hello! i need your advice regarding the situation of my friend...

she is an immigrant and she can start her citizenship process on june 2010. she recently got married and her husband has a tourist visa...they are now together here in US. the husband can stay here until july because he is only as i said a tourist visa holder. now they need your opinions about their situation because some people told them that the wife can file for a CR1 while he is still here and he doesnt need to go back to the philippines anymore..what would be the best way? i advised him to just go back home and wait for the processing but im not sure if thats the best advise or way....

the naturalization will take probably 6months and another 6 months for the I130, what do you think should he stay or should he go? hehe...

so your friend obviously has two options, petition for her husband as an LPR or wait til she's a citizen before applying.

petitions by an LPR take longer than those of a USC. the good thing is your friend can start the process now and make it shorter when she becomes a USC, -change the status of her husband from immediate relative/spouse of an LPR to immediate rel/spouse of a USC.

in either case though, her husband's visa stay of 4 months will not be enough for the whole process.

if she petitions for him now as an LPR, he'll have to wait til the petition is approved and then wait for a priority date to become current (date when a visa in his category becomes available) before he can actually apply for it. in other words four months (mar to july) of legal stay in the US is not enough for the whole process. even if he goes home after that, the whole process would still take longer than if she waits til she becomes a USC.

consular processing will apply to him if he goes home and your friend takes that petition route, but not while he is in the US on a 4-month only legal stay.

so if he doesn't want to become a TNT, tell him to go back to the phils before the visa expires, whatever the status of his wife's petition. otherwise, uscis/nvc will suspect that the tourist visa was used to bypass the immigration process.

hi good day fellow vj's. im preparing my reqrd. documents in the future interview for IR1 pet., im worried about my baptismal certificate. my first&last name was mispelled,father lastname mispelled, mother first name mispelled...do i need to bring this and show it to CO during the interview? or do i need to bring supporting documents like affidavit from lawyer,.do you think guys there will be a problem in my mispelled name. need advice! thanks in advance!


since it's just a baptismal certificate you can bring it back to the church and request corrections.

besides, baptismal certs are not required so for as long aas your BC is correct, you're fine :)

I got married last year and last Feb 2010 the consulate gave me one year extension with my passport. Since im already here in my country i decided to renew my passport this afternoon while i was there i encountered some problems coz of my dumbness i didnt know that i need to file the Marriage Contract and get it authenticated here in Philippines.. In short i still dont have a record that im already married here in Philippines coz my MC is registered in US.. And theyre asking me some papers too if i want to use my married name. But since im running out of time to process everything again plus i need to go back in US asap i just decided to renewed my passport with my maiden name again with still "single status". Can i still amend it later on?? Am i not going to have problem goin back to US? My old passport will goin to expire on Feb 2011... and right im jz waiting for the delivery of my renewed passport..



yes, you can have it amended when you come back to the US.

no, you won't have a problem coming back if you have our AP (i assume you have it coz it shows in your status that your AOS is still pending?)

just make sure you show both your old and new passport

We are at the point now of wanting to schedule our medical followed by interview in the next few weeks.

I want to confirm I am understanding correctly about scheduling. Please reply if you have already done it.

Scheduling Medical:

Can we just show up in the morning when they are open without contacting them for any medical appointment in advance ?

I have the phone number we can call to schedule USEM interview. We don't need any letter directly from USEM Manila before we can call to schedule or arrive for the interview correct ?
I mean once scheduled they are supposed to send a confirmation letter (packet) to my fiance right but we don't have to wait for this ?

We don't have to recieve this letter before we arrive at the scheduled USEM interview as long as we have prepared the documents, forms that are on this letter before we show up ?

I heard of some people not getting this letter in hand for a long time. That's why I ask. I want to make sure we don't need this appointment letter in hand.

