K-1 Fiance(e) Visa Process & ProceduresIntro and a Couple of questions about the USCIS website
I don't know the answers to all of your questions, but in terms of what the USCIS website shows for your Status (the one with the blue circles, yes?), ours changed from Initial Review to Request for Evidence at like, 9pm EST. and from RFE Review to Post Decision Activity around 8pm EST (Is it sad that I know these times? It's sad, isn't it :( ) Anyway, many members find their status NEVER changes, or changes really unpredictably. For example, we got email notification about our RFE, and our RFE Review, but not our Post Decision Activity (the most important one!). So, the USCIS site is not necessarily dependable, no.

As for your filing date, I believe you can go by the date on your NOA1?

K-1 Fiance(e) Visa Process & ProceduresCompliance Letter
In that case, I believe the compliance letter has to come from the bank, since they are the ones expecting continued payment while you're living abroad. I'd give them a call or book an appointment with a loan consultant.

Did the dealership finance your loan/lease? I believe this letter has to come from the institution you are paying for the vehicle?

K-1 Fiance(e) Visa Process & Proceduresstaying time in home country
I've seen a few different answers about "when the 6 months starts" (varying by a few days, regarding the "exact" day) but the validity is six months from when the visa is issued, usually the day of or a few days after the (successful) interview.

This 6 month validity applies to every K1 visa issued by the US.

K-1 Fiance(e) Visa Process & ProceduresLetter of Intent in I-129F
If you do get an RFE only for a letter of intent, and you have the letters ready to mail out the day the RFE arrives, you may lose a week or two. Our RFE was very minor but our petition was approved 19 days after our RFE was issued (so we had to wait for the RFE to come to know what we needed to do, and then fix the mistake, send it back etc).

K-1 Fiance(e) Visa Process & ProceduresWhat are some good examples of proof of engagement?

I do not believe anywhere you have to prove you are engaged.

The DS-156K form says to "attach the following documents" and includes things like a birth certificate, police certificate, Evidence of Financial Support etc, and "Evidence of Engagement to your Fiance(e)".

This form is submitted with Packet 3 before an interview can be booked. Still, I'm not sure they *can* say, "Ma'am you don't have a ring, are you really engaged?" so the evidence for this is probably flexible? Updated letters of intent are good evidence in lieu of culturally laden evidence of support?

USCIS Service CentersCalled USCIS for a consulate change request...
Ha, I never thought about it but both my fiance and I had our addresses changed in the middle of December which is apparently when our RFE was first processed (we didn't receive it, requested another copy be mailed - it was dated Jan 5). We also received written confirmation that our addresses had been updated.

In any case, mail from the consulate sent to me in the middle of February was still sent to my old address - I paid for forwarding services when I moved back in November... what more can I do people?!

I heard of a member about a month ago, who was allowed in with one of those reusable plastic grocery bags which held her large I129f package and evidence, maybe because it didn't zip shut?

US Embassy and Consulate DiscussionDS-156 Q.#38
Is there room to explain which of the above you are answering the affirmative to? I mean, you should check yes, because she was refused admission. If there is no room to explain, I would attach a page explaining the circumstances.

Previous refused admissions don't necessarily affect K1 applications, but it depends on the circumstances (like, if she was caught trying to smuggle drugs, I'd be worried).

US Embassy and Consulate DiscussionExpedite French Background Check?
I am in a similar situation - I am the beneficiary and took my 3rd year of university abroad (in my motherland of all places ;)). Now, I need a police check from over there, but ONLY the Montreal consulate can request it from the Amsterdam consulate so there was no way I could have taken care of this in advance.

I also wish I knew how long the process might take...

US Embassy and Consulate DiscussionBuying round trip flight
I remember seeing a thread about this a few months ago and many people opt for a return ticket simply because it is much cheaper!

The trouble at least one person encountered is that they forgot to cancel the return flight and several months later were rejected at some later step because according to flight records, they "had left the country"! In fact, the airline had sold their seat to someone else but had not changed the seat assignment record, so this poster was actually on file as having been on the flight though he (or she?) was not there. The suggestions from everyone in that thread were to book the return flight as far in advance as you can (6 months?), cancel the return portion promptly, and print confirmation of the cancellation should something like that come up with you.

Well that is certainly reassuring! My overnight trip list already requires an attachment so I will add something underneath to the effect of "many day trips for shopping etc.".

US Embassy and Consulate DiscussionDS 230 Question #35
Hello all,

I'm living near the US/Canadian border and often make casual trips into the States for shopping, work dinners, or dropping friends off at the airport in Buffalo.

Question 35 on the DS 230 says "List dates of all previous visits to or residence in the United States. (If never, write "never").

I've compiled all my overnight stays in the States, including all my visits to my fiance, but to what extent should I write all the day trips I've ever made? I fear that I am going to forget quite a lot of visits, and that I'm really just guessing vague dates for the ones I can recall. How precise do I need to be for this question and how far back should I go?

US Embassy and Consulate DiscussionDS-156K Question...
It says, "Evidence of engagement to your fiance(e)"

I asked our lawyer and he said that since we front-loaded our petition in the first place, we probably didn't need to submit anything drastically new, but I made a copy of the engagement announcement we sent to our family and friends, a copy of the receipt for the dress I plan to wear when we finally marry (and me in it at the store), and a print out of an email exchange I had recently with a priest about what our wedding service will look like.

