K-1 Fiance(e) Visa Process & ProceduresOh Boy, I think am going to get an RFE

Well here in PI, the petitioner just need to show that we met in person. The proof of ongoing relationship is only for the beneficiary's interview. I also did a poll about the screenshot and it showed there that only 3 out of 43 respondents said that the CO even checked it. Click here to see. This is PI though.

oops, it's not entirely true that the CO does not look at your proof docs. i also thought they don't. the truth is it only seems they don't, but somebody else actually does the pre-interview task of going through all your submitted docs even before your interview, such that when it's your turn they're already given a notes on what to ask you and what docs to verify with you etc, and which is why if your application is impeccable, you are hardly asked any "hard" questions =)

K-1 Fiance(e) Visa Process & Proceduresold passport needed

I lost my old passport which only recorded one trip to hongkong on year 2006.. i had new passport on year 2009. will i be asked of my old passport on my k1 interview in manila?

secondly, how many days after receiving noa2 that u contacted again nvc for the case number??

thanks so much

since the DFA usually returns the old with the new, i'm guessing you don't know where the other one is anymore?
in anycase, if that trip to hongkong was just for vacation (3 days or a week) then you don't have to mention it on your forms.

if it was from 2006 to 2009,or up until recently, for instance, then you have the option whether to mention or not that long out-of-the-country stay. if you do decide, get an affidavit of loss for your old passport/get a police clearance from the HK etc. =)

K-1 Fiance(e) Visa Process & Procedurespacket being sent from nvc to manila

Hello NVC received our packet on Nov 7th but as of a few mins ago still has not been sent to manila can any one tell me how long does NVC normally holds on to the packet before sending it to the embassey. As of now i am really getting worried as it has not even been sent from NVC as of yet. As my fiancee is just finishing her medical right now , getting her immunization vaccinations and interveiw is sch. on the 28th. of this monh but packet is still just sitting at NVC.

any idea how long it sits at NVC ????

Thanks

only nvc knows unfortunately. but updates are sometimes not accurate, and if your interview is on the 28th, your packet has plenty of time to get to the embassy.no worries. good luck on the interview! =)

K-1 Fiance(e) Visa Process & Procedures5 month old NBI check

helloooo guy! Thank God My interview will be on Dec 9 hope i will be with my fiance after Christmas.., visa journey helped me a lot to understand so many complicated things in preparation for our K1 visa, so THANK YOU AGAIN :D .anyway, i just want to know if my 5 month old NBI clearance is still ok... i know its valid up to 1 year,, but read some consulate reviews that sometimes they are asking for an updated NBi clearance.. do you guys think i should get a new one just to be safe and do i need to bring a copy of my fiance birth certificate during my interview?

Kind regards,
TEDDY&BEAR

your NBI clearance is still good, i wouldn't waste time and money getting one until necessary again. as for your fiance's bc, bring it and a photocopy, just like everything else you have because it's not uncommon that they ask for docs you're sure they have already =)

K-1 Fiance(e) Visa Process & ProceduresDo I need to do a name change with USCIS?

Hello everyone,

I just entered the US on a K-1 Visa at the end of October, and just got married on 11-11-11. (woohoo!!)

Just a quick question about how to go about changing to my married name. I have already applied for SSN in my married name, and I plan on getting my driver's license in my married name as well. So I got a few questions.

1) For the I-94 and my passport, do I need to change these, or can they remain in my maiden name for now?

2) I plan on filing for my AOS/EAD/AP in the next week or two, and I will be filling out the forms in my married name. Is this okay, or do I need to file a formal name change with USCIS?

I'm just nervous about having my passport and I-94 in my maiden name, and all my US identification is being completed in my married name....not sure if this is going to give me problems. As soon as I have AP, I am planning on going back into Canada to have my passport re-issued with the new name, but I want to make sure there will be no problems between then and now. (I also don't know if they expect you to get a new I-94 issued also....)

Any advice from anyone that knows or has gone through this already would be greatly appreciated!!

Thanks!

