hi there im just wondering if someone help me to answer this question please....
on the affidavit of upposr page page 4. no. 24b.

what should i put there i live wiht my parents and no income bec im not working. i live with my uncle step dad my mom and my granny
only my uncle is working in the family at the moment do i have to put his name on page 4 no.24b question? please help me or can i put none?
im going to use a co sponsor which is my sister and she doesnt live with us. please help me and thank you so much

hello shamangoddess...you may need to look at the attachment on that form again that tells you how to fill it out... the form is basically your proof that YOU or member/s of your household (people living with you) and if necessary the person himself who is immigrating, can be supported financially. you said your sister is your co-sponsor so better check if she qualifies to do that since she does not live with you. you dont have to put the names of the people living with you if you are not financially supporting them but you can include your uncle's income in the total household income. if it passes the poverty reqs you're ok even without your sister. if not, you have to ask your sister to live with you or live for a while with her until after the application is approved...hope this helps

Our case is taking so long (it's been more than a year now =( and I know it shouldn't be the case. It's so hard to be away from my husband and our 1 year old son...

it show only : wages, salaries, tips, ect (for work ) and gross reciept of sale (for band)

the question is what should he write on the total income in form I-864 affidavit of support? should it be the total of wages, salaries, tips, ect (for work ) and gross reciept of sale (for band) or just his work income?

and should he include the band tax which is not only for him because they are 5 in the band?

Hi to all my kababayan... please give me some piece of advice, i already sent all my documents to my husband a day after we received the I-130 approval and maybe because i was too excited and super happy that i didn't even noticed that i was not able to put my right thumb print on my NBI clearance.... so i was thinking to send my personal copy to him which already have my thumb print... i just want to ask if it is ok to send the personal copy of my NBI clearance to NVC? i was also thinking that he can send my NBI clearance back to me thru fedex and put my thumb print... then send it back to him... but its a little pricey especially now that we have lots of obligation... house amortization etc... thanks in advance God bless

if expense is the issue, then opt for the less pricey means...and yes you can send your personal copy of the NBI, if you won't have any immediate need for it

IR-1 / CR-1 Spouse Visa Process & ProceduresLittle Question About AOS Filing and Explaining my Situatino to NVC
QUOTE (Anethan @ Sep 17 2009, 10:00 AM) <{POST_SNAPBACK}>
Hey guys, im about to mail my AOS package today, and was wondering if I should include a letter explaining my job situation to them? I am having my mom co-sponsor, using I-864A. My situation is that I was working for a company from August 2008 until March 2009 making 28k a year, and got laid off. Before August 2008, I didn't have steady employment due to helping care for a sick grandmother, going to school, and other things. Then in February of 2009 I went and got married, came back and didn't have a job anymore the day I returned. I job searched for a couple months till I went to work for a place making 8.00 an hour, and then had another 2nd job working part time for some extra money.

Then I went and visited my wife again in August, and that further reduced my earnings this year, but I still have the same 8.00 an hour job, at full time that I had before I left (cool people at this place, even if the pay isn't that good.)

I also have a Bachelor's in Criminal Justice and can get a job that pays well eventually, its just difficult in this economy right now.

So my question is, shoudl I write them a letter explaining all this, or is it irrelevant since I have a co-sponsor? I just don't want them thinking im a bum and won't take care of my wife... but would telling them all this just slow things down or cause potential problems?

What do you guys think? Let me know, i'll be sending this package today!

no you don't since your i-864 (and accompanying docs) already reflects your employment situation and you have a co=sponsor to back you up (which means you pass the 125% above poverty income requried). you should be ok.

good luck and god bless!

