Removing Conditions on Residency General Discussionaffidavits
QUOTE (milleniumgirl @ Apr 27 2008, 04:15 PM) <{POST_SNAPBACK}>
Hi, here we go again...the green card expires in august,we almost have all the documents we need, but the witnesses affidavits...we are not living in the state where we got married,so we are living in a place where nobody knows us from the beggining of our marriage, this makes me feel worried.
There is a few people at my husband,s work who may help us, a friend of him (whose wife is a weirdo...cause she doesn't even return my phone calls)and maybe his boss, they have seen me going to visit my husband at work several times to bring him his lunch, to buy some groceries, sometimes I have exchanged a few words with his boss, etc and things like that) but well we have not gone out with them (you know to have dinner or to the movies or to visit each other house...etc)I was reading the examples of the letters and well none of those situations fit ours...plus our life is kind of isolated...my husband works days and nights, I work days and nights during the weekends and well we don't really have time to have friends or have fun going out ourselves very often or with other people and things like that...we spent our christmas at home him and I , for new year and similar parties I had to work, also some of his family who may have helped us was the reason for us to move us out away from the state where we got married and the reason to move us out of the damn town close to where we live now(long story) so we won't ask them for help, I have been thinking in something else that could help us to prove that our marriage is true ...and God it is true!!!! with all the troubles that we have been going through and we are still together, haha...well out of jokes, what can we do?any suggestions about what should we do?we have been married for almost 3 years but we don't have children, the first year we were pregnant but it didn't end up well , since then we have not tried it again and based on a mutual decision we don't want to try yet. I mention this because I have been reading some postings and some couples don't have witnesses but they do have children and this kind of help them, well in our case we don't have babies, so I don't know what else could help us to prove our marriage is true.(the rest of the documents are ok, joint account, bills and letter with our names on it, loan with our names, filled out taxes together, etc)

We live in the same town where we were married and do have friends that could provided affidavits but chose not to, we also don't have children together. We have strong financials and will go with affidavits if we gt an RFE. I will suggest that you get transcripts from the IRS, and don't only send copies of your returns and make sure to send "history" of bank accounts....an earlier statement and an recent statement from the same joint account.

good luck

A period of five years has elapsed since you became a lawful permanent resident; or

I believe there is a waiting period to sponsor another immigrant through marriage, if someone gained citizenship through a marriage to a USC.

Which seems to be 5 years since becoming an LPR, as the OP cites (from a form?). But I'd check with an attorney.

I take that back -- the waiting period seems to apply to permanent residents only; not citizens. I'd still check with an attorney though about any other issues in the case.

I'd say since the new hubby is out of status they would need a good immigration attorney, anyway, so the best plan would be at least have a consulatation with a good qualified immigration attorney.

Removing Conditions on Residency General DiscussionMortgage/closing documents
QUOTE (Collie @ Apr 30 2008, 02:14 PM) <{POST_SNAPBACK}>
Hi everyone,

What documents from the closing documents package for our house should we copy to send to USCIS?

There are a ton of documents and I am not quite sure what they want to see?

Thanks,

Kat

We are jointly titled on the house but not on the mortgage. We sent (a copy) of the executed copy of the HUD-1. It seemed to do the trick for the AOS so I figured it was fine for removing conditions. I added some HOA bills along with water and sewer bill with both names as well.
If you are joint on the mortgage, I can't see why a copy of the bill (with both names) wouldn't work, I'd say keep it simple.

But I remeber reports on TV when piles from some gov agency was just thrown away and any criminal could have an access. As far as I remember they were files with SS, names, addresses. How many situations like this were not aired?
I just had a nasty experience with identity theft-but mine was not as bad as for other 1mil people/year.
I understand that our paper packages get shreded. But this criminals are hunting for this king of garbage (from gov, banks...). 1 mil cases a year-that is a lot. virtually, we all have a huge chance to get violated.
PS: RFE due to blacking of bank data-I don't know. Some people here were approved with blacked data.

I recall someone posted they blacked out the numbers on their bank statements and received an RFE. It may have to do with how much other info you have provided.
BTW. Government agencies and their contractors shred any documents with your personal information on them. I can't say there are not dishonest folks working for the USCIS or no one working for the goverment has never stolen anyones identity. But before they get the jobs with access to your personal information extensive background checks are done.

I know someone posted they blacked out their bank account number info and got an RFE. I did not say that is why they got it...BUT I recall that was the speculation.
I'm also sure that there are agencies that are not as careful as others. But keep in mind everyone you send check to has the same numbers that are on your bank statement and I'm guessing a fair amount of those folks have access to your SSN as well. We do everything we can to protect ourselves by subscribing to a credit reporting monitoring service. Monthy reports and odd activity are dispatched to us.

