Removing Conditions on Residency General DiscussionMay 2011 Filers
My wife called USCIS today and we were told that we count six months different than they do. We were told that our case has not been 6 months yet and that we should call back after December 23. Our receipt date is May 23...now when I consulted the star charts in tandem with my slide rule and abacus six months in days would be November 23. Hell, even if you started counting from June 1, December 1 would make 6 full calander months. My wife even counted the months for her and the lady still said it has not been six months since our receipt date. The lady was very nice and at no time was she rude...but she stood by her guns that December 23 will be six months.


Well, now that I look back over the paperwork...she may be going off the receipt date of the biometrics appointment notice which is June 20th. If they use the receipt date of the bio then she is correct. I always thought it was 6 months from the reciept of acceptance of the I-751 package.


Oh well...it will come when it comes :P

Howdy folks!

I haven't written in a while basically I've just been reading along, just didn't have anything exciting to add! But congrats to everyone who has been approved and has received notices! Personally I have little to no patience and admire how y'all have stuck with it all this time!

But hubby had the interview at the consulate Monday and it was a success! APPROVED!
We arrived at the consulate around 12:45, waited until 1:30. Went through security and such. We were first in line and handed over all the documents (Passport, 2 photos, marriage cert. and copy, hubby's birth cert. and copy, and the I864's) He handed back the birth and marriage cert.'s and said to have them with us when we check in for the first time at our POE. He stapled things together and prepared them for the consular. Hubby had finger prints taken (all ten fingers!) and we were told to have a seat. We were then called up to the last window to pay the fee. We were told to sit down again and wait for our name to be called. After about twenty minutes we were called up! The questions were a joke, I'm so happy I was here with him and went up to the little window when they called his name. They mostly asked ME the questions and asked hubby two! I was asked if I was indeed married to my hubby, how we felt about the economic situation in the states, who my joint-sponsor was and what he did for a living, and where we planned on moving. He only asked hubby how his medical went and what he did for a living lol too funny. Finally after some small talk about his chickenpox and shopping experiences he said 'I'm going to go ahead and approve your visa' YAY! Should be getting it in the mail in a few days!

The one from the USA you would probably have to contact the local police station where you lived?? methinks the FBI wouldnt return your call for some time tongue.gif

My mother and stepfather are our joint sponsors, we were going over their forms tonight. My stepfather claims his two children as dependents still therefore gets earned income credit for them. Will we be able to include this money as 'income'?? Without it they may not meet our income requirements! help!

Just keeping everyone up-to-date!

We got our I-130 approval letter today! it was dated the 27th kicking.gif kicking.gif kicking.gif

We only got one little letter saying it was approved and for the forms they gave us an address through the US consulate website to download everything from.
Is this normal?lol either way if it weren't for this site and others like it I would be COMPLETELY lost!
Only thing we're waiting on now is my mothers and step-fathers tax info woohoo kicking.gif

Just wanted to keep everyone up to date, we filed our I-130, G325A's and all the other doc's at the consulate in Amsterdam!
Quick, painless and easy going. We were told it could take up to 12 weeks but the CO said probably less than that since we were so 'well prepared' WHEW!
Onto the next steps! good.gif

When I first came here in 2003 we went to City hall and applied for a residency permit for me, just needed my birth certificate and passport and proof from my then-fiance that he could support me and i could stay! I had to take some dutch classes for a year or so, but that was worth it. It was soooo much easier to come here than it is to go to the USA together! wacko.gif

Thank you! Its been a long time coming, FIVE years to be exact hehe but we finally did it. As for DCF here, as long as the american is a resident of the Netherlands you can file here at the consulate. Long time ago the american didnt even need to reside here, just as long as they were married in the Netherlands they could file and fly away the next day and leave it to the Dutchie to do all the work wacko.gif

Hey folks, I'm new to VJ and just found this thread!

My hubby is Dutch and I'm American, we were just married in Dec.08 and plan on filing our I-130 here at the consulate in Amsterdam by the end of this month! We live here in Rotterdam and are just dotting our I's and crossing the T's and trying hard not to freak out about everything lol. Its nice to see others' stories and know other people are/have gone through what we are!

I don't exactly "reside" there for the time being. So what lockbox would I use to mail it in? If I have to "reside" in one of the above states, I'm worried I will get my application rejected or told to go through the embassy(which I can't since I was married in the US). Would they be willing to send it to Canada?


Seeing as how you are already married and I take it your husband is a canadian citizen have you considered filing DCF (Direct consular Filing)? Generally if you reside in the same country as your spouse you can file at a local US embassy/Consulate no matter where you got married. It may be faster and less of a headache! I have started searching online, and I can print out a few emails that I have sent to verify that I have started looking for a job, but honestly I am probably going to do temp work or waitress or something, since it's not worth going through the hassle of getting a real, permanent full-time job if I am only going to stick around for a few months. So that means I can't act as a sponsor, right? Or can I fill out all the sponsor paperwork and just put $0 as my income, with a letter explaining my intent to work this summer and the fact that I will have $2000 a month in financial aid come September? I know they don't care about financial aid or count it as income, but in reality that's what we will be relying on, so I'm not sure how to go about explaining that.

Next, my mom has agreed to make her income available as a household member, because we will be living with her this summer, so she can fill out the I-864A (neither of us will be using our assets, basically because we don't have any). But because I can't show any U.S. income at this point and she has my two sisters as dependents, I would also like to ask my aunt and uncle to be joint sponsors.

So can this work? Do I have this straight?
1. I do the I-864, agreeing to be a sponsor without showing any income or assets. (Can I really do this? Do I just write $0?)
2. My mom does the I-864A, showing only her income
3. My aunt and uncle do the I-864, agreeing to serve as joint sponsors. (Do they both have to sign, since they are married, or can just one of them do it?)

Also complicating things is that my parents got divorced in 12/2008, so their 2008 and all previous taxes were filed jointly. Now they live in separate households and my mom's income is the same, but will I have to provide documentation of the divorce and my mom's lease to prove that he is not in the household? Confused...

You sound ok as far as domicile it seems.
As far as I know you can only have two joint sponsors. So either your mom and uncle, or mom and aunt, or just aunt and uncle.
Your mother would only fill out the I-864A if she were residing with you, I assume since you've been living in japan since 2007 that isn't the case so as cmdpdiva said she would need to fill out another I-864, to THAT form she can add an additional joint sponsor (either your uncle or aunt)
I don't think you can list any income that you are GOING to be receiving, only income you are currently receiving, since that's $0 put $0, they will only look at your mothers/uncles or aunts income. I think as long as your mother can show her individual income is enough to meet the requirements (w2's or tax return) and maybe a copy of the divorce papers that should do.


Someone correct me if I'm wrong...
