US Embassy and Consulate Discussiondo i need proof of custody??

I took it as 2 of the children have the same father. I would think that if you have signed letters from the fathers allowing change of residency that would be pretty solid.

Thats how I took it too...so if she has 3 kids, 2 fathers and two letters - it should be easy enough to get the third letter unless the father for some reason doesnt acknowledge that child which is why he's not on the birth cert. (Someone call Jerry Springer..we need a DNA test)

US Embassy and Consulate Discussiondo i need proof of custody??

i have 3 children with 2 different fathers.
i have residency order and parental resposibility over my 2 youngest children.
but i have nothing on my eldest. his father is not on the birth certificate.

i have sent out consent letters (through my solicitor) to both fathers asking permission to take the children out of the jurisdiction to live. both have agreed to sign and send back.

do i need to prove i have residency/custody over all of my children?? or will the letters of consent be enough?? :help:

thankyou for your time

If his father is not listed on the birth certificate I would think not but then I'm in the US. I dont know how your laws work over there. You say you have 3 children from 2 different fathers yet you have already gotten permission from those two fathers for the other two children. Do you not know which is the father for the child in question? Or is it that he does not acknowledge that third child?

I was just going to type what you said.

US Embassy and Consulate DiscussionPacket 3 and Baby!

Well, we received our Packet 3, got all the stuff together and in an envelope and...I went into labor! So on the day SAm was born we were able to mail out Packet 3 AND welcome our son into the world. It was a good day. :-) He weighed 6 lbs., 8 oz. and was 18 3/4" long.

So if I'm right, our next step is to schedule the medical exam, get our support person's information together, and wait for Packet 4? Pete flies back to England on April 23rd and we're hoping his interview date will be soon after so that he doesn't have to be gone for very long. Hope everynoe is doing well!

wow I bet you're SOO happy! congrats on both packet 3, Baby Sam, and you're new family. :)

It was burning away at me when I had mine, I WANTED to open but obviously didn't and knew I couldn't.

She can't enter with it in that state, like the others said, time to re-visit the embassy!

Haha... I was (and still am!) vaguely worried that I might accidentally open mine, even though I know you're not supposed to, and have no intention of doing so. I have been handling it very carefully in case I should somehow inadvertently rip that strip of tape off or something.

Yeah, I know that makes no sense at all, but I know what I mean!

I'm kind of amazed it was still properly sealed when I got it - I have no idea what the couriers did with it, but both the envelope and my passport were a bit mangled-looking when I opened the package from the Embassy.

accidentally - like you might sleepwalk and one morning find it opened next to the coffee maker?? lol Serious...we are all like little kids when told not to do something...maybe even more so after this journey ends and you're left with a myserious envelope! DO NOT OPEN!!

Aww Kat...everything points to a VISA! (instructions for the brown envelope, the medical looked fine etc.) Its safe for me to say Congratulations!! (ya did it!)

By the way...for you other posters...what happens when the medical ISNT ok? Do you get notified or does the person giving your interview get to be the bearer of bad news?

Well, as far as London goes I can offer some insight.

My husband was told that if there was anything remarkable about his health, he would receive a call from the panel physician.

I have read of at least on UK beneficiary who was informed by the panel physician of an abnormality on an xray.

The purpose of the medical at all consulates is to check for communicable disease. The panel physicians manual goes on pages and pages about tuberculosis. I know whatever the findings are about any communicable disease, such conditions are definately going to be reported to the consulate.

Only consulates can deny a visa. A physician cannot. The FAM contains direction to the CO's as to what conditions may be waiverable.

Anecdotal evidence in this community indicates that after the medical, no news from the panel physician is generally good news insofar as that requirement for visa issuance.

I always wondered that. I also wonder about people who have their medical a day or two before the interview. I have had HIV tests in the past and again recently because of my pregnancy and the fastest they could get my results back to me was in just over a week. They must whip those results out over night to be able to approve a visa that quick. Or maybe thats why you dont get your visa on the same day as the interview. But then if the physician says that everything is ok what other processing is taking place that would require a week or so to get the passport back?

