I wish that was all my problems but it is one of many, this has been along and difficult process for us and in no way is this the only problem we have or had......I am glad she did not get hurt, but then again she was hurt mentally, and I feel terrible it had to happen to her!


as long as the receipt no. is still readable, it will be accepted. if not, she can go back to the bank where she paid for it and ask for a copy.

criminals know that most of the people who go the st luke's extention clinic carry a lot of money, unfortutanely your fiancee was one of their victims.

please tell your fiancee to be extra careful when she goes to the embassy for her interview. that's another place where she can be vulnerable especially if her interview is early in the morning.

you can when you get your EAD. first you have to get married, apply for AOS and include an EAD application with it.

as far as working for a call center, it's tougher here in the states because you have to compete with the native speakers of the language. but if you have what it takes then you definitely compete smile.gif

hello eros. this is what i found under the USEM website about inadmissability.
212 a (5)A says this:

The doc specifies all specific instances where an applicant will be inadmissable.
in sum, it starts...

Section 212(a) of the Immigration and Nationality Act reads:

(a) Classes of Aliens Ineligible for Visas or Admission.-Except as otherwise provided in this Act, aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States:

1. health related grounds
2. criminal and related grounds
3. security and related grounds
4. public charge

and then

(5) Labor certification and qualifications for certain immigrants.-

(A) Labor certification.-

(i) In general.-Any alien who seeks to enter the United States for the purpose of performing skilled or unskilled labor is inadmissible, unless the Secretary of Labor has determined and certified to the Secretary of State and the Attorney General that-

(I) there are not sufficient workers who are able, willing, qualified (or equally qualified in the case of an alien described in clause (ii)) and available at the time of application for a visa and admission to the United States and at the place where the alien is to perform such skilled or unskilled labor, and

(II) the employment of such alien will not adversely affect the wages and working conditions of workers in the United States similarly employed.

(ii) Certain aliens subject to special rule.-For purposes of clause (i)(I), an alien described in this clause is an alien who-

(I) is a member of the teaching profession, or

(II) has exceptional ability in the sciences or the arts.

(iii) PROFESSIONAL ATHLETES-

(I) In general.-A certification made under clause (i) with respect to a professional athlete shall remain valid with respect to the athlete after the athlete changes employer, if the new employer is a team in the same sport as the team which employed the athlete when the athlete first applied for certification.

(II) Definition.-For purposes of subclause (I), the term "professional athlete" means an individual who is employed as an athlete by-

(aa) a team that is a member of an association of 6 or more professional sports teams whose total combined revenues exceed $10,000,000 per year, if the association governs the conduct of its members and regulates the contests and exhibitions in which its member teams regularly engage; or

(bb) any minor league team that is affiliated with such an association.

(iv) LONG DELAYED ADJUSTMENT APPLICANTS- A certification made under clause (i) with respect to an individual whose petition is covered by section 204(j) shall remain valid with respect to a new job accepted by the individual after the individual changes jobs or employers if the new job is in the same or a similar occupational classification as the job for which the certification was issued.

(cool.gif Unqualified physicians.-An alien who is a graduate of a medical school not accredited by a body or bodies approved for the purpose by the Secretary of Education (regardless of whether such school of medicine is in the United States) and who is coming to the United States principally to perform services as a member of the medical profession is inadmissible, unless the alien (i) has passed parts I and II of the National Board of Medical Examiners Examination (or an equivalent examination as determined by the Secretary of Health and Human Services) and (ii) is competent in oral and written English. For purposes of the previous sentence, an alien who is a graduate of a medical school shall be considered to have passed parts I and II of the National Board of Medical Examiners if the alien was fully and permanently licensed to practice medicine in a State on January 9, 1978, and was practicing medicine in a State on that date.

