I went for an Interview 2009, and i was put on Ap, then a month latter i got a message for another interview, then i got denied, and the files were taken back to the US, then we got a letter of intent to deny, and they asked for proofs, and we gave them what we had, which was phone records, pictures, tickets for two trips, email message and a letter from my wifes friend and her daddy stating that the relationship is real, we do not have no property in our names or she does not have nothing that has my name
a letter was sent in 15th of Nov saying failed to submit sufficient documentary evidence to prove the bona fides bye a preponderance of the evidence because the petitioner provided insufficient corroborating evidence of their relationship since 2008. now they give us a time period of one month to appeal, we still dont know what evidence they want as we do not have nothing else, what can we do?

the proofs that you mentioned (unless there are others) are more for a fiance/e petition, not for IR/CR1
you need to show docs (govt especially) where both of your names appear, sharing of finances, insurance (even just from employment showing she is beneficiary), bank accounts. docs from your local census showing that she/you are already married to the other, certification from your local registrar/municipality that you were and are still married and not just boyfriend/girlfriend

call the the nvc too and ask what other docs they can accept/are looking for.

Will the madness ever cease! We provided a certified copy of our marriage certificate (instructions say you can provide either the original or a certified copy) and the NVC says that the certified copy we provided was not from the government agency they recognize. They said that the document should have come from the Registrar General. I explained to them that their information is incomplete. You can obtain an official marriage certification from either the Registrar General or from the AMA - Accra Metropolitan Assembly. Most of the people I know who were married in Accra were married at the AMA. The difference between the official certified copy and the original is the the certified copy comes with a letter of authentication from the AMA as further evidence of the document being official. My husband retained the original copy (he could have used the certified copy or the original) so that he could present it at his interview as instructed on the NVC website. So, I have emailed the NVC with details about this misunderstanding including the link to the AMA's website and I am waiting for our original certificate to be received in the mail from my husband. Hopefully, we have provided them with additional information on the marriage process in Accra, Ghana. Unfortunately, it has set us back probably by a month to getting our case closed. The good news is that was the only problem with our paperwork. Hopefully, this will be resolved before I receive the original from my husband because I hate to have to give them both official copies of our marriage certificate - then my husband will have to get another certified copy - oh well. Just thought I would share for others going through the process in Ghana.

Always something. I guess I can't blame the NVC for not being an expert on everything in every country. Patience has become our friend.

My wife passed her interview last friday, they only asked a few general questions and looked at the wedding pictures. They were very nice to her. She went for her physical on Monday and because of the holiday she couldn't take until Tuesday. Thew will send her visa to Cebu when and if the results are ok. The will forward the results on Tue the 7th.

Question 1: Anyone know how long it will take for them to send the visa if her physical is ok?

I am working in Dubai and done tomorrow I will fly to the Philippines and escort her home.

Question 2: When she gets her visa sent to her and does her CFO is she free to go immediately?

Question 3: Does anyone know the cheapest cities to fly one way to in the states?

Thanks in advance to everyone here....Ours wasn't the fasted visa but the advice here has been strong and by crossing all the t's and dotting the i's everything went the way it is suppose to. It would have been a lot harder journey without everyones support.

1. if she passed the medical, it would take 2-3 weeks (since she's in cebu).

2. yes, as soon as she gets her cfo sticker and cert, she's ok to fly

3. there are more cheaper one-way tickets from the Phils to the eastcoast, CA especially. PAL always has flight sales online. and then you can check out domestic flights. some have as low as $39 one way (like jetblue) depends on where your final destination is.

Hello everyone , Did any one received any CHECKLIST COVER LETTER from NVC, after a week they submit the DS230 , because is very confusing to me , the letter looks they are looking for some more papers but they don't explain what is missing ,
I keep calling the number NVC provides but no one pick that phone up .

This if my first time posting but this site has helped me so much I cant thank you enough.

My wife has her interview in two weeks and we are making sure we are well prepared.