IR-1 / CR-1 Spouse Visa Process & Procedures?? About Philippine Vaccines ( Medical )
QUOTE (BRB @ Sep 24 2009, 09:57 PM) <{POST_SNAPBACK}>
Thanks for the feedback. She is getting the vaccinations now and she will be able to present the documentation at the medical interview. I think it will be cheaper for her to get them there than here in the states. She can get the HPV for about 3500 pesos ... I think. The HEPA A & B will run about 10,000 pesos for the full series of each. If anyone else has any information please share.

hey brb, your fiancee is not required to get vaccinations other than what is covered by the medical fee. you'll already be paying more than P10k, think about it. whatever vaccines fit her age will be given her after the medical.

however, if the expense is no issue to you, the HPV vaccine as far as i know is for 26 yrs and below so that one is ok as an addition to what she'll get from the medical package and you'll definitely save money if she gets HEPA A&B in the phils too.

QUOTE (Rosie and David @ Sep 24 2009, 09:15 AM) <{POST_SNAPBACK}>
You go to St Luke and get your Exam as soon as you can ...some try and get it do the week they are to have their interview. That is very scary because what if you don't finish before the interview.

I Rosie's case I flow her to Manila and stayed a couple of days in a hotel there about 60 dollars a night about 3 blocks from St. Luke. There are lots of hotels in the area and lots of great places to eat.

Has for the HVP shot she only got one .. and then when she got here in the State we paid 200 dollars for her second. Sometime in October she will get her third and final shot.

St. Luke never gives them all, it's a plot to save money on vaccine so when the Spouse gets to the states and gets married they need to go to a CIVIL SURGEON in their area to get the rest.

REMEMEBER THEY DON'T NEED TO TAKE A NEW PHYSICAL ONLY THE SHOTS. People have been told they need the full exam ... on a K-1 or any visa that you have an exam done and is still vaild for one year. YOU DONT NEED TO TAKE A NEW PHYSICAL.

Just a reminder you need to pay the fee at the Bank (DBO) in your area of the phillippines and they stamp the I think ds-157 form that you take to the bank with you.

GOOD luck to both of you

GOD BLESS

Rosie and David

the vaccinations are just half of the medical requirement. when you get your NOA2 you/your fiancee should receive an email/mail saying that she's already assigned an visa applicant no. and is eligible to apply for a visa which is comprised of passing the medical and passing the interview.

when you get this notice you can call the USEM hotline right away to schedule for an interview. the medical usually takes just two days if your fiancee is completely healthy but others schedule it two weeks before the interview to give allowance for any issues that might come up during the medical.

if she passes the medical, she is given vaccinations on the second day and her results and passport are forwarded to the embassy.

click on "forums" (home page) then K1 process/application for all other info you'll need

IR-1 / CR-1 Spouse Visa Process & ProceduresBonafide Marriage (No chat logs, only a few letters)
QUOTE (gpmaan @ Sep 28 2009, 05:55 PM) <{POST_SNAPBACK}>
We've established a long distance relationship for about 11 years overall. We got married 2 years ago. We dont have YM chat logs, because we delete it from time to time (We didnt know the importance of this, prior). For the first 6 yrs, our main way of communication was via Phone, but whenn I bought phone cards, the normal course of action is to throw them away when you're done, I dont think anyone would really keep those unless they have knowledge of the situation that this may be useful in the future.

We only wrote a few letters from time to time (since we prefer talking on the phone anyway) but we do have lots of e-mails that we still have saved in the archive (thankfully) for the past 3 years. Are these good enough to prove that there's always been an ongoing line of communication?

Much thanks,

yes, those letters are still good, and emails too, as well as whatever you have now, that you have as proof of your relationship, latest call cards, and your past phone bills/her past phone bills that show each other's numbers, and of course lots of pictures, with different groups of people from each side.

IR-1 / CR-1 Spouse Visa Process & ProceduresBackup Information Package Lost!
QUOTE (wiz1205 @ Oct 1 2009, 10:46 AM) <{POST_SNAPBACK}>
Hi everyone!

My wife just passed her medical checkup in Manila. Her CR1 interview is scheduled for this coming Monday, Oct 5. (Assuming we won't be hit by another typhoon in Manila =(..).