- Tima

1) no change in name needed for i-94 or passport for leaving. remember, you used your maiden name in your I-94 coming to the US and you will surrender that the first time you leave as a pending AOS applicant (your AP is required for reentry to US not coming back) remember though that if you're going to fly, to book your name still in the name in your existing passport (they have to match). once you get a new passport in your married name you will still need to show/attach your old passport to show the stamps and that you left with your old passport and coming back with a new one. you shouldn't have any problems. =)

2) it's ok and there is no other formal process to change from your maiden to married name other than in your AOS form (whatever you want your name to be in your GC)

K-1 Fiance(e) Visa Process & ProceduresMultiple dissolutions of marriage in one year, will I get flagged?

In 1999, I married a Filipina and filed for a I-130 that got approved, shortly, I found out she was previously married and still was married so we seperated after that and the petition expired in 2002 or 2003. I consulted an attorney at the time and was told it was an unlawful marriage that was not recognized by fed or state law so there's nothing further I needed to do and besides at that point I didn't think I was ever going to file for a K1 for anyone ever. In 2007, I got married. That marriage lasted 2 years and we seperated in the summer of 2009. In January 2011 I met my fiancee, I made it a point not to come out t see her till my divorce was finalized. The final divorce trial was in March and so was the verbal ruling. The degree was not signed by the judge till early May. I met my fiancee in person in April, so technically the divorce was still not finalized. Around June, I asked her to marry me and she agreed. So I started researching the posibility of the K1 and consulted an attorney again. I was advised that since the 1999 VOID marriage was involved in a cancelled petition that it would be better that I legally get it annulled by the courts. So that I did. I was able to get the annulment in Sept.

So these are my concerns:

1) That I had a divorce in May 2011 (Seperated 2 years) and an annulment in September 2011 (Seperated 11+ years).
2) That I asked her to get married in June, one month after the divorce and 3 months before the annulment.

1) shouldn't be a concern/problem for as long as you have your docs in order
2)could be an issue because a) you met your fiancee while still technically married (crazy but there's an issue like this posted only yesterday (or today). maybe you can change your story a bit, say you met her in june fell in love in august or something similar just so you don't get caught in a seemingly silly technicality when you explain in the 129f how/when you met
3) shouldn't be a concern because you fixed it and have your docs (it was a fraud marriage, you didn't go through with the petition )
4)shouldn't be a concern because the first was void from the very beginning which made your 2nd marriage legal

you explain yourself pretty well and did everything you needed to do but if you can afford a lawyer, 2 heads are better than one =)

K-1 Fiance(e) Visa Process & ProceduresK1- interview / France/ Required documents?

Question,

For the interview will Notarized copies of my DD-214 Military documents be okay for the interview? I didn't know if it would be wise not to have the original out of my possession since its a pain to get another one if it was lost.

seems like it's not among the docs that need to be submitted in original, so you should be ok. double check with the form and instruction though =)

Got our noa2 after 138 days!!! =)

I have question about ds156.

#22.When do you intend to arrive in the US?

Did you guys put a date? I was thinking to put "ONCE VISA HAS ARRIVED."

Thank you so much!

whatever date you plan to arrive is ok (they know it's tentative most of the time), but you can't put "ONCE VISA HAS ARRIVED" technically because it's physically impossible for you to be in the US if you then had just received it, right? =)

K-1 Fiance(e) Visa Process & Proceduresi love you phrases cause denial of visa

ive read in some sites that if you put down i love you in your chat logs, skype or anywhere. the co may deny your visa because how can you be in love with someone you have not lived with ?

not true! if anything, you should show that feelings developed into love and what better way than in black and white, to use as proof (right?) and which is why a lot of applicants include their chat logs as proof.

although it's still more probable to fall in love with someone you saw in person, many VJ members are living proof that a lot of people fall in love with people they've chatted with for some time because they still see each other "face to face", although long distance.

think about this, if you asked yourself the same question and your answer's NO, then either you have not fallen/are not truly in love with whoever your chatting with and just happens to believe that you have to see te person live to confirm/verify your feelings for them, right? =)

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support

Could anyone tell me what do I actually need to submit to satisfy the requirement that I can afford to sponsor my fiance
for K-1 and will not allow her to become a public charge?

I intend to submit a letter from my current employer of over 2yrs
which states my position, date of hire, full time status and current pay which exceeds required poverty level

Also I am retired and receive a lifetime annuity which also exceeds requirement and will include a copy
of my last tax return and all W-2s that show this.