Here is what a recent guide I read mentioned I needed

Interview Forms / Items:
1. Valid Passport.
2. Original or certified "long" birth certificate. *
3. Original adoption decree. (if applicable)
4. Original or certified copy of the marriage certificate. (if applicable)
5. Original death certificate. (if applicable)
6. Original divorce decree. (if applicable)
7. Police certificate. **
8. Court record(s) (if applicable).
9. I-864 Affidavit of Support Form along with past 3 year U.S tax returns (or transcripts) and any other financial documents required. (see poverty limits here)
10. Court and prison records.(if applicable)
11. Medical examination information
12. Two passport-type photos (see specification) of the spouse or benefitiary

We have everything ready except item 9. I already sent in the I-864 with 3 years tax transcripts and employer letter to the NVC. Does my wife really need to bring copies of these to the interview? I dont have the 3 years tax transcripts, I would need to make yet another request. Why am I force to do this yet again?

if you will be able to get copies for her before the interview, it's better to get them still.

while you already sent those there are times when COs don't want (for many reasons) to check what's in your submitted docs and prefer to make things convenient for them and ask for those during the interview.

now, if you won't be able to get them in time for the interview, request for them anyway, (you'll still need them in the future) and tell your wife to explain that those were already submitted. if you're lucky, they will check your docs. if not, then the worst that happen (as far as the i864) is that they'll approve her visa but will ask her to come back with the docs before the visa is issued to her.

Good morning everyone. I need advise on how to get married in the Philippines.
Here's what I have had done in the past.
Met My fiance on July 26, 2007 (I.E.) she is Filipino working in Hong Kong.
Went to Hong Kong on 03/05/2010 thru 03/16/2010.
1. applied for a K-1 fiance visa 07/07/2010.
2. Fiance had interview in Hong kong on 03/05/2010.
3. suspended under adminastrative review because because of income (which was B/S).
4. Got Co-Sponsor on 05/2010, enough assets for co-sponsor (approx 1 million $ in assets).
5 Fiance had 2nd interview on 09/09/2010.
6. Visa petition sent back to USCIS 09/24/2010 due to section (221)g as we have failed to established a bona fide relationship even tho we had documented approx 223 pages of phone records.
Now what we plan to do is marry in the philippinesa in June of next year and our question is:
1. Is the process approximatly the same as a k-1 procedure after we marry?
2. After we marry in the Philippines, she has to go back to work in Hong Kong so will she have an interview in Manila because we married there?
3. What can be done as not to have any of this happen again.

Note: I have CML (Cronic Myelogenous Leukemia) Which is treatable with meds for a very long time, which I feel is one reason they denied the petition to begin with as my income is
well above the poverty guidlines


1. yes very similar but usually takse a little longer.
2. no, she can have the interview in HK.
3. focus your evidences on what's required. phonecalls alone don' do it. do not submit if your papers are incomplete. check every form, every answer. organize your application and remember, the interview w/your fiancee is a confirmation of all info you submitted so if all your docs are in place, it will come down to how she answers the CO's questions (could be why she got denied the K1) make sure she knows all she needs to know about you, your family, work, your plans etc)

I'm a US citizen and sponsoring my wife who lives in Pakistan. Her interview was in Islamabad on Nov 5, 2010.

At the interview handed us a blue slip and requested a missing document. The interviewer herself assured my wife that her visa is approved and as soon as we send the document the visa will be mailed back (The official said it in very certain terms so there's no doubt that we misheard). We sent the document back on Nov, 8th. They even confirmed the receipt of the document but we still have not received any update. It is very difficult to get a hold of someone over the phone. An email reply was that they're "reviewing the document". It been almost 6 weeks since the interview. Anyone else had similar experience? It's doubly frustrating when without asking they told visa will be mailed back ASAP. Could they have put our case in AP? I'm have hard time consoling my wife over this. So f'ed up.



i was in the same boat like you. waiting can really stress you out but waiting for weeks is pretty normal for AP cases like yours (after receiving the addt'l doc they have to go back and get your file in the middle of cases scheduled for processing) but if the CO said she's approved, they usually mean it. so relax and just pray she gets her visa soonest. :)

As a lot of you know from reading this forum, my petition was supposedly approved by TSC on 11/23/2010, but has not yet reached the NVC. There are 4 or 5 other filers in the same boat as I, and I am wondering if it would be worth filing an expedite request?? One of the criteria for filing the expedite request is if it is due to USCIS ERROR. If my NOA2 is bogus, and someone at TSC hit the wrong button and generated the letter, that would mean that my petition is still under initial review at TSC, and has not actually been approved. Seems like this would be a very big mistake on THEIR part. Do any of you have any comments or suggestions? Or, should I give it another couple of weeks to see what happens? I have already filled out the form 7001, and have it ready to mail.


with the holidays and all delaying everything, i'd wait and give it a couple more weeks even 3. if you've been approved then you're approved. congrats! :)

Hi everyone, I am worried about signing her name on her behalf. What do I do about wife who is unable to sign her name? She is Kenyan. She just prints her name or signs with one letter. I doubt this would be accepted.