© Uncertified foreign health-care workers Subject to subsection ®, any alien who seeks to enter the United States for the purpose of performing labor as a health-care worker, other than a physician, is excludable unless the alien presents to the consular officer, or, in the case of an adjustment of status, the Attorney General, a certificate from the Commission on Graduates of Foreign Nursing Schools, or a certificate from an equivalent independent credentialing organization approved by the Attorney General in consultation with the Secretary of Health and Human Services, verifying that-

(i) the alien's education, training, license, and experience-

(I) meet all applicable statutory and regulatory requirements for entry into the United States under the classification specified in the application;

(II) are comparable with that required for an American health-care worker of the same type; and

(III) are authentic and, in the case of a license, unencumbered;

(ii) the alien has the level of competence in oral and written English considered by the Secretary of Health and Human Services, in consultation with the Secretary of Education, to be appropriate for health care work of the kind in which the alien will be engaged, as shown by an appropriate score on one or more nationally recognized, commercially available, standardized assessments of the applicant's ability to speak and write; and

(iii) if a majority of States licensing the profession in which the alien intends to work recognize a test predicting the success on the profession's licensing or certification examination, the alien has passed such a test, or has passed such an examination.

For purposes of clause (ii), determination of the standardized tests required and of the minimum scores that are appropriate are within the sole discretion of the Secretary of Health and Human Services and are not subject to further administrative or judicial review.

(D) Application of grounds.-The grounds of inadmissibility of aliens under subparagraphs (A) and (cool.gif shall apply to immigrants seeking admission or adjustment of status under paragraph (2) or (3) of section 203(cool.gif.

...i don't understand either how she "failed" the interview and the CO marked her white slip x on the grounds of 212 a (5) A because it doesn't apply to her

...i hope you do call the USEM asap to get the details...good news is her case is not yet 221 (g) which means denied

i'm very sorry erosandsally.

but like you said, it was an honest mistake, usually she would've been told to bring the corrected document and given a white slip (for further administrative review)meaning until she submits that doc the CO won't be able to make a decision.

it wasn't like she made the error in the doc so the CO should have given her a chance to come up with it.

i hope she can tell you exactly how the interview went as far as that doc is concerned.

hi. the reason why you don't need to fill out what BDO attaches to your 157 is because it's just attached to your receipt. but as the embassy requires, you have to fill out a 157 form yourself, aaprt from the one BDO gives

1. do not sign in. you will sign in on your interview.

2. you're the fiancee (the one applying for visa), you are the one to sign it, not your USC fiance)

3. if you are single and a simple name ex. maria (first) santos(mother's last name in the phils/ middle name for americans) dela cruz (last name) and have never been called and used this name since you were born, you don't have anything else to put in "other names"

other names refer not only to other names used (if you were previously married) but also to aliases (if you used any at work/community etc) and third or fourth names (very common in the phils)

so if you have a long name ex maria (first) lourdes (second/other name) santos (middle name) dela cruz (last name)

in other words, whatever you are not able to include in the last name, middle name and first name category, indicate in "other names"

it depends on how many people will be in line that day, but the fingerprinting itself is very quick, just around 10 minutes.

there is no interview, not a formal or long one anyway.

you can bring your phone, just don't turn it on when you get in, i guess.

yes, you can bring your child.

bring your biometrics appointment letter among other things (bring your passport just in case)

read the instructions on your appointment letter to be sure.

not necessarily. the only main concern is what interview date you get. if you call for an interview schedule today, the earliest schedule they give can be the next week (but usually the next month), depending on volume of applicants.

if you can get the earliest schedule and she gathers all required documents, she can leave w/in a month or two.

if you mean other than a K1 process, she can apply for a (risky) tourist visa but w/no guarantee she'll be approved, especially if USEM sees that she already has a K1 application in process

as far as passport, she has to one asap for her K1 visa application.

seeing that the embassy already has your case, once you receive the official notice that your fiancee can already schedule for interview/medical exam, have her so do.

the medical takes 2 days, and should be done at least 2 weeks before the interview.

if she passes the medical and interview, visa delivery usually takes a week or sooner if she request the consul officer to allow her to pick it up herself (case-to-case basis)

in total, this could take just a month or two. then you can fly her to the US marry the soonest possible time after she arrives (some couples marry w/in a week of fiancee's arrival) then apply for AOS right away. the AOS takes some 4 (very rare) to 6 months (average) to a year/s. but if you're lucky and it gets approved w/in 6 months, she can already fly w/you (provided she meets the visa requirements of germany for an LPR)

if you leave by end of next year, hopefully you'll get things ready.

