Well I am a US citizen and my fiance is Mexican. I have been living down here in Mexico with him (only on a tourist visa).
We hired a Mexican/American Attorney. She told us she submitted the whole package Around the end of May 2011. We also submitted the other form that we will
get the notification in Email and US Cell phone text..
It is already July 18 and have not received anything from the USCIS. She tells me they are backlogged... but for 2 months?

Is this a little fishy or could it really be possible that they just haven't gotten to my package yet?


I also have another question, my fiance changes jobs alot usually staying at a job for about 5-6 months and changing. He's a waiter. The attorney told us
it shouldn't be a problem and she will email them if he changed again. Well after she sent the package he changed to another job, and now she's saying its
going to be a pain and that she might have to request to have the package sent back so she can redo it?

Whats the deal with this? Is it a big deal to notify them that a job isn't valid anymore.

This part right there also makes me think the lawyer has no idea what she's talking about. She can't "request" for a petition to be sent back to correct info on it. If something is missing etc. they will issue an RFE and then you can provide information, but I doubt this'll be a problem and you can just provide the new information on the job on the I-134 at the interview stage.

Thanks for the reply. My attorney is the one who handled it all, I have been asking for proof of the tracking number and company she sent the package off with and she just doesn't give me an answer of what it is. Then she tells me I have to be more patient because they are backlogged. I wish the easiest thing to do was to get rid of her, and find someone new but money is a big effect right now and I dont know if she is telling the truth or not.
She also would have written a check I suppose when she sent it in, but I have no info on that either.

I called the USCIS and they said my name wasn't in the system, but could it be that they are backlogged?

Ok, something is definitely very off. Yes, USCIS is backlogged but with issuing the actual approvals (NOA2) and NOT with the NOA1. That you should have received in under 10 days after submitting the petition. Also, did you not give your lawyer money for the check, the 340$ filing fee for the I-129F? Did she never mention anything of the sort? Something is definitely fishy if she refuses to give you straight answers and USCIS can't find your name in the system. I think you should consider filing yourself, is there a reason you have decided to file through a lawyer? Because it sounds to me as if that "lawyer" never actually filed a petition...

The address it was suppose to be sent to was the LockBox in Lewisville Texas I believe.

Wait, so you haven't even received a NOA1 yet? Was the check cashed? Anything? If that's the case, it's definitely fishy. You should receive your NOA1 (via text and email) around 3-10 tops after they receive your package.

Do you have an address in the US where the NOA1 was supposed to be sent to..?

we sent our I-129F last June 4, 2011 and we are glad we received our NOA1 on June 9, 2011 but on June 11, 2011 we found out that i am pregnant... well we call it our un expected souvenier from our my fiance's vacation last May 2011.. but that's where our lots of questions and some worries started... its not because of the baby but its because of the papers, we have been looking at the ussual timeline of NOA2 takes 5 months or more... our worries are 1.) my fiance is worried about me being pregnant without by myside, 2.) what if the NOA2 will take more than 5 months, we are afraid that the airline company's will not allow me to fly when my tummy is i think 5 or 6 months old already. 3.) if worst get worst i will give birth here in the Phils, of which my fiance don't really like it plus i heard that the visa will expire in 3 months if i will not fly by then? how true is that? anybody have any idea if we can request to expedite our NOA2 because of my situation?...


First of all, congratulations! :)

But I'm afraid USCIS won't see pregnancy as a good enough reason for expeditious processing. Haven't heard of it at least. I assume you are already 6-8 weeks along if you last saw your fiance in May, add the more or less 5 months until NOA2 you'll already be in your 3rd trimester and then it will still be an additional couple of months until you have your interview at the Consulate. I doubt you will be able to fly to the US visa in hand before the baby comes. I'm sorry.

But after you have the visa, it is valid for 6 months, so you have plenty of time to fly to the US.

So, the papers my fiance writes and signs have to be sent to me via mail? They wont accept anything that was signed by him, scanned, then emailed? I never thought about this before, but it seems to make sense. Sucks, because he's already scanned and emailed everything.


The signatures need to be originals,he has to print out the forms, sign them and send them to you via mail, yes.

Mine is in German too, yes.