I own my home and have no mortgage and list as "none" on I-134 and give it's value as I know it to be.
I will also include tax assessments for past year on my home and personal property which list their value as THEY know it to be.

As I already exceed poverty level as required both from annuity and current employment and own my home
free and clear is it satisfactory to just include a few bank statements showing
deposits over say one year?

Does this sound like I am in compliance for approval?

Anyone who has experience with this your advice is GREATLY appreciated.

Thanks

Hey from the looks of things I've got lots of time to ask questions and LOTS of experience out there!

yes, and if you have no dependents (or paying alimony or child support) then uscis will definitely agree you can and will be able to support your fiancee. all of the docs you mentioned are exactly what will get you approved as far as ability to support. all you need to do is gather all docs you mentioned and all other requirements =)

My fiance already book his flight to the Philippines this coming February, and looking forward to be in his arms again:) We were both hoping that he would receive the NOA2 once he flies back to US so it'll be such a good news for the both of us after his short vacation here. I'm not worrying much about the long NOA2 wait.. since i am positive that things will turn out well since prayers are stronger than impatiently waiting when NOA2 will arrive. What's important in every relationship is how you stood strong as a couple, and no matter how far the distance is.. the love you both have is much closer to your hearts (L) GOOD LUCK guys! Let's always remain positive B-)

K-1 Fiance(e) Visa Process & ProceduresWithdraw K 1 Petition

Hello everyone,
I really need some expert advise. My engagement has been disolved and I wish to withdraw my petition. I am still waiting on the second NOA and am not sure if I should wright now to USCIS or wait until I get the second notice and not to take any action. My primary concern is what information is sent in the packet to my former fiance. Particularly I am concerned about my personal identification number such as my ss # getting out. I thank you in advance for your advise.

if you're 100% sure not going ahead with it (you can't undo a withdrawal request once approved), write to USCIS right away with your request and reason. attach a copy of the NOA1, send w/delivery confirmation.

as for your ss#, ask yourself this: is your fiance/e computer-saavvy, very educated, a business person, knows about creditcards? this should give you an idea of the likelihood that you'll have problems in the future. hopefully from your papers will be disposed of safely. just keep all infomation you have about your fiancee including pictures just in case.

K-1 Fiance(e) Visa Process & ProceduresWhat are the chances of us being denied?

Hello all!
My fiancé and I met online about a year ago now. From the day we met, we have had Skype conversations every single day for hours at a time. I think in the entire year, we've only missed 10 or 11 days. We Started dating December 2010, and carried on the relationship until we met for the first time in June 2011. He lives in Arizona and I live in Ontario, Canada. We both traveled to New York to attend his cousin's wedding, where he proposed to me while we were dancing. After being in New York for 2 weeks, we came back here for an additional 2 weeks, and then he went home. Last month (October), I went and visited him for 12 days, and when I returned home, he purchased a plane ticket to come and spend Christmas with me (December 19th until January 7th 2012). We continue to have an amazing relationship going, we have never fought about anything, and we love each other more than anything in the entire world.
We sent our 1-129f application in September 16th, and they mailed it back at the beginning of October because the amount of the cheque was wrong, so we have to re-mail it with the proper cheque.
Our plans were for me to move to Arizona as soon as we were approved, but I'm really nervous we'll be denied because we've only been together for a year, and only been engaged for almost 6 months.
What do you think the chances of us being denied are because of the amount of time we've been together?
Also, would it be a good idea to send in the plane ticket receipt for him coming next month when we send in the new cheque? And would pictured from our visit last month improve any chances?
Thank you so much for your help!

the main requirement is having met PERSONALLY WITHIN the last two years and if you read posts here in VJ, you'll see that 6 months is not too short =)

yesterday i finished my psychiatric evaluation with St.Luke's.. the staff there told me to come back 2-3days after my evaluation.. after talking to the psychiatrist, she just said, okay thank you for ur time.. she didn't say anything in regards to all the confidential stuff we talked about..

