Congrats Michelle smile.gif

How is the job hunting going Gshennen?

My hisband and I are starting to feel the stress a bit now. Our interview is next week and there is no reason we shouldn't sail through but the little things are starting to stress us out. The doctor we went to is not helping the situation. At the moment I can't remember his name as my husband has been dealing with him mostly but we found out today he only works one day a week! We thought it was a bit strange when we went in that he said the medical may take 6 weeks. rolleyes.gif And then today we called up to have my husbands vaccination requirements faxed to his family doctor and we learn he won't be in the office til the day before the interview mad.gif We should have known when he said that it was no big deal if the paperwork made it after the interview and "whats a few extra weeks really"!!!!!!!!!!!!! Now I am sure you all know what a few extra weeks is in this whole stressful experience. But we are being positive and hoping the medical makes it in time. So I guess what I am trying to say is don't go to the doctor in Wellington that is listed on the Imigrations list! Vent over smile.gif

We don't know when we will be flying home yet. We are going to wait and see how the interview goes and then change our plane tickets. We have some that are booked for December. We want to be home early September though so once we get the green light we will change our tickets and buy our american flights.

Kimand Russ- I hope you receive some good news soon. smile.gif

We went for my hisbands medcial today. We are located two hours from Wellington so we went there for the appointment. It was $500 which sounds expensive having read some of the other posts. I suppose if we had had to fly to Auckland it would have been way over $500 so we are okay with that. The doctor did think it was strange that we received an interview date so soon but we aren't going to question it.

Yankiwi- It is frustrating traveling with heaps of bags especially when you don't know where you will be making your home. Let us know if you find a airline that will ship your bags for you. Would be great to know as my husband and I will be living out of suitcases for the forseable future and at the moment I am pretty over it. Nothing worse than sitting in LAX for twelve hours with all your worldly possesions!

Kelzm- It is great to see that someone is done and on their way to the big MOVE. Good luck with the garage sale.

Just received our letter from the Auckland Consulate saying that my Hubby's interview is on the August 13th. Crossing our fingers this all goes well. I am ready to be back home. The interview is a week before our 1 year wedding anniversary and I am hoping we will be celebrating both the anniversary and Nics residency dancin5hr.gif

As for moving belongings back to the States it seems like a bit of a nightmare. We had been looking to send home two bikes which are pretty small and only about 50KGs all up and it was going to cost 1200 each bike! So we have flagged that idea and are again selling off three quarters of our belongings to meet the 2 bags limit. Thank god for Trade Me jest.gif We have become good at this as we have been doing it for the past 6 years. My family thinks I am nuts when I pack my bags to fly back to NZed. The scale comes out and my bags get packed and repacked till the weight in each bag is perfect goofy.gif If the books are worth the money i would say try and put as many in your bags as possible and pay for the excess baggage. I am starting to think the excess baggage fee is less than the shipping cost. Also have a look on amazon and try to determine whether he will be able to buy some of the books second hand and if it will be cheaper in the end to rebuy the books. Probably not but it is worth a try!

Hi Everyone

I have been away from the computer for a wee while and man did I have some catching up to do! It is good to see that everything is going smoothly for some.

As for New Zealand Residency it is pretty easy in comparison. My husband and I had been together for just over two years when we applied. I sent in a huge packet with pictures and e-mails that we had written while apart. Plus we had documents saying we shared a bank account and all. The hugest issue was timing to police report with the medical but once we sent in the one package it was a waiting game. I think it took 5 months and I sent in my passport and could work and continue on with life. At the time of filing for my NZed residency I had been working here for a year though and had a company willing to keep me on.

As for our progress with USCIS we have hit a wall it feels like. We called the consulate in Auckland to see what we could do about speeding up the porcess. Now we are all sorts of confused. They sent us the medical packet along with the police check release. Now we have no idea if we need to conitnue with NVC. They said we didn't but the lady seemed cranky and distracted. So the question of the moment is do we need to continue with NVC or do we bring the I-864 and the rest of the info to the interview. We also spoke to a lawyer and that confused us as well.

To add to the fun I had an accountant sorting out my tax returns for while I have been working overseas and after three weeks of us stressing he sent back the incorrect info and kept saying that if I haven't worked in the US then I have nothing to worry about. WRONG ANSWER!!! So there was lots of crying and it was a bad day yesterday. So now I am freaking out that we will get an interview date and not have the correct tax information.

Wow that was a giant vent! Anyone have any advice? We are going to call the American Consulate in Auckland on Monday to try and get some answers so we don't mess these next few steps up!

