it's actually faster to get to the different floors using the stairs (only 4 floors if i remember right) it will save her time waiting for the elevator and provides for good exercise too! yes.gif

you're absolutely right. i think it's mostly for the comfort level that some people get in writing in specific languages/dialects, because it enables them to express in the clearest and most specfic manner and obviously hope those who speak in the same language would reply.

let's just be more understanding and ignore what we read that we can't understand...less stress, hehe, or take it as a challenge and learn to translate with the help of our SOs. smile.gif

if submitting application, get an affifavit stating the discrepancy as well as stating that both are one and the same person...it really depends on you fix it in your country...so call your local civl registry too on how they can correct this...you cannot explain this verbally during your visa interview. you have to provide proper legal documents.

since you're now approved, all you need to apply for visas! once you get the hardcopy notice, you're good for an interview and medical, so get appointments. the speed will be mainly up to you!

1. if you've been approved since may it means they won't send it anymore, just complete the list of docs required (see below)

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):
1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6. A copy of the NOA2 that you received in the mail.
7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)


2. it's better to get an interview schedule first then pay for it; they will print the receipt on a blank ds-157 , but bring your filled out one just in case.

it shouldn't be a problem for as long as in all other documents the second name is included, meaning in some documents his name is shorter (only the second name is included) and in some it's longer (includes the mother's maiden name)

but, yes, in your G325 you have to write down ALL the names he goes by

ex. on his 1040 : juan miguel dela cruz
on passport: juan miguel santos dela cruz
birth cert: juan miguel santos dela cruz

when you change your name later, you will find out that here in the US the middle name is the second name (whereas in the Phils middle name is mother's maiden name) and they don't use the mother's maiden name. so if you have only one name (ex john) and your last name is smith, and you don't have a middle name, then your legal name is john smith)

but you also have the option to include your mother's maiden name as your middle name... smile.gif

If anyone out there have similar case and who is already gone through this same situation, I will appreciate it very much if you can give me any details or input.
What did you do to accomplish the Custody Papers? Did you or have you gone to the court? Or did you file at the police station the missing father?,... or did you have your case published on the newspapers in the Philippines? Please any feedback... I will appreciate it... there is a person in a similar situation as you look up "i miss my son" here on VJ. anyway, while it is correct that in the Phils if the father is not involved in the child's life the mother has automatic custody, it looks like yours is not exactly that because you put the father's name in the birth cert.

so to be able say that you have had full custody of the child since his birth, you have to be able to say how this happened (because the father didn't know about the child, he just went missing, died etc)

to be able to help you find the answers, may i ask what happened to the father? is he still alive (or missing as you said)? do yo have access to him (if you do, do you think he'll be ok to sign a statement stating that he's acknowledging your son and that he's ok that you're stating that you've had full custody of the child since he was born?) it would help a lot if you still communicate with him.

you might or might not need to go to court, depending on the circumstances. did the father know? does he know now?

if it applies, you might have to state that you've tried to contact the father (to inform him about his son, ask for support etc) but to no avail so you took care of your son on your own and maybe with the help of friends and family, and now that you're here in the US, it's a family member/friend who's taking care of him while you send financial support, etc.

if you really want to do that pleasure trip you're really safer to extend your visa (some asian airports check tourist's travel plans for one reason or another) it's also easier to show a properly extended visa than verbally explain your situation to a non-english speaking person.

she can travel after getting her CR1 visa and restrictions will depend on where you plan to go. japan and korea for instance require a visa, while singapore, thailand and hongkong do not (for short trips)

This is not true for the initial petition. Proof of an ongoing relationship is only needed at the interview. All that is needed for the petition is proof of having met in person within the last 2 years prior to filing.

look slike what the USEM is saying is you have to make sure the accompanying english translation also bears a statement that the person who translated the doc is certified/licensed/competent (on the english translation itself) or accompanied by a separate doc stating the same.

you don't need to inform the embassy. what i did with mine was attach the old one to the new one during the medical (where they get it and forward to the embassy for your interview). that way they will see that you submitted the old one initially but you wouuld like the visa to appear on the new one.

attach securely though to make sure they stay together.

This was my experience with the process at the US Embassy in Manila.