i wonder though, what will she say on the result? like what will she write on the evaluation form saying that i am a perfectly normal thinker/person that'll never be a danger of a society and how will she say that i'm passed? everyone who undergoes the psychiatric evaluation passes it right? no i am not annulled the doctor just found scars on my wrist it all came from my ex boyfriend who used to beat me back in 2007 and i never had any history of self-infliction. i explained everything to her
i know i should just wait but i really want to feel at ease.. pleaseto those who had this kind of scenario i need ur reply regarding ur experience thank you a lot :)

if what you say has been confirmed by your psychiatristt w/medical documentation and you were able to prove during the interview that you are mentally healthy then should pass =)

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa: Cant find my certificate of citizenship, but have passport

Hello Everyone,

I'm about to file a K-1 Visa on behalf of my fiancee. She lives in India & I live in the USA. We've known each other for almost 3 1/2 years now & had our engagement ceremony in India last Dec.

I moved to the us in 1993 when I was 4 or 5 years old. I'm a legal resident & become legal through my parents. I have my passport, but cant find my certificate of citizenship. Not sure if it was ever made or requested. I don't know. My parents don't remember it ever being made or ever requesting it. They remember my passport being made.

I was looking through all the forms needed for a K-1 Visa. In "I-239F" form they ask for proof of citizenship in #10. & ask for cert. of citizenship #.I cant find the cert. of citizenship & don't know the number. Should I check the "Parents" box & select "No" to "Having obtained a certificate of citizenship in your name?" Not sure what to do, in case we might have requested in the past & lost it.

I looked online & found out it takes about a year to get replacement of cert. of citizenship. I can't wait another year. Our families want to do the wedding next fall.I don't want to do anything wrong or fill the form incorrectly. I was reading through the forums & saw that you can send pics of your passport pages in place of your certificate of citizenship in the 1st package.

If anyone can give me any advice or insight, that would be great. Thank you very much.

-Tegpal Singh

do you mean to say that you are in the US legally or that you were a permanent resident and have since become a citizen? just making sure. anyway, yes, select NO and submit all the pages (in color) of your passport, and make sure it's valid for at least 5 years. =)

K-1 Fiance(e) Visa Process & ProceduresPreparing for Interview-Phone records?

I am getting everything gathered for fiance's interview... Currently I'm working on the I-134 and supporting documents. I will be in jamaica Nov. 30th for a week and plan to carry down anything he will need for the interview (though I will be there at the time of the interview to bring whatever else.)

I have a prepaid phone and access to records seems to be the worst thing...Aparently I have to take a picture of each phone I want records pulled for (I've had two) and get the sim card in the picture, along with the dates for the records and detailed explanation of WHY I want access to my personal phone records... blaaaah... Each person on the phone with my prepaid company (Net10) tells me a little different of how to do it so I'm in doubt with the whole process. One customer rep on the phone said it takes a month to process the request and can only get one month of calls.

Currently as tangible proof of communication we have Skype calls/web chats from February to present day. The calls are long and sometimes all day long, day after day there's never a day without Skype calls. I also have proofs of Ezetop.com Mobile Top-up online (for fiance to call me international minutes) and there's online receipts of adding credit to my phone as well through Tel3.com. I can access my phone's Tel3 international credit call history by getting records online; however, it's only one or two minute phone calls due to me calling fiance and he just rings back. There's some days where Tel3 service is terrible and doesnt connect properly so my call history shows days where I call 5-10 times in a row to try and get through successfully... I'm paranoid that they'll see that like my fiance doesn't answer and when he does we talk for one minute only!! I'm getting overly paranoid now, guys...

Anyway he'll also have tons of pictures of us together and him meeting my family in August when they traveled to meet him. I have a few Western Union receipts, along with plane tickets and schedules etc.

