K-1 Fiance(e) Visa Case Filing and Progress ReportsQuestion on Affidavit of Support I134

Could anybody advise if all supporting evidence and employment letter in particular must be provided together with the I134 form for a public notary?

Only the I-134 needs to be notarised, the rest of the supporting evidence does not.

We got our NOA2 in the mail yesterday for a case that was approved on June 5th, if that helps you any.

Don't wait for the NOA2 to come in the mail, a person at CSC to tell you, or the status check online to say you're approved.

We found out we'd been approved when we got a letter from NVC saying they'd received out approved petition on 25th June. The status check on line still said pending, so did the automated telephone line.

On 7th July, we eventually got an NOA2 in the mail saying our case had been approved back on June 5th. We'd even called CSC around 11th June and they said we were still pending.

However, all the touches on your case suggests they are actively looking at it, and that it's not gone to NVC yet.

K-1 Fiance(e) Visa Case Filing and Progress ReportsMARCH FILERS!!!
I was awoken at 5:00am by my other half. She'd just got home from being away all day, and found she had a letter from the NVC in her mail box.

The letter stated that they had received our approved petition for an I-129F, and would be forwarding it on to the US Embassy in London within a week.

So, there we go!

Finally approved, we just don't know when. We've had no email update or hard copy of the NOA2.

We just hope we get the NOA2 in the mail too, as the London Embassy does list it as a required document for the interview.

The OH is going to call CSC and see if they can get the date we were approved from them, and I will update my timeline with that information. My VJ timeline originally told me I could be approved as early as 27th June, but it was obviously before then if the NVC received the approved case on the 25th June.

Well, I'm all happy now, and planning what needs to be done for the medical and interview now, in anticipation of the Packet 3 and 4 from the Embassy.

Oddly enough, both the quick online case check (by receipt number) and the full online check (by logging in) both show the case is received and still pending, and the detailed one still shows nothing from the touch on 06/05/2007.

Well done those who have been approved so far.

I'm still waiting, checking the online status by receipt number each day at a time, and not going to make another call (or get her to do it anyway) until Thursday.

Try calling the NVC direct, that's what I did. I just said that I was getting confusing info from CSC and I wanted to check if my case arrived yet. They asked me for my recipt #, Beneficiary's name and DOB. I never received an NOA2 and my case has already gone through NVC and is on it's way to the consulate. The number is 603-334-0700. Press 1 for Eng and 5 for a rep. I called around 8:45 EST and only waited about 10 minutes to speak to someone.

Took me about 3 minutes to get through to the NVC.

When I gave the lady my case number, all she could tell me was it wasn't there. CSC must still have it, unless the touch we got was it being transferred out to another SC

Oh well. The automated line said there was no updates, and when I called again and used the prompt combination, the message said I had to be the applicant or an attorney etc. I couldn't have the info, so I just hung up. I'll get the OH to call when she gets home.

Thanks for the help.

Check out my timeline, we have almost the same dates. Try calling VCS, they might already have your approved I-129. If you have read over this thread you can see that many of us were approved even though we never got our NOA2. Don't trust the info on the USCIS online tracking website. Good luck!

As the UKC, am I able to call up CSC and get an update, or does the USC have to do this since she is the petitioner?

Although I don't want to get my hopes up too much, because we filed at TSC (and then sent to CSC) on March 17th, I'm hoping we're going to hear something back very soon.

I am normally ok with waiting for things, but this is killing me! I almost died when we got our first touch, it was nice to know someone had looked at it!

Fingers crossed!

K-1 Fiance(e) Visa Process & Proceduresfirst receipt times
I think you may be getting a little carried away with yourself. You need to be able to deal with waiting, because there is a lot more of it to come. Getting your I-129F approved is just the first step in a very long journey. You're going to have to wait for case transferral to the NSC, and then on to the embassty, and then an interview, and then AoS waiting times.

You used a lawyer for your case, and it didn't work out as expected. This is one of the drawbacks of using a lawyer. They can't make it go any faster, they can either get it right, or do something to slow it down.

I'm sure if you just sit tight your case will be processed when they get to it.

I know it's hard to wait, but if you don't learn to deal with it, you'll drive yourself around the bend.

K-1 Fiance(e) Visa Process & Procedureswirlwind love affairs! other peoples experinces as to how the length of their relationship affected thier application?
As it's been said before, don't worry about being questioned regarding the length of your relationship. The petition is based on having met within 2 years and being free to marry, not having known each other for a certain amount of time.

Should the petition be approved, when you go for an interview, then you may have to demonstrate the legitimacy of the relationship.

As for the travelling to the US while a K-1 is pending, make sure you have plenty of evidence. If you're not confident with what you have (and keep in mind that the border control officer can reject you no matter what evidence you have with you) don't travel. Have him come here instead, there will be no problems with that.

K-1 Fiance(e) Visa Process & ProceduresSocial Security for K1
QUOTE (rin and john @ Jun 12 2008, 09:42 AM) <{POST_SNAPBACK}>
The big difference is a K1 can walk into a SSA office and get a SSN without an EAD within the first 76 days of presence; a K3 cannot. We tried. CRF8.274a.12.a(9) contradicts CRF8.274a.12.a by stating "as evidenced by an employment authorization document". When we went to the SSA they wanted either an EAD or GC.

I don't understand how "CRF8.274a.12.a(9) contradicts CRF8.274a.12.a".

