I would suggest a postal money order.


But their own bank can easily tell them when the certified check was been cashed..

You can also get a certified check from your bank...also guaranteed. good.gif

I do find it odd, though, that it took all ths time for them to realize your check did not clear. It's been my experience they find that out in matter of days (hubby has been given some bad checks mad.gif )

I'll give some of your answers a try...

Not to burst your bubble but it does not seem that the speed that you are scheduled for your biometrics has much to do with how quickly you are approved. If you browse this forum you will see that.

I can't tell you where the Washington Service Center is BUT the address should be printing on your form. We had our biometrics at the Philly Service Center and the address was on there.

The two NOAs all seem to hsve different #'s . The second one (that scheduled your biometrics) is the # you can use for online tracking.

Your first NOA should have been a letter extending your Green Card for a year, therefore no stamp in your passport is necessary, only the greencard and the letter.

No clue about the d/l situation in your State.

second question: we bought a house in 2006. but my mortgage/loan officer did not suggest to add my wife on the loan because I barely qualify for financing. therefore, now, the front page of my mortgage only has my name. However, the deed has my wifes name listed. this wont be a problem will it? I mean, we have other supportrs, but it just so happens that our biggest investment doesnt have her name, because of the suggestion of my loan officer.

P.S, I live in Oklahoma.


We are in the same (house) situation. Hubby had no social security # and for that matter couldn't work, when we bought our house, so they would not add him to the mortgage. I insisted he be on the deed. For the I751 application I submitted our HUD-1 as proof (just as I did for the initial G/C application). I believe the joint ownership is a strong enough proof (without the mortgage).

Here is my two cents..
I did not think they expect you to have everything jointly titled...But you need to address everything they asked for !!!!

I would send everything they asked for with nothing crossed out. BUT I'd send the deed & mortgage they asked for and a letter explaining that the Citiizen spouse had the property before marriage that since you intend to buy a property jointly in the near future you did not change the deed info.

I don't know what to tell you about the health insurance "claim" info. We have Keystone HMO which is a Blue Cross product, so I went online from the IBX website and printed something out from the subscriber portion of our page which showed me as the insured and Richard as the dependent spouse. We have not been approved yet, but I presume that's the type of thing they are looking for.

I believe the stamp in the passport is documentation of you being a permanent resident (conditional but you have the same rights as a PR as long as your case is still being adjudicated) so it should be acceptable for drivers license or work and not just for travel. Ofcourse different agencies may interpret it differently but i believe thats what the stamp is supposed to be.

That's it! We don't have anything else! We have simply found it easier to keep our finances seperate, and we can't supply any joint info regarding driving, because my wife doesn't drive.

I have no idea what to do. I can't make supporting evidence appear from thin air.

Help!

was a breeze

Richard's appointment was for 9 am, we got there about 15 minutes early. The facility is in an industrial building at Drummond Rd & Byberry Rd in the Far NE in Philly. It's brand spanking new. The people were very nice and we were in and out in less than 30 minutes. BUT it was early and plenty of people were arriving while we were there, so I suspect we may have been lucky.

The big tip is leave your cell phone in the car or at home...There is more than one sign and the guard asks you if you have a cell phone when you go to check in (I had already read the signs and went back and deposted them in the car).

We went USPS Express Mail (which includes tracking) if you use priority mail, which takes a day or so longer be sure to get DELIVERY CONFIRMATION (it's a green and white thing). You can track the # online (for both express mail or delivery confirmation) or by phone. kicking.gif

No offense taken, I find that personal experience more than makes up for some wise words from an Attorney, I got a first time DUI last year and I got approved with no interview etc.


I understand but each DUI is different and it would depend on the adjudication of one's particular case. I certainly would not just send off my 751 if I can any legal problems, with at least consulting a qualified immigration attorney. I'm glad it worked it for you.

On the instructions for the I-751 it states:

"If you have ever been arrested or detained by any law enforcement officer for any reason, and charges were filed, or if charges were filed against you without an arrest, submit:
2. An original or court-certified copy of the complete arrest record and/or disposition for each incident, (e.g. dismissal order, conviction record or acquittal order).
If you have ever been convicted or placed in an alternative sentencing program or rehabilitative program (such as a drug treatment or community service program), submit:
1. An original or court-certified copy of your sentencing record for each incident, and evidence that you completed your sentence, specifically;
A. An original or certified copy of your probation or parole record,
or B. Evidence that you completed an alternative sentencing program, or rehabilitative program...."

The problem: we have the complete arrest and sentencing records, but obviously we don't have evidence that he completed his sentence since he hasn't done it yet (it took over 3 months to even get a first hearing in court wacko.gif ). Luckily, it was a first offense, so his sentence is minimal (4 days community service and 1 day DWI class). He will be done with that stuff in 2 weeks. The real hurdle is probation.

If I submit what we have now, will we get an RFE for evidence that he has completed his sentence? Unfortunately, that would mean waiting until his probation is finished (possibly a long time). Will the DWI conviction cause any other problems that anyone knows about? I did some extensive searches for info about this and came up with very little. I imagine that our case will get some additional scrutiny, but I believe that our Removing Conditions case is quite strong.

The lawyer for my husband's DWI case said that the conviction would not be a barrier to his immigration case, but he said it may delay his Removing Conditions until everything is 100% resolved in the courts.

Maybe we should consult an immigration attorney, but I'm not sure if that would help anything.