I have been saying since this began that Nic and I are lucky. I have my resideny here so at least we can work and be together while immigration takes its time. It has been hard coming back to NZed after i thought i was finally going to be home and around my family. It is amazing the amount of money you spend trying to keep a marriage together when you are from different sides of the globe!

I have seen so many beautiful places and am counting the small blessings. Well thats when i am not crying cause i am frustrated and want to start having kids and a house. ha ha ha. My husband has a lot on his plate kicking.gif

Your time will come and you will hopefully come out stronger as a couple because of it. Thats my minute of positivety for the day. I will now spend the rest of it telling people not to fall in love with a foreigner. He he he should have listened to my mom 4 years ago.

DCF route? Sorry I don't know what that stands for. I am really new to this. wacko.gif In truth we have done the whole process the wrong way. When we sent in our packet way back in November I was in the states. We were going to wait it out but when we realized the process was going to take almost a year I couldn't take it and moved back to be with my hubby. Would have been done by now if we had realized we could have filed in Auckalnd. Problem with this process is you aren't an expert til it is done! blink.gif

Hello Everyone

Good to see there are some NZ/US couples out there. I just found this site and was pleased to see this thread. My hubby and I are both in New Zealand at the moment. I have been here for three years and I feel like we just finished getting me residency and now we are moving on to Nics US residency because the US is where we want to be for. Must say that the New Zealand process was much much much easier! It took 7 months and only involved one payment and one packet. Ohhh well if it was easy everyone woudl do it.

It hs been great reading everyones stories and feeling like we are not alone in our frustration and excitement.

K-3 Spouse Visa Process & ProceduresCan US citizen be in UK during K3 application process?
Are you a UK resident? If so you may be able to file in England. Have a look at the US Consulate website in the UK because it can be much quicker. I am in New Zealand with my husband until he is approved but I filed in the US by mistake. Didn't realize I could file in New Zealand. Hope this helps. Good Luck.

K-3 Spouse Visa Process & ProceduresMy perscective on a K3 process an Question
If you don't mind getting married in Switzerland the CR-1 has less steps. Your partner would enter the country and receive a conditional green card and be allowed to work once the i-130 was completed. My husband and I filed both an I-130 and the K-3 and they finished both applications at the same time. We followed through with the CR-1 route and dropped our K-3 petition. From reading on this site it seems common that they approve both at the same time.

Not sure what your situation is but if you were to get residency in Switzerland you may be able to do direct consular processing. Have a look at the US embassy website for Switzerland and see if they are a country that allows that. I know that the New Zealand Embassy processes almost immediatly or as soon as you have all the correct documentation. But again not sure if this is possible for you and you need to have lived in the country for a certain timeframe. Six months for New Zealand. Wish I had known this when I was applying but we took the long way!

US Embassy and Consulate DiscussionAfter NOA2 approved
Hey all...

I was hoping maybe someone who has received their NOA2 could fill me in on what I (the beneficiary) am going to receive in the mail soon... I know my fiance will have to fill the Afidavit of Support.. but I understand I will have to fill out forms too?
I just thought maybe if I knew what they were I could get a head start to speed up the process...

Thanks!

US Embassy and Consulate DiscussionThe dreaded question about I-134
I have been reading SO MANY posts about question 11 on I-134. What is the simple answer to this?

If your US fiance/e is going to support you when you are married until you are allowed to work, do they check intend?
In what situation would they need to put N/A?
I am sorry for this question as I know it has been talked about a lot. I just want some simple straight advice so nothing else can go wrong for me or anyone else.

I also have one more question. In question 8 they ask for names of people who are wholly or partially dependent on the sponser. Once again, if your US fiance/e is going to support you until you are allowed to work, then are you dependent on them?

You would think with ALL the paperwork they have you do, they would make things a bit clearer!

Thanks in advance, would really appreciate some straight forward answers.

Hey~

So I looked up the Embassy info for NZ, and there isn't any useful info about the 3rd packet. Does anyone know if we get one? Also I was wondering what the cost is at the Embassy? AND ... can we go to any doctor for our medical or do we get a list?
Thanks a lot for your time!

US Embassy and Consulate DiscussionPetition on its way to US Consulate!!!!!!!!
Just got an email from NVC saying they have sent my case on to the US Embassy or US Consulate  Wohoo!

I do have a question though... I had emailed them because my US fiancee has just gone back and started a new job, and I was changing his mailing address. They said that the case I was inquiring about has already been forwarded to New Zealand and to change the address with them. My question is, will Zach get mail from NVC or the US Consulate in New Zealand? I isn't too much of a stress because the old address is his parents, but we were just wondering if he is to expect anything?