We've hit a bump in the road on our way to the finish line. The post office lost a package that contained all of the backup information we prepared from the beginning of the whole visa process. Contents included: I-129F, I-130, G-325A, DS-230, NOA1, NOA2, yearly IRS tax information, bank statements, paystubs, proof of employment, and proof of relationship that we originally filed with her I-130. All of the forms are COPIES and a backup to the original documents.

All of the original documents were provided to the NVC. So I assume that they embassy would have all of this now. My question is now how important did that backup info package play a part in the interview process? Of course, we are a little bit worried since it took us quite a lot of time to compile the information.

Secondly, rather than panicking, we are preparing additional information for the interview. The new backup information will include new pictures of us, current email correspondence, recent phone logs, her bank statements with transfers I've made from the US, my paystubs, my passport/birth certificate copies, and our upcoming honeymoon reservations.

With that, do you all have any suggestions on what further documents and evidence we will need to prepare for her Monday interview?

Really thanks so much guys! This forum has been a blessing!

Andy

technically, the embassy will only ask for documents required of a K1 visa applicant that's why the packet that you sent for the 129-f is just considered back up. but sometimes, pre-screeners will ask for more copies of what you already sent for verification (and whatever other reason they may give) so saying that it was already sent is no use (not acceptable to them most of the time) so it's usually safest to have a copy of everything that they might ask for (again)

i always mention the experience of a fellow applicant who just handed a pre-screener a copy of her fiance's 1040, only to be called again after 15 minutes because the doc was misplaced by the same pre-screener.

if you can, have your fiancee file an affidavit of loss explaining what happened, just in case a doc they will ask for is among those in the packet lost by the post office.

good idea that she will bring whatever new proofs/evidence you have at the moment.

you're lucky if they don't ask for any doc other than visa requirements, but if they do and you don't have it, it could result in a big hassle and delay? not worth it.

applicants choose to bring the kilo upon kilo of back up docs to avoid giving the embassy a reason to delay visa approval.

good luck and god bless!

IR-1 / CR-1 Spouse Visa Process & ProceduresPre or post marriage adoption of niece?

Hi All,
My finance' is raising her niece as her own but hasn't officially adopted her yet. Adoption of my daughter to be is not a question. Which would be best: 1) my finance' to adopt before we marry or 2) marry then adopt? Which would be best from the immigration point of view? We are going IR1 for sure and my daughter to be is with my finance'. Any thoughts or advice would be welcome. Thanks all.
Bob helpsmilie.gif helpsmilie.gif

your fiancee has to legally adopt her niece first if she's planning on bringing the girl w/her. it takes a bit of long time, depending on the circumstance (lots of proof of psychological, emotional maturity, financial capacity etc, and several visits/investigations by the DSWD) so the sooner, the better.

after the niece is legally adopted, you can then petition your fiance as a K1 or marry her and go to for CR/IR, without any problem of the niece being included in the petition

think about any possible reason why they think your relationship is fake...why do you think they see your application as too organized?

IR-1 / CR-1 Spouse Visa Process & ProceduresURGENT.. VISA APPROVED BUT SAW THIS

visa annotation : ATTN: Class A or Class B (TB) conditions

ANNOTATION FOR MY 2 YR OLD BABY PASSPORT-- sophie passed both her medical and had her visa already im wondering if this will be trouble on her POE
and somehow im paranoid since I see this link http://travel.state.gov/visa/laws/telegrams/telegrams_1440.html-- APPRECIATE YOUR HELP

since your baby passed the medical and was given a visa, looks like she's ok to come to the US (unless your CO told you other things)

but you need to present certain things at the POE (maybe the CO who did your interview told you something about this?)

since the annotation in her visa is (b) maybe your CO told you about the following:

