Hey,

I need your help please.
I applied for a K-1 Visa and waited 5 months. Then I got denied because I forgot to send in all the information. I hate myself for messing that up. Now they gave me the option to do a "motion to reopen" or to start a completly new case. If I start a new case then it's gonna take 5 months all over again. My and my fiancé would hate to wait that time again. I miss her soooo much! Now my question is did anybody of you did the motion to reopen? Is that gonna take less than 5 months? Or is it gonna take longer? And they told me on the phone that I have to pay $640 to do this motion to reopen. Is that correct? (it didnt say anything about that money in the letter where they told us the case got denied). And can I come visit her in the US just for like a few weeks while we are applying all over again or doing the motion to reopen? And what would you recommend for me to do anyway? A motion to reopen or a new case? The money doesn't matter by the way.

Please somebody help me here. But only answer if you know what you are talking about.

I would NOT consider getting married as the solution to your problem.

Here's what happened (if you don't know how govt works...) I imagine that super swamped uscis saw your application and said "is this a joke? (they probably even took it as an insult) and then probably said "ok, let's give him back what he deserves".

So reopening the case would amount to nothing because you sent them almost nothing. It would be better for you to re-apply and this time make sure you send all the documents required, check that every form and doc is filled out correctly, signed and dated, organized and the fee/check written correctly with the correct amount. in other words this time, do not give uscis a reason to deny you.

It doesn't always take the average 4-6 months if your application is well organized. The sooner you start the shorter you have to wait. click on the forms here under K1, print the instructions and the list of requriements.

and do not apply for a tourist visa after sending your i129f if you don't want complications. good luck.

Today I went to the second interview,,,,,, a new CO wanted to restart from the biggining, and she grilled me by the questions... Finally she informed me that I am denied and gave me a paper that explains why :
Ineligible to receive a visa under the following section(s) :

- Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act or regulations issued pursuant thereto. The following remarks apply in your case :
( Please note that your case is being forwarded to NVC for further processing. The petitioner will be contacted to complete the process.

-Section 212(a)(4) : which prohibits the issuance of a visa to anyone likely to become a public charge.

- Further consideration will be given to your visa application after you obtain and present the documents listed above and/or the following: *
( please note you are welcome to submit additional information for Consular Officer's review for reconsideration of 212(a)(4) above.

What does all that mean?
What should I do in this case ?
They denied it because my fiancee is not working and she has no income ,,, but why we asked to file an affidavit of support?
For what it is going to be used this affidavit ?
I am lost and frustrated and can not believe what happened.


aside from the forms you submitted or failed to submit, it's also all the information you provided or how you asked the quuestions that made the CO decide to give you 221g. any that you would like to share?

also, you said your fiancee will go back to work after surgery. did she work before? did you submit her latest income tax return? or how long has she had not work?

the basis of the 221g is not being able to, in simple terms, prove that she will be able to support you once you're in the US. did you submit proof that your sister-in-law owns the medical center (because to the CO, it's unbelievable that the sister is rich and your fiancee doesn't have income).

if your fiancee has work for a short period of time, then it's acceptable but if she has not worked ever for instance, then that's a different story.

bottom line is your (and even you, with any assets you have)has to show ALL proofs you can possibly get to show that you will not later on be a financial burden to the US (because your fiancee is looking like one already).

do and redo the two forms 1364 and ready an i864 and.

On November 15, 2011, I had an interview at the us embassy in lagos and i answered all the question the CO asked me correctly. After answering all the question with confident, the CO paused for a while. The CO told me that my fiancee was still legally married when we met so he gave me a blue slip explaining that "Dear Visa Applicant, We are returning your visa petition to the Department of Homeland Security office where it was approved with our recommendation that the petition be reviewed for possible revocation. Any futher inquires should be directed to that office. The reasons are as follows:
Evidence submitted indicated that this relationship was entered into for purposes of immigration.
my fiancee was married before and the ex-husband use to abuse her. She seperated from him since the year 2007. the divorce filled in 2009 and finalized in August 2010. We met in late late 2008, proposed in 2009 and filled k1 visa 6 month after divorce finalized. we are so disheartening, depressed, and helpless. We went to be living together already, married and start having kids. how can someone has our lives in their hand. since then, i have not been very happy, i dont know where to go or where to start. we both cried. GOD help us. we love each other so much and this distants is effecting us. the co did not found any fault but that. according to the law,it is perfectly legal to get engaged before your divorce is final. we both were free to marry when we fill the petition.