True - in our case I worked for a state govt agency - we didn't shred documents - we paid an outside agency to destroy them - they use some kind of acids etc. (an employee of our agency oversees it as it is done). So this was better than shredding.
Not true - only sensitive jobs (where cash is handled etc.) require a background check. However a lot of work is privatized and those employees are required to be checked but we wouldn't know if they are or not. However, I felt very good about the process we had and till I retired I had not heard of any info being stolen. My only hope is that others are doing the same than we were doing. Good Luck

I work for a federal agency and our contractors can't get access to any systems (everything is electronic) without a background check and I understand that includes a credit check. There is lots of big brother. We have access to a system that runs checks on people (like Lexus Nexus). When I was a supervisor I was informed that a staff person from another section had run a check on a staff person that worked for me. Everything is looked at and monitored closely in our agency. Even when I called to get my tax transcripts from the IRS they were flagged, because my ex works for them and we had filed jointly for so many years.

I understand it's not the actual card. BUT when you change it with SS they do change your status and it will change with the the credit bureaus.. I did check. That's not to say creditor's won't give credit (obviously). Richard got his first credit card while he had his restricted SS card.

I made Tom go and get an unrestricted Social Security Card before his two year PR card expired. He went like 20 days before and they were trying to tell him some BS that he had to go 20 WORKING days before. Something like that, maybe it was 10. I don't remember exactly but they eventually gave in. What I took from that and from others on here, was that you can't get the unrestricted SS once your physical PR card expires. Which makes no sense since the status doesn't expire just the card. But you know how these government agencies are.

I personally already boycott Sears, they stink. Keep fighting it though. Did you go online and get a print out of what it says for his specific application? It sounded like that would have helped?

We ran (not walked) whistling.gif back to SS and got Richard's unrestricted card, as soon as the his G/C arrived... but really we had to...He could not have gotten an unrestricted Driver's License in Pennsylvania without it.

Unbelievable! I would think that is sufficient evidence.

Similarities that I have seen in other previous RFE posts:

--not enough evidence that spans the entirety of the marriage
--not enough evidence that shows co-mingling of assets and liabilities

The OP's list has both of these problems, so I am not surprised.

I agree. I was lucky and thank the fact that read VisaJourney before submitting our package. Although we had the documention to support co-mingling of assets and liabilities through-out the marriage, I most likely would have submitted our latest bank statements and tax returns and figured it was enough and presumed since it wad a continuation of what we files for AOS. Following the advice here I realized how wrong that was (whew).
Once again..showing how valuable this forum is good.gif .

Ok, I have a question ... most of us have come to the US a while - months if not longer than that after gettng married. So i assume the evidence they would refer to is from the time you actually started living together as husband and wife here in the right? I do not think we should provide evidence propr to that ... I am getting my pack ready myself ...

I'm not 100% clear on what you are asking but what I understand they are looking to see you didn't just open accounts and file taxes together recently just to satisfy the USCIS test of a valid marriage. By showing you have long standing accounts together (bank accounts, credit cards, tax filing etc) should satisfy that requirement.

wacko.gif I got a letter from Vermont Service Center today. It says "Submit copies of additional documents indicating that the marriage upon which you were granted conditional status was entered in "good faith" and was not the the purpose of circumventing immigtation laws. These documents should demonstrate the circumstances of the relationship from the date of the marriage to the present date (for the entire period of your marriage), and any circumstances surrounding the end of the relationship, if it has ended."
For I-751, I submitted:

  1. Copy of our 2006 joint federal and states of New York and New Jersey tax return.
  2. Copy of car insurance policy and ID cards.
  3. Copy of our credit cards showing a joint account.
  4. Copy of our health insurance confirmation statement for the year of 2007 and cards showing a joint policy.
  5. Copy of our bank statements on joint accounts.
  6. Copy of a postcard that my husband's cousin and her husband sent to us from Iceland, addressed to both of our names.
  7. Copy of our passport pages for vacations abroad and pictures that we have had.
We don't have jointly leased property or mortgage. No life insurance policies or no joint utility bills. My husband says, "Send the same documents as you sent before." I beginning to think that I need to submit tax return, auto and health insurance policies for the entire period of our marriage, but we do NOT save the old health or auto insurance polices. What do you think?

I would get the transcripts for all the joint federal taxes filed and submit statements from each year you've had the same joint bank account and credit card account...
If you have no joint leased property or mortgage I'd write an explanation why (eg US Citizen had property before marriage)
I agree sending the exact same stuff will get you nowhere.

good luck

Removing Conditions on Residency General DiscussionHow many pictures did you send?
We did not send pics, but we are not at the stage where we know if we will get an RFE or not.
I felt we had sufficient financial co-mingling to get by with no photos (joint deed to house, taxes bank accounts etc. AND hubby is a photographer and always behind the camera (and I hate having my photo taken).