So do I pursue the phone records (may not even be possible to access them for more than 30 days prior to today or may be not possible to access at all..) or do I continue on with what we have and skip the phone records?? Thanks in advance!

use your own judgment. if those logs look detrmental than hellpful as proof of your relationship, son't use them. stick with pictures, emails, chat logs letters, cards and other things =)

K-1 Fiance(e) Visa Process & ProceduresB1 versus K1

Hello everybody,

I have the following dilemma: I want to apply for a B2 to attend a conference in the US (I am a PhD student and a research assistant in my home country), but I think mentioning my American fiance will hurt my chances of getting it. I know many people in the US, most of which are people I've met while attending other conferences, so I can say yes when they ask me if I know someone over there. But if I don't mention him, could I get into any kind of trouble later on? Am I already in the system, can they somehow trace out K1 application which is processing at the moment?

have your fiance applied for your K1? if not, it would be safer not to mention him because they will then definitely include the possiblity that you will want to bypass the K1 and get married while in the US.

if however he already has submitted the petition, depending on how far he is on the process, you might need to mention him, but they will definitely ask you about your real intentions. so make sure you got the proof for that conference and exactly how short your stay will be.

K-1 Fiance(e) Visa Process & ProceduresAnother 1-134 Question...

My fiance and I are HOPING to see our NOA2 by January, but I have question regarding the Affidavit of Support. Just a bit of background... I lived in the Philippines from August 2009 until July 2011. It was during that time that we met and developed our relationship. I came back to the U.S. recently and have been employed since August. Obviously, I wasn't working in the U.S. during those two years I was abroad, and therefore, do not have W-2's or tax returns for that time period (CORRECTION: I DID file a tax return for the 2009 tax year because I did work up until August 2009, but did not earn any income for all of 2010). My parents are more than willing to be co-sponsors and more than exceed the income requirements to do so. I basically have 2 questions.

1. Per Part 1(n) of this document
http://photos.state.... Packet _3_.pdf
Do I need to submit my parents' bank statements and/or employment letters? Or will their most recent tax return and W-2's suffice for co-sponsoring?

But more importantly,

2. Since I don't have tax returns or a W-2 for the 2010 tax year, do I STILL need to submit my most recent tax return and W-2 (e.g. 2009). Or (assuming the visa interview will be sometime in January 2012) will the USCIS be looking for a 2010 tax return/W-2 (since I will not have filed a tax return for 2011 by then) which, needless to say, I will not be able to produce?

1) are you implying that you don't meet the above-poverty required income? if not, find out first if you do or do not. if you do, they you don't need your parents to co-sponsor.

2) yes, because whatever is your most recent tax return is what you are required to submit. and then you can attach to the form certs from your current employer (showing that at present you have income) as well as bank statements and a letter of explanation perhaps as to why you don't have a 2010 tax return (they need it in writing)

K-1 Fiance(e) Visa Process & ProceduresManila Taking Long Time After Interview

My wife had her embassy interview in Manila on November 8th... 3 weeks ago today. Everything went fine, they took her passport and her application and by our opinion we were all but finished.

Now 3 weeks have gone by and we have heard nothing. VisaJourney gives a time frame of something like 5 days between interview and receiving the visa for Manila. My wife's friends told her no more than 2 weeks.

We have tried calling the US Embassy in Manila and after several hours of trying, we have determined that the immigrant visa department there simply does not answer phones at all.

Can anybody make any suggestions, or offer any information, that can reduce our worries? Is this time normal? Is there a problem currently in Manila with visa processing? Anybody on the inside I can call?

Thanks.

if a visa is approved it takes days to 2 weeks to send w/in metro manila but longer if sent to provinces.

were you with her? if not, ask your wife the CO's exact words to her/instructions/comments , or where she was directed to go after the interview. that might uncover an info as to why her visa is taking too long

as for the embassy hotline, all you can do is keep calling until you get somebody to ask about your visa status.

I have received an email from the USEM telling me that they already had received the additional documents needed and forwarded it to the CO. Now I am more becoming very anxious. How long will the CO be reviewing that? Do they delay such or should I keep calling them? I know they are so busy but it has been over a year from the time we filed and a lot of plans had been cancelled. Another thing is the 2Go, cause I chose for Pick up.. The tracking number is not the case number right?
So confused! Pls help

how long the embassy is able to update your case depends on a lot of things including the docs you submitted (whether acceptable, accurate etc) the case itself and of course their work load. calling them every week is good. lets them know you're waiting =)

as to the 2go, your tracking is different from yourcase no.

