I agree that this is a broken system. I think the only way to make it better is make as much noise as possible. The chances that it will help are extremely small, but I don't see how it can hurt - so why not. I would love it, if all those who tell us that this is useless, could instead suspend their disbelief, and join the campaign. :help:
Especially those with NOA2's - you can't be too concerned about accidentally slowing down the process for yourself, right? And all it takes is some 10 min. of your time on twitter. And what if it works? What have you got to lose? :star:

If you feel so strongly about this, I would bring your concerns to USCIS. Call them and ask to speak to an adjudicator. Let him/her know what they are doing is UNACCEPTABLE. See if this helps or hurts your case.
Everyone on here goes through a long and trying process. What makes your case more important than others? There are some cases whose petition has been pending more than a year! It hasn't even been 6 months since your NOA1, which IS still within normal processing time.

This kind of logic only generates further abuse of applicants. Bureaucratic systems tend to treat you as poorly as you let them to, and the only way to improve their performance is to be the "squeaky wheel". Far from being selfish, it goes a long way toward helping other petitioners in the same situations. I hope people whose petitions have been pending for more then a year are raising hell, calling USCIS daily etc. If they need my help and support, I can gladly do it on their behalf as well.

Contact your member of Congress and your US Senators and ask them to bring about the changes that you seek.

Yes, I did that too. But one time may not be enough.

I called NVC on Apr. 14th, got instantly connected on the first try, their automated system didn't have my number, but the operator found me, and gave me an NVC number. Said it was received Apr. 12th, and will spend some more time at NVC before being routed to the embassy.
He said they will email me a notification (about sending case to embassy? do they really do that) I suppose, I should give them at least a week before calling again :)

Called the USCIS today, as I'm over 6 months.

I actually put a service request after 5 months (on March 1st) and receive an email reply
"the VSC allows 30 days beyond the posted date before the case is considered "Outside of Normal Processing Time" (ONPT). An additional 30 days must be allowed for adjudicative review and processing before we can request expeditious processing based on an ONPT request. If the petition is still pending after 30 days, and once we receive your formal request for expeditious processing, your case will be forwarded to the applicable adjudicative unit for expeditious handling."

So, now I am over 5months+30 days, so I called to file my "formal request for expeditious processing"

First CS rep told me that she can't put service request, since they are currently working on Sep. 11th, and when I asked for Tier 2, she just disconnected me.

I called again, and another CS rep. did file a service request for me. She also told me that the USCIS should get back to me within 5 days, but it might take longer for various reasons, so I don't need to call back if I don't hear anything in 5 days. I couldn't resist asking: since, based on past experiences, I have a reason to believe that I don't hear anything within 5 days, what should I do (and when) once 5 days are over? She just repeated the same line once again...poor girl, what else could she say... :bonk:

I talked to my fiancee this morning before I went to work. I am very relieved to hear that she and her family are fine. Her city was not damaged by the earthquake.

Good to hear that :), I was actually thinking of you (and others on visajourney with their loved ones in Japan), and how worried you must be. After our january vacation with my fiance, he went back to Moscow, landed in Domodedovo airport, and passed through the arrival hall minutes before the terrorist explosion there...It feels horrible being far from each other - when human life is so fragile.
My prayers are with people of Japan tonight.

I tried this approach after reading your post and was still not allowed to place a service request. The tier 2 officer told me that the computer system would not allow it until 30 days after the 5 month window has past.

Ouch. Try again in a couple of days. Not that a service request guarantees anything....

Also, it took a full 14 days to get a response to my service request, and the response was "your case is pending. we will notify you of a decision within 60 days." Great.

Most likely that's the response I'm going to get as well...and they'll still approve it whenever they approve it. But we'll keep rocking their boat - what else is there to do :hehe:

Just FYI for other September people:
Feb. 24th - my first call to USCIS customer service last week - was told I can't do the service request until 30 days from 5 months mark

Today, March 1st - second call to USCIS customer service, the rep. told me Vermont is working on August 21st petitions, but not a word about "30 days" grace period. I said it's not true, and I know September people already processed, then I asked to be transferred to Tier 2. She repeated that Vermont center is working on August 21, so she can't put in a service request. and I replied she's been misinformed, since some later applications have been processed in Vermont. She then said, she'll transfer me to another customer service rep., and I agreed.
She actually transferred me to an officer, who sighed, asked what service center I was at, sighed again. Then she said that yes, technically (another sigh)I'm past the timeframe, so she'll take my service request. She verified my address, gave me the confirmation number, and told that I should receive a letter with details on my inquiry within 10 days.
To their credit, I should say that everyone I spoke to in USCIS phone service at least were pleasant and polite. I hope I never have to bother them again :P

I moved up from being almost 450th to 150th in only two weeks! holla!


We also moved quite a bit, to no. 112. It's too bad that much of this movement comes from people moving from "within the processing time" to "up to 3 months beyond processing time" list, not from them actually getting NOA2.
The silver lining is that the tail end of "up to 3 months beyond" list consists mostly of people, who have not updated their status in ages...so within the next few months we should get there.

Oh, Nikki, I am crying just from reading your post. I'll be THAT girl in two weeks. I'm flying out on Thursday to meet my other half...for 9 days, and than I need to be back in the states. Last time was the first week of October. So excited we can be together after three months apart...and yes, you're right, one should NEVER think about the trip back before the morning of the return flight.

Hope this damn character-building exercise will be over for all of us soon!

The USCIS received our application on October 27, 2010. Still NOTHING! I have called several times & all they say is "It is in review." What should I do? We really can't afford an attorney right now. Any ideas? I am worried that there is a problem as it has been so long now...

A lawyer will not help you at this moment in time. Unfortunately, "in review" means that its probably sitting under a pile of other application on a desk in Vermont. I've read about other people who have contacted a Tier 2 operator or contacted their local gov't official. These are good alternatives to keep yourself busy, but at the end of the day, your application will finally be opened and taken care of.

Our application was October 2010 as well. I just recieved it NOA2 last week. I felt the same way, anxious and helpless. Unfortunately, there are many people in your situation waiting. Just be patient and you should recieve it soon. Good luck!

I see that your interview is coming up soon. Good luck on it! My fiancée was terrified the night before the interview, "Do we have everything? What did I forget? What did you forget? What are they going to ask?"
From everything she told me, as long as you are truthful and in love, you already have one foot through the door. I feel that they can tell apart the true couples and no way would they not allow two people to be apart more than they have to.

Want to let you know when you reach the 4th month or the 5th month, time just sorta stands still. You go to the website and it's stuck on INITIAL REVIEW. And you wonder, hey is there anybody at home at VSC?

Just to let you know, there is and eventually, you'll get the APPROVED and the NOA2 in the mail and the world is good again. Good luck to you!
