don't forget your ID photos for the visa forms, sign the back and paste them ahead so you don't have to waste time when you get in.

dress businesslike/decent, and bring a jacket and snacks/water

also, memorize as much personal information about your fiance (present and previous work, family story, siblings, parents, address, phone numbers) down to favorite food (sometimes COs can be funny with their questions)

Hi everyone! I had my interview on monday feb 1st and I got K1 visa approved I just want to know how many days does it takes for me to receive it. We are planning to book my flight on feb 15th even without the visa on hand. Do you think I can have my visa before that day? We really have to book a flight so I can attach a copy of my plane ticket to my resignation letter because my company is requiring me to at least give them my flight confirmation since I wasn't able to inform them 30 days before my resignation date. it usually just takes 3days to a week, but sometimes, for whatever reason, Air2 it takes longer to deliver.

if you don't mind the possibility of paying rebooking fees, go ahead and book the flight for the date you want/need and pray that you get the visa on time,

if you don't want the hassle of rebooking, and you can manage to wait, it's best to wait till you have the visa literally in your hands

also, don't forget that you still need to attend the CFO seminar and get a sticker on your passport.

On the DS 156 Question #22, where they ask what date do you intend to arrive in the US, I had my fiancee leave it blank (as per the example form on VJ), but during the interview, her interviewer asked her. So she said "as soon as I receive my visa - maybe in March". She wasn't expecting to have it already. The interviewer put March 2010 on the DS 156. My question is, Can she come earlier than that? I can bring her here on Feb 24th. I don't want to wait another week. Is that o.k.??? Thanks for your help in advance.

I was hoping someone could help me.
I was wondering if whilst i am waiting for my green card application to get cleared after I get married whether or not I will be allowed to enter the USA on a tourist visa or whether or not I have to stay out of the country until it gets cleared?



assuming you're a K1 applicant (based on your profile) you cannot enter the US until you go through the whole K1 visa process and actually get the visa...

and applying for a tourist visa will more likely cloud your intentions (is it to wait patiently till you get your visa and get married) or go the US get married and hope things will go faster) so although you can always apply for that, chances are you will be asked a lot of questions...

so better to wait till you get your K1 visa

now, if you're waiting for a Greencard, you're not a K1 applicant but CR/Ir probably...so make up your mind first :)

that is an obvious on uscis' part. although your fiancee already got her visa and is literally good to go, it would still be better to call the uscis about it just so they don't have the wrong validity/NOA2 in their records, that might cause a
non-match/confusion when they check your fiancee's record at her POE

hi. i'm currently filling out the DS 156 form. on question #36, it asks "Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?" my dad has been petitioned by his brother (F4 visa category i believe) and that includes my mom and all of us, his children. i do not really know what happened to that petition (if it was discontinued or still current). my question is, what should i answer to question #36? should i answer yes and write my uncle? or no? i really need your help. thanks in advance!

you should put no because your uncle's petition for your dad does not automatically include nieces/nephews. your dad has to be the one to petition you later on when his status permits :)

Hi everyone!

We are currently in the process of arranging the supporting documents for our K1 visa application.
We are just concerned about my fiance's name from her previous marriage.

Here's the scenario:
1. the annulment from her previous marriage was granted and she has all the legal documents to prove it
2. but all our supporting documents (such as plane tickets together, etc) still reflect her name from the marriage because all her identification cards haven't been changed to her old maiden name (she's from the Philippines and it takes a while to process change of name) so she has no choice but to still use her married name in all transactions that require her to present a valid I.D.
3. currently, her passport, driver's license (and other i.d's) are still under the process of name change

Our question is:
1. do we need to attach a letter with our application to explain why she still uses her married name even if the marriage is annulled?
2. OR is it enough to just include a copy of her marriage certificate and annulment papers?

We're really confused and we don't want to make a mistake the first time we send out the I-129F, we want to avoid any delays.

1. no you don't have to, but it certainly won't hurt to do so to clarify her situation.
2. it's always better to submit more than what is required just in case they want to "cross-examine" documents

the truth is, although her previous marriage has already been annulled you don't have to change her last name back to her maiden name because she's allowed to keep that if she wants to (although in your case the real reason would be to be able to submit the application already while name change is being processed).

besides, like you said, her other documents will show that the change was due to marriage and that that marriage has been annulled.