K-1 Fiance(e) Visa Process & ProceduresSSN questions

Hi VJ's

I am trying to fill up the SS form and do have few question to ask anyone who may have knowledge or are done with their SSN application:

1. QUESTION 1 - EXAMPLE NAME: Grace Flores Santos ( First, Middle, Last name ) what must be supplied in:
"FULL NAME AT BIRTH OTHER THAN ABOVE "
"OTHER NAMES USED" FYI: I was previously married and annulled back in the
Philippines, so do I need to place my previous married name?

2. Citizenship FYI: I entered the US 3 weeks ago and is filing for this SSN before I will get married so the choices are:
- LEGAL ALIEN ALLOWED TO WORK
- LEGAL ALIEN NOT ALLOWED TO WORK ( SEE INSTRUCTION ON PAGE 3)
- OTHER ( SEE INSTRUCTIONS ON PAGE 3 )

3. PARENTS INFO FYI: Since both of my paretns are Filipino Citizen and is still in the Philippines, do I still have to supply their names in
in it and if YES, should I check UNKNOWN? I know it sound weird as it sound to me, clicking unknown seem not right
knowing that they don't really have SSN :D

4. QUESTION 12 " Name shown on the most recent social security card issued for the person listed in item 1"
Well, I wasn't previously issied anything hence this is my first time applying for an SSN..should I leave it blank?

Thanks for the help VJ's

1. if you have a third name (some filipinos do like maria teresa concepcion santos), then that's where you put it
you have to understand too that unlike in the philippines, here their middle name is not their mother's last name but a 2nd name given them (you will realize this when AOS time comes) for now, your mother's last name is your middle name

other names (previous married names, aliases used) so, YES

2."allowed to work" (although many ssa staff do not know this) they will probably stamp your ss card with "allowed to work w/INS doc" onyour card)

3. they're still alive so YES, and then NA or N/A for the SSN

4. blank is ok

keep calling them and informing them that you have not received anything since the first RFE notice up to the present. this is the only you can do so that whoever keeps posting "we will send you a notice" will tell the same to the section that does the actual sending.

no, they can't approve/deny you if their last notice was an RFE, they are waiting for that unfortunately.

unfortunately also, uscis systems don't won't together so that what they're saying is not always what they're doing =(

K-1 Fiance(e) Visa Process & ProceduresNew phone number?!

Hey VJ Fam,
Is it important that I keep my same phone number?....I am beyond pissed with my cell service so I want to cancel them and if I do I will lose my number. Thanks for the help!

if you're here in the US, most if not all cell networks allow you to keep/use your existing number to open a new account with them so i shouldn't be a problem =)

K-1 Fiance(e) Visa Process & ProceduresMedical Examination

When the beneficiary of a I-129F petition receives their medical examination prior to their interview for the K1 Visa, will the examiner also view their entire medical history? Thanks.

indirectly yes, because the medical exam done for the interview is thorough enough in determining any pre-existing conditins, plus there are forms filled out where all info about medical history are required.

K-1 Fiance(e) Visa Process & ProceduresVERY DEPRESSED BADLY NEED HELP

wow..i see you are from tucson, my fiancee is also from there...:) we are still looking at the factors of me as a nurse, and he is actually currently working and we are both young..factors considered in this public charge finding..

public charge finding...simply means they see from your docs that there is no way your fiance can financially support you because he can barely support himself.

if he can't find a co=sponsor (parents/siblings) get married (can you support him?) but make sure it won't just lead to more financial problems) or give it more time and apply when he has enough income to meet the above-poverty line requirement

K-1 Fiance(e) Visa Process & ProceduresProof of an Ongoing Relationship: Question about pictures

Hi there! I'm new here and my fiance and I are trying to get everything together for the I-129F package. I had a question about sending proof of an ongoing relationship. We have pictures to send except they're all just on my computer. I don't have a fancy picture printer or anything like that. I just have a normal black and white printer. Will that be okay? If not, where can I go to get them printed?

walgreens and walmart print them out so cheap $25c or something.