She travels to other African countries with an unsigned passport.


by any means, dont sign for her. you might be accused of a lot of things (forgery, coercion)
since she'll be signing a lot of papers from now on, it would be best to have her decide on how she wants her name to appear and sign her passport with that (a printed name is considered a signature really as long as it's written with her own hand. and in most forms there's a provision for writing her name in her native alphabet, if it's applicable.

Hello everyone,

What do I put as "Current Occupation" on the DS-230 if I graduated college and never worked before. I graduated with a B.A and am studying for the GMAT to try and get my Masters degree. I never had a job and I do not think I am classified as a student since I am not currently in school.

Also on the I-864 they ask for "Sponsors income and employment." Should I put in "Unemployed" even though I was never employed?


since you have no income at all, you definitely need to have a co-sponsor, no other to do it unfortuantely =)

Take a hike. You got proof of all of them that have
attornies all got RFE's, or you just make stupid coment

I bet you there are more RFE done by people doing it

Yes, you have to. Police Certificate/Clearance is the same though in some countries it is called something else like in Dubai, UAE they call it Good Moral Conduct.



No, you don't have to, only the NBI is required. Police clearance is required if you lived outside of the philippines for at least 6 months, and it's for every country you lived in for at least 6 months, not every city.

This is very time consuming, I have been copying from Yahoo I.M. archives. And than pasteing to Word document. Its not as orginal as printing chat right out of the archives, but takes less time. Printing right from my yahoo archives only does 2 pages at a time and is hard to line up w/out chat overlaps
I hope the easy way will be excepted, dates, time and names are shown, just not the yahoo logo.

Hope this sounds ok, I called VSC shortly after receiving my NOA 1. I was given a referal # to get my fiance's name corrected on the document. Was told it takes 30-45 days for that to be handled. Called back today to confirm that story, It's the same, 30-45 days from referal date.
I hope this sounds ok, maybe this means it must be looked at by an ajudicator ? innocent.gif

hi all, my husbands interview is on sept 9. We submitted nbi for the NVC stage dated june 22. Now my concern is to get a new NBI clearance it would take 45 days because of the new system. Is it ok to submit the NBI dated june 22 , will they ask for the NBI really? please enlighten me. thanks all.



NBI clearances are supposed to be good for 6 months (unless it has changed), it usually indicated on the document itselt. so you should be good to go. also, you are no required to present a new clearance each time for every stage in the process. you just need to be able to show the original if and when asked.

I want to prepare things ahead of time that is why I am starting to gather up all the necessary papers needed in renewing my Philippine Passport. I have some concerns about this process though because I don't know how to and where to start. I need your help guys especially for those who had already tried renewing their passport here in the states.

My questions are:

1. My Philippine passport will expire on February 2011, when should I start the process?

2. How much is the fee?

3. Where to renew it?

4. What are the requirements?

5. Does it require a personal appearance?

The Consulate is receiving applications for the new Machine Readable Passport (MRP) beginning June 02, 2008. The old “green” passport is no longer issued.

Each applicant must personally appear at the Consulate, except for minors 8 years old and below and senior citizens 65 years old and above, and bring with them the following:

Duly accomplished passport application form
Most recent Philippine passport
One (1) copy of the passport data page(s)

For brown passports – copy the pages which show the data and picture of the applicant

Two (2) identical photos taken within the last six months of size 4.5 cm by 3.5 cm on a Royal Blue background. Complete details on photo requirements for the MRP may be viewed at www.dfa.gov.ph/consular/PHOTO%20GUIDELINES.pdf.
USPS Express Mail Postage Stamps
It takes about six (6) weeks to process the MRP as the approved applications are sent to a central processing facility in the Philippines.