It depends though, will she have the interview at the Consulate in Frankfurt, Germany? If yes, no need to translate as all documents can either be in English or in the language of the country in which the Consulate is in. If she goes to any other Consulate, then yes, she will have to have it translated into English.

I see in your timeline it says Frankfurt, Germany. So no need for translation :thumbs:

As far as I know, they say it takes around 1-2 weeks right now. I applied for one at the end of May and received it exactly 2 weeks and 1 day later via mail.

It's a scam. They don't notify via email and this year's lottery announcements were done yesterday on July 15th, so anything before that is not real. Happened to a friend of mine as well :(

This is just a name we give the packets after you get NOA2 yes packet 3 is what to bring to interview and packet 4 is what you send back


Well, yes it's just terms that are used here but you get packet 3, the instruction letter, which tells you what to send to the Consulate, and then after that is done and you send the forms, you get packet 4, the appointment letter, which contains the interview date (I think though this is only for the Consulates that allot the interview dates, not the Consulates where you book the date yourself...).

We got NOA2 on July 11th but then on the 25th we got this email:

Your Case Status: Post Decision Activity

On July 25, 2011, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

We called NVC and they said they got our approved case then they send it back for review and we have to contact USCIS for more info. Then when we contact USCIS they didn't give us any reason why our case got sent back and told us to wait for 120 days. It took us 6 months to get NOA2 now they told us to wait for another 120 days. Anyone have any suggestion?


I would open up a separate thread for this and ask again. I have never seen this happen before but maybe someone else has and can help you with this. Good luck!

Is it true that if we get married and file for CR-1 that my fiance/husband won't be able to enter the US until the visa is approved? We live in the caribbean and for us it is virtually impossible to go anywhere without flying through the US. It will cause problems for his job if he cannot fly through because of the process. Any ideas on that aspect? I guess I have a bit more reading to do....feeling a bit discouraged. Thanks for your help!


He should be able to fly through or enter the U.S. on the VWP as long as he can sufficiently prove to the Immigration Officer, if asked, that he has no intention of staying permanently (at least not until he has the visa of course). He should always have binding ties with him when flying to the U.S. during the process and he should be fine.

I had the same RFE so I sent in pics airline tickets, itineraries and as far as the passport pages his international passport did have his number on every blank page but as for me the cover page has my number but my stamped pages had no numbers on them to prove it was me traveling soo I went all out and color coded the itinerary and the date stamps for cross reference and added an explanation why these dates were highlighted.

Why would they ask for an affidavit? The affidavit of support is only needed at the Consulate stage and not for USCIS. They only ask for what is missing so they probably sent photos with the initial petition...

We got our RFE today, saying they need more evidence of meeting the last 2 years. in BALD letters they typped "copies of passport pages that show the identification page and admission stamps." Is that all they need then? i def know, that i did not send that, i only included the admission stamps.

do they need more? or is that enough? is it true, that we will be denied if we sent them the wrong information now? We sent the tickets already, but the online tickets are in german (well u can still read them because its only numbers and dates) and the boarding passes don´t include the YEAR (never realized that before)


I'm the beneficiary and I included a copy of all the pages of my passport in the I-129F package precisely because of this reason. It is not stated anywhere to do so but only when you send also the identification page they can match the page with the admission stamp to your passport and make sure it's really the beneficiary's passport. The identification page states the passport number that is also visible on every single blank page of the passport so this way they will know that it is truly the beneficiary who traveled and whose passport was stamped.

This is why I think they are asking, to make sure the copies of the admission stamp you sent to them was really from your passport, so this is what you send and you should be fine :)

You do NOT need to get a translation. German is accepted at the Frankfurt Consulate, the documents have to be either in English or in the language of the country where the U.S. Embassy is in. I was fine, too.

I'm really surprised people who have no experience with the Consulate in Germany just blurt out false information :bonk:

What a HUGE blunder with something so basic! It looks like a trip to the copy store with my pasport and birth certificate is in order. They say once email that I can ask questions about my case. I want them to go over every, piece of it to see if there are any more errors!!!!!! First, Vermosnt says it sent it to thr "above listed consulate" where the was NONE listed and now this. It is infuraiating how imcompentent some of these peiople are!!

Good point, though he said he's here on a visa waiver program so I'm not sure what the requirements are for that.


