chart, be sure to add this to the letter wink.gif

on part 6 24B should be the co-sponsors relationship and income
on part 6 24c is the TOTAL (lines 24 a&b) so both from co sponsor and sponsor
on part 6 24d check that box because your cosponsor will be filling out the I864A
on part 6 24e do not check this box (would only be checked if you lived in the same household and you were using your money/assets as well)

IRS transcripts are usually easier to obtain and read than photocopies of everything, but either one is accepted.

Personally I would say the grandmother is RETIRED...unless she is actively looking for another job or plans on working again in the future? I think the letter would suffice along with the proofs (checks or statement of some sort), seems good to go good.gif

It sounds to me like you made a 'voluntary departure' within the time frame they gave you...you were not arrested and deported. I wouldnt think you need to file any I-212...someone correct me if wrong here...

Since you filed DCF your process should take 10-12 weeks or somewhere around there ( so we were told when we filed our forms DCF )
Your wife fills out her own I864, i would convert the income into dollars to make things easier. the Household size on her form will be TWO (you and her)
One of her parents will fill out an I864 and the other an I864-A, their household size will be THREE (them, plus you, your wife does not need sponsoring)

Your wife is always your sponsor, she will need to prove domicile or that she is re-establishing domicile in the states. Somethings to include to prove this would be bank accounts she has maintained (or is opening) signing a lease agreement (even if its with her parents) voting records, maintained a mailing address in the states etc..

Hi there!

I wouldn't suggest filling in the 'assets' part, since you do not meet the 3X requirement. Fill in the I864 with the salary from your teaching job and supply the required documents, they will most likely look towards your mothers AOS for the info they need.

Yes, send them both at the same time, keep them in their own little stacks (your papers with your forms, her papers with her forms)

Just to add! If you live with your mother she will fill out the form I-864A! If that is not the case, you fill out an I-864 and she fills out her own I-864!

Say her shortfall was $1000, your assets would have to make up three times that amount, ($3000) or for sake of argument five times that amount ($5000) in order to be considered. If they do not meet that requirement they wont even consider them and you will need a co sponsor. If she has a family member or friend that could co sponsor it shouldnt be too big of a set back, maybe two weeks for them to gather info and documentation!