We submitted the K-1 visa application to the California center and they acknowledged receipt of it on Oct 8th 2009,
We are still waiting for any word on it. I have flown back to USA just so I would be here when we got it but it still has not come.
Also what happens if and when I do get something from them, what do we do with it. We have all doc's that we should need but just need physical and interview. We are ready but nothing is coming out from them.
Any info or help would be great.

you mean you got the NOA1 for the 129f already? that's a good. now it's in the process of being evaluated and while the average no. of months it takes is 4-6, it could be shorter or longer, depending on such factors as completeness/correctness/accuracy/organization of application, the person evaluating your application, bulk of applications for your batch/month etc.

at least you haven't gotten any notice for additional docs (RFEs)...just wait with lots of patience and before you know it you'll get your NOA2 (approval notice)

the annulment papers are all that's needed and in the forms she'll be asked all other names she's used anyway.

by the way, it's not automatic/understood that she goes back to using her maiden name once annulled. a woman can continue (if she chooses, for convenience) to use her married name :)

Ok so I’m filling out i-134 and had some questions.

1) Question # 10. Do I need to put in my fiancée’s name in her or is this about if I had previous applications submitted?

2) Question #11. Obviously I am applying for K-1 fiancée visa. What do I put in here? I will be marrying her as soon as she enters the USA and get AOS started. In that time frame obviously I will care for all her monetary needs. Can I just state "I intend to care for all her monetary and living needs."?

3) Do I need to send tax info because the information on the application say only if self employed.

4) On the instruction sheet they sent her from the Lebanese embassy it states "I-134 filled out and signed by petitioner, along with proof of petitioner’s employment". So does this mean just need form and letter from work saying I work for them and what position I have. Or do I need to have my employer put more info?

4) employment cert is a very good proof too, w/c will prove what you claim/indicated in Item 7. It just needs to say what your position is, how long you've been w/the company and how much you earn.

Hi all!

My fiancee sent the I-129f on 03/18/2010 and I will go to visit her (to give her the ring!) next week. I have a round trip ticket... I read somewhere that I will have to tell the immigration officer we asked for a K1 visa... Do I have to since it hasn't (and it won't be) been appoved by the USCIS yet?? What if I want to go back later (maybe in June)??
Other question > I read in the VJ K1 guide that: "Depending on which U.S. airport you fly into (NY JFK) some will issue a temporary 90 day work authorization if asked for". Someone can give me more information abt it?? (do I have to ask prior entering the US? Do I just have to ask the immigration officer?). I will live in NY (Poughkeepsie) and I usually flight to JFK.

if asked about the reason for your trip, just tell the truth
if asked about petition applications, tell them about your a29f as well
but never ask about work authorizations while at the POE because that will defunitely create
suspicions about your real/other intent for visiting.

remember you're a tourist and are not allowed to work/study while visiting/"touring" :)

I should say A LOT QUICKER??

First of all I would like to thank everyone on this site for all the information that is posted here. I really never thought I would be trying to marry a woman from another country, but as they say "stuff happens".

My sweetheart is a Filipina who lives in Kuala Lumpur and of course is a most wonderful person. I have followed everything on here regarding the submission of my petition. I sent my package to the California Service Center on the 9th of March, they received it on the 11th and according to the NOA1 the receipt date is listed as March 12th. I even had the paper copy in my hands by Friday the 19th.

I have looked at the processing times listed here and I see that they have been dropping but the speed is taking me a bit by surprise (a very nice surprise). I was perparing to wait months for her to come over and I thought i would have a lot of time to get the house fixed up but from the looks of things I better get busy. Because I submitted the perfect petition I will not have any of the dreaded RFE's and I am making the bold prediction of a NOA2 by April 30th :thumbs:

Cenomar is CErtificate of NO MARriage, which she has to request at the Natl Stat Ofc. she can get online at the NSO website so she doesn't need to go home to the phils to get it.