Visa waiver program means no visa necessary if your country is part of the program. You don't need to apply for anything except fill out an ESTA online (Electronic System for Travel Authorization) which is usually immediately approved if you don't have any overstays or criminal background etc. and that's it.

Wow! That right there is my single biggest fear. I want to start making plans for my Fiancee arrival, like wedding plans and such, but am afraid that the CO will do what he did to you.

What questions did he ask?
How long have you known your Fiance?
Did you have an attitude with him?

Relationship starting too fast sounds pretty hokey to me. By the time the I-129F even gets approved, you have been together for at least several months.

Something else that doesn't sit right with me(and hopefully doesn't come to fruition) but how can the USCIS say "Yes, it is a valid relationship" only for the Consulate to to say "No, it is not a valid relationship"?

So sorry, Don't give up though! It will work out. Just need to find out exactly why it was denied, fix it, and try again.


Just wanted to set this one right: USCIS does only determine whether the beneficiary is eligible for a K1 visa by meeting the requirements of having met in the two years prior to filing the petition and that both parties are free to marry, and also does some background checks (criminal history..) etc.
You can frontload a petition with relationship evidence to cover all your bases and for the Consulate stage but this is not what USCIS primarily looks at.

I'm visiting my fiancé in just over two weeks, staying for seven weeks.

so so so so nervous about the POE, don't have many ties to Australia that I can show, I live with my parents, currently unemployed - Job ended a few weeks ago, I do help my dad out with his work though (He's an IT Tech at a school and sometimes I go with him to help out (He's self employed though so I can't get a letter from the school as proof)) and I'm getting unemployment payments from the government right now (Going to tell them on Monday about my trip) and will probably have to go see them once I return to Australia. Would a letter from my dad and maybe proof of an appointment at the government office be enough proof that I -do- intend to return and that we -are- doing the K1 visa (aka the legal way) and I don't intend on staying?

Just worried because when I traveled to the US before (Nov 2010) the officer in LAX asked what I was doing there, and I just said "Visiting friends" (Which is true, but I was mainly there to see my boyfriend (now fiancé) and stayed with him the entire time, I didn't bring him up though incase they questioned me (first time flyer back then!)) - but obviously now a K1 visa is in progress, I might come up on their screen.

So so so nervous :( ugh. :help:


I can't really say whether what you have will suffice, but I would additionally take a copy of your NOA1 and maybe even a cope of the whole I-129F package, to show proof that you are going the correct, legal way and are serious about this.

I flew into JFK on May 6 of this month and it really made me question whether they see pending visa petitions. We had filed in January and were waiting for our NOA2 when I came to visit (we actually got approved while I was there) and the CO did not ask me anything. And if I say anything, I mean that. Only a "hi", then took and scanned my passport, stamped my Customs Declarations, took fingerprints of the 4 fingers of my right hand (no right thumb, no fingers of my left hand, no picture) and then shoved the passport back at me and said "bye, bye". Seriously, that's the only things he said and I was, of course, in shock...pleasantly, but I had expected him to ask something at least. So I dunno if he was just in a good mood or if they really can't see pending visa petitions... :unsure:

I haven't one to the U.S. yet while the I-129F was pending since we just filed last week after my last visit, but I made the strange experience last year that every crossing of the border was actually easier the more I visited, and initially I had have figured I would be the other way around.

I visited my fiancé for the first time for two weeks in March 2010, before that I hadn't been to the U.S. in 3 years (back then I didn't know him, went on a 5 day post-graduation NYC trip with my mom). I landed at Newark and the CO didn't even look at me but asked all sorts of question like Who was I visiting (I said friends), where did I know these friends from, when did I meet them, how long was I staying, when would I return to my home country, what was I studying in school, how long was I in school already, when would I graduate etc. All in all probably 20-30 questions but no proof of return ticket or other binding ties needed.

I visited again in September/October 2010 for 6 weeks and had been stressing even though my last visit had been 6 months ago. So I flew through JFK, and only got asked length of stay (6 weeks) and purpose of visit (a friend...she didn't ask further). So, two questions and I was sent on my way.