The only reason I emailed to change it and not him (for those of you wondering) is because he is working long hours and is very busy, while I sit here on my bum waiting waiting waiting!

Thanks everyone!

US Embassy and Consulate Discussion'Tis the season to be JOLLY!!!
MERRY CHRISTMAS TO YOU ALL.... at a time when you would think that people are slowing down for Christmas.. we are all getting approved and things are going faster than ever!!

I received and sent off Packet three yesterday and made a medical appointment. The earliest they had was Jan 8th :( I was sad because a long time ago when I was naive about this whole process, I booked tickets to return to the US on Jan 16th. But today I get a call from the medical center and they had a cancellation! And they CALLED me! Wow :) :) So I am going today for my medical and will hopefully get an interview date SOON!

Plus the Consulate in NZ have made a special note that I would like to leave the country by Jan 16th so they are going to see that when they book my interview and I may get there on time!

It is so good to hear that things are moving along for everyone else now... I know we all can't wait to be back with the love of our life and I think this new years is going to bring A LOT of happiness for a lot of people on this forum.

K-3 Spouse Visa Process & ProceduresCan husband visit while he waits?

He can always try but will probably be denied based on the fact that there's probably no way to prove beyond a doubt that he would't be an immigration risk, considering that you have a K3 pending. Pretty hard to prove soldi ties to a country that you're planning to leave....

Couldn't you say that for just about ANYONE who visits though? Aren't they almost ALL planning to leave eventually? And as for doubt, .....there is no way to prove beyond a reasonable doubt that ANY person....no matter what the circumstances, won't stay.

I'd say her husband has just as good a chance as my wife who visited me 4 times on a tourist visa while our case was pending. She also left a country that she didn't have to go back to......but she did.

I don't agree with your statement that he'd "probably" be denied entry. They could just as well have said the same thing about my wife, ....that she'd be an immigrant risk......there was no gurantee she'd go back, other than for our word.

I'd say , based on what she has told us, that her husband has just as much chance as anyone else....I don't know why his odds are less than any other spouse who visits while an application is pending.

Nearly EVERYONE who visits a spouse/fiance' is coming from a country they plan to leave......eventually....and are an immigration risk.

I would tell "girlafraid7" that the odds of her husband being allowed entry to the USA are just as probable as any other spouse who visits while an application is pending.

There is a good chance he'll get in......but there is no 100% guarantee of this. people do...and have been turned back. But her odds are no less than for my wife........and no less than for other spouses who visited during the process.

She just needs to make sure her husband is prepared with paperwork that show ties..........and more importantly......meets the right customs agent. ;)

Amen to that!!

K-3 Spouse Visa Process & ProceduresWhere do i send the I-130
Were in the same boat now, Emerald.

Our case was being 'pre-processed' in Auckland, but my husband is not a resident of New Zealand.
New Zealand previously waived that restriction, but can no longer accept petitions from USC still resident in the U.S.

So...were stuck with K3.
Were also trying to decide if its a good idea for me to visit my husband for a couple of months while we wait this out, as we had planned to be together at this point and the law came into effect for us a week before our interview.
Were a little upset to say the least and spending some time together would be helpful at the moment.

In the last email I received from the consulate here, they said that petitions would not be accepted from USC, but in a matter of time they'd be accepted once again from USC resident in foreign countries.

You may still be in luck, but I know....the waiting to know is just difficult.

Waivers (I-601 and I-212) and Administrative Processes (221g)Will this hurt my chances of being allowed to immigrate?
The more I look into it the worse it looks. Most of the info I can find points to a lifelong ban for even trying marijuana once.
I hate this! All I want is to be with my husband crying.gif Are people not allowed to make mistakes?????
I don't think lying about it is even an option, I've never been able to tell a lie, whenever I've tried I might as well have a big flashing neon sign on my forehead saying "I am lying"
Is there any way around it? How do I know if I'm eligible for a waiver? and how does that work? when would I have to file that?

Waivers (I-601 and I-212) and Administrative Processes (221g)Will this hurt my chances of being allowed to immigrate?
I posted this in IR-1 / CR-1 Spouse Visa General Discussion, but someone told me I should post here too as people in this forum might be more knowledgeable about this type of situation.