anyone with similar experience.....


so sad to hear your situation. looks like the response to your application was based on a technicality (did the CO find out when you met though your response?). anyway, it's not yet final. you may still have a fight (it will still be reviewed)she could (has to) prove that the failure of the marriage was the husband's fault (she said she was abused,did she apply as VAWA?) and divorce was filed 2009 (by whom?) because of legally acceptable reasons (was she afraid of husband/threatened?).

hello everyone... i did ask this question before, but need some straight answers! please help me! I am so worried this has been bugging me for sometime now.. just received our NOA2 hardcopy so we can schedule interview after getting MNL case number... Just want to know if the USEM will honor AFFIDAVIT OF DISCREPANCY regarding the error in my Birth certificate.. (gender issue).. My lawyer said my case is still pending.. i don't know if it will be finalized by the time of my interview i don't wanna be put on AP.. So here's my question for those who encounter the same problem and for those who have knowledge about this.. can i really use AFFIDAVIT OF DISCREPANCY during interview at USEM? Thank You!



gender discrepancy, although serious, is not as serious as say place of birth or date of birth. but seeing that it's not as 100% proof as your person that you really are the gender described in your BC, you have to combine that with affidavits from people who know you, school records, employment records, barangay records, pictures of you over the years showing clearly showing that your gender has always been whatever you always declared it, as well as a very good explanation as to why it never corrected/no attempt to correct it?

if you can't get as many supporting legal docs are you can, you might end up doing it the longer, expensive, court way =(

 that is a lot of money for consultation and for vietnam. tell our fiance that all she  needs to be is honest during the interview. she will not be asked how good her education is or if how much money she has. she will be asked simple questions about our relationship and her intentions. she is not alone, there are hundreds who are feeling the same way she is simply because they don't know what to expect. what she should be nervous about is if she has all her documents ready, payments ready, -all requirements for the interview. trust me, after the interview, she'll be okay.

Hello again, I am almost finished preparing my K-1 visa forms and photos...

 

The problem is, my fiancé in Vietnam is very nervous about this whole process. I have talked to her about this web site and the fact that we are fine preparing this ourselves and with the help of visajourney.

 

She made an appointment with a lawyer and they filled her head full of doubt. They told her they would walk her through the whole process from start to visa approval for $2,000. I told her I am doing all the work, and a lawyer will basically proof read our packet and mail. At a cost of $2,000

 

She is worried about her interview and believes she will say something wrong. I have told her it is all about the truth and us. That we will keep the whole process simple and honest. She is terrified that we will make a mistake and cost us another year or more apart. The lawyer has told her that she can help coach her for the interview. I am frustrated about this.

 

I would much rather spend our money on another visit, and preparing for our lives together.

 

Any words of encouragement for her? Any ideas how to comfort her on the interview process? Our case is simple and straight forward, nothing out of the ordinary. Just two people who fell in love 7,000 miles apart.

Yes it is stated on there. We simply overlooked it and thought the affidavit of birth would be sufficient.


 

uscis does not give exact timelimes for RFEs. but from secondary experience, the sooner you reply, the sooner the result. good luck!

Hello all! We just had an interview at the Montreal Consulate. The officer requested an English translation of the birth certificate. My question is does anyone have any experience or been through something like this, how long does review and approval take? We were not given great instructions from the officer so we had to search around the web to find what to do next. We sent the documents through the chosen Loomis Branch. Did we complete this correctly?

Any feedback would be greatly appreciated. Thank you.

 

you have an easy problem to solve: find a legitimate business that translates legal documents such as your BC (because not everybody understands written technical french). follow other instructions such as format and other docs to be insreted) send it right away to the address you were given and you'll get approved =)

indicate the date you signed it or if it's not too far away from the date you created the document, put the same date, it does not really matter as long as it was signed within 30 days of submission.