I will add since then we have had a few photos taken together, just in case we get an RFE. He handed the camera over to friends on vacation and Christmas etc.

It's my opinion in the scheme of things the photos should count for very little. It's easy to stand together and smile for the camera, even in a fake marriage.

Removing Conditions on Residency General Discussiontravel while waiting for approval
QUOTE (gringuitalokita @ Jul 6 2008, 11:50 PM) <{POST_SNAPBACK}>
I mostly just read these days but want to share a story...

Paolo and I applied to remove conditions at the beginning of March, had biometrics in April and got the one year extension stamp a few weeks ago. We travelled to Mexico for a week to visit family. Today we returned to Miami.

At immigration she cleared our son and I and then asked Paolo where his visa was. We explained that we had the stamp. After that she typed a bunch of stuff into the computer and turned on the red light. Another man came over and she told him "Mom and baby are fine but he has a B10 and ADIT stamp. This man escorted us to a room and told us to wait to be called.

There were probably 30 other people in this room and 3 immigration officers - 2 of whom went to lunch soon after we arrrived. The biggest problem with this is that my son is sick (got some kind of stomach infection in mexico) - so I really needed to change a nasty diaper. I asked the officer if they had a restroom and he replied "sorry, not here". The room was not very clean and I had to change my son's diaper on the nasty stained floor. We ended up being there for 2 hours. After one hour Paolo was called up and they asked him where he went, what he did, how long he was out of the country and what is his ss number - which he couldn't remember - but thankfully had the card with him.

Finally, after two hours they called him again, stamped his passport and we were free to go. They never did tell us why we were stopped.

The biggest problem now is that I lost my passport. At one point they asked for it and I can't remember if I got it back or not because I was preoccupied with the baby....

We have a trip planned for Dec to go to the Caribbean. Last year when coming back into the US (from the Caribbean) the immigration officer queried Richard quite at bit and seemed to be determined to give him a hard time (his Green Card was still valid). He seemed to stop when he looked up and realized the line was getting to long, so his fun was over. We have decided because of this and stories like yours we are going to only look for direct flights. A long delay would cause us to miss a connection and with airlines the way they are today, we would really be screwed. This entire process….the length of time, the attitude etc is really wearing. I talk to many federal employees with different agencies and few could get away with “service” like this.

Bad news from USCIS...
Friday afternoon, we received a letter from USCIS claims that "The FBI can't check your fingerprint-card... blah blah blah... need to have it done again.... blah blah blah.... This time is FREE to get your fingerprint done...." March 8th @ 2PM.

This is the kind of incompetence that I have read all over the board, until now I got a chance to experience it first hand.
Wasted 3 weeks for nothing. The lazy yarning girl who took Kim's fingerprints did a sloppy job of capturing the prints, Kim told me that the girl complained how sleepy she was, how she wanted to go home and play with her little son, and how casual she was as if she knew what she was doing.... Kim noticed the machine didn't display "ACCEPTED" or any indication that the print was good on a couple of her fingers. But the girl insisted that it was good.... HOW MAD!!!!!!!!!! Note: wasted a good day of work for this SHEEEEEEEEITTTT! USCIS can you hear me now!
Sorry for venting!!!!!!!!!!

OK, March 8th @ 2PM, take-two!

Boy that really stinks...We were all re-fingerprinted at work (with the new "technology") for new Federal Government ID cards and there lots and lots of problems with them. BUT they knew right away....there was no delay.
They may be able to hear you..but the question do they care....the answer would be NO

Would someone more tech savvy than me please post our awesome update - the letter (dated 1/25/2013) arrived in the mail today providing the interview date of March 4, 2013.
Many thanks

I have a question for those of you who received your interview letters. Before your letters arrived in the mail, did your online status changed from "your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling to your N400, APPLICATION FOR NATURALIZATION was scheduled for interview"? Or did it remain the same and the letter just arrived in your mail box? If the online status did indeed change, did you receive the email and text message notification? Thanks in advance.

No letter yet but we did get an email that states "On January 24, 2013, your N400, APPLICATION FOR NATURALIZATION was scheduled for interview. You will receive a notice with a time and place for your interview" Our status on the website matches the email. But also provides no interview date.

I just got this email "On January 11, 2013, your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling." So if someone more tech savvy than me would add this to the list I would appreciate it. It looks we are running parallel to our neighbors to the north  .