Ok, kind of a story here, bear with me.
Me and my hubby met about 3 1/2 years ago online (I am hoping to move to the US with my daughter so we can be with him), we both suffer from mental illnesses, hubby has PTSD from serving in the army, and depression and panic/anxiety disorder. I have suffered from depression and anxiety. Both of us have been on medication for it, and have been through therapy. When we met, we were both going through a pretty rough time and it was on an online support group chat room that we met.
Will they ask about this at any stage of the proceedings? either in a form or in the interview, and will it hurt our chances of myself and my daughter being able to move over to the US? Should I be up front about it, or not say anything unless they ask specifically? If they ask how we met do I lie and say it was through some random chat room?

Also I did a fair few drugs when I was a teenager, I was a bit of a wild child for a while, smoked a lot of marijuana, did LSD and magic mushrooms. I was never addicted to anything i don't think, I just decided one day I had enough and that was it, I haven't touched any drugs for about 8 years now. I've never been arrested or convicted of anything and am now a law abiding person. Will they ask about drug use? Will that hurt my chances at all being so long ago?
Hubby has never touched a drug in his life.

ScorpiankhFemaleNew Zealand2007-06-26 19:28:00
K-3 Spouse Visa Process & ProceduresK3 ... is it worth it?

There is always the possibility that if you have not filed for either K-3(I129F) or CR1(I-130) that the "immigration bill" will for some unknown reason pass and NVCNational Visa Center) and USCIS(Homeland Security) will be buried in the whole mountain of inquirys and paperwork that will crush them. My wife and I filed for both to insure she joined me the qickest and most pratical way possible. Both are currently about two weeks apart and we will most likely be together by the end of the summer.

ummm ... what is the "immigration bill" ?

... excuse my ignorance, I've only just started trying to get my head around the forms and procedures, haven't started looking into other factors yet.

K-3 Spouse Visa Process & ProceduresK3 ... is it worth it?

Hi, I'm in New Zealand, wanting to move to the US to be with my hubby. I've been researching all the visa and immigration stuff for the last few days, and I have to admit i'm a little confused.
As far as I can tell the purpose of the K3 is to allow spouses of US citizens to live and work in the US while waiting for the cr1 to be approved, essentially allowing spouses to be together sooner than they would otherwse be. But it seems that the wait times for the cr1 and k3 visa are about the same at the moment, and there seems to be a LOT of posts here from people saying their cr1(i-130) was approved before their k3 was ... so is it really worth it to go to the effort of applying for a k3 visa?

ScorpiankhFemaleNew Zealand2007-06-26 17:35:00
K-3 Spouse Visa Process & Proceduresgeting there sooner

I keep getting told that you can go to the US BEFORE your K3 visa gets approved ... is that true? Sounds a little too easy to me.

if it isn't the case does anyone know of any way to get over there sooner?
Hubbys mom has alzeimers and I want for her to get to know my daughter and spend sometime with her before she forgets who we are :( . I know my mother in law has always wanted grandchildren and my daughter is her only grandchild (well step-grandchild).

Australia and New ZealandHoneymoon in New Zealand!
- I'd like to go in March; is that a nice time of year or would October be better?

Agree with above poster, March is a better time, the weather is more likely to be nicer and more settled. October is still cold. If you want to swim in a lake in October in the south island, you better bring a wetsuit.

- Is 10 days enough to cover both the South Island and North Island?

Not remotely. It's enough for a pretty nice (but by no means thorough) tour of one or the other, or a 'highlights' trip of both with lots of internal flights, as suggested above (which would be essential if you wanted to see a lot of good stuff on both islands I think)

- If limited by time and money, which island should we focus on?

Agree with above, like cities, decent coffee and good solid tourist infrastructure? Go North Island. Like cute towns amongst large open unpeopled landscapes with untouched natural SPLENDOUR? Go South Island.

- Any stops we should be sure not to miss?

Kayaking/hiking, Abel Tasman National Park

- Any specific suggestions? We like hiking, I'd love to go kayaking somewhere, and hang out by a beach or a lake for a couple days.

See above points re: weather, if you want to spend time IN the water, and it's October or March, Coromandel or further north is probably your best bet. Everywhere else will be chilly. Otherwise South Island roadtrip all the way (don't bother going as far down as Invercargill).

My 2 cents, for what it's worth (and I am totally biased having been born and raised in the sth island), but yeah, we're based in Nelson at the moment, and it's spectacular. Lots of amazing bike trails, hiking, kayaking etc all around this region. If you want to go feral for a few days, might I suggest Golden Bay. Footwear optional.