I recommend that the US Parent be at the interview. Both my wife and I was present .
Application are accommodated by appointment only. When I was in the PI I did mine as a drop in case with my daughter because of time constraint and got the interview four days later. Can’t say that it will work for everyone.

One thing for you to be concerned is For out of wedlock children But I must emphasize all of the documentary evidence on part 9

For me the main things they looked at was physical presence in the same location at applicant’s time of conception, ultrasound and pre-natal care records, they never ask for pictures or looked at the one‘s I submitted.” but never say never”
They talked a lot about DNA and my case was bullet proof so just be prepared.
Don’t forget you have to bring the child with you they want to see him/her.
This is my list of documents that I submitted to the US embassy in Manila for CRBA.

DS-2029 with 2”x 2” full face passport photo. (child)
NSO true copy birth Cert. (child)
Passport application. (child)

Proof of parent US citizenship.
1) US passport.
2) True copy of live birth cert. with original seal of vital records office. A must have!
3)High School transcript ..(Yeah funny, but I’ll tell you more about it later it’s not a joke)
4)True copy of NSO Marriage cert.
5) Proof of physical presence in same location at time of conception. Airline tickets, copy of visa stamps.
6) Proof of mothers pregnancy, ultrasound, pre-natal records, hospital billing statements, and pictures.
Now about the school transcript you as a US citizen have to prove you are a citizen, you have to show that you have been living in the US for 5 years in a row….. They will not take your tax returns as proof, I can tell you why but I don’t want to write a small book about it. When you give them your school transcript they take them with out a word…Had her US passport and CRBA cert. in about 10 days at my wife’s home. PI.

yes, it's ok...just make sure you have more than just WU receipts like letters, cards, and pics to go with that.

Some tips on the affidavit of support

If you need more than one affidavit, fill out the entire form but leave the signature blank, then sign each copy and
the original. It states in the directions
that you can do this.

Not having adequate income will not usually be a problem if you have a co-sponsor, according to experiences
posted on the newsgroup, as long as the co-sponsor has adequate income/assets.
Be aware that the co-sponsor must have enough income/assets for both your fiance, any fiance children that will
be immigrating, and his/her own household. However, that IF the US fiance has been on welfare or other
government benefits for a lifetime or has no plans to work actively, the consulate can still deny the visa based on
the likelihood that the foreign fiance will become a public charge. Just having a co-sponsor may not be sufficient.
An actual case has been documented wherein a fiance visa was denied because the petitioning fiance was on
government benefits and would not be working, even though the US fiance had two co-sponsors.

When assets are used, the assets must equal 5 times the difference between the annual income and the
needed 125% of the poverty level, this is because the affidavit is in effect for 5 years. For instance, if you
needed $15,500 income and had an annual income of $13,500, you would need an extra $2,000 of assets for 5
years, or a total of $10,000 in assets in addition to your income. In general, if you are deficient on yearly income
for sponsorship and your assets are somewhat borderline, do not take chances--have a co-sponsor. If you do not
have a job or a steady income from other sources (such as retirement income), you will likely have to get a
co-sponsor for your spouse, even if your assets are adequate. The USCIS looks VERY CLOSELY at current income
and not just the assets.

While there are no specific income requirements listed in the I-134 form directions, you will be judged by the
same criteria as the I-864 form requirements when they are issueing the visa at the foreign US consulate, so
provide financial information for the I-134 with those guidelines in mind.

Basically, your employer letter should state "To whom it may concern: (first name,last name) has been employed
full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an
annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company
letterhead.

Some foreign U.S. consulates require a 2nd affidavit of support which is called "sponsor's financial responsibility
under the social security act." It is a simple form and easily filled out and signed. The Hong Kong consulate does
require this form, as does the Sydney (Australia) consulate.

The foreign fiance's income can NOT be counted on either affidavit (except when the foreign fiance has been
living with the fiance, married, and in the US for six months), however the foreign fiance's assets CAN be used if
they are readily convertible into cash. The USCIS is concerned ONLY about the US fiance's income/assets. (Note
that in other situations the foreign spouse's income MAY be counted on I-864 affidavit, such as foreigner in U.S.
on work or student visa who marries and then files for adjustment of status. IF the foreign spouse has LIVED IN
THE HOUSEHOLD of the U.S. spouse for at least 6 months, then his/her income CAN be counted. There are
NO situations involving fiance visa in which foreign spouse's income can be counted, as far as I know, when
interviewing for the fiance visa or when filing adjustment of status within 6 months of arrival in the US.)