I'm trying to figure out the affidavit of support for my fiance and his father. My fiance doesn't make enough to sponsor me on his own, so his father agreed to be the co-sponsor.

I'm a bit confused about who is listed as a dependent.

Does my fiance list me as a dependent, since he's bringing me to the USA? And for my father in law - will he list his wife, youngest son, myself and my fiance as dependents? My fiance is 26 this year, so I'm not sure if that counts...

I feel kind of stupid even asking this, but I just want to make sure we're doing this right. :bonk:

Hi, we're just wanting to clarify G325A part where it asks
"Applicant's last address outside the US of more than 1 year"

My fiance/the petioner was just naturalized. Went to US when he was 14, so before that time he was in the Philippines.

He understands the statement as: Him being the USC already, he left the US and stayed in another country for more than a year, then he should put something in this field. But since he hasn't, he wants to put NONE.

I understand it as: Stating whatever country you've been to even before you got naturalized, therefore he should put where he lived in the Philippines before he left for the US.

Any idea on who's right? :whistle:



yes, he should put the last address he stayed at for more than a year when he was still in the philippines. this part enables the govt to see where he was last at before going to the US (last permanent add they could trace). good luck and god bless :)

Hi folks,

First off, i'm a worrier :unsure: Magical knows that and he has couraged me through it.

I submitted a lot of good evidence, including translations of our marriage certificate.

But I thought it would be difficult to translate a receipt which contains pieces of information all over the sheet itself. And thinking that a receipt will not be as significant compared to more important documents.

What will happen? Has this happened to anybody?

1) Will they send me an RFE?
2) Will they reject the visa application? (sorry i know it sound extreme on my part)
3) Will they just let it through?
4) Should I send in a translation? I sent in my I-130 packet 1 month ago.

Thank you in advance and please pardon my worries. It's been 4 months now being away from each other. And it's taking its toll on my wife and I. And we both wanna be with each other soon.

just wanna ask regarding the ITR of my husband because we dont know which to put and follow on the form I-864, on 2008 and 2009 he had declare with his previous wife.. and her sister.. and on 2010 her ex wife and him file for seperate ITR, i am not sure about what it is written but he showed me and that's what i understood, it is on the upper portion of the page and saying seperation of ITR and so on.. dont know what follows.. and still declare his sister and now my question is.. are we still gonna put the ex wife on the number of household? the are divorce already.. and is that gonna be a problem on our NVC processing and to my interview soon though we dont have a date yet? im just so worried about it..

it says there, household includes him, you, dependent children, other dependents listed on his last income tax return and any immigrants he previously sponsored in an I-864 form that he is STILL OBLIGATED TO SUPPORT. ask your husband what the final divorce decree says about his obligation to support the ex-wife or if that ex-wife is now a US citizen, in which case her name does not need to be included.

Hello, how can we show joint ownership of a house or property or lease an apartment if we live in another country not the US? Will they still accept this document if our apartment is in Morocco? And how can you share finances when you cant put your husbands name on any banks or anything like that if he doesnt have a social security number? whatever you have that is proof that you are still married and living together so if that apartment has both of your names in it then you can certainly include it. other proofs are bills, bank statements, official letters, cellphone contracts, medical/health/life/ car insurance, -everything and anything you have that shows you now share some things

Its now been 3 months since my Noa1 for I-130! Im becoming more and moree unpatient every single day! I always try to keep my self busy but I always end up on this websitee or the USCIS website checking my case status even though I think its still early for any notice lol I really hope I dont have to wait much longer! My husband is filing I-130 for me. I have a question about filling in the G-325 A, Bio Info.
Is it correct that I shouldn't leave gaps in time when I fill out the "Applicant's employment last five years"?
Because I'm a housewife now, and I was a student for a year in the last five years. If I have to write "Student" as occupation, Do I need to write the name of my school?
Also, when you write the address of employer, do you write the full address?
Because I'm originally from Hong Kong. And addresses in HK can be quite long. Can I just just write "the name of employer, Hong Kong" instead?

you should still include periods of unemployment then in parenthesis "studying/schooling), so that you don't have holes in the years. your choice if you want to specify the school and address. the address of the employer should be as complete as you you can indicate. =)

basically copies of everything your husband submitted initially, updated copies in there are new ones, original documents required (ex nbi etc) and the original forms required for immigrant interviewees DSs etc (click the link under cr1 "guides")

She's circled that my visa was refused, and also the bit that says I could overcome the refusal by submitting more documents, then on the back she's circled passport - the reason is that it was washed and isn't neat enough to put a visa in.

