Removing Conditions on Residency General Discussionmarriage certificate
QUOTE (meod @ Jul 12 2008, 03:05 PM) <{POST_SNAPBACK}>
do i have send a copy of my marriage certificate along with I751???thanks.

A marriage certificate is not needed. They want to see all documentation AFTER the marriage that shows you entered into the marriage in "good faith". i.e. finalcial records, insurance policies, birth certificates of children, photos, proof of vacations together etc...

Removing Conditions on Residency General DiscussionI-751 questions about affidavit
QUOTE (choochi @ Jul 23 2008, 02:53 PM) <{POST_SNAPBACK}>
hello everyone!

hi...am a non -US citizen and am gonna be applying for removing conditions next week and i just have a few questions;
am wondering where do we get the sworn affidavit forms? my husband argued me about it....he says affidavit means its a legal form of documents and needs to be notarized....i dont know,i just thought of that as a letter from your family or friends swearing that the marriage is legit...and on it they stated thier names and signed it and maybe their address and how they achieve the knowledge about us...(in other hand, their relation to us)...thats what i thought it is....but now am so confused,he wants me to search a documents on USCIS, i tried i couldnt find one( probably bcoz i dont know what am looking for,lol...) so i dont know....
hope somebody here can help me with this...give me a clue on GENERAL INSTRUCTION NO.5
what is that? is it just a letter or do we have to print some kind of form thats from USCIS...and have it signed by our family and friends.
thanks a lot in advance...

The below link is a template that you can follow, add your information, print and YES have notorized however keep in mind that they advise you to have this done only if you have insufficient proof that your marriage is legit. I did not send one in my particular case since my husband and I have financial accounts together, a son, travel records, pictures and insurance information however your case might be different. GOOD LUCK

Removing Conditions on Residency General DiscussionIs this enough evidence?
QUOTE (Kweli @ Jul 23 2008, 08:14 PM) <{POST_SNAPBACK}>
Please tell me if this enough

My current GC
Our son's birth certificate
Bank statement showing both names
Tax return showing both names and the same address
2 affidavits signed by friends
Our appartment lease showing both names and same address
One piece of mail showing both names and same address
Utility bill addressed to both of us.
Driver's licenses showing same address
Some pictures taken at our son's baptism

I think you have a great list however remember when you send financial records is good to have more than one statement since it shows that you have had it throughtout the whole marriage. I sent 4 which was for every 6 months we have been married. Also, it is a good idea to highlight for example automatic deposits like payroll or tax refund to show that you use that account for both of you.... GOOD LUCK

Thanks

Removing Conditions on Residency General DiscussionQuestion about the I-751?
QUOTE (poetrywriter @ Aug 5 2008, 12:51 PM) <{POST_SNAPBACK}>
My husband's 2-year greencard will be expiring in about 4 weeks. I am mailing off the I-751 application today but what happens if the greencard expires before you get the NOA? Can you use the receite from the money order showing that you did mail it off until the NOA comes in the mail? I have everything I need for the application, noterized letters from family and friends, bills and accounts in both of our names, photos of our marriage and pictures of our daughters birth and the cover letter. I am more worried that I wont get the NOA before the greencard expires. We don't plan on leaving the country or taking any trips( who can afford to? lol) SO do you think it will be ok?

Considering the time frame you should be ok because they usually send it within 30 days from the receipt of the package however if I can provide you with a little piece of advise I would recommend that you send the package via FED EX so you can be assured that they have received the package and you will have proof (signature of person who signed for the package). GOOD LUCK

Removing Conditions on Residency General DiscussionI-551 Stamp vs. NOA Extension
Hello All....

We received our NOA for my husband's soon to be expired green card. We will be traveling overseas during the Christmas holidays. I know in the NOA it states that it is ok to travel with this document however I am reading in this forum that sometimes in the POE they give you a hard time.....and even take the expired GC away from you !...

Here is the question... I was thinking about getting the I-551 Stamp on my husband's passport however I read yesterday ( in the news section a letter that was sent out by the HS Director) that the procedure is at the time of the stamp the GC has to be provided to them....

I thought without a GC we could not travel and I am not confident that in Argentina (where we will be traveling to) they will take the NOA as proof.... especially since it is written in English.... Has anyone experienced this scenario and what do you guys think is the best approach? I am just a little concerned since we will be traveling with our toddler and I do not want to wait in Newark for needless time if I do not need to...

Please help me crying.gif

A 10 yr GC holder? really? according to your timeline you are not yet there....

nothing to do before hand or to start with

the timeframe is about a year (some say 6 mos.) before re-entry permit is needed

What about citizenship? If you can wait then there is no issue with all this....

We intend to wait until he gets his 10 year GC.

Can you please answer the rest of the questions? Which is the process that I would need to do?

Thanks

Removing Conditions on Residency General DiscussionLeaving US
Hello everyone!

My husband is a 10 year GC holder and we would like to go back to our country to "try out" if we want to live there.

Here are the question.

What process do we need to start?
What is the maximum time he can be out of the country without loosing his privileges?
How long does it take to get an approval?
Do we need to have a reason to justify request?
Is their a chance that if and when he returns they will not allow him in?

Thanks

Removing Conditions on Residency General DiscussionPending I-751
Quick question...