-----------------------------------------------------

PHS envelope for all Class A or Class B TB conditions

-----------------------------------------------------

5. PHS may need to track the whereabouts of those V applicants with any diagnosed TB condition or Class A medical condition. To assist in this matter, V visa holders with a TB condition or any Class A medical diagnosis must present USCIS at the POE with an envelope containing three copies of the medical exam, as well as an address and telephone number in the United States where they can be contacted by the PHS. The envelope should be labeled "For PHS Use." Any envelope approximately 9 inches by 12 inches will serve this purpose. USCIS at the POE will transmit the applicants contact information and the medical exam forms to the appropriate quarantine personnel at PHS and/or CDC. A copy of the applicants DS-3052 in the PHS envelope could serve as the requisite contact information as it includes the U.S. address, but it will be left to posts judgment to determine how best to formulate the PHS envelope.

6. Posts may wish to enlist the services of panel physician staff to make the 3 copies of the medical exam. Panel physicians may be authorized to charge an additional modest fee for this service. The original medical form should be returned to the applicant, as he/she will need it when he/she enters the U.S. with the V and later adjusts status with USCIS to LPR in the United States.

What happens when a V visa holder arrives at the POE without the medical exam?

------------------------------------------------------------------------------

7. All V visa holders, including those with "normal" medicals, should be reminded to have their medicals readily available for USCIS upon arrival at the port of entry. USCIS field guidance currently being revised will instruct USCIS inspectors at ports of entry to notify appropriate quarantine (PHS/CDC) personnel when a V nonimmigrant arrives at a POE to apply for admittance to V status without any medical documents or without a waiver (if one is required to overcome a Class A medical condition). PHS/CDC will place a "medical hold" on V visa holders who arrive at POE without their medicals. "Medical Holds" require that USCIS defers the applicant until he or she is examined by a civil surgeon and submits completed medical documents and/or a waiver application.

if not, just have the above ready to lessen your worries.

good luck and god bless! :)

IR-1 / CR-1 Spouse Visa Process & ProceduresPossible RFE?

As I was reading through one of the posts here on VJ, I noticed that I-130 Part C Question 17 was discussed. "List husband/wife and all children of your relative" For my husband, I only place our daughter's information. I see that I should have added my name as the wife and I only realize it now. Stupid stupid me. So do you think this is a possible RFE? Is there anyway to get around it? Like sending a new amended form? Thanks!

you're the petitioner and your relationship to the beneficiary is already established in part A so you don't need to include yourself :)

How do I contact or find out if the Embassy has received my husband petition, we already got an email with the interview date?

did you get an interview date because you/your husband received a notice saying that you're already eligible to get that interview? if so, it means your embassy already has your husband's petition

IR-1 / CR-1 Spouse Visa Process & Procedurespls i need your advice...

we're planning to get married in the Philippines. how long does it usually take to go to US after filing for a CR1 visa? does the sponsor required to have a job in the US? and do u think i can go there using my tourist visa while waiting for my spousal visa? thank u very much. :innocent:

a CR1 (USC citizen + foreign spouse) petition can take an average of 6-8 months depending on your application docs/circumstance. you may want to search VJ member abbysheryl whose application took only 5mos and ask for tips/advice.

in any case, if you want to use a tourist visa (i take it that you mean you have a valid tourist visa right now?) to visit him while your CR1 is being processed, you may do so (since it was already granted prior to your CR1 submission) but you have to go back to the phils and finish the CR1 process. you cannot wait in the US for its approval.

tourist visas applied for before a petition is approved is very hard to get because it casts a doubt on the applicant's intent (just to visit or circumvent/bypass the petition process) :)

IR-1 / CR-1 Spouse Visa Process & ProceduresPassport question

I have a question regarding my wife's passport. When she goes in for her interview, will she need to have her name changed on her passport? Nothing I have read anywhere specifies, and we are curious whether or not she should change it before the interview. If she doesn't, will she get flack at the POE? As long as her tickets match her passport, she should be fine, right? We haven't filed our package yet...just getting the duckies in a row before we start. Thanks!