My fiancee has a B.S from St. Paul University Quezon City in Hotel and Restaurant management but i cant figure out if her degree is valid in the U.S or if her schools accreditation is valid here for transfer of credits i just dont know anything lol :bonk:


not entirely. if she'll look for a job that does not require a degree (highschool level only) then it's not needed, but if she will look for a job in her field then it will be applicable as is (employers usually will give other proof of past job experience), and then if she wants for pursue higher education or teach in her field, she'll need to have her tor evaluated by an equivalency agency to see if hers is equivalent to US degree/standards or if she needs to get more units to compensate for non-equivalency :)

We did list the childs name on the application but we are unable to provide a birth certificate for the child since my fiance and his ex-gf are not in good terms. What will happen then? Should we have not listed the child on the application?


it's ok that the child's name is on the application whether your fiance will bring the child over with him to the US or not, it's better that the name is on paper just in case in the future he changes his mind and petitions the child. however, your saying that he and his ex are not in good terms so he can't get a bc is not clear. if he's on the bc he doesn't need the ex to get a copy, he can apply for it himself. now if he's not, then in the future he will have to establish his relationship with the child through proof (ex. dna) to be able to bring him to the US and at the same time get a permission from the ex, or establish in court that she's not a good/fit mother, or wait till the child is 7yrs old and hopefully chooses to go with him instead of the ex.

Hi Everyone I need some advice. In Line 10 of the I134 it asks, "I have submitted a Visa petition(s) to USCIS on behalf of the following person(s)."

My question is do I list her daughter here? I listed her daughter in line 3 and she is on the I129F. Her daughter is 15 yrs old. I just wanted to know if I list her in line 10 as well.

Any and all help would be greatly appreciated.

no. it's correct that she is in no. 3 (just accompanying because she;s a derivativr)

Hi, I have a family friend working as a welder since December 2006. He was recruited through an agency in the Philippines and was given an A2 Visa (Business permit good for 5years) at the time, until last year. He went back last year to PI and was given a 2 year extension I-94 Visa. So, basically he's been living here in Texas for 5 years and will be going on 6 years (2012.) He's been with the same company/agency ever since but he did not have a specific address or even a PO box number on file but uses his work address as his “address.” He said, “he goes to different job sites around the country a lot to do his work.”

So, the question now is there a way for him to get another extension; perhaps another working permit; or maybe something else? It's really a shame with all those years invested already, he just had to go back to the Philippines again. Also, it's too bad that he wasn't able to find an USC wife to marry, as he is still single. are you he has an A2 visa/business permit? if you go to travel.state.gov, A2 is for foreign military personnel or if it's just A that means he's been working for a govt agency which from your description doesn't seem like it.
verify with him what visa he has because that will determine whether he can apply for adjsutment of status or not.

then go to uscis.gov and see "adjustment of status/permanent residence application" to see if he qualifies to adjust. otherwise he has to start looking for a wife (if he wants to stay here) or stay in the philippines after his extension expires. =)

you don't get it right away, that's for sure. but you can request right after being approved if you want it sent "rush" which is 3 days compared to a week or two =)

I just got my xray today for the company that im working with as that compulsory...and fiance and I are planning to go for that medical check up at St Lukes in two weeks from now...

Ive heard that one should only have 2 xrays a year? and must be taken after 6 months if ever needing... got me thinkin now, IS THIS TRUE?

I know St Lukes will have that xray also..will i need to get that again even if its only w2 eeks after i got this xray for the company im working with??

i'm assuming you are the fiance/e beneficiary? if so, then that company xray result is good enough(assuming also that the results show clear/negative etc)

the 2/year xray is ideal but if you need to have it, then it's out the window =)

yes you can, and no visa required for your intended length of stay. make sure you don't go beyond this though if you don't want to have to go through the process for extending your stay =)

Then you need to call them and asked who signed for it because someone must have signed for it if it said delivered. Find that out then go from there.


they don't require signature to confirm delivery so if post office info says delivered, even though you say you didn't receive it, chances are it was delivered; and considering they send out notices pretty quickly on average but it's been over a month now...

Just need someone who can help her get a hassle free passport for tourist travel. Things like migration does not need to be said to get the passport.