US Embassy and Consulate DiscussionSerious Problem!!!!

Again, there is nothing illegal about applying for a tourist visa and visiting the US, even if the K1 is in process. Again, pursuing a K1 shows that you do not intend to immigrate using a tourist visa. You said you were not engaged at the time of the tourist visa application. Therefore she did not lie. Denial of a tourist visa has no relationship to a K1. If you are concerned about what *could* happen at the interview (and concern for this is wise), make sure you have all the evidence possible of your relationship and the exact dates and events so you are prepared to explain. End of story.

I agree.

I still think your story in interesting. I presume you produced a police certificate and had to file a waiver to get your K3 approved? If so, it's interesting to me that these same crimes caused a denial of your status adjustment.

hi, yes they are both here ,HOMESICK !! apparently i should have not been issued a k-3 if i was to be denied or the convictions would cause a problem when adjusting,NOBODY should be issued a k-3 after being denied apparently. it should be an immigrant visa not a non immigrant ,you cannot be denied adjustment with an imm visa ,whereas ,you can with a non, thanks for your interest, andy.

Try typing the letter yourself and submitting it for signature. It just needs to include how long you've worked there, your pay, your employment status, and your pay. My boss wrote one paragraph to the effect of she has worked here since January 2006, is employed full time, and makes $2.13 per hour plus tips.
Along with my last years tax return and paystubs this was sufficient to prove my ability to support my SO.'

I find by writing it yourself you make sure all the necessary income is included and it is easier to get a signature than an entire letter.

No, you can't type it on a plain paper - you will need official stationery. So the best thing to do is to tell them what you need it for - seems like you are too paranoid about your sponsoring a foreigner - are you ashamed of your fiancee? Why? Don't worry about your co-workers wanting to know - this is normal in any job and you have to deal with it in a dignified way to make it work for you. How are you going to deal with your neighbors/friends/family who will want to know even more than your co-workers. If you are ashamed of this fact - then you should not go forward with it. Millions of us are not ashamed of it - we are proud of this and are very happy with our decisions. Good Luck

Sorry - but where did you get the idea that the OP was ashamed of his fiance??? This person is obviously frustrated at the fact that everyone at Walmart is nosey! (Which by the way is a job none the less) It is NOT his co-worker's business what happens outside of the workplace. My advice - fill out "the form", explain only to your boss or HR the reason for it then carry on with your petition. If they refuse and want to be jerks about it you can always use your paystubs as proof of dates of employment and pay rate. Good luck.

To my fellow US-Germany filers (or anyone with good input). I need to send a bunch of documents to my fiance in Germany. (Documents I could have sent back home with him in January when he was still here had my attorney not told me it was unnecessary, but that is a different issue ;) ) This includes a copy of my birth certificate, financial docs, etc. The last time I shipped using USPS, the package arrived about a week later than it should have, even though I paid the higher price. And another time I sent a package to one of my friends in Germany through USPS, she never received it. I want it to get there as quickly as possible. I looked into DHL, but it is about $20 more expensive than sending it with USPS, if the service is worth it, I don't mind the cost. But I wanted to see if any of ya'll have recommendations.

Thanks!

K-1 Fiance(e) Visa Process & ProceduresSending items for my fiance to include in I-129F Package
My petition was packed full just like yours and was approved no problem - I believe overkill is better than them asking for more. The way I organized it is the key. I simply assembled it as instructed and the evidence of meeting was like a walk through time from start to finish. The tickets of my first trip, the bus passes we used, the phone calls leading up to that first visit, bank statements with withdrawls coinciding with dates during that first trip, etc. it was in a timeline...then on to the second trip then his trip here. I had no RFE's and the Interview was scheduled to have all the original documents of the petition and evidence of correspondance after the filing date of the petition. The more organized you make it for these people the smoother things will go. You sound like you're ready.

Hey all,

I realise that I am probably being extremely ####### about things but I am sending some documents for my American fiance to include in the I-129F package and I want to make sure I have included everything. My fiance will be adding items of her own, obviously the actual I-129F form, cover letter etc and items that must be completed by the US citizen, but she will also be adding additional proof of having met in the past 2 years such as eticket receipts etc.

