If the applicant has to bring a "form from the embassy", they likely expect you to bring Packet 3 with you. At my medical this week (yes, in Canada - maybe there's a different policy), I was required to show documentation with my name and new case number on it, and Packet 3 (or 4) has that.

I also paid online but then when I got my Packet 3 (or 4?) in the mail, the instructions said they only accepted cash in person at the interview. Immediately underneath, in bold, the page reminded readers that payments could be made in cash or with a credit card... I guess it's about time they updated their paperwork.

I could tell you that last week in Montreal, I started waiting to be let into the consulate at 7:15am and was out on the street, approved by 9:45am but every consulate is different and every case at the consulates vary!

Any advice at all? I haven't had my interview yet, and don't know much about your consulate, but it's my understanding that if one of the required documents is missing the day of the interview because of some unforeseen delay or emergency, and the interview goes well, they hold on to your passport, and really do just wait until the missing document arrives. If it jives with all the other stuff in your package, they issue the visa, and it gets sent without further trouble from the applicant. Of course, they are not likely to say, "well sir, everything looks great, as soon as we get that I134, we'll get that visa to you right away" but from what I've read around here, in the 'best case scenario', that is basically what happens.

^ I was just about to ask about this very thing - is there a timeline or link that we can look at for K1 filers from their NOA2s to their Montreal interviews? It's a bit of a letdown to see some applicants are waiting nearly as long for their interviews as for the NOA2s.

I have never crossed in Calgary, sorry. I usually cross the bridges over the Niagara River in Ontario. The worst experience was at the Queenston/Lewiston in May - I was asked to go inside with my ride to the airport, and the officer went through every single thing in my purse and wallet while questioning me, my education, work, my relationship. It was a gentle and polite interrogation, but it was definitely a demonstration of power and intimidation. Also, it was all my fault because I didn't have an itinerary, nothing to show my return flight, and zero (hard evidence) ties to my job and education. Somehow, she let me through "just this once" after firmly lecturing me (I deserved it) about how much it was my responsibility to bring various proofs etc etc.

Other times I've gotten several extra questions (I mostly use the Peace Bridge) about my fiance, where he lives, what he does, what I do, how long I'm going for, what I'm coming back to and that kind of thing. In August, I got a couple of extra questions because I was visiting for 3 weeks ("That seems like a long trip, hmm?" "uhm.... ... does it?") Ever since my lecture though, I always cross with my work contract and pay stub, and an itinerary, and ever since that lecture, no one has ever asked for my proofs again. I just don't know what to make of it.

I'm a permanent resident, though, and I almost always have a tourist visa stapled into my passport (the 90 day VWP visa) just because I live so close to the border and find myself crossing to go to concerts, or shopping or work dinners at the Cheesecake Factory (why not?), so maybe there's some record of my extremely frequent crossings?

Maybe five or six years ago, (before I was so experienced) I went to the border to fly out to see my mom with a long expired visa, probably a year or older inside my passport (they don't remove it when you drive across but apparently, not surrendering this visa by the end-date means you must be hiding illegally in the States, mooching off the system... who knew?), and the border guard kept me waiting for ages, and I honestly did not understand what the big deal was - I was so clueless. I was scolded and lectured then too (like a dummy, I was only worried I was going to miss my flight), but I didn't get turned away then and no one has ever brought it up since.

Anyway, those have been my border experiences. Like I said, most of the time, I get the standard, "where are you going? how long are you going for? are you bringing any alcohol etc, have a nice day" I'd say, go prepared (like others have suggested), don't be afraid, keep your answers short and honest, and they'll have no reason to wonder about your intentions.

1. I think yes, as long as you more or less let her speak for herself, I can't imagine them asking you to like, wait outside.

2. Only in terms of stress and worry but it doesn't hurt the K1 process at all. My border process is so hit and miss, I never know quite what to expect. I've had one terrible one, and 2 other notably bad ones, but the rest have been surprisingly easy, and I am always afraid that I'm due for another bad one...

Maybe - you have 6 months after the visa is issued to use it to enter the States, but if you marry in May or June, you'd have to apply for AP (Advanced Parole) to get back into the States after the wedding, but I don't know enough about that to say whether you'd have a chance...

No worries :) DOS is the Department of State: I'm under the impression they know everything about your case once it leaves the NVC, and are generally very helpful with dates and what steps of the process you're in etc. when you call.