No, no changes required on passport name. she'll be fine at the poe.

yes, it's important that you remember to match her ticket name to whatever's on the passport.

make sure also that her passport is valid for 6 months minimum but if you're still in the process of preparing docs, you have plenty of time to renew passport if it's close to expiration. if it's good gor at least a year more, then you're good :)

IR-1 / CR-1 Spouse Visa Process & ProceduresObtaining a Philippine passport and CFO

Hello,
My wife living in Cebu is having difficulty obtaining a Philippine passport. The DFA told her that she needs a CFO seminar before getting a passport, and that she needs a copy of my divorce decree and photos of our wedding. My divorce decree was already used in the processing of our marriage license. This seems unreasonable to me! Will someone please explain this passport/CFO process to me? It is for an approved I-130, CR-1. Thanks!

have your fiancee print out the info below, but print it from the dept of foreign affairs website, and have her bring it to dfa-cebu. maybe they got her confused because she's applying for the first time (?) and wants it in her married name and she happens to be married to a fireigner (?)

IR-1 / CR-1 Spouse Visa Process & Proceduresbringing Mom in US

Oh no....

thanks Girl....

if you would like her to fly w/you/make it to your wedding you have to start early because visas for tourist can take 1-3 months to apply for (from preparation of docs to interview.

your mom will apply for a tourist visa and use the 156 and 157 forms, and prepare docs that will show she has strong ties/reasons to go back to the phils (such as employment/work, children, husband, properties etc).

the rest of the info below can be found at www.state.gov :)

The presumption in the law is that every visitor visa applicant is an intending immigrant. Therefore, applicants for visitor visas must overcome this presumption by demonstrating that:

The purpose of their trip is to enter the U.S. for business, pleasure, or medical treatment;
That they plan to remain for a specific, limited period;
Evidence of funds to cover expenses in the United States;
Evidence of compelling social and economic ties abroad; and
That they have a residence outside the U.S. as well as other binding ties that will insure their return abroad at the end of the visit.

Required Documentation

Each applicant for a visitor visa must submit these forms and documentation as explained below:

An application, Nonimmigrant Visa Application, Form DS-156, completed and signed. The DS-156 must be the March 2006 date, electronic "e-form application." Select Nonimmigrant Visa Application Form DS-156 to access the electronic version of the DS-156. Important Notice: At certain U.S. Embassies and Consulates abroad, nonimmigrant visa applicants are now required to apply visa using the new DS-160 Online Nonimmigrant Visa Electronic Application, instead of the nonimmigrant application forms DS-156, 157, 158, and other related forms. Learn more and find out which Embassies have converted to the DS-160 Online process.
A Supplemental Nonimmigrant Visa Application, Form DS-157 provides additional information about your travel plans. Submission of this completed form is required for all male applicants between 16-45 years of age. It is also required for all applicants from state sponsors of terrorism age 16 and over, irrespective of gender, without exception. Four countries are now designated as state sponsors of terrorism, including Cuba, Syria, Sudan, and Iran. Select Special Processing Procedures to learn more. You should know that a consular officer may require any nonimmigrant visa applicant to complete Form, DS-157.
A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States (unless country-specific agreements provide exemptions). If more than one person is included in the passport, each person desiring a visa must make an application;
One (1) 2x2 photograph. See the required photo format explained in Nonimmigrant Photograph Requirements.
What are the Required Visa Fees?

Nonimmigrant visa application processing fee - For current fees for Department of State government services select Fees. You will need to provide a receipt showing the visa application processing fee has been paid, when you come for your visa interview.
Visa issuance fee – Additionally, if the visa is issued, there will be an additional visa issuance reciprocity fee, if applicable. Please consult the Visa Reciprocity Tables to find out if you must pay a visa issuance reciprocity fee and what the fee amount is.
Additional Documentation

It is important that you refer to the Embassy Consular Section web site to determine visa processing timeframes and instructions, learn about interview scheduling, and find out if there are any additional documentation items required. Learn more by contacting the U.S. Embassy or Consulate.