The third visit last year is the one I stressed about the most since it would be my third in 9 months, obviously, and because I had just been there 7 weeks ago, as I was going to visit over the holidays, this time with a ring on my finger. I had binding ties such as proof of enrollment at university and bank statements showing my balance and proof of health insurance in Germany, just in case and was fully prepared for lots of questions and possibly secondary. So again, I arrive at JFK and when I get to the CO, she wishes me a good morning, takes my passport, scans it, takes my fingerprints, stamps my passport and wishes me a nice day. Those were the only two sentences she spoke to me, not even one singly question, not even the standard "length of stay" and "purpose of visit". :blink: I thought it was a joke, I just couldn't believe it.

I am now thinking about visiting for like a week in May, but kinda scared now that the K1 process is started..

All in all, VSC approved 48 VJers this last week. Not bad. That's their highest weekly approval rate for VSC since the week of the 31st of January. I really do hope they keep moving, now that they don't have to worry about a possible shutdown and can just concentrate on approving our petitions :lol:

I'm only staying for 11 days too in May, because I'll be in the middle of my semester so it's already the longest I can stay and miss classes. Blah :( but anything is better than nothing!!

Hey guys.
Im just dropping in to update.
I had a brace fitted on my top teeth this week to align themm a bit, so i have appointments every 6 weeks which i know will break the next few months up for sure :)

On a diff note, i fly out to see Ashley in Dallas next friday. Cant wait!!! Im taking with me my itinery, a letter from my employer stating when i have to return to work, my business cards and my dental appointment card.

I have also persuaded my gp to ive me my MMR and Tdp vaccinations, so il have those when i get back.#

Ashley and i also signed upto our first apartment this week, she moves in june 1st so itll be all there waiting for me for when VSC finally get doing something.

You CSCers are laughing atm, theyre rocking!!! while vsc, although managing to do 12 on monday, have only done 4 since this week.
A week into April and still almost 50% of Sep to do!!

I know people always say 'yeah but VJ only represents a small percentage so theyre prob approving petitions elsewhere' but im not bein funny, they havnt been approving elsewhere for 6 months!! Theyre shockingly slow i just really hope they hurry up!! I want my NOA2 by end of July latest!!

A lot of people actually updated their timeline later so checking the VSC list now, it shows 42 approved petitions between the 4th and 8th of April. That's not bad AT ALL in my opinion. 15 of those were on the 8th alone, I guess the government shutdown scare got people moving :thumbs: Hope they keep it up!

I hope you have a great time with your honey, how long are you staying? If it's no hassle, tell us about your border crossing experience...I'm personally flying out to see my fiance in 26 days, and it's always good to hear from others in the K1 process who flew to the US to visit :)

Before applying for the K1 I was always asked "reason for staying in the US" and I said visiting friends, and like I said, in December I didn't get a single questions about the reasons of my stay.

Hi guys :) since we are talking about crossing the borders while in the K1 process, I have a question too. I'll be visiting my hubby to be in May for 11 days, last time I was there was over the Christmas holidays and New Year's until January 9 for 3 1/2 weeks, before that I was there 6 weeks in September/October 2010 and before that two weeks in March 2010. Even on my third visit in December I got asked nothing, even though my last visit was less than 8 weeks prior, I didn't even get the "business or pleasure" question but I doubt I'll be as lucky again.

Binding ties that I will have are return ticket, certificate of enrollment at university, certificate of health insurance in Germany, and latest bank statement to show I can support myself and of course a cope of the NOA1. I am living with my mother so I don't have a lease agreement to show. Do you think that would be enough? I could also get a professor write a note for me that I am in the middle of writing my bachelor thesis and need to be back in order to finish my degree.

Also, when asked "business or pleausure" or "reason for visiting", would you go right out and say "visit my fiance"? Or just say vacation and if they ask further e.g. with who am I staying, say my fiance?