I had a Canada-wide police check done, partly because my job requested it (I work with minors) and partly for the sake of my K1 application.

Basically, I went into my city's police station, was directed to the records department, said, "I need a police check, like the kind for all of Canada, and for working with minors" and the lady said, "Ah yes." So I filled in a piece of paper, paid a fee ($45?), and was told to give it 6 weeks, call to check that it was ready, and then collect it again. When I came back, I asked again, "this is good for all of Canada, right?" and was assured that it was. I did not supply finger prints.

Since I've lived in 4 or 5 different parts of the country since I was 16, I'm counting on this particular check to really be "nation-wide" and it's dated October 22, 2010. Montreal interviews are being booked into May now, which will make my check more than 6 months old, so I am also hoping there will be some flexibility on that particular policy.

This is something that can be handled after getting NOA2 from USCIS.


It *can* be handled after getting the NOA2 but in my city it takes 6-8 weeks to have results returned.

Maybe call ahead and ask how long it might take for a Canada-wide police check and keep in mind that these are usually valid for a year so be careful of the timing.

I have a new case number (MTL 2011 etc), and I have the paperwork all ready to go. I was prepared to wait it out, but didn't expect to hear such claims from the DoS agents on the phone about Packet 3 from the NVC.

In any case, I'll try to give them another call Monday and keep a close eye on the mail :)

I had to laugh when I read your post, Because thats exactly what they told my fiancé when he called DOS yesterday. They told him NVC sent the packet 3 and Montreal is waiting for your fiancé to send it back. For an hour I thought that the packet got lost. But anyways I did some research and NVC does not send the packet 3. It’s the consulate's job.


Aah, that is pretty terrible of the DoS then. I thought they were more reliable for information and accuracy?

What are the negative consequences of sending the Packet 3 forms/checklist without having been issued one from the consulate? Like, if I send one this weekend when really, the consulate hasn't issued Packet 3 yet, is it just going to get tossed when it gets there? The last thing I want to hear is, "we're waiting for YOU!" because I am ready to go!!

CanadaPacket 3 from NVC?
Hello all,

I called the DoS this morning to confirm what seemed unlikely from yesterday's agent and was told that the NVC sent me packet 3 on February 1st. When I suggested that our case hadn't left NVC until February 3rd, so how was that possible, I was told it wasn't that unusual - the NVC was just trying to work ahead...? Really?? Apparently Montreal is waiting for me to send the paperwork but I haven't received anything from NVC these last 3.5weeks...

So, what in the world?? Should I take this as the permission I need to get our paperwork to Montreal ASAP?

The next step is to start calling the numbers in this here thread: link! - they'll be able to tell you if your paperwork has been logged at the Montreal consulate, which is, unfortunately, where your paperwork is headed, and where the interview will take place.

Paperwork in this link is what is required for the next steps in the process but you probably have about 3 weeks (at the very least) until it is requested from you. The worst part (for me, anyway), is that interviews in Montreal are being booked for the end of June right now. We are dealing with the slowest consulate in the history of consulates. Okay, I'm exaggerating because it makes me sad, but anyway, you'll get lots of help from folks around here, but you've got some time. Have your fiancee fill out the forms in the second link, even just to practice, because sometimes it can take a bit of head scratching to remember all the information they need.

I don't know the answer to this one, but keep in mind that it is a US Consulate so the staff is not necessarily Canadian, let alone French Canadian. Everyone, at every consulate, has to bring English translations of all their foreign language documents so my guess is that the same applies in Quebec.

The checklist does include things that do not apply to the K1: proof of domicile is only for CR1 (I think).

Also, your fiance should fill out an I134, but not an I864.

You only need the DS230 (I and II), 156 and 156K, 160, and I 134... Well, I think those are the forms I sent in. Look around this Canada thread (esp. the "K1ers waiting on Montreal") - we've all been discussing these very things.

An older, wiser member posed a hypothetical question in the following situation:

Say you drive up to the border as you've always done in the past, and this time you get a few more questions than usual. Because you're a good person, you tell the officer, truthfully that you are traveling to see your boyfriend/girlfriend. In follow up questioning, you say that you don't really plan to come back because you've decided to get married and settle down in the States.

Now, do you think the agent at the border will let you through? Because we all know just how that scenario would end, we're going through the painful separation and expense of filing for K1 and IR1/CR1 visas.