From what I understood we don't have to have USEM interview letter in hand or (K Packet) as long as we have the completed forms required below:

Just to make it clear, the medical is done before the interview. the results of the medical are a major part of the visa process, which if the embassy doesn't have at the time of interview could result in delays in the visa approval.

yes, st. luke's appointment is not required. just go there any day (opens at 7am) w/the necessary docs (the NOAs you have/MNL/case no. passport, 2 ID photos to be submitted to the embassy together w/medical results, medical fees) make sure your fiancee doesn't have her period when she goes there.

yes, you can schedule for an interview already, chances are your fiancee's case is already w/the USEM or on its way there. in any case, as long as she already has a case no (MNL#) she's good for an interview. just make sure the schedule you will get will leave you plenty of time to gather all the docs she needs and supporting docs that would come from you, such as the affidavit of support.

depending on the size, kind, and amount of money you want to spend, you can purchase from here and send it though a courier.

but if you want to be practical as well, it would be better to just call the big malls there about what they have. they all have delivery services, except when the address is very remote.

or you can contact a friend to do the purchasing for you, so as not to ruin the surprise :)

Hi.just came to the states last month and we plan to have a civil wedding ceremony this coming 28th.But before that my fiance is asking me to sign for pre-nuptial agreement.He is widowed for 9 years and have 2 sons not living with us.I think he dont trust me!!if ur in my situation guys what's ur reaction or opinion.Do u agree with prenup?any comments pls.


it's probably not because he doesn't trust you but because he wants to protect specific things that he has put aside for his 2 sons and for himself that might become automatically conjugal if he doesn't make the pre-nup.

talk about it with him, make sure it doesn't say you will get absolutely nothing if he dies or you get divorced, because then that would be a different story.

if he doesn't trust you, then sign the pre-nup to prove that you're trustworthy (you're not after his properties because he acquired them before he met you anyway) plus here in the states divorce happens to 1 in every 3 marriages (i could be wrong) so that could be another thing.

sign it, you have nothing to lose if you don't have properties yourself, or if you do, the pre-nup protects you from losing them.

She failed physical and has to do the sputnum test What happens now? What is the next step? What happens if she doesn't pass after the two months?


if the sputum test comes out negative, she'll get to go ahead with her interview.
if not, she'll have to undergo treatment, reschedule her interview and go back to st luke's after 2 months (or depending on what';s required for her)to have another sputum test/x-ray, to see if her symptoms have cleared. if they do clear, she'll be cleared as well to go to her interview.

it will delay things a bit but all your fiancee has to do is follow whatever treatment sched she'll be given to get through it.

Hi to all;

My appointment visa confirmation says that I need to pay 2-3 days before my interview. April 5, 2010 is my interview, and it is after holy week and after a long vacation. It is even mentioned on the letter that the embassy will not accept any underpayment? Next week will be holy week and I dont know when should I pay. I went to BDO already and they told me that they cannot confirm to me the technicallity of the letter because it was the embassy who made it. Please advise! Thanks.


2-3 days means at the latest, -which means it's ok to pay way before your interview date, say next monday. though next week's already the start of holy week, banks are open till holy wednesday usually. BDO is open on saturdays too.

My petition arrived in Manila today (Friday) and I've received the MNL#..

I was going to see about having Milagros go take her medical next week while she has a break from school, but I wanted to confirm something.. We don't have an interview date yet and I did not receive anything in the mail just yet from the NVC.

Would she still be able to take her medical, or would that pose some sort of issue? Can she just provide a copy of the NOA2 and the NVC MNL #?

Appreciate any input.. I really just want her to go next week so she won't miss any school..



that's exactly what you need to bring to the medical, the MNL no. (proof that her case is w/the USEM)
she can already go for her medical and you can already call for an interview date (make the date at least 2 weeks after her medical schedule)

make sure she brings the other necessary things such as her passport (6mos validity or better), 2 USEM-standard ID photo, and medical fee

no need to call for an appt, the earlier she goes there, tje better.

also, tell her to avoid going on a monday (busiest)

Please help, I have a few problems.
I filed way later then planned. I bought my fiance's airline tickets for may 15 (they are non refundable), is that enough time to get the K1 visa? Oh, I should be good sent packet in last week already!