So is this good news? Or is there a chance they'll receive the new passport and be like, "Naaahh, still not approving you."?

Also, not to scare anyone, but I got GRILLED! For a few moments I thought I was poo out of luck. Reason was cos I spent 5 months in Mexico.



you're not yet approved. you have to submit whatever she specified you lack (reason for 221g) and get a new passport so they don't have any more reason to deny you a visa. oh, and do it soonest =)

I, Xxxxxxxxx, the petitioner of these two I-130 petitions for my wife and for my son, do hereby understand that my petition will be put under administrative review due to some unintentional honest error made by my father when he filed my N-600 application last April, 2010. I was working in Alaska during that time when my father filed my Certificate of Naturalization application without my prior knowledge so he committed a mistake of declaring me as single when in truth and in fact; I was already married since February 11 of 2009. My father knew nothing about my existing marriage because I hid the truth from him about it because he believed that I was still young to enter such big responsibility, more so, my application for my naturalization was not yet filed and he was worried I might encounter problems later thus he didn’t want me to marry my girlfriend back then, since anytime after I’ll be naturalized, I can file a K1 and K3 visa for both of them very fast and easy. But I made the decision to marry her anyway without my father knowing it last February of 2009. I came home to the Philippines to marry my girlfriend (who is now my wife). From then on up to the time of the filing of the N-600, my marriage with my wife was concealed to my father and he was not aware of it, only now that I need to petition my wife and my son that I need to reveal everything. Being declared as single in my N-600 and now filing I-130 petition for my wife and my son might occur as a red flag to the USCIS, thus I am doing this declaration to discuss my case and be honest as much as possible regarding the discrepancy with regards to my marital status. And I am aware that my petition may be put in certain difficult situation because of this. In connection to this, I am taking the full responsibility for all my actions and I am solely accountable for whatever action I made in the past and I believe that my father and I did not do any material misrepresentation of my case but a lapse in judgment. Hence, I hope that my petition will be judged fairly and with kind understanding.

I declare further under perjury that the above mentioned statements are true and correct.


so you're IR/CR1 case not a K1? anyway, i'm not sure it's necessary to offer the information on your petition beforehand. think it through. and then if you really decide to go ahead with it, it might help to include actions you took (if any) to correct the honest mistake, or why you did not take any until now (time of application)? =)

Hello all,

 

I have a silly question about the DS-260...

 

It asks, "Is your spouse immigrating to the U.S. with you?"

 

I assume it's talking about me, the petitioner right?

I'm a citizen, but I live in Japan and have for 12 years. 

I'm moving back to America when my wife goes.

 

Does that mean that I answer no? When it asks me again do I answer no again?

no such thing as a silly question. better sure than sorry, right? anyway, yes, it's asking you the petitioner. and your answer is no because you are already a citizen and not applying to immigrate as well.

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp with middle name.

I have applied for my wife for CR1 category. When I applied I used her father's name since she had the old passport. Now being that said, she obtained a new passport under my middle name. I am worried that this may cause a problem when she go for interview. As of right now, we are at DS-260 stage, can anyone please advise what to do with this situation. She currently has two passport. one is canceled and one is current. The current one has my name and the canceled one has her father's name. Please advise.

 the cancelled one passport has no bearing anymore on her application (she does not need to show it unless it is asked for for verification). it's the current passport that she will submit for her visa stamping. so she should be ok. although your description is a little confusing when you said that her new passport has your middle name? you meant your last name, right? if it's your last name then you did the right thing.

if i remember right, the question is all previous (Old)  addresses since you were 16 years old> so if you lived at only one address since you were born, then you write only that address. if you moved several times, you write down all the addresses since you were 16yrs old. if you moved also when you were 15 yrs old, you don't include that. only addresses where you moved when you were 16 and older.