K-1 Fiance(e) Visa Process & ProceduresClarification for the initial application

i have lots of pages for our chatting and calling together(facebook, rebtel, yahoo chatting & email), is there any limit to number of pages to send and should i send those proof with the submission of the application..or are there some words(sexual) that should not be on these chatting pages...advice please.

i have some lists with me but i need more clarification of the one to send with the initial applications
1. 129-F
2. G-325A
3. Letter of intent to marry within 90days of arrival (from both of us)
4. Pictures taken together with friends and family (pictures taken wit each other)
5. Cover letter of how we met ....
6. Birth certificate (is this for both of us??)
7. copy of my international passport (both US and Nigeria??)
8. copies of tickets
9. Photo passport for each of us
10. check of $340
11. records of chatting, calling and email..

please i need someone to go through this list to help me out if omitted anything or if its completed..

thanks guys, this site keeps us all as family....

i imagine that you don't want other people to see your very private chats so you don't have to include those. but the ones that you should include, so it's not too thick, are those that represent when you started, the middle and the latest. so if you've been chatting a year, you could include one or two chat logs for every month, something like that. =)

K-1 Fiance(e) Visa Process & ProceduresI-134 and freelance work

Hello, I have some questions about filling out the I-134. I work in post production which is freelance work, though mostly normal W-2. An employer letter is pretty useless since I work for different companies. So I should have 3 years of tax returns and a letter from my bank and bank statements? For annual income I should put: 2010? An average of the three years tax returns I will include?

Thanks for any advice anyone might have.

whatever latest income tax returns you have is ok and yes bank statements. on the form you will indicate your present income as well and proof of that so at the time of application, whoever your employer will be is useful =)

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support

Good morning. I'm a new member. My fiance has an interview coming up soon in Nigeria. I was working part-time last year and my income from last year was very low. I started a full-time job in May and with the salary I am earning at my current job I can sponsor him. I got a letter from my current employer stating how much I make, my job title, and that it is a full-time position. I was going to get a Co-sponsor but the Co-sponsor's 2010 tax transcript states that she's receiving unemployment compensation. Can my fiance go to the interview with the letter from my cuurent employer or do I still need a Co-Sponsor since I don't have Income tax returns for the 3 years?

you have to be able to show (compute) that you meet the above-poverty (125%) guideline for your application. so show everything you need. if your current employment shows that, plus the required tax return/s. if not, then you will really need a co-sponsor fill out the same form you did. also if you read the form it says there assets (even those of your beneficiary) can be used so consider that too.

K-1 Fiance(e) Visa Process & ProceduresLost Passport

I have not entered the US yet.

if you don't find it, inform the embassy first and then get a new passport right away, don't forget to bring an affidavit of loss (go to police precint and report the loss)and bring it to DFA w/your other requirements and when you get your new passport, go to the embassy w/new passport, affidavit of loss and a letter requesting re-issue of visa.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa denied, Motion to reopen?

Hey,

I need your help please.
I applied for a K-1 Visa and waited 5 months. Then I got denied because I forgot to send in all the information. I hate myself for messing that up. Now they gave me the option to do a "motion to reopen" or to start a completly new case. If I start a new case then it's gonna take 5 months all over again. My and my fiancé would hate to wait that time again. I miss her soooo much! Now my question is did anybody of you did the motion to reopen? Is that gonna take less than 5 months? Or is it gonna take longer? And they told me on the phone that I have to pay $640 to do this motion to reopen. Is that correct? (it didnt say anything about that money in the letter where they told us the case got denied). And can I come visit her in the US just for like a few weeks while we are applying all over again or doing the motion to reopen? And what would you recommend for me to do anyway? A motion to reopen or a new case? The money doesn't matter by the way.

Please somebody help me here. But only answer if you know what you are talking about.
I appreciate your help.

I would NOT consider getting married as the solution to your problem.

Here's what happened (if you don't know how govt works...) I imagine that super swamped uscis saw your application and said "is this a joke? (they probably even took it as an insult) and then probably said "ok, let's give him back what he deserves".

So reopening the case would amount to nothing because you sent them almost nothing. It would be better for you to re-apply and this time make sure you send all the documents required, check that every form and doc is filled out correctly, signed and dated, organized and the fee/check written correctly with the correct amount. in other words this time, do not give uscis a reason to deny you.

It doesn't always take the average 4-6 months if your application is well organized. The sooner you start the shorter you have to wait. click on the forms here under K1, print the instructions and the list of requriements.

and do not apply for a tourist visa after sending your i129f if you don't want complications. good luck.