A question about the G325A, should her extented time in prison have been listed here? I am affraid this may hold things up.
Well, I am sure that the I -130 was filled out correctly!
After all we did get our NOA 1 and check was cashed really fast !
Our evidence of relationship, that's solid. We first met during a drug bust in Manila, this is well documented including goverment pictures of us.
We are both still married to others, that shouldn't be a problem. Once we get our interview, Manila will be able to see it's true Love!
My main concern is that I signed my full name on all documents like my passport.

ang ibig sabihin siguro ng asawa mo eh dapat ang income nya sa isang taon (para sa 4 ma miyembro ng pamiliya) at least ganoon, kasi may tinatawag na poverty guidelines na dapat maabot para makapag-petition ng asawa. ngayon kung hindi abot ng asawa mo yon, pwede syang kumuha ng tinatawag na co-sponsor, -kamag-anak o kasama nya sa bahay na pwedeng tumulong. kung meron, yung taong yon ay mag fill-out din nung form para dalawa silang mag-sponsor sa iyo.

may pag-asa ka pang makaalis...ang income ay isa lang sa mga kailangang ipakita...mag-send ka sa akin ng PM (i-click mo yung envelope sa may pangalan ko) kung makakatulong pa ako :)

ok I kind of dragged my feet on this ....but we haven't gone to get her card yet .....here is the question......should we go this week to get it when we are getting married in a few weeks or should we wait till after the wedding so we dont have to make 2 trips and get he married name on it?


if there is no immediate need for her ssn. it will be morepractical to wait til after you're married. remember though to do it NOT later than 2-3 weeks prior to her 1-94's expiration :)

I want to renew my passport (Washington D.C Phil.Consulate)and then file to report of marriage but i dont know where to have valid photos that meets their photos specifications.We did not file AOS yet and i dont know what photo shop good for AOS photos.


photo for report of marriage and AOS should be 2x2, color, white background, although on the rep of marriage form you will cut it to fit the space provided. (we did this just 2 weeks ago)

Hey all,

My wife just renewed her passport in San Francisco 2 weeks ago since her old one expired. I remember seeing something about a new passport number being assigned, is that true? The question I ask is because I am trying to book a flight to the Philippines on EVA Air and it is asking for her passport number. I don't know if they change the passport numbers for sure or not. If they do change the number, do you think I could I put her old passport number in the box? Trying to book the flight for May and request time off from work, but now I am not certain because her passport wont be released until April 29. Anyone have any answers? I tried calling EVA Air but kept getting people who barely spoke recognizable English and I don't even think they understood what I was talking about.

if hers is the old passport (non0machine readable) then yes she will get a new passport number.

but i know that you can book flights now and call in the passport info later :)

you should already have received it. anyway, you can email them and ask about your application, just follow the instruction on how to do it, at their website :)

I have a few final questions on the paperwork before we go to our interview soon. I tried to put them all here instead of starting too many threads.

Please reply if you have done your interview already and have helpful comments :)

1. For my Letter from Employer, Can I just make a letter with our company letter head that shows my job title, salary, start date etc and put my manager's title and contact info at the bottom ? Or do I need his signature on it also ?
He works in another city and I've only seen him twice.
Is the letter with my employment details good enough ? I will have paycheck stubs and W2's of course.

2. Is it any problem that the company name I work at and the company name on my paychecks are different ? I work through a consulting agency but for a different company on site.

3. Since I filed our I-129F for our K1 I have moved and have a new job. My home address and employer info on my original G-325A is outdated. Do I need to bring a new G-325A with my new correct address and employment info ?

4. On my original I-129F some people suggested that I put for my fiancee's current employment as "homemaker" and put her mom and home address for employer. That is since she has never been employed and just helps her large family daily with housework and care. One of the forms for the interview asks for employment info including a business contact phone number for her. Should I just put the same there with her mom as the employment contact ?

5. Bank Records: Can I just print out the main page of the last 12 months bank records showing total deposits monthly and final balance instead of a signed Bank Letter ? (I'm not sure if my bank will give me a signed letter like that.)

6. What is the National Identification Number (If Applicable) on the Non-Immigrant Visa Form DS-156 ?
Is that like her national ID number from some ID card ?

7. On the DS-157 "Have You made any Specific Travel Arrangments" ?
Should I put we plan to leave on this date (x-x-xx)... but are awaiting visa. Or is it better to put "No" we have not made any travel arragements ?

8. What Paperwork if any does she bring to the CFO Interview ? I heard some CFO session people asking for remittance records and even a CENOMAR or proof of singleness before for the US citizen fiancee. There was a thread a while back on this.
Do we need to prepare to bring anything to her CFO session ?