The US fiance is ALWAYS the primary sponsor, but may have a co-sponsor. If there is a co-sponsor, both the
US fiance and the co-sponsor will EACH have to fill out the affidavit I-134 or I-864 and EACH will have to provide
supporting documentation.

NOTE: I-864 SPONSOR MOVES: FOR the I-864: If the sponsor or co-sponsor moves, the USCIS should be
notified within 30 days via an I-865 form.

as for the CFO seminar, yes you can already attend that but since you don't have your visa yet, instead of getting the sticker and certificate on the same day, you get it when you come back and present your passport/visa

docs needed for your interview, aside from the 1-134 are these:

A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6. A copy of the NOA2 that you received in the mail.
7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

I have met her. We spent almost three weeks together in the Philippines. To the others in the thread she is currently not working. So I am doing full support for her.

I have asked her to breakdown expenses, and have only received guesstimates on expenses. Then when have gone into it further. She told me had paid for a birthday party and gifts also. She has no children. This is really causing pain at this point because do love her, but the lack of responsibility with money pains me. 300 dollars seems excessive in 14 days. I fear she has given her mother money to get involved in a networking scam over there. As well as giving money to everyone in the family. I really do not know for positive though, and it pains me to ponder these questions. Would just rather address this now than 6 months down the road. We are to the point that just filed for 129f.

Edit: She is paying for a boarding room. She is leaving there this month, and it is provincial, and not Manila or Cebu.

I am looking to see if my concerns are just in my head, or if there is reason to be concerned. I am not trying to bash her or anything of the sort, or grab attention. Thank you for the replies.



1. insist on an expense breakdown.
she has gotten used to receiving the amount and must think you earn a lot more that you actually do
she has to know that as much as you can send her that much, you're earning just enough.

2. if she's saving or sharing the money, she should stop doing so because then the other people she's sharing to would think you're ok with it and that the money's for them too (something about the culture makes them think this)

3. as early as now she should learn money responsilibity. $300 is more than twice the salary of an entry-level employee in the phils.

it's way more than enough for boarding house, food, clothes and cellphone bills, especially if she lives in the province.

chances are she's supporting the whole family and extended relatives, which is not a bad gesture on her part but not good for your relationship if you don't have a say on it, and not even aware of it.

this is a problem. the earlier you fix it, the earlier you will know about the real intentions/feeling of your fiancee.

i'm in my third trimester...actually last 3 weeks of pregnancy...and my first trimester was really bad...i didn't have an appetite for anything...always nauseous but couldn't vomit, couldn't stand most food etc.

to help with the whole process, both of you can search on the internet for what the normal symptoms and there are countless pregnancy sites she can sign where she can find help with food, symptoms, see the progress inside her, etc

...or buy the book "what to expect when you're expecting" my sis-in-law bought it for me it answers a lot of questions for you when you don't have a lot of people around that you can ask, and it covers EVERYTHING..

for now though, you can buy unsalted crackers so she doesn't starve herself and a ginger drink, this combination worked for me.

i hope she didn't get that affidavit from one of the instant notaries right outside of the embassy...they're good for simple affidavits but it's not an affidavit of support you need...it's an affidavit of discrepancy...still, since the discrepancy in her name is major (as if the two names belong to two different people) she will need to do it the long (more legally correct)
way

if you/she really wants to fly with her son, she can process the correction (might require court appearance etc) with plenty of time. anyway her visa will be good for 5/6 months. that should be plenty enough till she gets her son's passport.

Interview (in person) for Adjustment of Status

Eventually most people (see exception below) will receive a letter from the CIS informing you of your interview date. It will include instructions on what to bring to the interview and any required items you may need to complete before hand. One of the most critical items requested will be "evidence of the relationship" which proves that your marriage is true and faithful (i.e. photos, joint checking account, joint lease, joint mortgage, and birth certificates of children if any, etc.). Also, it is important to bring the current passport of the beneficiary to the interview. The interview is fairly painless and may be video recorded and lasts between 15-30 minutes. If approved you will be mailed your "green-card" shortly after the interview date (weeks).