"Any alien who is within a class of aliens described in paragraphs (a)(3), (a)(4), (a)(6)–(a)(8), (a)(10)–(a)(15), or (a)(20) of this section, and who seeks to be employed in the United States, must apply to U.S. Citizenship and Immigration Services (USCIS) for a document evidencing such employment authorization. "

This section only refers to categories (a)(3), (a)(4), (a)(6)–(a)(8), (a)(10)–(a)(15), and (a)(20). Individuals who fall under these categories "must apply to U.S. Citizenship and Immigration Services (USCIS) for a document evidencing such employment authorization".

That part has nothing to do with K3 individuals who are category (a)(9). The rest of the section does (i.e. "Pursuant to the statutory or regulatory reference cited, the following classes of aliens are authorized to be employed in the United States without restrictions as to location or type of employment as a condition of their admission or subsequent change to one of the indicated classes.").

K3 holders don't need an EAD to show they are work authorized. This is totally separate to the SSA requiring an GC or an EAD to give K3 holders a Social Security Number. The SSA has it's own set of rules and policies. CFR8 is there to define what the USCIS does. CFR20 is about SSA.

Good question, lets apply some logic here. Why is it that K-1 is "Work auth" and the other K-Visas are not? Perhaps this has to do with the fact that the K-1 is her to marry, and the others are not?

QUOTE (Thai family @ Jun 11 2008, 08:14 PM) <{POST_SNAPBACK}>
K-3s aren't work authorized, so there is no other logical explanation that I know of (even if it isn't logical).

They are. Have a read of CFR8.274a.12.(a)

United KingdomLondon Medical on Monday the 18th...
*taken from Nick's Tips

The Medical Exam

Can be booked as soon as you know your LND number. Must be done before the interview.

The Knightsbridge website is herehttp://www.visamedicals.info/us.asp Most people are scheduled at the Bentinck Mansions clinic. You should take your police report, immunization history, filled out questionnaire, and medical reports of any past or current illnesses including psychiatric. More from the Embassy:

http://london.usemba...xamination.html .

http://photos.state....ical_letter.pdf This contains the USA Medical Questionnaire that you are to fill out and take to your exam. You have to answer the following questions.

Have you ever been hospitalized (including psychiatric admission)?
Have you ever had a disease of your heart or circulation?
Have you ever had a disease of your lungs?
Have you ever used tobacco?
Have you ever had tuberculosis?
Have you ever had a stroke, seizures or other neurological disorder?
Do you have a major impairment in learning, intelligence, self-care, memory or communication?
Have you ever had any mental disorder or depression?
Have you ever misused or abused drugs?
Have you ever had an addiction to or abused alcohol?
Have you ever caused deliberate injury to yourself or others?
Have you ever caused deliberate damage to property or had trouble with the law because of a mental condition, mental disorder or while under the influence of alcohol or drugs?
Have you ever had any sexually transmitted disease?
Have you ever had yaws, leprosy or malaria?
Have you ever had diabetes mellitus or other endocrine disorder?
Have you ever had a malignancy (cancer)?
Have you ever had any kidney or liver disease?
Do you have any visible disability (including loss of arms, legs or eyes)?
Is any medical treatment (including surgery) pending or anticipated?
Do you take any medication? (Please list all medications on a separate sheet)
Are you pregnant? If the answer is yes, please provide evidence of pregnancy/copy of pregnancy test result. Date of last period:____ Expected delivery date: ____
The doctor may want a report from your NHS doctor if you answer yes about any of the conditions above. Exception: smoking, pregnancy. They are basically seeking more information about the diseases/conditions. They will tell you to send them a medical report before they can complete the exam results. Save yourself some delays and take a report to your exam if you have any medical conditions. or take medications. They want to know full diagnosis, date, cured or ongoing, if it requires medication, etc. It’s a letter/report from the doctor, not copies of you records.

Immunizations

Immunizations are not required to get the visa. BUT they will be required to adjust status so might as well get them taken care of (hopefully free) by NHS. Adults will need (within the last 10 years):

MMR – Mumps, Measles, Rubella (if born in 1957 or later)

Tdap or Td – Tetanus, Diphtheria, Pertussis (whooping cough)

USCIS will okay your AOS if you get Td or Tdap or DT or DTP or DtaP. The difference is the strength of the immunization and the combination. D (big dose for diphtheria), d (little dose for diphtheria). The adult versions are Tdap and Td, but you may not be able to find those in the UK, so try for one of the others. Td is a booster without the pertussis (whooping cough) part. You’re ok with that one too.

Varicella – chickenpox If you had chickenpox, you don’t need the shot. They take your word for it.

Influenza – during flu season Oct 1 – Mar 31 for ages over 6 months. New rule in Nov. 2010, so it’s not just for over 50s anymore. If you will be mailing your AOS between April 31 and Sept 30 (not flu season), the flu shot will be excused by USCIS since they received it when it wasn’t required. If you mail AOS during flu season, but your visa exam wasn’t flu season, it will also be excused because it wasn’t required at the time of the medical exam.

Daily :)

6 hours ahead so am at work when my Fiancee wakes up which i always make myself available for and call her to start her day off good :)

before she took on extra hours at her job when i got in from work we would MSN each other for hours on end (often which a few calls inbetween) and i usually end up staying up to the wee hours of the morning

and inbetween all that when were both not at the computer we chat via emails, facebook and the likes

its safe to say i spend every available spare moment i have in my life spending time with my Fiancee as it makes the wait that little bit easier