 

as for the evidence, no need to notarize nor sign, but make sure your photos say on the back who are in it.the occasion and date.  goodluck

anything and everything that shows that since  you met, you have been communicating...communicating about what? travel, meeting up, dating and that the communication has been steady and consistent and means that the relationship is serious. so for pics, around 6 showing you/both of you with each other's friends, family, at each other's countries, phone bills showing have long you  talk, how many times a day/week/month. the more, the better.

Please help, I have a few problems.
I filed way later then planned. I bought my fiance's airline tickets for April 2008 (they are non refundable), is that enough time to get the K1 visa? Oh, I should be good sent packet in last week already!

A question about the G325A, should her extented time in prison have been listed here? I am affraid this may hold things up.
Well, I am sure that the I -130 was filled out correctly!
After all we did get our NOA 1 and check was cashed really fast !
Our evidence of relationship, that's solid. We first met during a drug bust in Manila, this is well documented including goverment pictures of us.
We are both still married to others, that shouldn't be a problem. Once we get our interview, Manila will be able to see it's true Love!

Here it goes, I carefully nigotiated with the vermont center to get an early, super fast NOAH 2.
Knowing it can be cold up in that area, I used that to my advantage.

I offered the agent a entire frieght train of snow melt and snow blowers. One truck load of 6069 pairs of pink fur lined slippers ( one pair in red). One years of comlimentry dunkin donuts coffee for all, sugar and cream included.
In the end I was forced to throw in C -47 load of gummy bears as well.

Everything you need is here ! Even if your concidering using a lawyer, get started now! It could take you weeks to gather the items an attorney is going to need. You and your red head fiancee should simply click on guides button at top of main page. There is your attack list, no matter lawyer or not. You still need all those documents, pictures, evidence.

I recently sent 7 lbs of evidence/documents and 3 lbs of food items by USPS EXPRESS international . It cost $ 120.00, never again.
It took close to two weeks for a phone call that came from customs or something, apparently you must pick the package up if it comes by USPS EXPRESS. Zenaida had to pay taxes as well to add to the insult of not being delivered to the door. wacko.gif

you're right the embassy would usually require you to put your current address and then change it when you have a new address. when changing addresses, you have to call your visa center and they'll tell you what to do.

if you don't want trouble in doing it over and over again...photocopy (and clear copies) ALL, from the first to the back page, ALL meaning even the blank ones, because they want to see if the blank ones are really blank and not missing (which would make them suspect) ALL is ALL and remember CLEAR. now for the birth certificates, you can photocopy them anywhere as long as the copies are clear. make sure you bring all originals on your interview. good luck!

1. tell your fiance do the interview, she'll only need to mention/elaborate on her 3-month br work IF she's asked about it, otherwise she'll be fine, no need to offer the info/background about it.

2. you don't need an attorney at this point in the process because your application is in its last stage, -the interview. wait for the real outcome before you worry

it's normal to worry/panic but you shouldn't have googled because of course that attorney is going to say it would be denied to scare you so you will get his services. unfortunately, that attorney's advice of refiling is totally wrong, because your 129-f (meaning every and all information about her and you are already with USCIS) so any significant changes will be noticed and you will be asked to explain the new/different entries.

before going ahead with cancellation, find out the facts first...who said that the visa's GOING to be denied (usually it is either approved or denied, unless you have direct access to the consul officer who actually decides on this); mere past work at a go-go bar doesn't sound like a good-enough reason for a consul to deny visa (i personally know a person who came here on a k1 and who was in the same job) unless there' something else to it; who told you to just file a new petition? (the old one will not just be thrown away, it will be in your record and will always be referenced)

you should check on every detail first to make sure that if you do file another petition it does not end up having the same results.

congrats! next step is for you to gather and send all requirements for your fiancee's K1 visa application, for your fiancee to gather requirements she'll need for her visa interview, call the USEM to ask for an interview schedule, for your fiancee to prepare for her medical exam.