I have placed all the documents in a folder organised into seperate plastic sleeves, here is a list of what I am sending:

First Sleeve
G-325A (4 original signed copies)
Additional information sheet (4 Original signed and dated copies)
Letter of Intent (2 original signed copies)

Second Sleeve
Copy of photo page of passport
Copies of Student Visa to enter US and Passport Stamp. (I met my fiance whilst on a student visa)
Copy of I-20 to enter US on a student visa
Copies of ID’s, credit cards and debit cards
Copy of birth certificate
2 recent passport photos with my name on the back

Third Sleeve
Copies of letter, itinerary and tickets of planned visit to America in March 2007
Frequent flyer program printout showing all previous trips to the US
Various etickets, showing that I entered and left the United States last year and that we took a trip to another US city together.
Hotel confirmation and email from our trip
Email showing my fiance's travel plans when she came to england last year (she will add the etickets)

Fourth, Fifth, Sixth and Seventh Sleeves
LOTS AND LOTS AND LOTS of emails between us (spread across 4 sleeves)

Eighth Sleeve
2 UK cellphone bills showing calls between us
I UK landline bill showing calls between us
1 US cellphone bill calls between us
5 used international phonecards

Ninth, Tenth and Eleventh Sleeves
US & UK bank Statements that my fiance will correlate with hers to show that we were in the same places at the same times (spread across 3 sleeves)

Twelfth Sleeve
Copy of a personal letter
Receipt for a package sent to the US for her
Movie ticket stubs from movies seen together
4 birthday & Christmas cards sent to me from my fiance
10 digital photo prints of us together in the US and the UK

THATS IT!

Have I included enough? Do i need more of one certain thing? Or have I missed anything out altogether?

Any information would be wonderful as its a very stressful process and I don't want to be hald up by an RFE!

Thanks everyone!

K-1 Fiance(e) Visa Process & ProceduresResidential address
If it were me I would simply write "No House/Street Number - See attached Explanation" on the space where it asked for street and number. Then attach an explanation on a separate piece of paper ( I would do one for the i-129F and 4 for the G-325As) as to why he doesnt have a number as you did for the forum in your post. The G-325A will also ask for a history of addresses unless he's lived there awhile so Im assuming there will be a pattern. No matter how cumbersome it may be, its better to take the time to get the packet right the first time instead of getting an RFE later on. Good luck!

Hi all,

My fiance doesn't have a standard address. On the I-129F and G-325A and has street and number; however, my fiance doesn't have a street or number. The address is just the small town, city, and country. When the mail arrives in the city, it is delivered to his small town by name only. Does anyone foresee any problems with entering his towns name where it says street and number. Thanks in advance for the replies.

Im sorry to hear this. These are items I would have included in the original petition to prove that your relationship is valid.....emails, ticket receipts regardless who bought them, pictures of the two of you together, phone bills, etc. Moving on...I would write as many pages as you can with details of how your visit together was...did you see movies together? Meet her parents? Did you visit any places that you might have pictures or souveniers from? Yes - write a novel if you have that much information to provide. Its a shame you went all the way only to provide more evidence...it will soon be over...you only have one more hurdle.

My fiance went for an interview and made a mistake with the month where we met......somehow a lost in translation, in any case, she was told that she is ineligible at this time and must provide more documents such as:

  • Proof that I purchased the plane tickets
  • Statements of events of how we met and how we spent time with each other while I was over there.
My question is - how many pages do I need to write? I mean I can write a novel if I have to but is it necessary?

Thanks in advance.

I at no time said he would be denided entry on a VWP.... what I did say was it is very unlikely that he will be given a B2 visa from london....

You asked about a K1 and I said you can file for it from any country of the world... it will be up to you and the embassy dealing with it if it will be approved.... that has nothing to do with a B2 or a VWP...