9. Does anything need to be Notarized anymore ? I thought the I-134 Affidavit of Support needed a Notary but I don't see the space anymore for a Notary Signature and stamp ?

1. you can do that but somebody still has to sign on it, right? actually, your immediate supervisor can attest to your employment info, or anybody who has the authority (such as your HR officer) can do that for you.
the info you mentioned that you will include in the certification is adequate.

2. no problem with that, but if you don't want to have to worry, just attach that short explanation to your W2s/pay stubs.

3. no for your employment, but your fiancee should at KNOW about the two employments just in case (though unlikely) the CO sees it in your papers and quizzes your fiancee about it. and definitely the new address because she'll be putting that on the 156 and it will definitely show when USEM puts your papers together

4. i'm sure i wasn't one of those who suggested that (i remember your post about that). i'm not sure if homemaker is considered employment, but if you can supply other info (salary, supervisor, address etc) then go ahead. it might create sonfusion though w/USEM people if they see that she worked at her mother's house (the same address as your fiancee?) and she was paid for it? but since you already did, for consistency, just do the same

5. yes you can do that if you have no issue w/privacy. but actually your bank can give you a certification w/just the summary, -how long you've been a customer, how much you have in deposit total, and that certification is more official

6. leave that blank because it's not applicable

7. the truth, it doesn't matter to the CO until your paper is problematic, then they will advise you

8.remittance record? that is not true (CFO people have no business knowing that)
she should bring instead all personal info about you (she will fill out a form), passport w/or w.out the visa on it, photocopies of the info page of her passport (4-6 pcs), if goes there after she gets the visa, photocopy of visa page (4-6 pcs) parents' consent (depending on her age) and P650 total fee, extra money, yeah, a cenomar too, in case they ask for it out of the blue (they don't need it either)

9. no need for notarization

take darnell's advice. or if you want to give your wife a chance, take her to counseling, but still be ready for the worst that could happen and for what she might do against you legally.

This seems strange that they require this during the medical. Is this a requirement? We do have the other court documents (marriage licence with annulment on the side, Finaility of Annulment). Do they ask for this at the interview?



your fiancee should ask them why they're asking for it before complying.
it is indeed strange that st' luke's asked for that. they don't have a need for it, and even at the interview only the finality of annulment is required.

the only thing they do pass to the embassy the 2photos and the passport w/the medical results, unless there's a new policy now regardng other docs. :)

I'm going to have an Affidavit of Support & Consent and Special Power of Attorney notarized & authenticated at my nearest Phil. Embassy which is in Washington, D.C.

What should be the size of this document? Short or Long/Legal???

the easiest way (but a little bit more money) to get a CENMAR would have been online.

anyway, you don't need a CENOMAR because you are already married. you need to get a cert of marriage now.

CENOMAR is certificate of NON marriage so you won't get it now even if you request because your records will show your recent marriage.

call the embassy and st. luke's directly. that's the best way to know if they are/will be open on a specfic day.

don't worry, it's normal. it does take time for your bodyclock to adjust. some take just days, others weeks...i have a friend who's been here since june and was able to adjust only in september.

read a book or watch tv, -anything to get you sleepy and try using an alarm clock to force you to wake up in the morning.

everntually your body will get it smile.gif

from personal and friends' experience, manila is quicker for CFO (either PRISM or St. Mary's in QC, offer several sessions a day). but if you're tired (can't blame you) cebu is the only other choice.

if CFO is the last thing on your list and you're in manila anyway...

1) you're ok w/what you have. no need to bring interview reqs, except personal info about your fiance (for the form that you will fill out)

2) one of each is safe, 2 is better (sometimes weird things happen like embassy staff misplacing what you just submitted) you need the interview appt letter (that's your pass to enter the embassy, security will not let you in w/out it)
don't forget to pay for your visa application prior to interview (that's the first thing you will show/submit once inside embassy)

3) yes you need to include each and every country, no matter how long each trip was, otherwise you will be withholding that information from them and result in a lot of "whys" during your interview

i feel relieved now...but about the appointment letter, after fiance called today, USEM ryt away sent me 2 emails informing about my interview date....i printed it out..so i guess that can substitute the packet 3...my luck if packet 3 will arrive days bfore my flight to manila for the interview....but as uve said, appointment / interview letter will do..wish me luck...