Applicants must demonstrate that they are properly classifiable as visitors under U.S. law by:

Evidence which shows the purpose of the trip, intent to depart the United States, and arrangements made to cover the costs of the trip may be provided. It is impossible to specify the exact form the documentation should take since applicants' circumstances vary greatly.
Those applicants who do not have sufficient funds to support themselves while in the U.S. must present convincing evidence that an interested person will provide support.
Depending on individual circumstances, applicants may provide other documentation substantiating the trip's purpose and specifying the nature of binding obligations, such as family ties or employment, which would compel their return abroad.

did you show them your gc as proof of legal residence? :)

IR-1 / CR-1 Spouse Visa Process & ProceduresVisa is in!!!! WTF!!!

Hi everybody, i've been viewing this forum every now and then when i had questions about my wife and 2 step-daughters' immigrant visa process. Quick background: I'm in the U.S. Air Force. Wife and 2 girls are from the Philippines. We had a son a year and half ago. Been Married almost 4 years now. We processed the I-130's while we were living in Japan and got all the way to the medical exam and then we moved to England where we have completed the interview and now just received the visas. Just like most people we had a lot of issues when we started our visa process. I won't bore you with all the details but the bigger issues were: "married for U.S. citizenship benefits", DNA tests, late birth registrations, and PITA interviewers. Now 3 years later we have finally received the visas. The courier for the London embassy dropped it off last week to our passport office on the base. Now yet another problem in our journey.

I opened up the package as soon as i got home. First thing i noticed was a giant yellow package stapled to my wife's visa, no big deal, except the rip it has caused on the visa going right through the picture of my wife. Next thing i noticed was the expiration date on the visa. Issued: 7 Oct 10 Expires: 26 Nov 10. Both my daughters have expiration dates of 6 Apr 11.

I emailed the embassy and was told that "her visa has been limited in accordance with the validity of her medical examination". And in regards to the rip in the visa: "as long as everything on the visa can still be read it is still valid for travel to the United States".

Has anyone ran into this issue? We are planning on traveling on 20 Nov. The visa operator said as long as we enter the U.S. before 26 Nov we are good and that we don't have to leave before the visa expires. Is this correct? I know everybody is different but how picky can i expect the immigration office to be when i get to the states?

Thanks in advance.

w/the response that you got from the embassy, you're good to go. just make sure you print it out to show at immigration upon your arrival, -just in case you get a picky immigration officer. good luck and congratulations =)

IR-1 / CR-1 Spouse Visa Process & ProceduresPlease help

I went for an Interview 2009, and i was put on Ap, then a month latter i got a message for another interview, then i got denied, and the files were taken back to the US, then we got a letter of intent to deny, and they asked for proofs, and we gave them what we had, which was phone records, pictures, tickets for two trips, email message and a letter from my wifes friend and her daddy stating that the relationship is real, we do not have no property in our names or she does not have nothing that has my name
a letter was sent in 15th of Nov saying failed to submit sufficient documentary evidence to prove the bona fides bye a preponderance of the evidence because the petitioner provided insufficient corroborating evidence of their relationship since 2008. now they give us a time period of one month to appeal, we still dont know what evidence they want as we do not have nothing else, what can we do?

...the petitioner provided insufficient corroborating evidence of their relationship since 2008...

the proofs that you mentioned (unless there are others) are more for a fiance/e petition, not for IR/CR1
you need to show docs (govt especially) where both of your names appear, sharing of finances, insurance (even just from employment showing she is beneficiary), bank accounts. docs from your local census showing that she/you are already married to the other, certification from your local registrar/municipality that you were and are still married and not just boyfriend/girlfriend

call the the nvc too and ask what other docs they can accept/are looking for.

good luck and god bless