This is the case status update that tells you you've been placed in line for interview :)

Thanks, I presume you are emailed/texted or find that status online. I have checked Richard's online status and did not see anything that looked like that, but I'll have to look again  .

Looks like no one from Texas Service Center has had their status changed to Interview InLine as of yet.

:help: What exactly is "IntInLine" ? I'm not sure where that status comes from. Thanks

Richard's biometrics appointment was easy peasy. His appointment time was 10 am, we arrived about ten minutes early. He was taken right away and we were on the way home at 10 am. The application support center in Philly is in the NE part the city with free parking. The interview will (sadly) not be here. But glad this step is easy. Good luck to all that follow.

We are joining the December filers. Hubby's (L) N-400 is read to go. All I have to do is get it to the the Post Office before 1 PM tomorrow. If all goes as planned our June 2013 vacation will be his last with as a UK Citizen. How fitting that we are visiting Bermuda  .

I checked my USPS tracking this morning and got this status  "You entered: EOxxxxxxxxxxUS
Your Item's Status
We attempted to deliver your item at 5:24 am on December 10, 2012 in DALLAS, TX 75222 and a notice was left because an authorized recipient was not available. You may arrange redelivery by visiting <a href="https://www.usps.com.../redelivery</a> or calling 800-ASK-USPS, or may pick up the item at the Post Office indicated on the notice. If this item is unclaimed after five days then it will be returned to the sender. Information, if available, is updated periodically throughout the day. Please check again later."

I guess this is normal. It's only the notice that they have the applications, since it's express mail and has to be signed for.

US Citizenship General DiscussionN-400 July 2012 Filers

well, when we had our interviews, the Philadelphia's processing time was current and people were getting their oath letters at the end of the interview for a ceremony scheduled about a week later. You can see such a trend on the trackitt as well.

We both were handed over N-652 at the conclusion of the interview with "recommended for approval" selected. They do not keep Green Card or any other travel document with them at interview, rather such documents are kept at oath ceremony. My interviewing officer confirmed that I should be getting the oath letter in about 2 weeks time since Philly has multiple administrative oath ceremonies twice a week (on Mondays and Fridays). After about 3 days, my wife's case got scheduled for oath whereas mine is still stuck at "Interview and Testing" status.

What is even more mind boggling is the fact that now Philly's processing time shows May 2012 cases being processed for N-400. This does not make much sense - but I can only think of this as a cause of delays in my case.

Sorry that you are stuck. I think I read that you did go to your Senator. If you do not get satifaction (the Senator's office should have picked up the torch for you) write a polite letter to the White House. I think you can do that online. It sounds like you really have gotten the bum's rush :bonk: . Good luck to you !

Did you get N-652 with recommendation for approval, or otherwise? If you were recommended for approval then keep on talking to tier 2 rep and see if you can talk them into opening up an SR for you - given that we are almost at 5 months mark (from the date of filing of our case). Remind them that you were recommended for approval. Explicitly asked whether the supervisor review has been completed or not.

In my case, even though my wait time had not been 90 days, nor the 5 months mark had past, but surprisingly the rep voluntarily opened the SR for me - since all he could see was that the case had been adjudicated approved as of the date of my interview. I am hoping that by Dec 15th (the lapse of 2 weeks of SR period) I will get something positive out of it.

Btw, the response from my senator's office was to wait and expect an oath letter by Jan 1st. Not sure, how did they come up with that date!

Hi alterego, We just sent in hubby's N-400 (also Philly filers.) I don't see too many of us, so do you know if your case is unique ? I see filers for other places get their oath directly after their interview. Philly is a big place you would not think there would be these issues. Also, did they take your Green Card at the interview ?
Thanks and good luck !

US Citizenship General DiscussionPhiladelphia immigration is center moving to University City
The Philadelphia office of United States Citizenship and Immigration Services will move into University City by the end of 2013.

According to USCIS spokesperson Anita Moore, approximately 135 employees will relocate from the current office at 1600 Callowhill St. and the Application Support Center to 30 N. 41st St., just outside Penn's campus.

I have a friend at GSA who tells me that they expect to relocate August (2013) and there will a nice room for the oath ceremony.

QUOTE (Moldovandish @ Sep 13 2007, 10:11 AM) <{POST_SNAPBACK}>
Well, my green card expires December 13th. I counted 90 days back and it looks like Sept. 14 is the day. Can I go to the post office today or do I actually have to wait till tomorrow, the 14th, to mail it out?
Oh, and is it okay if the dates on I-751 and the cover letter are a few days early or do they have to be signed not earlier than the day the 90-day window begins?

I can't answer this, but had the same question...so was bringing it up to the top, hoping someone can helpsmilie.gif
thanks...