Sometimes I think their is some misperception as to how girls from the philippines are, I can only relate my own story. First I have always thought that girls from this part of the world are beautiful both inside and out. I was fortunate to have been to the Philippines when I was serving in the USMC and have been to diffrent parts of Asia for business since then.

To me a girl is a girl is a girl meaning yes there will be cultural influence and yes maybe certain attributes that are local to that community or area but beyond that is a woman, a woman who just happens to live in another country who sometimes eats diffrent foods, speaks other languages and lives in a diffrent climate. What woman anywhere in the world does not want to be loved and cared for, and to feel secure, and I answer most all women do. once in love geography goes right out the window.

Of course there is an attraction to a better life, but thats just an attraction, the real thing is the same old things that have drawn couples together and kept them together for centuries, Love, Committment, chemistry, similair beleifs and attitudes, being able to make one another laugh and just that over all feeling of being meant to be. I think there are a lot of misperceptions both on behalf of westerners as well as east, I think though if people search their heart they will find that it all comes down to love, no matter where you may be from.

For me, I know I met a girl who just happens to live in another country and for me she is the girl I love, not a girl from the philippines, but just a beautiful woman inside and out. I think most of the people here on VJ know this and are lucky, so that being said cheers to us all, God Bless us and our realionships today,tommorow and the next.


your question concerns guys who have been married/has had relationships both to filipina and another nationality...i agree every personality imaginable is found in every nationality and i believe "why a filipina is a combination of factors":

1. among other non-english speaking nationalities (other asians included) filipinas converse effectively in english the most
2. being from a third world country, filipinas are comfortable with just the necessities in life
3. our culture has taught us to be polite as much as possible
4. filipinas come from a family-oriented culture so we do everything in our power to keep the family together (we don't consider consider separation right away if our marriage is in trouble (husbands with multiple mistresses are sometimes tolerated)
5. we don't have divorce in the philippines (it's a predominantly catholic country)so we're not really used to it
6. luck still plays a part because there are crazy filipinas too just like in any other country =)

other guys and gals have a take on this?

2004 and 2005 I went to Japan as an Overseas Performing Artist I stayed 6 months [2004] and went back [2005] and stayed for 6 months again. My question is do I need to get a police clearance from Japan even though it was 7 years ago?.. Please help me. Thank you for help in advance.

HI,

I'd like to ask a question about expiration of visa. I applied for I-130 for both my parents. I remember when I paid the visa last July that it's stated there that it's only valid for a year (when i paid online through travelvisas.gov.).

When they had medical last November, they find a scar on my mom's chest x-ray and was advised to have a sputum culture test and it will take 2 months for the result and if it's POSITIVE, it will take her 6 months treatment for tuberculosis. My dad, on the other hand, is advised to do a skin test and SLEC said that they will call the US Embassy to reschedule the interview.

From the timeline that I have, if she's positive, will it expire her visa and do I need to go back to square one for this OR the Embassy or National Visa Center extends the visa that I paid?


I'm positive that she will have a negative result, but I'm still wondering what if she got a positive result. I hope I could get response from this. Thank you!


it's 130 that was approved. anyway, no need to reapply and pay again. before the expiration (say 3 months) request for extension citing your parents' extended required medical

Hello!

We got our NOA2 email at 6pm CT on 11/23, how long should I expect to wait before NVC receives the petition and assigns an MNL number? I know the holiday slowed things down..

Not 100% clear on the process after getting the NOA2 about scheduling the interview. So after getting the MNL number, can we go ahead and pay the VISA fee and schedule the interview? Or do we have to wait to schedule the interview once the NVC sends the packet to Manila? I do have my packet almost ready with the DS forms and all our evidence to be sent to the Philippines soon. Getting very excited, we're hoping to have the interview in the beginning of January..

Hi everyone! Both my wife and I just regained our Filipino citizenship and are planning on moving to the Philippines in January 2012. We are wondering if we still need to apply for Philippine passports in order to buy one way tickets to the Philippines. Can someone help us? My wife is currently pregnant and is due mid December and we'd like to know if the baby needs a Philippine passport as well. We'd love to leave by January 2012 but the current Phil passport processing time is 8 weeks. Thank you so much!


to buy one-way tickets, no. you enter the Phils as US citizens but bring your dual citizenship forms and old passports to show at immigration. you can wait til you're in the philippines to apply for new ones.