I just came back a little over a week ago from the US, and had no trouble at the POE (Dulles in D.C.). I had my return ticket, a letter from my employer and a copy of NOA2 with me just in case, but no one wanted to question me - a little disappointing actually :blush: Im absolutely sure that you will have no problems whatsoever since it's obviously a vacation. I think that with longer stays (a month and more) they might want proof of ties etc., because then it doesnt appear like a small visit for a vacation anymore. I read somewhere that they have no way of finding out that you have a petition for a K1 pending, that it's not on the computer or anything so it won't pop up on the screen when they scan your passport. Does anyone know if that really is the case? I imagine that with my visit, if it had popped up on their computer they might've questioned me a little more... not just the normal "What is the purpose of your visit?" "-Vacation" "-Thanks, have a good one".
anyway, I hope you two will have a great time in Germany and when you visit him in May (L)

Haha yeah I know what you mean. He'll be leaving here all sad, thinking he won't see me for over 4 months and I'll know I'll see him in just 40 days. That'll be hard but the surprise will be worth it. I've wanted to do that for so long and now is the last chance before I enter with the K1. I am hoping too that I won't get any trouble since I'm staying only 11 days, and I'll have binding ties with me and the NOA1 copy of course (debating whether I should take copy of the whole I-129F package, what do you guys think?). Hmm I'd like to know whether they have a way of seeing whether you have applied for a visa...but if they ask for purpose of visit I think I'd say "to visit my fiance" and not just "vacation" don't you think? I think just saying vacation would be not really a lie but not really the truth either. This time it'll be 4 months since I was last there, last year I was there 3 times and between the 2nd (6 weeks total) and 3rd (3.5 weeks total) visit there were only 7.5 weeks and I wasn't even asked ONE question, not even purpose of visit or length of stay...I doubt that I'll breeze through Immigration like that for a second time, no one is that lucky lol.
And thank you Eve, I'm so happy to have Angelo here soon and so excited for my surprise visit! And then hopefully it won't be long until the NOA2 comes :thumbs:

Nope, luckily he isn't, I'm the planner and organizer so I was the one who did the research here on VJ and put the package together. I told him there's a board I go to talk to others going through the same process and I printed out the guides etc. from here for him to read through but he's not on here :)

You will be ok! No worries! Just take some paperwork stating that you have connections back home. Any utility bills, university statements, etc. I've crossed the border 2 times and i've been good to go. I surprised Jay back in January! He cried once he gathered his barings, tears of joy that is. His mom helped hide my car and everything. Luckily he didn't make his bed that day so i was easily able to just "blend" in, under the sheets. Then i popped out and said "surprise". The look on his face was absolutely priceless and made it so very worth surprising him.


I hope so! What I had with me last time in December (didn't have to show anything though) was a certificate of enrollment from my university, bank statements showing I could support myself, certificate of health insurance and that's it. That's what I'll bring this time too. I am living with my mother right now so I can't show a lease agreement but I am hoping that that will be enough in case they ask. I'm planning to wait on his bed too when he comes home from work :D can't wait to see his face!

Just wanted to share this with you my fellow January filers:

I just booked a ticket to go see Angelo in May for 10 days! It's gonna be a surprise visit, he won't know anything! He's coming here next week to Germany for two weeks and thinks we won't see each other for over 4 months after that, but I knew that was impossible for me so I found a good deal and just booked it!!! :dance: I just hope it'll go smooth with Immigration, I'm going through JFK...so far I never had problems there but this time it's the first time that I'm crossing the border with a Visa application pending.

I did call the USCIS customer service people again on Friday. I got thru to the 2nd level person. She was nice enough. I asked her to please, please, please put a message thru to the IT people on my behalf and she said she would. She did not give me any time frame though.


My fiance called them on Friday too, the second level person put a request through to IT and said if we didn't hear from them or if it wasn't fixed until March 19 we should call back. So since you called the same day maybe wait 2 weeks too and if until then still no change, call them back. I just really really hope it'll be fixed until then :unsure:

So Angelo just called them. He got put through to the second level and spoke to a very friendly and helpful officer who put in a request with IT right away and told him we should hear back by March 19 (which means that until then it should be fixed, I guess) :thumbs: If not, we should call back anytime. Phew, I hope we will be able to see it soon then!!

That's great!! :dance: You have the same NOA1 as we do, we still can't see it. My fiance called once after we passed 30 days but they didn't really help him so today he will call again to put in a request with IT. May I ask what you wrote in the emails and how long did it take for them to fix it?

I hear ya!!! Fingers crossed. We set a tentative date of October 8th (families kept asking). We'll push it back if we have to but hopefully it'll work out.