Yep - and based on the approved example letters on this forum it appears to be no big deal. Im not as concerned about the IMBRA filing as I am about him filing a K1 while visiting on a B2. I wouldnt normally go this route but the average timeline from filing to interview date is so far off... he will miss my complete pregnancy and perhaps the birth. I will be visiting him in April so we're only looking at a couple months of being apart.

Let's all understand the IMBRA filing requirements for a waiver...

A waiver is required on your third petition regardless of outcome or time unless this is your second petition and it has been less than two years since your previous APPROVED petition. It is petition approval that is the threshold not visa approval.

I sense you will need a waiver request for sure if you file before December 2007 (based on what you indicated).

How can the B2 be denied based on a pending K1 if the K1 isnt filed until he here's on the B2? Sorry..thought you read my initial post. Also - Let me add that this visit is not strictly for a family purpose. He has relatives in California and many friends from Scotland in Florida. So the B2 would be used for its legitimate purpose.

MRS BILLY BONG,

You're proposing a long visit for a family purpose, with a return home only to wrap up the K1 visa when the time for that comes. Sounds suspiciously like immigrating now and taking care of the necessary business later - an excellent way to get the B2 visa, or entry using it, denied.

Your I-129f petition will require a waiver request if it is submitted within 2 years of the submission of the last petition. If 1HappyGuy is right in his sense of what is happening it may require a waiver request even if there is more than 2 years between the petitions.

Sorry people I need to fill out my profile but I'm a little hormonal and need some questions answered. My man is in Scotland and Im over here in california. He came to visit last october and left timely mid january. Well I just learned a couple weeks ago that im pregnant. I thought maybe it would be a good idea for him to visit in June with a B-2 tourist visa so he can be here during pregnancy and after the baby is born in September. My question is this: Can we file a K1 visa petition when he gets here? I was hoping we could be together during the wait for the baby while its processing. Yes I know he needs to return for the medical and the packet 3 etc etc...no problem. I have filed a K1 petition in the past with another (December 2005 with an interview date of June 2006) but we fell out and the interview was canceled. Which is another concern..how long do I have to wait to file another one? Can we file a K1 while he's here on a B2? Does the embassy take into consideration the police report and or medical needed to aquire the B2 when it comes time to process a K1? Is there any exceptions when a child is involved? (my guess is probably not) I've used this forum in the past to present a flawless petition so I appreciate any input you can give. Thanks in advance...xx

NY, I tried scouring the Tel Aviv US Embassy web site for information on physicians and exam costs but didnt have any luck. When packet 3 comes it will have your physicians listed then you can call for pricing (im sure you already knew this) Maybe if you find your fellow Iraeli VJers they can guide you in the right direction.

K-1 Fiance(e) Visa Process & ProceduresAre you ready for this......Visa approved!!!!!

To all in our community,

We have all ups and downs. Today I stand before you a man who seats at the highest vistas and with the heart felt emotions. Proclaims that "we were granted our visa!!!!".   Nadya and I both cried with tears of happiness. Even during the times when I felt we were forgotten. I always continued to pray. I believed in the love that started us on our journey. I wrote so letters and asked from help in anyway I could. In the end it was our faith and love that saw to this path. It was the many people before me who helped me continue to be undaunted. Their stories and support helped me to keep my head. So now this journey ends and a new one begins. Funny how life is....you got to love it!

Scott and Nadya

Congrats to you and your loved one and your bright future ahead! Can I ask why the I-129F took almost a year to recieve an NOA2??? Your timeline doesnt specify and RFEs.

Yep...then they're big ole liars! I knew it. I think they say 6 months so we leave them alone and then are we're much happier when we realize it was only 3!

Hope you hear something in the next few days to prove Im right!

If I remember correctly - before the 2/20 change, the date was July 16th.

That date cant possibly be just for service center processing - think a poster on here was right in saying TOTAL time to interview as there's a bucketfull of VJer November filers who just got their NOA2s!

What was the processing date before it was changed? I think they're a bunch of liars (god I hope) The date August 21st is month petitions were recieved that they are now processing. Everything has a trend and what goes up must come down (as evident in the timeline graphs) So hopefully our Husk sheds a bit of light when he says that CSC is in hiring mode.