Probably I'll print off a new batch of Christmas pictures, and some from my next upcoming trip along with updated letters of intent and even more recent boarding passes and the like.

US Embassy and Consulate DiscussionInterview at UK-London Embassy in Six Days!
Oh man, I am praying for something like this to happen to us...

As for the photocopies, it's my understanding originals of things like birth certificate etc. are required, but having a copy of everything submitted will make any surprise questions or apparent mistakes at the interview part easier to clarify.

Most people find the paperwork is not really looked at very thoroughly, but no one has ever regretted having it with them, if only for the peace of mind.

US Embassy and Consulate DiscussionHow long before the wedding date should you arrive?
Yep, I would look into state requirements for the marriage license/certificate. We plan to marry in New York, and the wait time is 24 hours between the marriage license and the marriage certificate. About halfway down this page is a list of the wait times in the 20 states that have them.

US Embassy and Consulate DiscussionK1- Which consulate in our case?
I believe you can have it updated - you could try calling the USCIS.

The most recently I've heard of this was Canada-specific: a lady asked to have her application moved to the Montreal consulate from the Vancouver consulate after the petition went through NVC. I believe she dealt with the consulates directly... ?

US Embassy and Consulate DiscussionForm 156-K
Yes, I feel the same way - I have also been reassured that the embassy does not require originals to be mailed in, but maybe call your consulate (if possible) to check with them? I wouldn't send originals at all unless a live person at the consulate said your package would not be processed without them.

I'm thinking the checklist assures the consulate you have the originals ready to go, and they (plus a copy) are requested at the interview.

US Embassy and Consulate DiscussionDS-156K
Hi there, I included a picture of my dress and the receipt, copy of the engagement announcement we sent to friends and family, printout of emails sent back and forth between a priest and I about wedding plans, and more recent pictures of us together at Christmas, and me at my bridal shower.

Even if none of these are available to you, you can simply update your evidence of a relationship pictures and things, and the petetioner needs to write a new letter of intent to marry that is dated within a month of the consular interview.

Good luck!

US Embassy and Consulate DiscussionVisa Question
Ah, well, I haven't applied for a spouse visa, and I don't know much about the New Delhi process, but in general, after the case gets sent to the consulate in question, an interview is usually booked between 4-8 weeks after NVC completes the processing. For the most part, it seems like the consulate keeps the passport of folks who are approved and it is shipped back to them (though some can go back to pick it up) with a visa inside, anywhere between 2 days or 2 weeks later with, depending on the consulate.

US Embassy and Consulate DiscussionVisa Question

Hello there Guys, I was a bit confused about the Visa being given to my wife. Since I am a US Citizen, I know things happen different for Citizens compared to Non-Citizen and I wanted to know what is the Process of getting ther Visa. Will my wife get the Visa right and there after the Interview or does she has to wait and if this is the case, what is the Wait Period. This is for Embassy in New Delhi, India. So if any of our memebers who are from India and had a similar case like mine is, please share your thoughts or if anyone has any info on this, please share.

Thank You!

Josh

Hi Josh, it looks like you've applied for a spouse visa but you don't have any timeline information available - have you submitted a petition to the USCIS? Is your case already at the embassy in New Delhi? If you let us know what stage of the process you're at, our answers can be more informative. In any case, information in this link might be useful though the Guides tab along the top of the site and the India forums will be the best help for you!

As long as you meet the income requirements (and have tax returns and pay stubs to prove it), you don't even have to declare assets and savings, according to senior members on this site.

US Embassy and Consulate DiscussionNo More Slots until May?
This isn't directly related, and it won't offer much consolation, but I'm interviewing in Montreal, and interviews are booking on June 22nd these days :(

I've seen elsewhere on this site that the Manila fiance/spouse interviews are full for March and another person was wondering why they couldn't see the April availabilities.

You might want to start reading through the Regional forums to see what the Manila folks are expecting in terms of timing and paperwork.

US Embassy and Consulate DiscussionPacket 3
You can always call the DOS (1-202-663-1225) and ask them if Packet 3 has been sent to you. You'll need your MTL case number, but you're allowed to submit the required paperwork as soon as they tell you it's been sent, and before you have the actual P3 in hand.

Our Packet 3 was sent last Monday. I submitted the required paperwork right away and Xpresspost says my P3 paperwork arrived in Montreal Thursday morning. This morning when I called, the DOS asked me if I'd received P3 yet (not yet), and if I didn't have it by next Monday, to give them another call. Of course, I'm calling them almost every day, waiting to get permission to book an interview but that's how it's gone for me anyway.

That's right - the police check goes to the interview with you. Most consulates accept it up until it is 1 year old, regardless of the validity date on the actual certificate.

US Embassy and Consulate DiscussionCan my fiancee take care of her medical exam?
If the applicant has to bring a "form from the embassy", they likely expect you to bring Packet 3 with you. At my medical this week (yes, in Canada - maybe there's a different policy), I was required to show documentation with my name and new case number on it, and Packet 3 (or 4) has that.