Anyone have any insight?


No lecture here... I think you got the point. I'm going to suggest you seek the advice of an immigration attorney. We used an attoney for our initially AOS and it's one thing she sternly warned us of...DUI etc. When we called her about the lifting conditions she said unless something happened along the way (eg DUI) we could do it ourselves and save her fee...which is what we did....
I would at least make the inquiry....

Don't get me wrong most people adore Richard..same thing they all love the accent and adore the English wit/charm (which he has plenty of laughing.gif ).. but he says every so often he'll be in a meeting or someplace and he'll encounter a redneckish type that he gets the vibe from. Richard also loves it here. He intends to go for his Citizenship next year and it has nothing to do with Green Card/USCIS hassle etc., especially all he does is sign the forms...he is quite oblivous to all this angst (it's left to me) whistling.gif

I'm just curious to know if anyone else read the USA TODAY article on people sueing USCIS because of the long delay for citizenship? I can't say I blame them.

Does anyone know of people sueing for the long delays to get conditions removed? And have anyone had any luck getting their senators involved?

I just found the article Immigrants sue to speed citizenship applications and was not surprised but still annoyed by the over 500 (mostly ignorant) reader comments that followed the story...I guess it's a sad commentary on the USA Today readership....or maybe the popular in general (?).

I've seen that folks (here) have contacted their Senators but it does not appear that it is much help, which surprises me. As someone who was in a position working for Fed, that dealt with Senator's & Congressman's offices, I know those issues ALWAYS got results.

I believe the service centers are closed Mondays and open Saturdays. Several people here have reported Saturday appoinments..good luck.

Maybe because it's tax season, but I got mine in five days. I'd say if you don't get them in a week call and request them again (maybe try and speak to a human, if you can.)

You won't have to still own the house in order to use the deed as evidence that you have been mingling your holdings. It is very good evidence that you have made financial ventures together.

I'll give this a try based on advice given to me. I'd say mostly because of the rent, utility bills etc being established such a short time ago and mail being sent to PO box JUST TO BE SAFE I'd send the affidavits of support from friends and a couple photos, in addition to what they have.

I have looked through the documentation requirements for the I-751 and it does not look too bad. The attorney also said that we have to provide "many" letters of people who know us and copies of their drivers licenses. We called the attorney we used for our AOS, she recommended we do it ourselves. She was sure it would be not problem, but of course if we felt uncomfortable, she would file for us, we never got to the $$ stage. I admired her honesty. Add to that, she had her assistant call and follow up a week before the due date to make sure every was OK and that we had indeed filed with no problems. I assured her it was done and if we had an issues they would be the first to know.
That said...I have have to add the help and advise I got from VJ was so valuable...

Someone else who had their prints done in Philly reported the same thing here a week or two ago.

When they took our electronic prints for updated id cards, at work, there were several people with fingerprint issues BUT they knew right away. I was told the machine let them know if the prints were acceptable...sounds like someone was not paying attention.

We received our NOA1 on January, 23rd. Nothing since then. Our AOS office is Philadelphia and I've noticed in the forum statistics that there are aproximately 55 days between NOA and biometrics. It's not 55 days yet but, from what I have read, the appointment notice arrives about a month before. I am concerned because we chose two addresses on the I751, address and mailing address.

Also, supposing that whole processs is delayed for another year, can the I-551 stamp be applied in my passport even if it is expired?

There does not seem to be any rhyme or reason to scheduling the Philly biometrics. Richard's NOA1 was dated 12/14/07 and the biometrics letter was received 1/11/08 for a date of 1/30/08 BUT others Philly filers who applied earlier didn't get hear/or get scheduled for biometrics until after we did. I also voted N/A. We did not include affidavits and are still waiting. We had several people to ask and if was just a matter of writing a letter it would be fine, but coordinating people to schlep to a notary etc. just seemed like an imposition that we didn't think was necessary. We felt our application stood on its own..of course we know if we get an RFE we'll have those nice friends to fall back on. Fingers and toes crossed (for us and the rest of the waiting Vjers out there especially the long suffering TSC's/or TSC/VSC's blink.gif )

And this years taxes, but I dont have those finished yet, was going to get an extension since I have been at the hospital 24/7 and now Mom is in hospice its even worse. Just dont have TIME to want to fool with this #######. crying.gif

I am just out of ideas. I sent everything, I mean everything that we had. I just dont know what to do, and we cant afford to buy a car together right now, to have it put in both our names.

I guess I am just ranting, but if anyone has any ideas on new things we can do together, ??? We have a joint checking, I am beneficiary on his work life insurance policy, all that. This would have to be something we could create I guess.

It notice that you did not mentioned transcripts from prior year tax filings or bank accounts. The accounts should show a history..not only the most recent but an earlier statement to show that you did not just open the account..

I mention this because I have been reading some postings and some couples don't have witnesses but they do have children and this kind of help them, well in our case we don't have babies, so I don't know what else could help us to prove our marriage is true.(the rest of the documents are ok, joint account, bills and letter with our names on it, loan with our names, filled out taxes together,etc)


We live in the same town where we were married and do have friends that could provided affidavits but chose not to, we also don't have children together. We have strong financials and will go with affidavits if we gt an RFE. I will suggest that you get transcripts from the IRS, and don't only send copies of your returns and make sure to send "history" of bank accounts....an earlier statement and an recent statement from the same joint account.