We have the I-751 application pending (Vermont applicant) whistling.gif . We are in the process of moving and I would like to know if by automatically completing the AR-11 & I-865 does that change the address on the pending application. In other words at which address will the GC be sent to? Do I need to call them also?

Any help would be appreciated.

Thanks

Removing Conditions on Residency General DiscussionLifting of Conditions FORM Name ?
Hello Everyone:

I am trying to change my address on-line via the USCIS website and it is asking me for the form name in order to change the address on the pending case.

My husband's GC expired in August and he came into the country as a K-1/Fiance Visa.

We have received the extension for the one year and I have the application # however the form (under the case on line search) it states form .... CR189 however that form is not on the listing.

What is the correct FORM name for the lifting of conditions?

Please help me.... I only have 2 days to complete the change.

Thanks

Removing Conditions on Residency General DiscussionUpdate on Case
Hello All:

Quick question

I have a I-751 pending in which I changed the address on the case via on-line.

Do you guys know if that will show as an update or "touched" on the case once it enters the system.

I was told that it can take up to 45 days to receive the acknowledgment notice from them however I was hoping that I can find out sooner in the event that I do not receive the document.

Thanks

Removing Conditions on Residency General DiscussionChange of address
QUOTE (Nick81 @ Sep 16 2008, 09:06 PM) <{POST_SNAPBACK}>
Hi all,

About 3 weeks ago I phoned USCIS to update my address (my wife and I moved apartments). I updated my address on my pending I-751 (or CRI89 as they are listing it).

They said I would receive a confirmation of this, but so far I haven't received anything in the mail. Does anyone know how long this typically takes?

I'm just a bit concerned as it is the "removing conditions" application part we're waiting on. My wife (as my sponsor) has already received confirmation of our change of address.

Many thanks

smile.gif

I am going thru the same thing and when I spoke to the USCIS representative they told me I was going to get a confirmation letter within 45 days from receipt of the letter.

GOOD LUCK

Removing Conditions on Residency General DiscussionDriving License Expiring FIled 1-751 in June08 What to do?
QUOTE (siddharth18 @ Sep 18 2008, 10:02 AM) <{POST_SNAPBACK}>
My wife's driver's license is expiring in December 2008, but the I-751 approval is not expected until June 2009. We have received the NOA1 and the Biometrics completed. We have the biometrics stamp as well. What do we need when go to the driver's lecense center? Will they cause problem if we give them the NOA1 and biometrics stamp letter? Or do we need to get the I-551 stamp for the license? I guess we will have to get it if she travels to India??? The Indian immigrations personnel at airports can be extremely moody and picky...... unsure.gif

My husband was in the same boat and all we did was take the original NOA1, his GC, SS card, Passport and it was renewed for 1 year from the date of the original liscence expiration date.

Removing Conditions on Residency General DiscussionIs he going to be DENIED?
Thank you all for your support believe me it helps! And you guys are right WHEN we applied we did not lie however I am concerned that when the biometrics report goes to them (we applied in May 2008) therefore they have not gotten to our application as of yet it will show. Does anyone know if this is enough to be rejected or worse the extension revoked or not allowed entry back to the US. I am worried because we have a baby who loves his father and I do not want to separate that bond. This is his first and only offense, he has never been in trouble with the law, he works and pays taxes. PLEASE HELP ME? What should we do?

Thanks

Removing Conditions on Residency General DiscussionIs he going to be DENIED?
My husband and I already received the 1 year extension letter and in the middle of processing for his 10 year GC.

Here it's the deal:

My husband was arrested Friday because we go into a fight. He has been charged with domestic violence.
Is that enough to deny him getting approved?
Is the extension still good or will they revoke that too?
Will he be deported?

I know I am jumping the gun since he was already released and he needs to go back to court with the lawyer I am just trying to see what is someone's experience with this situation. I KNOW he needs to speak to an immigration lawyer I was just hoping someone can provide me info with their experience.

Thanks

Removing Conditions on Residency General DiscussionAR-11 Change of Address
I not only did the AR-11 on line but I also sent the hard copy via mail. When I called to confirm that they have received the information (since the rep. stated that I will receive something within 45 days) they stated that the mail was never received and that "we must of had an issue with the system" eventhough I had a confirmation ####.... I recommend that you contact them personally AFTER all is done to confirm.

Removing Conditions on Residency General DiscussionGood Luck and Thank You ALL
I just wanted to thank everyone who in their small part has contributed to helping my family in our visa journey. My husband finally got his 10 year GC after more than 3 years in this process.

It is hard to believe that over 3 years ago I was pregnant, my fiance was in another country without EVER having the possibility to even visit here (income restrictions) and looking at the very realistic possibility that I was going to be a single mother.

After 3 years he made it to the birth of our son by 2 weeks (K-1 Process), became a temporary resident and now finally a permanent resident and to make things even more precious I found out that I am pregnant with our second child.

I wanted to remind you guys to keep the hope and my prayers and good wishes are with all of you in this journey. I sincerely hope that all of you get what you are seeking.

I filed the I-751 May 23rd 2008 at VSC, just wondering if there is anyone out still waiting with me? It seems that transfers for CSC are getting approved already and we are still stuck at VSC.
I read somewhere that they are trying to clear all the files before getting ready for April 1 H-1B season, also read they will be done transfering all the files to CSC be end of March. Any inputs?
I suggest that these people start drinking redbull!!!!