Australia and New ZealandNZ: cr1 petition

Yup - it's definitely scary and on the day of my interview I was terrified, but all in all it's not as bad as people make out and you have nothing to hide (and I hate to say it - it's pretty clear around some areas of this forum you will find that some people DO and that's why they're worried!). NZ is of course probably one of the lowest countries at risk for fraud so the process is the same for everyone else because it has to be, but everything is pretty chill.

I did my medical once I had a date, but I'm pretty sure you can do it as soon as you have your ACK number as that's all they need at the medical stage. I chose to fly up and do mine in Auckland because the Christchurch and Wellington doctors were male and they do a physical, but if you're not ridiculously shy about your body like me then it's pretty harmless (no smears or anything like that). You'll get the forms that you need filled out at the doctor with packet 3, with a list of the doctors.

You will get this form with packet 3 - http://travel.state....L-0001-1203.pdf You will fill that out and send it back to them. It's all done out of your sight once you've completed that form.

Thank you, you've made me feel much better. There does not seem to be too many kiwis on this site, so it's really great to hear about your experience dealing with Auckland.

I am so grateful NZ is a low fraud country, even though I have nothing to hide, I still get worried that someone might think that I do (this is probably why I always freak out going through customs and immigration anywhere). The last time I went to the states it was on VWP (before any of this immigration stuff), but I had just quit my job in NZ and was entering for a long visit so got hauled off into a little interrogation room to make sure I was telling the truth.. They let me in and I get why that happened now, but I didn't at the time, I was so naive! So now I am just generally quite scared that someone somewhere will not like the look of me and that someone gets to have final decision on whether or not I can be with my husband. Gulp.

So! I will try and be as prepared as I can be, so there are no nasty surprises.

Thanks for the medical info, I didn't realise Wellington was an option, that's helpful to know. I have no shame, male doctors can do their worst. I am well experienced in being a medical piece of meat, so to speak. Thanks also for clarifying the police process, it's weird that NZ does that differently.

Australia and New ZealandNZ: cr1 petition

Hey hun,

I've been in the USA for a month now.

The Auckland embassy are wonderful to deal with and things go quickly - especially if you have everything prepared to go and get in touch with their immigrant visa section when you get close to the end and hassle them for an earlier appointment ;)

Good luck! Nothing is certain, but you will easily be in the USA by October unless something crazy happens!

Thank you for the encouragement! I hope the US is treating you well.

I am really glad to hear the Auckland embassy is good, I generally find embassies quite scary. I will get in touch with them once we get to the NVC stage I think.

Also, what is the deal with the police check in the process? I realise that that needs to be done by the embassy, but when do they do that? After they get the stuff from NVC?

Also also, medical? Do I have to wait to be advised by the embassy to do that? That has to be in Auck or Chch right?

I really hope you are right about October, trying to be as on top of the application as I an be!

Many thanks :)

Australia and New ZealandNZ: cr1 petition

Hello!

Posting to see if any other kiwis are out there who have just filed for CR1 visas?

Me (Kiwi) and Hub (USC) live in NZ - he's here on a temp visa.

We mailed our petition from NZ yesterday, expect it to get to USCIS early Jan, and REALLY HOPE to be in USA by October 2013.

Sing out if you are in a similar position!

Ok, I guess not! Any KIWIS at all out there? Anyone? I'd love some NZ buddies stuck in this visa waiting game.

(no offense to all my Australian friends...)

Hi everyone

We Just got back from Auckland today. We drove 5 hours to get to Auckland and once we got to our hotel we realized nobody grabbed the folder of documents!! I thought she grabbed it and she thought I grabbed it, so after 3 hours of ringing around and trying to get a courier to bring it to us by 9am, we never found one that could guarantee it's arrival by 9am. Then we rang Napier airport and they said we could put the folder on a plane for $110 and we will receive it in an hour, so we did that and picked it up at the airport.

Next day we had our interview at 9:30am, we arrived at 9am and waited about 30 mintues until there was someone at the window, first we gave all our documents to the nice lady at window 3 after we had given her everything she said it looked very good for us to be approved. So after waiting about 45 minutes we were called to window 5 for our interview by Nicholas. He was very nice and made us not so nervous by telling some jokes. He asked us a couple easy questions like what we plan to do when we get there and what city we are gonna live in and with who, after some more jokes he said that we were approved and explained what we would need to do at poe, and that was it, altogether the whole process took about 2 hours but about 1:15 of that time was waiting.

When we arrived home today we saw the courier packet was already delivered to us, we weren't home so we are picking it up tomorrow.

We are leaving for Colorado December 5th so we got 3 weeks to get the rest of our stuff sold, which is quite a bit of stuff.