My wife came here on a K-1 visa. We are married and awaiting processing of the AOS. She has her EAD card. She also has a State ID card. We plan a trip back to the Philippines in about a year from now.

Purchasing one way tickets is much more expensive. We are trying to avoid that. When I purchased my round trip ticket to go bring my wife here, I purchased her a one way ticket (800 USD) and myself a round trip ticket (1200 USD). Using Northwest Airlines flying from Charleston South Carolina to Manila.

Has anyone been through this and what did you do to prevent purchasing one way tickets???



I took my vacation last May 2009, I bought plane ticket with my married name and I found out that, you cannot enter in to the boarding pass unless your plane ticket and your name into your passport are match , so I have to go the Phil conulate to amend my passport and I found out when your husband are married before and divorce to a filipino citizen . They said I cannot amend my passport because PHIL did not honor divorce, all that they can do is to give me a certification of one of the same person . I got the cerification on the same day with zealed, and my vacation was hassle free !

Just buy a plane ticket with name match in to her passport and you will be fine!



your travel will be after a year yet, so she should be getting her GC by then, which should show her married name, which will not match her passport name, and when she changes her passport in the phils, it won't match her ticket name anymore...

get a ticket in your wife's maiden name. she will get her new passport (married name) AND old passport (maiden name) back anyway (unless the DFA changes its policies by then and not give back the old passport). anyway, bring your orig marriage cert too as back up doc at the airport for coming back.

I was there today too. smile.gif Although our daughter and I didn't arrive till 8:00 a.m. We finished around 1pm, not bad.

Since Pippo (our daughter, she is 10) had primary complex when she was little, they gave us a choice:

- either come back the next day and bring a medical certificate from her pediatrician detailing how she was treated, and then she would need a chest x-ray; OR

- have the TB Skin Test (TST) done, get the results on Friday (no choice, it's a 72-hour wait no matter how you slice it). If they are negative, then nothing else needs to be done...she can proceed with immunizations.

We went with the TST. Going back there on Friday...I really, really hope nothing else needs to be done. Wish us luck!


Yup she was there today .... I am not sure what all the tests she had to do ... I know she had the chest xray and they with drew blood .... than was asked to return on October 28 for release and vaccinations ....


if they said "for release and vaccination" then your fiancee passed...i hope she heard the date right though.it's also possible that whoever told her to come back gave her the wrong return date...if not, then looks like her results just happened to take longer than normal so don't worry .

anyway, this is the reason why people are told that having the medical one week before the interview is ok but not really ideal.

again, don't worry. just have her attend the interview, when she's done with that, the embassy will wait for the medical results and then issue the visa.

Will this be an issue or a problem? If so, I would rather just not submit the police clearance and just send the NBI, or if you think it won't be an issue, i an just send it... the deal is, that blah blah2 and blah blah3 are right next to each other and she lives on the boundry..

Okay, the last issue, is about work... my wife hasn't had a "real" job. She worked for relatives helping out in their home business, which is a bakery for about a month when she was 15, and then again for a couple more moths when she was 17. Does this need to be listed? Or does it count since it wasn't "real" employment with a company with payroll etc.

the police clearance and barangay clearance are not required to don't include them. the discrepancies in these docs would only cause unecessary trouble for your fiancee.

the police clearance/s asked for applicants are those from countries (other than phils) in which they worked/resided for 6 months or more.

the employment being asked is only for the last 5 years, so check first if her employment when she was 15/17 is covered. if so, then yes those have to be included. not "real" as they are, they're still considered employment because she earned from them and had employers yes.gif

The BDO is that the bank payment for the visa application?

If so, unless another $131 drives you bankrupt.... and be glad that your fiance did not get hurt...

please pay it again and get a new receipt from Banc De Oro, if it make you worry so much...

I wish that was all my problems but it is one of many, this has been along and difficult process for us and in no way is this the only problem we have or had......I am glad she did not get hurt, but then again she was hurt mentally, and I feel terrible it had to happen to her!


as long as the receipt no. is still readable, it will be accepted. if not, she can go back to the bank where she paid for it and ask for a copy.

criminals know that most of the people who go the st luke's extention clinic carry a lot of money, unfortutanely your fiancee was one of their victims.

please tell your fiancee to be extra careful when she goes to the embassy for her interview. that's another place where she can be vulnerable especially if her interview is early in the morning.