if you did your medical and interview already, you should've gotten directions and a list of requirements for that. but since it seems you didn't,

bring at least 4 photocopies of visa and passport ID page, only because photocopying is expensive at the CFO.

also make sure you know a lot about your USC fiance, you will need to fill out forms during the seminar.

fee is hopefully still P650 total (bring extra cash to be sure).

it's good to be early so you can get the sticker and certificate early too and go home early as well.

take MRT from baclaran, get off in cubao, take MRT going to katipunan, get off at katipunan stop...st mary's is right beside that station.


if you can, please request the staff to update themselves with the laws and procedures of USCIS and NVC, if they haven't done so yet. they gave completely wrong information to my batch last year.

it's best that you call st luke's directly before hopping on a flight to manila, to make sure they're open the day you plan to have your med exam. flights might get cancelled too if pepeng hits hard.

line outside the embassy is only for checking if people have valid appointment letters. when your fiancee gets into the building, there will be guards leading people to K1/K3 etc interview seats, the seating will determinine who goes first to the first phase first, -getting a number smile.gif

not sure if it's gonna work, but you might wanna try calling in about the mistake in the notice before the card arrives and notify uscis about the mistake. this might correct the dates before the card is sent and could save you money and hassle of returning the card and requesting the corrections.

Removing Conditions on Residency General DiscussionAnyone approved without evidence of commingled finances?

I thought bank account statements are needed for interview to show activity and usual eveyday spendings on the account? We don't really use that account, only if we really need it for emergencies.


your bank statement doesn't need to show spending. what' important is you have it. besides, there are a lot of other proofs of co-mingling such as letters/cards addressed to both of you, pictures of you at family gatherings, joint tax filing, etc

I was in Phil dec. and Jan., I had seached all the online engines for that flight. My regular travel agent was around the same price. When I told my filipino worker/friend about the price, he told me he could do much better. I didnt listen much until he called his agent from virgina, USA( mostly filipina's), price was $ 300.00 less than cheapest I could scroung up. They also have sister branch in Phil. I really need some help in here, please. :-( I'm trying to book a one way flight from Cebu (or Manila) to US using online booking engines. I was able to find some "really" good deals but my problems are these:

Anyone in here has some suggestions on what to do? Or anybody knows a site which would allow bookings for credit cards issued from other countries aside from the US or Canada?

I have Visa and Mastercard, and I prefer buying online coz it is much cheaper compared to travel agencies here in our area. I just need a booking engine which would accept my credit card.

I would really appreciate some help guys.

Am sorry to say about I believe your going to have problems with this issue. Herpes 1 and 2 are a very contagious virus that we don't need more of it here in the States. I really hope am wrong but again good luck!!

I know a nice place in quezon city, 1399 php, double bed, book over phone or on line direct, no deposit in advance, pay cash is ok. I have been there three times. Do not just walk in there, u will be shoehorned into the upgrade room, not any better! Good food, its the Great Eastern Hotel.

After hearing from all of you, I now fully understand akin babae dislike for taxi drivers. We had a nasty encounter/argument that climaxed with the driver nearly refusing to let us out. He just stopped in the middle of a three lane road, trying to teach us a lesson. With my very whistling.gif limited knowlege of Tagalog, it was sorta scary. At my babae demand, he did end up pulling up to a waiting taxi.

I was riding a mopped close to the old Clarks Air Force Base and some police were pulling over foreigners. They noticed me and pulled me over. I was told I needed to pay 20,000 paso or I was going to jail for not having my license on me.
I told them I didn't have the money, but did in a safe at my hotel. They as where was the hotel. I told them the hotel was next to the tours police, they seemed not to like that and told me to cross the street and put the 2,000 paso I had in my pocket under the blanket in the back seat of the van parked there.

Or I should ask, are they needed sooner than interview ??
I just dont want to send it to early, so financial support and relationship evidence is recent.

He, he Mike. I know how she felt, I spent 13 hours waiting out side while poor Zenaida waited in line for her passport.

Funny, a news camera crew showed up when we where there. They wanted to film the long lines, and they did so from outside. The official's looked like they might ruff them up at first. blink.gif I was the only white boy hanging around, thought I may end up on TV. whistling.gif innocent.gif
