Hello b_4desi,

What you are referring to is the direct USCIS filing at the Delhi Embassy. There is a minimum 6 month residency requirement, and the full details are here at the Delhi Website:

There are other routes availble to you that do not require you to be an Indian resident. You can file the I-130 here in the U.S. and pursue the IR1/CR1 route or the K-3 route.

This is good advice, although I did not follow that when I submitted my I-134 to my fiancee. I ended up listing income + stock certificates because of was scared of the specific wording in the Mumbai Packet 3 (even though I went through Delhi Embassy, I assumed it to be similar.)
In the end, its up to you to decide what you are comfortable with. Although I have never heard of anyone having an issue following this advice of pushbrk/yuanddan, I still wanted to deviate.

I am afriad you are not in a good position. Depending on your visitor intent when you entered the U.S. using your B1/B2; you could have applied for I-485 Adjustment of Status.

Since you have left the country, that is all moot - you have the K3 or the IR1/CR1 option. DCF may be available to you if it is offered by your consulate and your U.S. Citizen spouse wants to relocate to your country to live there for 6+ months. (Of course, that makes it harder to show U.S. domecile and sufficient U.S. income above the 25% above poverty line).

At the danger of putting words in the OPs mouth, I believe what he is trying to say is that he does want to marry his fiancee - however, for his relationship to work, he needs to support himself by working ASAP.

I can understand that sentiment, as I share that as well. Luckily for me, I am the U.S. Citizen, so it does not affect me. Had I been in his shoes, I would looking for the same information.

And I agree 100% with pushbrk - it is very wise for you to ask about this beforehand.

Depending on what type of work visa he has, and where in the process he is, he can get married and his spouse will pick up derivative status.

He is not eligible to file for a k-1 visa, as he is not a U.S. Citizen.

I should add that this has nothing to do with India or its culture.

And yes, his spouse would need to do some paperwork, although I am unsure of specifics.

Not having photos does not sound tricky to me, provided that you have evidence of meeting within a two year period prior to filing. Passport stamps, boarding passes, plane tickets, bills and receipts with both your names on it, all of which are stronger evidence then just photos.

#1. Meet her in person, and gather evidence of said meeting in terms of passport stamps, boarding passes, receipts with both your names on it, photographs, etc.

#2. Talk to her and decide what you want to do - get married in Phillipines or get married in U.S.

#3. Choose the K-1 or K-3 based on what your plans are. Both are similar (give or take a couple of months) in time frame... and both can be very long depending on how the process falls out. That is why it is very important to decide what you want first, and pick the visa path that matches your desires.

And don't forget, just like the stock market, past results do not guarantee future performance... so just because a K-1 or K-3 was fast before; does not mean it will be fast for you.

Provided that the state in which you plan to solemnize the marriage allows such a marriage; you should have less problems. I suggest you detail all these issues specifically in a well written letter along with your I-129F application. You should also plan on demonstrating the bona-fides of such a relationship to the consulate; as this is not a very typical relationship; and they may be concerned that you are smply bringing your 1st cousin to America; and not serious about marriage.

You might want to get an opinion from a qualified immigration attorney.
